Three years ago Myron asked me to take a turn chairing our
South Dakota Auto Dealers Association. I was excited for
the opportunity to become a part of this nearly 100 year old
organizations history. At the same time, I had a bit of concern as to how badly I might screw it up. All of our members,
whether they come from big cities or small towns, have a
right to be well-represented.
Last week at our Annual Convention in Pierre, I reflected
that I didn’t think I had made much of a difference. Myron
reminded me that sometimes no news is good news. On reflection, it should be
noted that our NextGen group is off to a fine start! These new dealers will carry us
through the 100th Anniversary of our association and well into our next 100 years! So, I say to you, our esteemed members of the South Dakota Automobile Dealers
Association, thank YOU for a delightful 2015-2016. I look forward to our future

First off, I would like to thank Myron and the rest of the
board for allowing me this opportunity to serve. I look forward to meeting each of you and learning more about your
business, along with how the changing technologies have
affected you.
I know that on the heavy duty truck side, it is a never ending
battle with training and warranty recovery. Employee shortages, especially when
dealing with qualified technicians, is always a concern, along with employee retention. At I State Truck Center we have been putting extra emphasis on employee
engagement meetings and trying to understand what is important to them.
I would like to thank the SDADA staff for doing an excellent job organizing and
planning the convention. They did an awesome job! I would like to extend a
special thanks to all the vendors and speakers that took time out of their busy
schedule to spend time with us. The progressive dinner was unbelievable! It was
a great way to meet folks and see how their various locations operate.

When you read my May/June column
year after year, you probably get tired
of reading about how great the convention was. If that is so, be prepared to
be tired of it again!
The 2016 SDADA Annual Convention
that was recently held in Pierre was
again a huge success. We had great
seminars, great food and great entertainment. It was very nice to see so
many dealers and vendors in attendance. I want to thank the
Pierre Area dealers for their insights and involvement in planning
the convention. On behalf of all attendees, I also want to thank
the Pierre franchised auto dealers for opening their dealerships
for a progressive visit that included some fantastic food and refreshments.
Kudos also need to be given to the Convention Strategic Planning Committee that spent a great deal of time with a facilitator
to determine what is the best way to schedule the annual convention and what speakers and entertainment will best draw and
keep the crowd. We followed the plan developed by the committee and the result was a huge success.
I personally want to thank Mr. Bruce Eide for his leadership during the past year that he served as Chairman of the Board. When
I approached Bruce, as a Sioux Falls dealer, to consider accepting the position, I am not sure he had an idea what he would
face during his year as Chairman (including a written column
for every monthly publication of the SDADA Report). Great job
Bruce; I appreciate your leadership and guidance for the past
twelve months.
Several things of note occurred at the annual convention: Bruce
Eide passed the gavel to a very capable individual, Doug “Dutch”
Van Santen, who will now serve as Chairman of the Board for
the next year. Of note, I believe this is the first time in the history of the SDADA that a heavy truck dealer is serving as Chairman. Scott Peterson was chosen to receive the 2016 Chairman’s
Award. Scott is a very deserving individual that has contributed
a great deal to the SDADA and the SDADA Board of Directors.
John Iverson was chosen to receive the 2016-2017 Franchised
Dealer of the Year Award. John will now enter national competition in the Time Dealer of the Year competition that is held in
conjunction with the NADA Convention. Congratulations John!
Again, a very well deserved award to a great guy and an avid supporter of SDADA.

NADA Director’s Message
Do Americans know how lucky they really are? They have Uncle Sam to protect them from themselves.
The Federal Trade Commission has proposed a survey of consumers regarding their experiences
trading in, buying and financing vehicles at dealerships. The commission will conduct 40 interviews with consumers that are 90 minutes in length.
In 2015, there were over 38 million used vehicle transactions and over 17 million new vehicle
transactions in our country. The FTC will conduct 40 interviews and will then have a complete
understanding of the automotive market in America! This survey is a repeat of the one the FTC conducted five years ago. That survey found no systemic
problems with the auto-retailing sector. Processes have certainly gone to hell since that survey!
I know I can be a bit cynical but perhaps we should survey health care patients, attorney clients, insurance company customers, mobile phone customers, etc. Is there no room for improvement in any of these transactions? Some would suggest that
market forces and competition would be very good at improving and streamlining the processes.
At some point, perhaps consumers must be responsible for their own choices. There are many options in the marketplace if
them one

shenanigans going on with the CFPB in their attempt to regulate and punish those involved in auto finance lending. This is
your government at work!
Supreme Court Issues Pro-Dealer Opinion in Service Writer Overtime Case: The Supreme Court issued an opinion in Encino Motorcars v. Navarro, vacating a 2015 Ninth Circuit Court of Appeals decision that had held that dealership “service
writers” are not covered by the federal “salesmen” exemption from overtime pay. In doing so, the Supreme Court expressly
rejected a 2011 U.S. Department of Labor (DOL) interpretative regulation that service writers/advisors are not "salesmen"
exempt from overtime. In particular, the Court faulted DOL for failing to give adequate weight to dealerships’ reliance interests during the rulemaking process, and for failing to provide a “reasoned explanation” for the abrupt change of policy. The
Supreme Court’s decision requires the Ninth Circuit to reconsider its prior decision consistent with the language of the Fair
Labor Standards Act (FLSA) without giving “controlling weight” to the DOL’s 2011 regulation. In March 2015, the federal Ninth Circuit Court of Appeals ruled that service writers are not exempt from overtime as “salesmen.” That decision was based on the Ninth Circuit’s conclusion that preamble language found in a 2011 DOL rulemaking
constituted an interpretation of the FLSA entitled to legal deference. Together with the state dealer associations covered by
the Ninth Circuit, NADA filed an amicus brief in support of a certiorari petition with the U.S. Supreme Court. The Supreme
Court granted “cert” in January and heard oral argument in April. Former Solicitor-General Paul Clement expertly (and successfully) argued on behalf of the petitioner with NADA’s amicus brief being cited several times during the argument and in
the Opinion itself. Overtime FAQ for Dealers: As I mentioned in this space last month, the U.S. Department of Labor (DOL) issued a rule that
dramatically increases the salary and compensation levels that must be met in order for "white collar" dealership employees
to be exempt from overtime. NADA has issued a new FAQ publication on the white collar rule's impacts on dealerships and
their employees.
OSHA Issues New Injury and Illness Electronic Reporting Mandate : Starting in 2017, certain dealerships must begin submitting employee workplace injury and illness records to the Occupational Safety and Health Administration (OSHA). All dealerships must maintain reasonable procedures by which employees can report work related injuries and illnesses promptly and
accurately. The new reporting rule builds on existing mandates requiring dealerships with 10 or more employees to accurately
record and post employee workplace injury and illness using OSHA Forms. In the future, these forms must be made available
to OSHA and state labor inspectors upon request. Car dealerships with fewer than 250 employees at a single "establishment"
are not required to submit forms to OSHA.

Federated Insurance’s Claim of the Month - Could It Happen To You?
A dealership gave a loaner vehicle to a customer while the customer's personal vehicle was being serviced. While driving three friends home from a party, the customer rolled the vehicle.
Two passengers died, a third was injured. The deceased passengers' estates and the injured passenger made valid injury claims against the dealership, because the driver was a permissive user
of the loaner vehicle. A loaner agreement was signed, but insurance was not checked. The customer had no insurance.
CLAIM AMOUNT: $4.25 million
What policies are in place to help prevent this from happening at your dealership? Do you know
who's driving your vehicles? Federated recommends several best practices to help protect your

• Obtain copies of the customer's valid driver's license and proof of insurance.
• Require the customer to provide proof of liability and physical damage coverage.
• Examine license and insurance to verify the information matches and neither has expired.

Developments in the Division of Motor Vehicles
There have been changes of key leadership within the Division of Motor Vehicles and most recently many
changes within the Dealer Licensing Program. Division goals and priorities have also been established, such
as, providing better customer service to all stakeholders, maintaining a title turnaround time of 14 calendar days or less, enhanced communication efforts, and improved and better utilization of technology. Specifically, in the Dealer Licensing Program
we are working on the communication efforts by establishing a Listserv email group of all licensed dealers so we can communicate directly and instantly with dealers. We are also establishing a Dealer Advisory Group to contribute to brainstorming
ideas and providing advice on legislative matters. We have revised our dealer agent territories to provide better support and
coverage to our dealers throughout the State. Staff is working on updating our manuals and educational materials, in addition
to, documenting procedures and checklists for consistent actions when assisting dealers. New dealer setup training is being
implemented along with the revision of forms, documents and website information.
We are very excited about all of the enhancements to the Division of Motor Vehicles. A major contributor to those enhancements is the leadership team put in place.
Director, Division of Motor Vehicles – Lisa Weyer
Weyer is the newly appointed Director of the Motor Vehicle Division for the South Dakota Department of Revenue. Prior to becoming the Director in February of 2016, she served as the Deputy Director, joining the Division in 2014 upon relocating to the
Pierre area.
She holds a Bachelor’s degree in Business Administration/Management from Black Hills State University.
As a native of Sturgis, she spent most of her professional career involved in local government and the tourism industry in
positions such as Deputy Finance Officer for the City of Sturgis, the Director of the Sturgis Motorcycle Rally and the Executive
Director of the Sturgis Area Chamber of Commerce. All of these professions developed a dedication and commitment to public
service.
Deputy Director, Division of Motor Vehicles – Monica Weischedel
Weischedel is the newly appointed Deputy Director for the Motor Vehicle Division. Weischedel has been with the Division for 34
years, serving in many capacities where she gained an invaluable foundation of knowledge and experience which made her an
excellent choice for the Deputy position. Weischedel has a personal connection to the Dealer Licensing Program with her ten
years as a Dealer Inspector from 1998 to 2008.
Supervisor, Dealer Licensing Program – Lori Colberg
Colberg was promoted to the supervisor position in late May. Many of you may already know her as she grew up in the dealer
industry. With 23 years of experience she has a solid foundation and understanding of the motor vehicle laws and regulations.
She will serve from the Watertown Department of Revenue office while still maintaining a small territory herself in the middle
eastern side of the State.
Ron Rysavy remains our Dealer Agent for the southeast corner of the State and Pilo Pena is the Dealer Agent for the western half
of the State.
Lori Langdeaux, currently the Program Assistant, has been promoted to the Dealer Agent position in Pierre to cover the midsouthern territory. We have created a new Dealer Agent position in Aberdeen covering the northeastern corner of the State.

Scott and Susan Peterson were
unable to attend this years convention as they were at the South
Dakota State High School Rodeo where their son Jon was competing.
Bruce put a cell phone on speaker and held the microphone up to it in order for the convention attendees to be able to hear their conversation. Scott was very surprised and honored to receive this award.
Scott has been an avid supporter of the SDADA. He is an amazing man with a long list of accomplishments. It’s because of Scott’s character as a man and his integrity as a South Dakota franchised auto
dealer that he was selected for this award.
Scott and Susan will celebrate 28 years of marriage in July. They have two children. Jon is 18
and Jayme is 14. Scott is a member of several groups: SDADA, St. James Lutheran Church – Belle
Fourche, SD Stock Growers Association, NADA, SD Retail Association, Belle Fourche Chamber of Commerce and the Sturgis Chamber of Commerce. He served on multiple boards and committees: SDADA,
Belle Fourche Area Community Center, Belle Fourche Economic Development, Purple Pride, Dakota
Territory Buffalo Association and the National Buffalo Association.
He has been given numerous awards: Ford President’s Award and One Ford Elite Award (several times),
Chryslers Elite Dealer Award (several times), 2015 Sturgis Retail Business of the Year, 2014 SD Retailers Distinguished Service Award, 2014 Black Hills Community Economic Development Small Business of the Year, 2013-2014 SDADA Chairman of the Board, 2010 Belle Fourche Ag Business Persons
of the Year and 2010 Belle Fourche Chamber Employer of the Year.
His hobbies include activities with the kids (rodeo, soccer, basketball, track, 4H), driving cars fast, riding horse, hunting and an occasional half marathon. He enjoys being a rancher and farmer with buffalo, cattle and hay ground.
He is thrilled to be celebrating 25 years at the new car store in Belle Fourche Sept 1 2016.

BOUGHT CLIFF’S INTEREST AND THE DEALERSHIP BECAME IVERSON MOTORS. JOHN’S FATHER MERVIN
IVERSON AND HAROLD MAX TOOK OVER THE DEALERSHIP IN 1954 AND THE NAME CHANGED
TO IVERSON-MAX MOTORS. MERVIN AND HAROLD STARTED WITH JUST 10 TO 15 NEW AND
USED VEHICLES. THEY PURCHASED THE GRAHAM AUTOMOBILE COMPANY AND ACQUIRED THE
DESOTO AND PLYMOUTH FRANCHISES. ON MARCH 11TH, 1957 IVERSON-MAX MOTORS SUFFERED A $70,000 LOSS AFTER A FIRE DESTROYED THE DEALERSHIP’S REPAIR AND BODY SHOP. BY
JULY OF 1957 THEY HAD REBUILT A NEW 50X100-FOOT FIRE PROOF SHOP. IVERON-MAX MOTORS
BECAME AN IMPERIAL DEALER IN 1961 AND IN 1964 THEY ADDED THE CHRYSLER FRANCHISE
TO THE DEALERSHIP. BY 1976 IVERSON-MAX MOTORS HAD EARNED 15 “DISTINGUISHED DEALER
AWARDS”.
JOHN IVERSON STARTED HIS CAREER IN THE AUTOMOTIVE FIELD IN 1971, WASHING CARS FOR
50 CENTS AN HOUR AFTER SCHOOL AND ON WEEKENDS WHEN HE WAS JUST 13 YEARS OLD.
BY 1973 HE HAD WORKED HIS WAY INTO EXHAUST REPAIRS AFTER HOURS BEFORE GRADUATING
FROM HIGH SCHOOL. IN 1979, JOHN CAME ON BOARD TO HELP HIS FATHER RUN THE DEALERSHIP AND IN 1996 HE BECAME PRESIDENT.
WITH HARD WORK AND DEDICATION IVERSON’S HAS GROWN OVER THE PAST 60 PLUS YEARS.
IN 1996,THEY BUILT A NEW BUILDING ON SOUTH BURR STREET AND THE DEALERSHIP MOVED
TO ITS CURRENT LOCATION. ALONG WITH THE NEW BUILDING THE DEALERSHIP CHANGED ITS
NAME TO IVERSON CHRYSLER CENTER. IN 2000 AND 2010 NEW ADDITIONS WERE ADDED TO
THE DEALERSHIP. IN 2012, JOHN FURTHER EXPANDED IVERSON CHRYSLER CENTER TO INCLUDE
2 SALES OFFICES AND 3 BODY/SERVICE/ACCESSORY SHOPS. IN 2014, HE PURCHASED SIBLEY

Barry Burgess
December 5, 1921 to May 11, 2016
It is with a heavy heart that we pass on the news of the death of Barry Burgess, at the age of 94.
He was the father of Jim Burgess, Black Hills Harley-Davidson, Rapid City, SD
Barry was a World War II veteran. He flew 49 missions as a bombardier on the B-24. He was awarded
a Purple Heart and the Silver Star for his heroic efforts. He was an avid lover of cars and meticulously
restored numerous antique automotible to concours condition.
Keep the Burgess family in your prayers as they mourn their loss.

July 18, 1919 to June 24, 2016
We are saddened to inform you of the death of Janetta Deniger, at the age of 96. Janetta was the
mother of John Deniger, Prostrollo Motor Sales, in Huron, SD.
We pray that the Deniger family can hang on to the wonderful memories of Mrs. Deniger as they mourn
their loss.

Ford dealer starts work on new site - West 26th lot to hold 1,000 vehicles

Sioux Falls Ford Lincoln is starting construction at
its new location.
Randy Nehring, whose family owns the business,
bought the 15acre parcel on West 26th Street near
Lowe's in 2013.
"We're excited about it," he said. "We intend to stay
in Sioux Falls forever."
The Ford dealership opened at its current location
along West 41st Street in 1972. The Empire Mall
later was built next to it.
Nehring purchased the dealership in 1995 when it
was BenHur Ford, but the former owners retained
the property.
Nehring's lease expires at the end of 2017. Needing more space, he went looking for land several
years ago. "I wouldn't have been able to rebuild at
that location because of size," he said. "It's not large
enough to support the volume for a market the size
of Sioux Falls."
The new location will include
a 90,000 square foot dealership building – twice the
size of the current one – with
Ford's newest dealership design.
"It will have new features
like a much expanded express
maintenance facility, so people won't have to wait in
line, and the whole 15 acres will be dedicated to a
Ford Lincoln store," Nehring said. "We don't have
any intentions to have the out lots be developed."
He estimates there will be space to park up to 1,000
vehicles.
"It's extremely easily accessible by anybody in the
community. We've learned if people can get on a busy
freeway and get off an exit and get right to where
they go easily, they will come from anywhere," Nehring said. "Everything is protected by lights, so they
don't have a traffic issue, and it will be really good."
A groundbreaking is scheduled for June 9. Construction is scheduled to take one year.
When the dealership moves, it also plans to relocate
its body shop to a different location. A 40,000 square
foot Abra Auto Body & Glass will be built on 4.5
acres adjacent to Luxury Auto Mall, which the Nehring family also owns.
That project, as well as any redevelopment on the site
next to The Empire Mall, can't start until the property
is cleared from existing floodplain restrictions. That's
scheduled to happen by the end of
the summer.
The owners of that site haven't
announced plans for it, but it is
expected to remain as commercial property.
