Students are expected to maintain a minimum grade point average (GPA) of 2.0 in all programs. Students in the J.D. program must complete each required course with a grade of 70 ( C ) or above within 48-52 consecutive study weeks to continue to the next academic year and maintain an overall GPA of 2.0 or better for all coursework applicable toward the degree to graduate. •Any students on academic probation will be prohibited from taking more than one course during the following session that he/she was placed on probation status. •Once the student has met the academic requirements, the student will be removed from academic probation. A letter will be sent to the student, from the Registrar, advising the student of the removal of probationary status. A copy of this letter will be placed in the student’s permanent file. Placement on academic probation will result in the following action: (1) a letter (sent by email and postal mail) will be sent to the student, from the Registrar, advising the student of their probationary status. A copy of the letter will be placed in the student’s permanent file. The letter will address the consequences discussed below. •The Dean will forward his/her recommendation to the President for approval. If approved, the recommendation will be sent to the Registrar for submittal of formal disqualification letter. Applicants should submit a transcript of all previous law study along with their application form to admin@paclawschool.com All prospective transfer students are individually evaluated for purposes of awarding transfer credit. In evaluating the transfer courses, IPSL will look at whether the student applicant received a passing grade in the law courses completed at the other law school. That determination will be made based upon what was considered by the other law school to be a passing score. IPSL will also take into consideration where the law school courses were completed, whether the previous law school was an ABA, state accredited, or unaccredited law school, as to the effect the courses may or may not have upon the necessity for the student to take or be exempted from taking the FYLSE (First Year Law Students’ Examination). Grade Dispute If a student has a dispute with their grade, the student should immediately contact their Instructor preferably by email directly to the Instructor, or through the Administrative Director, to be forwarded to the instructor, in writing, asking for further explanation for the assigned grade. Upon receiving the response from the Instructor, if the student asserts that the grade results from unfairness, a departure from established grading policy or a clearly shown mistake, and the student presents credible evidence of such claim, said claim shall be considered by a separate Grade Review Committee. The Grade Review Committee shall be comprised of the Dean, the Academic Director, and at least one instructor, independent from the instructor who assigned the grade. Upon timely receipt of such a written claim, (not more than three (3) weeks after the examination or course grade is given) along with all relevant evidence to be considered, the Grade Review Committee shall consider the evidence presented by the student and shall discuss with the instructor, who assigned the grade, the basis upon which his or her grade determination was made. The Committee shall reach a final judgment and shall notify the student, Repeating courses Students who fail a course will be required to repeat the course. Students are allowed to retake a failed course one time. Upon successful completion of the repeated course, the student will be allowed to commence the next academic year. Both attempts at the repeated course will remain on the student transcript and are used to calculate cumulative GPA. A student whose study at IPSL is terminated because of failure to comply with academic policy or who violates the satisfactory academic progress 18 withdrawal grade is not computed into the student's GPA. For information regarding the refund policy on withdrawals, see the Refund Policy. Withdrawals will not be processed by the Registrar until the student has obtained all necessary clearances. in writing, of its final decision within one week of the Committee’s decision. The Grade Review Committee may decide to uphold the decision of the instructor, to raise, or lower the grade, based upon IPSL’s policy on grading. The decision of the Grade Review Committee will be final, and the results shall be entered into the student’s records as the final grade if a course grade, or modified or changed if an exam grade. Unauthorized Withdrawal A student who unofficially withdraws from a course without submitting proper notification will be considered to have withdrawn from IPSL and may not be considered for readmission to the institution. Students who have not requested a formal Leave of Absence but have not had any registration activity for one semester will be considered to have withdrawn from the institution. Students in these circumstances will be required to reapply for admission to the institution and, if readmitted, will follow the catalog in effect at the time of their readmission. Incomplete Grades/ Course Extension Students must initiate the request for an Incomplete (I) before the end of the course/semester. An Incomplete (I) is a temporary grade which the faculty - at their discretion -may give to a student. The assignment of an incomplete grade is appropriate when circumstances beyond the student’s control, such as illness or necessary absence have prevented the student from completing the course requirements by At the end of the academic term only students who have attended the class more than 60% of the sessions are eligible to receive an incomplete grade. Withdrawal Leave of Absence (LOA) Literature on higher education studies suggests that students who pursue an uninterrupted course of study have the highest probability for successfully completing degree programs. Those students are also the best performers in the degree program and receive the maximum benefits from their learning experience. Students who have experienced stop-out episodes are clearly performing below the level of their counterparts who engage in continuous learning in their degree program. Furthermore, their probability for completing their degree program is much lower. Students who are unable to complete a course in which they are currently registered may withdraw from the course by submitting a written request to the Registrar. Before the withdrawal can be processed, students must obtain tuition and fee clearance from Finance. Students should submit the withdrawal request as soon as they become aware of their inability to complete the course. Students are only allowed to withdraw through the first two-thirds (2/3 or 66%) of the class. Failure to give proper notification of intent to withdraw from a course will result in an "F" being posted on the student's official record. Students who withdraw from a course are not eligible to receive a refund. A In order to maximize the quality of learning experience for students and maintain the quality of 19 academic programs, IPSL has adopted the following policy: Students must maintain a cumulative grade point average of 70 or above to remain in good academic standing. Students with below a 70 cumulative grade point average will be placed on probation, as provided for in the IPSL Student Catalog and Handbook. A student on probation who is unable to improve his or her cumulative grade point average, or a student whose cumulative grade point average falls below 60 at any time will be academically dismissed. Students in the second and beyond academic year(s) must maintain a yearly grade point average of 70 or above to remain in academic good standing and be allowed to advance to the next academic year of study. The same rules regarding probation shall apply to such students. Students who complete the first year of law study must pass the First Year Law Students’ Examination (FYLSE) required by the California Business and Professions Code Section 6060(h) and Rule VIII of the Rules Regulating Admission to Practice Law in California, as part of the requirement to qualify to take the California Bar Examination. A student who passes the FYLSE within three (3) administrations thereof after first becoming eligible to take it will receive credit for all legal studies completed to the time the examination is passed. A student who does not pass the FYLSE, as described above, will be placed on academic probation. If the student chooses to continue taking courses, the student will not receive any credit until the student has passed the FYLSE. If the student passes the FYLSE on the 4th student may continue his or her courses; however, the student will only receive credit for the First Year of legal studies. Upon successful completion of the Ethics/Professional Responsibility course, as well as having completed the First year of legal studies, is eligible to sit for the MPRE (Multi-State Professional Responsibility Exam). After passing the FYLSE, and satisfactory completion of all required courses (as listed in the IPSL Student Catalog and Handbook) in each of the Students may request a leave of absence at any time prior to the first day of the semester by submitting a written request to the Registrar. Students who are on WA for no more than three consecutive semesters will retain their current catalog rights and will not be required to reapply for admission. Students who wish to take more than 12 months of leave will not be eligible to continue attendance under their initial catalog and will be required to reapply for admission. Graduation Requirements To be eligible for graduation for a J.D. degree, students must meet all of the following: •Complete required course totaling 78 credits •Have a minimum cumulative GPA of2.00 •Receive a grade of 70 (C) or higher in all courses required to meet program requirements •Pass the FYLSE •Petition the Registrar for graduation •Satisfy outstanding financial obligations Graduation is held annually. Students who are within one academic semester may participate in the graduation ceremony. The following standards shall be applied equally to every student. Every First Year Student must successfully complete all of their first year courses in order to advance to the second year and beyond. First Year 20 Exam. Students are required to maintain their student log of hours, attend (asynchronously) class through videotaped lectures, and do all of the required assignments, study, and examinations, in order to graduate and receive their degree. Upon successful completion of the required courses and achieving the minimum GPA requirement, a student must petition the Registrar for graduation to begin the degree audit process. This process verifies that the student has satisfied all requirements, including successful completion of all courses, validating that the student has no outstanding financial obligations with IPSL and the student has fulfilled the State Bar of California requirements. At the conclusion of the audit process, the student will be conferred the J.D. degree, mailed a diploma and an official transcript. Honors Exceptional scholarship is recognized upon graduation based on the following scale: The student status will be upgraded to “graduate” and the degree conferral date will be the date of the last semester that the student was enrolled. Accredited School 和 Unaccredited school 的区 别: Accredited School 规定学生到校上课并且在校内 设有规定的图书馆。所谓的规定图书馆就是在图 书馆内存有规定数量的书籍,不包括 CD 和 Computer Program。本校属于 Register Unaccredited Correspondence Law School. 所谓 Unaccredited 学校就是不需要学生出席,图书馆 内也不存有规定数量的书籍。这并不代表学校不 被承认。从本校毕业后同样可以拿到法学博士 (J.D.) 学位和参加司法考试的资格。虽然我们没 通俗的认识是律师就一定要出庭打官司,但是在 美国并非如此。美国有两种律师,一种是 Transactional Attorney(事务律师),另一种 是 Litigation Attorney(出庭律师)。通过司法 考试以后,学生可以选择从事事务律师或者出庭 律师,亦或两者兼顾。 事务律师不需出庭打官司。亦称作公司律师 (Corporate Attorney),因为这些律师大多在商 业公司做幕后工作,比如为企业写合同,决议, 31 法律意见以及托管信托协议。他们的工作目的是 让企业避免诉讼。美国是一个法制国家,在任何 领域都需要一个事务律师。我们最经常听到的移 民律师,房地产律师,和保险法律师均毋须出庭。 其他领域包括环境法,教育法,知识产权,遗产 信托,税法,艺术等等。 时间方面学生可以按照个人的进度灵活安排,每 个月需要交给学校一张 self-check sheet。但是如 果学校看到有学生经常缺课,会打电话询问原因。 出庭律师需要处理诉讼案件。任何诉讼都需要 出庭律师,比如民事诉讼,刑事诉讼,商业诉讼 等等。大部分的律师都是事务律师,出庭律师相 对来说比较少。很多学生都因为母语不是英文而 担心出庭,但其实很多在美国出生长大的律师在 法庭上也对出庭有心理压力,因此也有很多人选 择成为事务律师。 我有很多时间,可不可以快点上完课程早毕业? 法学博士(J.D.) 学位是由加州律师协会签发的, 他们规定学生一定要完成四年的课程。学校也不 建议你匆忙结业,因为学校教授的内容是以后考 Bar Exam 和就业后一辈子所需的知识。如果匆 忙结业,很多内容会学得不够扎实,考试的时候 就会面临很大的困难,将来就业处理案件也不够 自信。学校建议,如果你有多余的时间,反复游 览课程,多问教师问题,把内容学得透彻,这样 才是真正的有利于学生。 在出庭时,要保持轻松的心态。如果没有听懂对 方律师的陈述,就如实的告诉法官你没有听懂, 请求重复或者解释。有些律师不懂装懂,反而会 造成不利。 有没有作业?考试日期是哪一天? 有的时候教师会在上完课程后留作业。请把写好 的作业用 email 寄给学校。 根据学生入学的日期,每三个月会给一次期中考 试。学生可以再家里完成后 email 给学校。期末 考试是一年之后。 学校 email: admin@paclawschool.com 学校建议新生不要担忧。在考律师执照之前,学 生要用英文学习四年的法律。四年的时间,如果 认真学习,学到很多法律知识和单词之外,英文 也会充分提高。学校之所以提供半年的中文补充 课程,是因为有些学生用英文理解法律单词会比 较困难。因此学校提供 6 个月的时间一边听英文 课程,一边听中文课程,让学生更容易的了解和 吸收授课内容。6 个月后,所有的学生都要用英 文听课。对英文不太好的学生来说,除了可以学 习法律以外,也是一个学习英语的好机会。而且 随着美国和中国的交流逐渐争加,市场上也越来 越需要懂得中国语言和文化的律师。英文好的律 师很多,但是会说中文的美国律师却很少,这是 本校学生的优势。 我在哪里可以买得到教科书? 你可以在附近的书店或在网上购买,例如 ebay, Amazon, half.com 等。或者你可以交付学校 $600.00 教科书费和 $30.00 运费。学校会马上寄 给你教科书。 学校有没有 Baby Bar Exam 的复习班? 本校有两种专门为 Baby Bar Exam 设计的课程。 详情请与学校联系。 此外,从法学院毕业后,有很多道路可以选择, 律师并非唯一。更多内容请看常见问题的“拿到 法学博士学位后,如果我不想考司法考试,可 以做什么工作?” 通过司法考试后,我可不可以住在美国当律师 或者自己开一家律师事务所? 司法考试合格后,可以通过 E-2 投资创业签证在 美国开律师事务所,或者可以以 H-1B 签证工作 一年再申请移民取得绿卡。 我平均一天要学几个小时? 第一年课程比较多,平均一天五个小时。第二年 开始会比较轻松,平均一个星期十个小时。 32 在加州拿到律师执照后可不可以去其他州当律 师? 各个州法律略有不同,大部分都需要通过当地的 司法考试 (Bar Exam) 才能获得当地律师资格。 有 12 个州承认外州律师资格,无需通过当地考 试。有一些州和加州法律基本一致,可以不用考 试。剩下的州政府都要求外州律师报考并通过当 地司法考试。 所以整体来说,在加州拿到律师执照后,如果要 去外州当律师,通常有两个选择: 1. 通过当地州的司法考试。加州司法考试是全 50 个州中最难考的考试之一。如果你考过加州 考试,通常也会考过其他州的司法考试。 2. 不参加当地考试,你可以申请执行一些联邦法 案,比如移民法。根据每个州的不同,申请程序 和规定也有所差异。 本校毕业生可不可以去其他州考司法考试? 从本校毕业后即获得报考加州司法考试 (Bar Exam) 的资格。通过加州司法考试后,如果想去 外州当律师,根据外州法规,通过外州的司法考 试(有若干州无此要求)。 如果毕业生只想在外州考试,根据外州的要求补 充一定学分后可以考试。 拿到法学博士学位后,如果我不想考司法考试, 可以做什么工作? 美国是一个法制国家,做任何领域都需要了解美 国法律。如果不想考司法考试,也有很多行业可 以选择,在很多职场上也可迅速升职。以下是一 些简单的例子: 33 LOS ANGELES CAMPUS www.paclawschool.com 213-739-1564 / 888-921-8899 3350 Wilshire Blvd. #777 Los Angeles, CA 90010 admin@paclawschool.com * Reservation of Rights: INTERNATIONAL PACIFIC SCHOOL OF LAW reserves the right to make changes to provisions of this catalog, and its rules and procedures, at any time, and from time to time, as it so determines in its sole discretion.
