NOTICE OF APPLICATION FOR AN ORDER
West Midlands Passenger Transport Executive ("Centro") of Centro House, 76 Summer Lane,
Birmingham, B19 3SD is applying to the Secretary of State for Transport under section 6 of the Transport
and Works Act 1992 for fhe above-mentioned order under section 1 of thaf Act
The application is fo be made subject to an environmental impact assessment.
The draft Order would revive powers of compulsory acquisition for the purposes of the works authorised
by the Midland Metro (Birmingham City Centre Extension, etc) Order 2005 (Sl 2005/1794) ("the 2005
Order"), which expired in 2010, and would also authorise a variation, of approximately 700 metres, of the
alignment of the tramway authorised by the 2005 Order within Paradise Circus Queensway in the centre
of Birmingham, to integrate with changes to the highway proposed as part of the redevelopment of
Paradise Circus. The draft Order would confer on Centro powers to acquire land compulsorily for
purposes connected with, or ancillary to, the construction of the tramway along the re-aligned route.
These provisions include powers fo acquire land or rights over land, to extinguish private rights, and to
use land temporarily. It would also confer powers enabling Centro to carry out such works as may be
necessary or expedient in connection with the construction of the tramway and fo operate and use the

1. NOTICE IS HEREBY GIVEN that the Council of the London
Borough of Newham on 2 December 2013 made the above mentioned
Orders under Sections 6 and 124 of the Road Traffic Regulation Act
1984, xs amended.
2. The general effect of the Newham (Bus Lane) (No.l, 1995)
(Amendment No. 1) Traffic Order 2013 will be to allow pedal cycles
to enter and use the contra-flow bus lane on the north-east side of
Great Eastern Road towards its junction with Broadway E15.
3. The general effect of the Newham (High Street, Stratford and Great
Eastern Road Bus Lanes)(No.l, 2004)(Amendment No. 1) Traftic
Order 2013 will be to revoke bus lanes in the following lengths of High
Street E15:
(a) the north-west side, from a point 52 metres north-east of the northeastern boundary of Nos. 80/82 High Street E15 to a point 90 metres
south-west of the south-western kerb-line of Warton Road;
(b) the north-west side, from a point 35 metres north-east of the northeastern kerb-line of Carpenters Road to the south-western kerb-line
of Great Eastern Roed; and
(c) the south-east side, from x point 7.5 metres south-west of the northedstern boundary of Nos. 383/387 High Street E15 to x point 13 metres
north-east of the north-eastern kerb-line of Sugar House Lxne.
4. The general effect of the Cycle Lanes Order will be to introduce
cycle lanes operating "at any time" for use by pedal cycles only in:
(a) High Street E15, the north-west side, from x point 24 metres southwest of the north-easternmost south-western wAll of No 6 High Street
E15 to a point 1 metre south of the north-western wall of No. 322
High Street EIS;
(b) High Street EIS, the south-east side, from its junction with
Broadway E15 to a point 42 metres south-west of the south-western
kerb line of Hunt's Lane;
(c) Broadway E15, the main carriageway, the south-east side, from a
point 3 metres north-east of the south-westernmost wall of No. 65
Broadway E15 to its junction with High Street EIS;
(d) Romford Road, the north side, between its junction with The
Grove and e point 19 metres north-west of the party wall of Nos.
]4/16 and 18/20 Romford Road;
(e) The Grove, the east side, between a point 9 metres north of the
party wall of Nos. 1 and 3/5 The Grove and its junction with Romford
Road; and
(~ The Grove —the west side of the island site located xt the junction
of The Grove, Romford Road and Broadway EIS — from a point 24
metres south of the party wall of Nos. I and 3/5 The Grove southward
for a distance of 32 metres.
5. The general effect of the Prescribed Routes Order will be to:
(a) amend the existing order for the road closure (except cycles) in
Bridge Road E15 between New Mount Street and Dxwn Crescent to
reflect the extent of the current closure;
(b) a11ow northbound cyclists in Cam Road to proceed xheed into a
cycle route at the junction with High Street E15; and
(c) allow vehicles to turn right from High Street EIS into Warton
Road..
6. The general effect of the Waiting and Loading Restriction Order
will be to introduce new restrictions on waiting and loading by vehicles
operating "at any time" (double yellow lines and double loading kerb
blips") in High Street EIS and in lengths of Broadway EIS, Rumford
Road and The Grove adjacent to the cycle lanes referred to in
paragraph 4 above. New restrictions will also apply in lengths of side
roads adjacent to High Street EIS, typically for 10 metres from their
junctions with High Street E15.
7. Copies of the Orders, which will come into force on 9 December
2013, and documents giving more detailed particulars of the Orders,
are available for inspection during normal office hours on Monday to
Friday inclusive at Newham Dockside, 1000 Dockside Road E16 2QU
for a period of six weeks from the date on which the Orders were
made.
8. If any person wishes to question the validity of any of the Orders
or of a~fy of their provisions contained therein on the grounds that i[
or they are not within the powers conferred by the Road Traffic
Regulation Act 1984 or that any requirement of the Act or any
instrument made under the Act has not been complied with, that person
may, within six weeks from the date on which the Orders were made,

West Midlands Passenger Transport Executive ("Centro") of Centro
House, 16 Summer Lane, Birmingham, B19 3SD is applying to the
Secretary of State for Transport under section 6 of the Transport and
Works Act 1992 for the above-mentioned order under section 1 of
that Act.
The application is to be made subject to an environmental impact
assessment.
The draft Order would revive powers of compulsory acquisition for
the purposes of the works authorised by the Midland Metro
(Birmingham City Centre Extension, etc) Order 2005 (SI 2005/1794)
("the 2005 Order"), which expired in 2010, and would also authorise
a variation, of approximately 100 metres, of the alignment of the
tramway authorised by the 2005 Order within Paradise Circus
Queensway in the centre of Birmingham, to integrate with changes to
the highway proposed as part of the redevelopment of Paradise Circus.
The draft Order would confer on Centro powers to acquire land
compulsorily for purposes connected with, or ancillary to, [he
construction of the tramway along the re-aligned route. These
provisions include powers to acquire land or rights over land, to
extinguish private rights, and to use land temporarily. It would also
confer powers enabling Centro to carry out such works as may be
necessary or expedient in connection with the construction of the
tramway and to operate and use the tramway once constructed. These
include provisions relating to street works and to the temporary
stopping up of streets with the consent of the highway authority,
powers to discharge water, construct temporary tramways, survey and
investigate land and carry out safeguarding works to buildings as well
as powers to erect traffic signs and charge fares. The draft Order would
also confer powers(including powers to acquire land)enabling Centro
to carry out a minor adjustment to the 2005 scheme outside the
Paradise Circus area. Provisions of the Railway Clauses Consolidation
Act 1845 (c.20), New Roads and Street Works Act 1991 (c.22), Midland
Metro Act 1989 (c.xv), Midland Metro (Penalty Fares) Act 199] (c.ii),

1992 for the above-mentioned Order under section 1 of that Act. ''
The drah Order would revive powers of cortipulsory acquisition for the purposes of the works authorised
by the Midland Metro (Birmingham City Centre Extension, etc) Order 2005 (SI 2005/1794)("the
2005
Order"), which exPfired in 2010, and would also authorise a variation, of approximately 1'00 metres, of
the alignment of the tramway authorised by the 2005 Order within Paradise Circus Queensway in the
centre of Birmingham, to integrate with changes to the highway proposed as part of the redevelopment of
.Paradise Circus.The draft Order would confer on Centro powers to acquire land compulsorily for purposes
connected with; or ancillary fo, the construction of the tramway along the re-aligned route. These
provisions includepoveers to acquire land or rights over land,to extinguish private rights, and to use land
temporarily. It would also confer powers enabling Centro to carry out such works as may be necessary or
expedient in connection with the construction of the tramway and to operate and use the tramway once
constructed. These include provisions relating to sveet works and to the temporary stopping up of streets
with the consent of the highway authority, powers to discharge water, construct temporary tramways,

survey and investigate land and carry out safeguardingworks to buildings as well as powers to erect
traffic
signs and charge fares. The draft Order would also confer powers (including powers to acquire land)
enabling Centro to carry out a minor ad'ustment to the 20D5 scheme outside the Paradise Cucus area.
Provisions of the Railway Clauses Cooso~idation Act 1845 (c10), New Roads and Street Works Act 1991
(c.22), Midland Metro Act 1989 (c.xv), Midland Metro (Penalty fares) Act 7991 (c.ii), Midland Metro Act
1992 (c.vii) and Midland Metro (No. 2) Ad 1992 (c.viii) are incorporated to the extent specified in the
draft Order.the draft Order also contains protective provisions for relevant statutory undertakers. ,
The application is to 6e made subject to an environmental impact assessment and contains a statement
that a direction for deemed planing permission is being applied for.

Notice is given pursuant to Rule 13(6) of the Transport and Works (Inquiries Procedure) Rules 2004 that
Mr. J Watson BSc (Hons) MICE FCIHT MCMI, an Inspector appointed by the Secretary of State for
Transport, will open a public inquiry into the application by West Midlands Passenger Transport Executive
("the Applicants") for the proposed Midland Metro (Birmingham City Centre Extension Land Acquisition and
Variation) Order under section 6 of the Transport and Works Act 1992 on the 1st Floor, 43 Temple Row,
Birmingham, B2 5LS at 10.00am on Wednesday 19 November 2014.
The draft Order would revive powers of compulsory acquisition for the purposes of the works authorised by

Jocelyn Bennett's heartbroken family
said medics are due to switch off her baby
daughters' life support machines today.
Melody and Rose were born hours after
paramedics finally reached Jocelyn, who is
in a coma and may never meet her babies.
`Ihe 27-year-old rang the ambulance
service after suffering severe stomach pains
at 5.39am last Wednesday.
But crews were unable to open the
entrance doors at the Druids Heath tower
block where Jocelyn lives with hex partner
and their three year-old son.
Birmingham City Council said that they
