SCHAEFFER' S FENCE - APPROVAL TO LOCATE IRON FENCE BEYOND
BUILDING LINE
This item was deferred at the November meeting of the Commission to allow time for the City Attorney to
prepare a Letter of Indemnification for signature by the Schaeffers and to allow Staff time to make
additional field measurements.
Mr. Hearnes, Assistant City Engineer, and I visited the site at 11760 Ladue Road on Friday, December 8,
1995 to measure the setback of the fence surrounding Woodbridge Condominiums. The fence parallel to
Ballas Road is set back 13 feet from the edge of the curb line. The fence is set back 11 feet from the curb
line at the intersection of Ballas and Ladue. The setback along Ladue Road is 11 feet and it reduces to 9 ft.
8 in. from the edge of the curb further west on Ladue prior to indenting in preparation for the entrance
gates.
By our field measurements and judgment, the Schaeffer' s fence would need to be set back 7 feet from the
edge of the curb on Ballas to be clear of the road right -of w
- ay and 3 foot road right -of w
- ay easement. This
location at 7 feet from the curb would appear to be feasible without altering the berm.
It is the recommendation of Staff that the pillars and gates be indented a minimum of 20 feet from the edge
of the curb line on both the Ladue Road and Ballas Road entrances to allow a vehicle to approach the gates
in their closed position and be fully clear of the traffic lanes. This indentation would appear to be
physically feasible at both locations.
Attached is a copy of the proposed Indemnification Agreement prepared by Mr. McCarter. Also attached
is the Staff Memo from the November meeting, which gives additional background information.
Action on this item will be in the form of a motion for approval, approval with conditions, or denial.

SCHAEFFER' S FENCE - APPROVAL TO LOCATE WROUGHT IRON FENCE BEYOND
BUILDING LINE
Mr. &
Mrs. John Schaeffer, the owners of the property located on the southeast corner of the intersection
of Ladue Road and North New Ballas Road, are seeking approval from the Creve Coeur Planning and
Zoning Commission to install a fence beyond the front yard setback line.
The Schaeffer' s property has been encroached on over the years through the various road widenings and
improvements to Ballas and Ladue. The property contains a single family home, with a driveway which
runs diagonally across the property connecting N. New Ballas Road and Ladue Road. As a result of the
most recent improvement to North New Ballas, an earthen berm was constructed from the driveway
entrance on North New Ballas northward to Ladue and then eastward to the drive entrance onto Ladue.
The Applicants desire to construct a 6 foot high wrought iron fence, which would begin on their southern
property line at the end of the existing shrubbery and would go west to North New Gallas Road. It was
explained to Staff that the fence would then run approximately 2 to 3 feet behind and parallel to the curb
line of North New Ballas. When the fence reaches Ladue Road, it would turn east and continue to the end
of the existing landscaping on the northern property line. There will be 7.,foot high brick pillars on either
side of both driveway entrances, with wrought iron gates between each se of pillars.
Section 26 -78. 3 of the Zoning Code allows the Planning and Zoning Commission to approve the erection of
a fence beyond the building line upon review of a Site Development Plan. In recent years, the Commission
has approved only those fences beyond the building line which enclosed entire neighborhoods, such as
Carlyle, or fences erected
maintained by the Trustees of a subdivision, such as Rolling View Farm on
Conway Road.
The Schaeffers have experienced many unusual and potentially dangerous situations on which they will
elaborate at the meeting. This request is not a request for a variance but a request for special
consideration. However, it would seem that for the Commission to be fair and consistent, it would need to
determine that this situation is unusual and unique and different from other fence requests denied in the past
and different from sites which are eligible to apply for such a request in the future.
Should the Commission choose to approve the request to extend the fence beyond the building line, it is
suggested that the Schaeffers submit to the City of Creve Coeur a letter of indemnification from any
damage which may occur to their fence from vehicles or accidents along North New Ballas or Ladue
Roads. The Schaeffers would also need to insure that the fence is not located on the public right -of w
- ay of
either street.

KOHN' S KOSHER MEAT & DELI - APPROVAL OF CONDITIONAL USE PERMIT
AND SITE DEVELOPMENT PLAN
This Applicant is seeking approval from the City of Creve Coeur to construct a delicatessen within a retail
building on the northwest corner of the intersection of Old Olive Street Road and Guelbreth Lane. This
property contains approximately 1. 01 acres and is zoned " GC" General Commercial. This parcel is not
included in the Old Olive Area Land Use Plan because the Area Plan only includes the property on the
south side of Old Olive Street Road. The property currently contains a vacant building, which is in a state
of disrepair. The lot has been utilized by the Lou Fusz Automobile Company for storage of vehicles at
various points in time.
The Applicant proposes to demolish the existing structure and construct a 7, 750 square foot building on the
site with associated parking facilities. The Site Development Plan indicates that 400 square feet of the
building will be used as a delicatessen/ restaurant and the remaining 7, 350 square feet will be used as retail
facilities. This combination of uses produces a parking requirement of 49 parking spaces. The proposed
plan indicates a total of 49 parking spaces. The proposed total site coverage is 69 percent. The maximum
site coverage allowed within the " GC" District is 70 percent. The proposed Floor Area Ratio is . 17; the
maximum allowable within the " GC" District is . 50. The proposed building setbacks are in conformance
or exceed the required setbacks within the " GC" District. The properties to the west, east and south are all
zoned " GC" General Commercial by the City of Creve Coeur. The property to the north is within
unincorporated St. Louis County and is zoned " R6" or Multifamily Residential. There is sufficient green space being provided along the northern property line to meet the requirements of the code where the " GC"
District abuts a residential district, and the plan indicates the construction of a 6 ft. high wooden light-
proof fence along this northern property line. There is an existing privacy fence that runs along the north
side of a driveway which serves the apartment complex. This existing driveway is immediately adjacent to
the north property line of the subject property.
The proposed building is a one -story building with a partial basement. The building will be constructed of
a combination of split face block, brick and metal frame glass openings with an asphalt shingle roof canopy
on three elevations. The rear elevation will consist of split face masonry units. It may be necessary to
provide mechanical equipment screens along the north elevation in order to screen any rooftop mechanical
equipment.
The comments of the Assistant City Engineer have been addressed by the submitted plan. Attached is the
report of Mr. Richard Shearer of HBA, Inc. regarding the landscape plan for this site. Also attached is a
draft of a Conditional Use Permit for the operation of a restaurant. The conditions may be modified as
deemed appropriate by the Commission.
Action on this item will be in the form of a recommendation to the City Council for approval, approval with
modifications, or denial. The suggested Public Hearing date is Monday, January 22, 1996.

HBA has reviewed the above cited landscape plan. There ere several "instauces where the plan does
not comply with the ordinance. The numbers and species of some trees do not conform to speoific
requirements contained in the city's zoning ordinance.
1)
Section 26- 87.6(a) of the ordinance requires street trees to be located between 8 and 12 feet
from the back of the curb with one tree required for each 40 lineal feet, or part thereof. of
std frantage. Six street trees are required along Old Olive and six additional street trees
are required along Guelbreth Lane. Only four titm are proposed along Guelbreth.
2)
Bradford Pears are not on the city' s list of approved street trees.
HBA has approved
Bradford Pears in the past, although in those cases such trees were used as only one of two
or more deciduous trees. The use of Bradford Pears as the only deciduous trees is not
specifically allowed by the ordinance and is inconsistent with previous landscape plan
approvals.

Section 26- 87.6( c) of the ordinance requires that in addition to landscaped areas in the front.
back or side yard areas, a minimum of 10 square feet of interior landscaped area shall be
provided within the parking lot for each 350 square feet ofparking spaces and driving aisles.
This equates to almost ten square fcet of interior landscape area per parking space. No
interior landscaped areas are proposed.
4)
Section 26- 87. 6( d) of the ordinance requires that each separate interior landscaped area
include at least one deciduous shade tree of a type and size required. The landscape plan
also proposes that white pines be located adjacent to the parking lot. White pines are not
suitable as parking lot trees and do not meet the ordinance requirement.
5)
The ordinance requires that the Latin name of all plant material and the quantities of each
be indicated on the landscape plan. Latin names are not provided for the Bradford Pears,
White Pines or the Junipers.

PLAZA MOTORS - APPROVAL TO AMEND C. U. P. AND SITE DEVELOPMENT PLAN
Plaza Motors is seeking approval from the City of Creve Coeur to expand their existing facilities within
their complex at 11830 Olive Boulevard. Their property, located on the south side of Olive Boulevard
between North New Ballas Road and Center Parkway Drive, is zoned " CB" Core Business by the City of
Creve Coeur. Within the " CB "" District, an automobile dealership is a conditional use and the expansion
or enlargement of a conditional use requires an amendment to the Conditional Use Permit.
This particular request involves additions or expansion of several different areas of existing buildings and
the construction of a new car wash building. It is proposed to expand the east and west sides of Building
A" which houses the BMW, Cadillac, Porsche, Audi, and Range Rover sales. The expansions would
increase the footprint by 10, 436 square feet. The existing Mercedes building will be expanded by 524
square feet, and the car wash building proposed to be located near the Infiniti building will contain 1, 000
square feet of floor area.
The addition on the west side of the BMW /Cadillac building is basically replacing the open air canopy
which exists there today. The addition to the east side of the building will be onto an existing paved area.
The additions will provide additional showroom floor space and covered or indoor service write -up areas
for BMW and Porsche, Audi, Range Rover. It is also proposed to construct seven additional parking
spaces in front of this building for customer parking. The addition to the Mercedes building will add two
additional service bays to the building and will be in an area that is already paved. The 2, 000 sq. ft. future
service extension shown on the plan was a part of the overall Site Development Plan approved in 1991.
The proposed car wash facility would be located in the existing parking area on the north side of the Infiniti
building adjacent to the retaining wall between Plaza Motors and the Phillips 66 Service Station. This area
would only be visible or noticeable to drivers north bound on N. New Ballas Road. If this location is
approved, it is probable that additional landscaping may be needed to help screen or buffer that area of
visibility.
As a result of these proposed additions and renovations, the overall site coverage would increase from 78. 2
percent to 78. 3 percent. The F. A.R. on the site would increase from . 33 to . 35, which is well below the 2. 0
permitted for a Class " D" lot within the " CB" District. The plan also indicates an excess of parking spaces
being provided on the site after the additions. The plan indicates a total of 69 excess parking spaces. This
parking count does not include the temporary surface lot located on the west side of Decker Lane. There is
no landscaping changes or modifications proposed with this plan.
The one major issue noted during the plan review relates to the required front yard setback of the
BMW /Cadillac building from the Olive Boulevard right -of w
- ay. Section 26- 72. 2( a) I of the Zoning Code
requires a building or structure to be located at least 65 feet from the right -of w
- ay line when there is a

parking area located in front of the building or a 35 foot setback when there is no parking zone in front of
the building. The proposed addition, on the east side of the building, would be 25 feet from the current
right -of w
- ay line and 36 feet from the right -of w
- ay prior to an 11 foot dedication by Plaza Motors for the
widening of Olive Boulevard. If the proposed customer parking area was removed from in front of the
building, credit could be given for the dedication of right -of w
- ay and the setback would comply with the 35
foot minimum.
The amendment to the C. U.P. could be as simple as changing the reference date on the approved Site
Development Plan to the current plan date. Action on this item will be in the form of a recommendation to
the City Council for approval, approval with modifications, or denial. The suggested Public Hearing date
is Monday, January 22, 1996.

MONSANTO - APPROVAL OF SITE DEVELOPMENT PLAN FOR EMERGENCY
UTILITY BUILDING
Monsanto is seeking approval of a Site Development Plan to construct an Emergency Utility Building to
service its West Campus. The proposed building will be located in the northeast portion of the western
campus near the ramp from east bound Olive Boulevard onto south bound Lindbergh Boulevard. This
campus is zoned " RO" Research Office Park by the City of Creve Coeur.
The proposed building would contain approximately 5, 254 square feet of floor area. The building would
be one story and 16 feet in height, constructed of brick masonry on all four elevations. The purpose of the
building would be to provide emergency power and heating/cooling in case of a major disaster or loss of
power by Union Electric. The building would contain three diesel powered emergency generators, electrical
switch gear, pumps and other associated mechanical equipment. On the exterior of the building will be
three emergency chiller /condensers within a screened enclosed area. The site will also contain a 20, 000
gallon underground diesel fuel storage tank as a supply to the generators. This installation will have to
meet the requirements of the Creve Coeur Fire Protection District, St. Louis County Mechanical Division
and Federal EPA regulations.
The proposed building would be within an existing paved area and, as a result, there is no additional
stormwater runoff. There would be a loss of 33 parking spaces, which would have little impact on the
overall campus count. The proposed location will not be highly visible from off s-ite because of the
adjacent grades and existing plant material, except for possible visibility from one or two areas along the
ramp from Olive onto Lindbergh. However, it is suggested that additional evergreen material be planted on
the slope behind the building to improve the screening similar to the arrangement around the fire pump
structure located a short distance to the south of this proposed structure. Any noise generated by the
facility would not be a disturbance to any residential areas because of its remote location and distance from
adjacent residential subdivisions.
Action on this item will be in the form of a motion for approval, approval with modifications, or denial. No
action by City Council is required.

CHAMINADE - APPROVAL OF LANDSCAPE PLAN
Upon approval of the Conditional Use Permit for the maintenance facility for Chaminade, the City Council
requested the Landscape Plan be reviewed by the P & Z Commission to insure the proposed plant material
and arrangement will provide an adequate screen and buffer all year for the adjacent residential structures
located in Frontenac. The plan was forwarded to Mr. Richard Shearer of HBA, Inc. for review, and his
report is attached for your use and information.

WESTMINSTER CHRISTIAN ACADEMY - APPROVAL OF C. U. P. AND
SITE CONCEPT PLAN
Westminster Christian Academy, located at 10900 Ladue Road, is seeking approval from the City of Creve
Coeur for a Conditional Use Permit and a Site Concept Plan to allow an expansion of their school facilities.
This property is located on the south side of Ladue Road, between Graeser Road and Spoede Road and
contains approximately 30 acres. The entire 30 acres is zoned " A" Single Family Residential. Within this
zoning district, a school is a conditional use.
This institution applied for a Conditional Use Permit and Site Concept Plan approval in the summer of
1994, which was ultimately denied by the Creve Coeur City Council in March of 1995. This resubmittal is
similar in scope and context to the original plan, with the following revisions:

of the plan remain the same as previously submitted regarding building additions, sizes and locations.
The Applicant has not submitted new documentation or reports regarding traffic, stormwater or noise, but
does request that the previous submittals be entered into the record for consideration. With a reduction in
the available parking and seating capacity of the auditorium, the traffic study should still be valid.
This Site Concept Plan is being reviewed under the existing section of the zoning ordinance and, as a result,
any approval given will run with the property and C. U.P. and will not expire --similar to Covenant
Theological Seminary and Missouri Baptist College. Individual phases or portions will require review and
approval of Site Development Plans by the P & Z Commission. The Site Concept Plan should clearly
indicate that the auditorium will contain a maximum of 900 seats and should also contain a phasing
schedule for the various portions of the project.
Attached is a draft of a Conditional Use Permit which contains the proposed conditions as prescribed by the
Council in March of 1995. Action on this item will be in the form of a recommendation to the City Council
for approval, approval with modification, or denial. The suggested date for the Public Hearing is Monday,
January 22, 1996.

MX" DISTRICT REGULATIONS
The City Council held a Public Hearing on the proposed revisions to the " MX" District regulations at their
meeting on November 27, 1995. Based on public comment from an affected property owner regarding
permitted uses of existing structures, the Council chose to have the Commission review the stated problem
and make a recommendation to Council. The problem related to existing residential structures which have
been converted to a commercial use under the provisions of Section 26 -52 of the Zoning Code and which
were subsequently zoned " MX" Mixed Use and what use the structures could be allowed under the
proposed " MX" regulations.
Attached is a draft of a Resolution which could be adopted by the City Council which would allow these
existing structures to be used for any uses defined as a Class I use in the " MX" District for a transitional
period of five (5) years.
Action on this item would be in the form of a recommendation for approval, approval with modifications,
or denial. The City Council would consider the Resolution at their meeting on January 8, 1996.

Attached is a draft ordinance which would amend the City of Creve Coeur' s billboard regulations. This
amendment would make the current regulations slightly more restrictive. These amendments are based on
the regulations adopted by the City of Lake St. Louis, which were recently held to be valid and enforceable
by the Circuit Court in St. Charles County. These proposed amendments are based on the attached letter
from the Mr. Dudley McCarter, City Attorney, to Mr. Michael McDowell, City Administrator.
