JASON "JUMBO" JONES: Based on my professional training and experience as a 2 police officer investigating DBG/Towerside criminal street gangs and a review of police reports, 3 sheriff's records, photographs, and other documents, it is my opinion that Jason Jones ("Jones") is an 4 active member of Defendant DBG gang. 5 I personally know Jones, whose moniker is "Jumbo." 6 Jones does not report to live in the Proposed Safety Zone. 7 8 9 EVIDENCE OF GANG ACTIVITY - CRIMINAL CONDUCT regarding an assault that had just occurred. (Police Incident Report No. 050730928.) 10 According to the report. Jones and a juvenile DBG member assaulted a victim, punching 11 the victim in the face and knocking the victim down on the floor. When SFPD officers 12 went to arrest Jones, Jones resisted engaging the officers in a violent struggle. Jones 13 threw a loaded pistol he had concealed on his person to the ground. SFPD officers seized 14 a box of ammunition from Jones' inside jacket pocket. Jason Jones was arrested for illegal 15 firearm possession and assault. Jones was convicted of carrying a loaded firearm in a 16 17 18 19 20 21 22 23 24 25 26 27 28 On June 30, 2005 at 11:30 a.m., SFPD officers responded to Mission and Geneva Streets public place. On December 1, 2005, Jones was convicted in San Mateo County of felony evading a police officer and was sentenced to three years of probation and 6 months in jail. On March 4, 2006 at 8:54 p.m., Jones was seen loitering with known DBG members including Floyd "Freak" Jackson in the area of 1613 Sunnydale Avenue. (Police Incident Report No. 060244674.) According to the report, SFPD officers conducted a warrantless search of Jones pursuant to the conditions of Jones' probation. SFPD officers seized suspected cocaine base (crack) packaged for sale and other sales indicia. Further, SFPD officers recovered additional cocaine base packaged for sale within five feet of where Jones was standing. Jones was arrested for possession of cocaine base for sale. Jones was convicted of possession of base rock cocaine for sale. 103 EXPERT DEC OF OFF KUMLI ISO PI-PEOPLE v. (Police Report 3 No. 061372852.) According to the report, SFPD officers approached Jones on the 1500 4 Block of Sunnydale Avenue, within the Proposed Safety Zone and in DBG turf, to arrest 5 Jones on an outstanding warrant. As officers approached, Jones entered a vehicle Glass 6 was driving attempting to evade police, and was eventually was stopped at 1600 7 Sunnydale Avenue within the Proposed Safety Zone. Jones was arrested on the 8 outstanding warrant. 9 On November 21, 2008 at 3:27 p.m. SFPD officers responded to the corner of Sunnydale 10 Avenue and Hahn Street, within the Proposed Safety Zone, after being flagged down by 11 an unidentified complainant who expressed fear that something was going to happen. 12 (Police Report No. 081247097.) According to the report Jones was seen near 1500 13 Sunnydale Avenue with known DBG members and associates including Joseph "Stub/z" 14 Smith, Sean "Dough" Beard, Anthony "Ant" Durant, and Alsedee "Jizz Mac" Green. 15 Although SFPD received a calls of possible shots fired, no weapons were recovered. 16 On January 15, 2009, at 2:38 p.m., SFPD officers patrolling the area of the Sunnydale 17 Housing Development saw a vehicle stop in the middle of the intersection at Sunnydale 18 Avenue and Santos Street. (Police Incident Report No. 090053376.) According to the 19 report, Jones was the driver of the stopped car. Jones motioned to a juvenile DBG 20 member to come to the car. The juvenile DBG member briefly entered the vehicle Jones 21 was driving, exiting with a silver handgun in his hand. Jones and the juvenile DBG 22 member were arrested on various firearms charges. 23 24 25 EVIDENCE OF GANG ACTIVITY – ASSOCIATION On May 5, 2005, at 1:45 p.m., Jones was observed loitering with a known juvenile DBG 26 member at Sunnydale Avenue and Hahn Street in the Proposed Safety Zone. (Field Interview Report No. 3 07000838.) 4 On July 10, 2008 at 3:00 p.m., Jones was observed in a green Lexus with known DBG 5 member Joseph "Stub/z" Smith at the intersection of Hahn Street and Visitacion Avenue, 6 in the Proposed Safety Zone. (Field Interview Report No. 08000928.) 7 On July 31, 2008 at 2:20 p.m., Jones was observed loitering with known DBG members 8 and associates, including Joseph "Stub/z" Smith and Aliton "Tiggz" Woodson, at 1765 9 Sunnydale Avenue, in the Proposed Safety Zone. (Field Interview Report No. 10 11 08001005.) On August 30, 2008 at 4:30 p.m., SFPD officers observed 14 known DBG gang members 12 and associates together at a Kezar Pavilion youth football gang, including the following 13 Wallace "Gater/Swally" Pellette, Jason "Jumbo" Jones, Joseph "Stub/z" Smith, Deantray 14 "Tray" Reed, Kim "KI" Mitchell, Kevin "Duke" Mitchell, Aliton "Tiggz" Woodson, and 15 an Oakdale Mob gang member. 16 On November 5, 2008, at 12:00 pm, Jones was detained on the 1700 block of Sunnydale 17 Avenue, in the Proposed Safety Zone, with known DBG members Alsedee "Jizz Mac" 18 Green, "Joseph "Stub/z" Smith, and Samoa "Kilo" Lefiti. (Police Incident Report No. 19 081184217.) 20 On Monday November 10, 2008 at 1:40 p.m. Jones was seen loitering with known DBG 21 members and associates, including Sean "Dough" Beard, Joseph "Stub/z" Smith, and 22 Alsedee "Jizz Mac" Green, in front of 11 Brookdale, in the Proposed Safety Zone. (Field 23 Interview Report No. 09000357.) 24 On November 26, 2008, at 3:40 p.m., Jones was seen loitering with known DBG 25 members and associates, including Raymond "Boo Gotti" Rodgers, Alsedee "Jizz Mac" 26 Green, Aliton "Tiggz" Woodson, and Joseph "Stub/z" Smith, at 60 Brookdale Avenue. in 27 the Proposed Safety Zone. DBG, et al #502-262 k:\press\releases\gangs 2010\sunnydale expert dec\final expert declaration - part 11 (dbg members jones - kim mitchell).doc 1 On December 3, 2008, Jones was seen loitering for more than an hour with a known 2 DBG member in the area of 1772 Sunnydale Avenue, in the Proposed Safety Zone. 3 (Field Interview Report No. 081291135.) 4 On January 5, 2009, at 2:30 p.m., SFPD officers were looking for Jones, to question him 5 regarding a December 31, 2008 shooting of a known gang member. (Police Incident 6 Report No. 090015263.) According to the report, SFPD officers observed Jones loitering 7 with known DBG members and associates Alsedee "Jizz Mac" Green, Joseph "Stub/z" 8 Smith, Aliton "Tiggz" Woodson, and Stephen "Stevie Mac" Glass, in front of 1759 9 Sunnydale, in the Proposed Safety Zone. 10 On September 11, 2009, at 2:00 p.m., Jones was seen loitering with known DBG member 11 Llewellyn Ledbetter at Santos Street and Velasco Avenue, in the Proposed Safety Zone. 12 (Field Interview Report No. 09000693.) 13 On May 24, 2010, at 2:51 p.m., Jones was observed loitering and talking to known DBG 14 members including Floyd "Freak" Jackson and Jordan "J.O." Jordan in front of 1765 15 Sunnydale Avenue, in the Proposed Safety Zone. Jackson's presence violated conditions 16 of his parole. Jackson fled when officers approached and was not apprehended. (Police 17 Incident Report No. 100481728.) 18 On May 24, 2010, at 4:46 p.m., Jones was seen loitering with known DBG members and 19 associates, including Allen "Nutso" Calloway, at 1765 Sunnydale Avenue in the 20 Proposed Safety Zone. JORDAN "J.O." JORDAN: Based on my professional training and experience as a 14 police officer investigating DBG/Towerside criminal street gangs and a review of police reports, 15 sheriff's records, photographs, and other documents, it is my opinion that Jordan Jordan ("Jordan") is an 16 active member of Defendant DBG gang. 17 I personally know Jordan, whose moniker is "J.O." 18 Jordan does report to live in the Proposed Safety Zone. 19 20 21 EVIDENCE OF GANG ACTIVITY - CRIMINAL CONDUCT On December 28, 2009, at 1739 Sunnydale Avenue at 8:33 p.m. SFPD were patrolling 22 the area of the Sunnydale Housing Development. (Police Incident Report No. 23 091319501) According to the report, there had been TOWERSIDE related shooting in 24 the area and SFPD officers were concerned about additional retaliatory violence. SFPD 25 officers observed Jordan, Samoa with known DBG member Samoa "Kilo" Lefiti loitering 26 in front of a boarded up housing unit at 1739 Sunnydale Avenue. (Lefiti had a stay away 27 order which prohibited him from entering the Sunnydale Housing Development.) Jordan 107 28 EXPERT DEC OF OFF KUMLI ISO PI-PEOPLE v. SFPD officers located a loaded silver 2 firearm inside Jordan's waistband. Further investigation revealed that the serial numbers 3 from the firearm had been destroyed. Jordan was convicted for being a gang member in 4 possession of a firearm. 5 On April 26, 2010, at 1450 Sunnydale Avenue at 2:10 p.m. SFPD officers observed 6 Jordan and known DBG member George "G Thang" Washington were walking in 7 between the building lines near 15 Brookdale Avenue. (Police Incident Report No. 8 100038558) According to the report, Jordan and Washington saw police and tried to 9 evade contact. Jordan reached into the front of his waistband and started running away 10 from officers, running through the basketball courts at the Sunnydale Housing 11 Development and ending at the Little Village Market at the intersection of Sunnydale 12 Avenue and Hahn Street. After apprehending Jordan, SFPD officers searched his person 13 and found marijuana packaged for sale. Jordan was arrested. Washington evaded 14 capture. 15 16 On May 17, 2010, Jordan agreed to a judicial order imposing "Special Conditions of Probation for Gang Members and Associates." (Police Incident Report No. 100481728.) 3 4 EVIDENCE OF GANG ACTIVITY - ASSOCIATION On July 31, 2009, at 3:30 p.m., Jordan was seen loitering with known DBG members and 5 associates, including Alex "Pee Wee" Price, Alsedee "Jizz Mac" Green, and Tantrell 6 "Trail Mix" Crawford, at the intersection of Santos Street and Brookdale Avenue, in the 7 Proposed Safety Zone. ( Field Interview Report No. 09000530.) 8 9 On May 3, 2010 at 2:55 p.m., Jordan was seen loitering with known DBG members and associates, including Anthony "Ant" Durant, Alsedee "Jizz Mac" Green, Tantrell "Trail 10 Mix" Crawford, and George "G Thang" Washington, at 47 Blythdale Avenue, in the 11 Proposed Safety Zone. (Field Interview Report No. 10001127.) 12 On May 26, 2010 at 12:50 p.m. Jordan was seen loitering with known DBG members and 13 associates, including Tantrell "Trail Mix" Crawford, in front of 34 Brookdale Avenue, in 14 the Proposed Safety Zone. (Field Interview Report No. 10001200.) 15 On May 26, 2010 at 4:54 p.m. Jordan was seen loitering with known DBG members and 16 associates, including Tantrell "Trail Mix" Crawford, in front of Santos Street and 17 Brookdale Avenue, in the Proposed Safety Zone. Jordan. 15 16 17 18 19 20 21 164. police officer investigating DBG/Towerside criminal street gangs and a review of police reports, sheriff's records, photographs, and other documents, it is my opinion that Llewellyn Ledbetter ("Ledbetter ") is an active member of Defendant DBG gang. 24 During a March 5, 2010 San Francisco Sheriff's Department classification and interview, Ledbetter admitted membership in DBG. 22 23 LLEWELLYN LEDBETTER: Based on my professional training and experience as a Ledbetter does not consistently report to live in the Proposed Safety Zone. EVIDENCE OF GANG ACTIVITY - CRIMINAL CONDUCT 25 26 27 28 112 EXPERT DEC OF OFF KUMLI ISO PI-PEOPLE v. DBG, et al #502-262 k:\press\releases\gangs 2010\sunnydale expert dec\final expert declaration - part 11 (dbg members jones - kim mitchell).doc 1 On August 28, 2002, Ledbetter was convicted of battery with serious bodily injury for an incident that occurred at 1501 Sunnydale Avenue. 10 2 3 4 On August 6, 2003, Ledbetter was convicted of tampering with marks on a firearm. (Police Incident Report No. 030209573.) 5 On July 15, 2006, at 8:12 pm, SFPD officers saw Ledbetter with a group of known DBG 6 members including Raymond "Boo Gotti" Rodgers loitering in front of 1551 Sunnydale 7 Avenue. (Police Incident Report No. 061213262.) According to the report, Rodgers was 8 wearing a baseball hat with "SD," "Gotti," and "DBG" writing on it. Manuel "Fresh" 9 Rose, another DBG gang member, was also present. Rose would be arrested later the 10 same day for being in possession of a loaded and concealed firearm. 11 On April 6, 2008, at 10:50 pm, SFPD officers investigated a report of shots fired in and 12 around the 1600 Block of Sunnydale Avenue. (Police Incident Report No. 080360498.) 13 According to the report, SFPD officers saw six black males, including Ledbetter, 14 loitering on the 1700 Block of Sunnydale. As soon as SFPD officers approached, 15 Ledbetter ran towards the unit block of Brookdale Avenue. Officers saw Ledbetter 16 holding his pants as if he were trying to conceal a gun. Ledbetter evaded police and was 17 subsequently contacted at 47 Brookdale Avenue, but was not arrested at that time. 18 On July 24, 2008 at 12:53 p.m. SFPD officers conducted a traffic stop of a vehicle with 19 Ledbetter as a passenger. (Police Incident Report No. 080777746) According to the 20 report, SFPD officers immediately detected the odor of freshly smoked marijuana. SFPD 21 investigation revealed Ledbetter to be in possession of marijuana for sale. Ledbetter was 22 subsequently convicted of marijuana possession. 23 24 25 26 On March 3, 2010 at 4:10 p.m. SFPD officers executed a search warrant at 47 Brookdale 10 During that incident Ledbetter assaulted Police Officer James Richards, saying to the officer "I bet you are a faggot Richards. Where do you hang out after work, because I would meet you and beat the shit out of you. Richards you are so weak. If you book me into jail Richards, I promise I will kill you negga. You don't know who you are fuckin with boy." (See Police Incident Report No. 020509189.) 27 28 113 EXPERT DEC OF OFF KUMLI ISO PI-PEOPLE v. (Police Incident Report # 100207392) According to the report, Ledbetter was 2 seen attempting to run out the back door, yet was detained by officers. Ledbetter was 3 found to be in possession of keys to the house and to a safe in a bedroom. SFPD officers 4 further found $1,410, two digital scales, numerous ziploc plastic baggies, 33 small plastic 5 baggies containing suspected marijuana, a plastic sandwich bag containing suspected 6 marijuana, a 12-gauge short barreled shotgun with four live rounds, and a box of shotgun 7 shells. As SFPD officers were executing the search warrant, Ledbetter's cellular phone 8 rang numerous times with callers asking for quantities of marijuana: the first caller asking 9 for three "dimes", the second asking for an "eighth", and the third asking for two "dimes." 10 11 12 13 14 EVIDENCE OF GANG ACTIVITY - ASSOCIATION On March 14, 2008 at 4:30 p.m. Ledbetter was seen loitering with known DBG members 15 and associates in front of 78 Brookdale Avenue, in the Proposed Safety Zone. (Field 16 Interview Report No. 08000297.) 17 On September 11, 2009, at 2:00 p.m., Ledbetter was seen loitering with known DBG 18 member Jason "Jumbo" Jones at Santos Street and Velasco Avenue, in the Proposed 19 Safety Zone. (Field Interview Report No. 09000693.) 20 21 165. SAMOA "KILO" LEFITI: Based on my professional training and experience as a 22 police officer investigating DBG/Towerside criminal street gangs and a review of police reports, 23 sheriff's records, photographs, and other documents, it is my opinion that Samoa Lefiti ("Lefiti") is an 24 active member of Defendant DBG gang. 25 I personally know Lefiti, whose moniker is "Kilo." 26 During a March 5, 2008, August 15, 2008, November 5, 2008, and December 29, 2009 27 28 San Francisco Sheriff's Department classification and interview, Lefiti admitted 114 EXPERT DEC OF OFF KUMLI ISO PI-PEOPLE v. Further, during a November 5, 2008 interview with SFPD officers, 2 Lefiti admitted to being a "DBG" gang member, telling officers that he was "DBG for 3 life." 4 Lefiti does not report to live in the Proposed Safety Zone. 5 6 EVIDENCE OF GANG ACTIVITY - CRIMINAL CONDUCT 7 On July 26, 2005 Lefiti was convicted of possession of base rock cocaine for sale. 8 On July 15, 2006, at 8:12 pm, SFPD officers saw Ledbetter with a group of known DBG 9 members including Raymond "Boo Gotti" Rodgers loitering in front of 1551 Sunnydale 10 11 Avenue. (Police Incident Report No. 061213262.) According to the report On April 12, 2008, at 3:10 p.m., SFPD officers heard approximately ten gunshots fired in 12 the area of 1450 Sunnydale Avenue. (Police Incident Report No. 080382210.) 13 According to the report, Lefiti was seen in the area with known DBG members and 14 associates including Deshawn "Posso" Byes. SFPD did not recover a weapon although 15 they did find eight .45 caliber shell casings in the public street in front of 1450 Sunnydale 16 Avenue. 17 On May 20, 2008 Lefiti was convicted of possession of base rock cocaine for sale for an 18 incident occurring on the 2000 Block of Mission Street. (Police Incident Report No. 19 080234984.) 20 On May 31, 2008 at 12:53 p.m. SFPD officers were patrolling the area of 16 Brookdale 21 Avenue when they saw Lefiti with other known DBG members. (Police Incident Report 22 No. 080571087) According to the report, Lefiti was advised by SFPD officers that he 23 was not permitted to loiter on Housing Authority property. SFPD officers watched Lefiti 24 leave the area of 13 Brookdale Avenue and continue to loiter on the 100 Block of 25 Blythdale Avenue. 26 27 28 115 EXPERT DEC OF OFF KUMLI ISO PI-PEOPLE v. DBG, et al #502-262 k:\press\releases\gangs 2010\sunnydale expert dec\final expert declaration - part 11 (dbg members jones - kim mitchell).doc 1 On June 14, 2008 at 5:21 p.m., Lefiti was observed in the Proposed Safety Zone after 2 shots were fired with known DBG member Joseph "Stub/z" Smith and a juvenile DBG 3 associate. (Police Report No. 080623597.) According to the report, as SFPD officers 4 approached, the juvenile took off running into the neighborhood while holding a firearm. 5 The juvenile threw the gun in the direction of 1505 Sunnydale Avenue, and was later 6 apprehended. 7 On August 14, 2008 at 8:32 p.m. SFPD officers were patrolling the area of Santos Street 8 and Brookdale Avenue. (Police Incident Report # 080857473) According to the report, 9 SFPD officers were informed that a DBG rival was shot in front of 250 Napoleon Street, 10 and officers were concerned about possible retaliation. SFPD officers saw four 11 individuals loitering in the area of Sunnydale and Brookdale Avenues. As officers 12 approached, Lefiti began to wave his hands from side to side serving to signal to the 13 others that the police were coming. Another known DBG member Kevin "Duke" 14 Mitchell evaded polices, ducking behind a corner next to a trashcan in front of 2 15 Brookdale Avenue. SFPD officers recovered a .45 automatic handgun with its hammer 16 cocked back lying at the top of the trashcan. Officers also seized a black ski mask from 17 Kevin Mitchell's person. Lefiti and Kevin Mitchell were both arrested. 18 On November 5, 2008, at 11:07 a.m. SFPD officers responded to a call that someone 19 brandished a weapon near the Hall of Justice. (Police Incident Report Nos. 081184217 20 and 081183877 ) According to those reports, Lefiti threatened and assaulted known 21 TOWERSIDE member Diondre "D-Nice" Young and his two companions. Lefiti, in the 22 company of other known DBG members, told Young's companions that he was "I'm 23 about to pop this nigga," (referring to Young). Young and his companions called for 24 police. Lefiti was subsequently arrested and booked for firearm possession, probation 25 violations and gang related charges. Lefiti was arrested in front of 1765 Sunnydale, 26 while in the company of known DBG members Alsedee "Jizz Mac" Green, Jason 27 "Jumbo" Jones, and Joseph "Stub/z" Smith. 116 28 EXPERT DEC OF OFF KUMLI ISO PI-PEOPLE v. DBG, et al #502-262 k:\press\releases\gangs 2010\sunnydale expert dec\final expert declaration - part 11 (dbg members jones - kim mitchell).doc 1 On November 3, 2009, at 11:47 a.m. SFPD officers served Lefiti with a civil stay away 2 order which prevents him from being within 150 yards of any and all San Francisco 3 Public Housing Property. 4 On December 28, 2009, at 1739 Sunnydale Avenue at 8:33 p.m. SFPD were patrolling 5 the area of the Sunnydale Housing Development. (Police Incident Report No. 6 091319501) According to the report, there had been TOWERSIDE related shooting in 7 the area and SFPD officers were concerned about additional retaliatory violence. SFPD 8 officers observed Lefiti, with known DBG member Jordan "J.O." Jordan loitering in front 9 of a boarded up housing unit at 1739 Sunnydale Avenue. Lefiti had a stay away order 10 which prohibited him from entering the Sunnydale Housing Development and was 11 arrested for violating that order. Jordan attempted to evade officers and resisted arrest. 12 SFPD officers located a loaded silver firearm inside Jordan's waistband. Further 13 investigation revealed that the serial numbers from the firearm had been destroyed. 14 On January 6, 2010 at 3:48 p.m. SFPD officers saw Lefiti smoking a cigarette at the 15 basketball courts on the Sunnydale Housing Development property. Lefiti was arrested for violating his civil stay away that 17 requires that he stay 150 yards from any and all San Francisco Public Housing Property. 18 19 20 EVIDENCE OF GANG ACTIVITY - ASSOCIATION On April 23, 2008 at 7:00 p.m. Lefiti was observed with known DBG members and 21 associates, including Alsedee "Jizz Mac" Green and Joseph "Stub/z" Smith, loitering in 22 front of 1818 Sunnydale Avenue, in the Proposed Safety Zone. (Field Interview Report 23 No. 08000416.) 24 On May 27, 2008, at 2:45 p.m., Lefiti was seen loitering with known DBG members and 25 associates, including Alsedee "Jizz Mac" Green and Joseph "Stub/z" Smith, at 60 26 Brookdale Avenue in the Proposed Safety Zone. (Field Interview Report No. 09000006.) 12 On July 17, 2008 at 6:30 p.m. Lefiti was seen loitering with known DBG member and 13 associate Deantray "Tray" Reed and an Oakdale Mob gang member in front of 1765 14 Sunnydale Avenue, in the Proposed Safety Zone. (Police Report 24 No. 061363754.) According to the report, police observed a group of young black males 25 run out of a Jack in the Box restaurant. A witness told police that one of the individuals 26 in the group had dropped a gun on the floor and picked it back up. The group divided 27 into two vehicles, which officers subsequently stopped. Police discovered a 5 quantity of suspected crack cocaine base in the second vehicle and arrested Kevin 6 Mitchell for gun possession. Kevin Mitchell was subsequently convicted of carrying a 7 concealed firearm. 8 On October 30, 2007 at 12:55 p.m. SFPD officers patrolling the area of the Sunnydale 9 Housing Development saw Kevin Mitchell in front of 1755 Sunnydale Avenue. (Police 10 Incident Report No. 071113464) According to the report, had an outstanding Daly City 11 warrant for being a felon in possession of a firearm. SFPD officers arrested Kevin 12 Mitchell at 1755 Sunnydale Avenue and found a plastic bag containing four live rounds 13 of 9 mm ammunition. Kevin Mitchell was subsequently convicted of possession of a 14 controlled substance while armed related to the above Daly City warrant. 15 On July 18, 2008 at 11:30 p.m. SFPD officers detained Kevin Mitchell at 1751 16 Sunnydale Avenue in connection with a firearm investigation. (Police Incident Report 17 No. 080756950) While conducting a related gun investigation, SFPD officers conducted 18 a warrantless search of Kevin Mitchell's residence located at 1755 Sunnydale Avenue. 19 While conducting that search, officers recovered a silver colored handgun. 20 On August 14, 2008 at 8:32 p.m. SFPD officers were patrolling the area of Santos Street 21 and Brookdale Avenue. (Police Incident Report No. 080857473) According to the 22 report, SFPD officers were informed that a DBG rival was shot in front of 250 Napoleon 23 Street, and officers were concerned about possible retaliation. SFPD officers saw four 24 individuals loitering in the area of Sunnydale and Brookdale Avenues. As officers 25 approached, known DBG member Samoa "Kilo" Lefiti began to wave his hands from 26 side to side serving to signal to the others that the police were coming. Lefiti and Kevin Mitchell were both arrested. 4 On October 24, 2008 at 3:32 p.m. SFPD officers heard gunshots that appeared to be 5 coming from the intersection of Sunnydale Avenue and Rey Street. (Police Incident 6 Report No. 081138979) According to the report and subsequent investigation, SFPD 7 officers found two gunshot victims, one in front of 1145 Sunnydale Avenue and the other 8 around the corner on the 200 Block of Rey Street. Both victims were TOWERSIDE 9 members. One of the victims told police that he and the other victim were at the corner 10 of Garrison Street and Sunnydale Avenue when two black males came running from the 11 corner of Garrison Street and shot at the two victims. SFPD officers reviewed video 12 surveillance footage which captured the shooting. A witness identified Kevin Mitchell as 13 one of the two shooters. Kevin Mitchell was arrested. (Police Report No. 070228709.) ·According to the 7 report, SFPD officers saw Kim Mitchell and others playing a video with the volume so 8 loud that officers could clearly hear it from approximately 75' away. Officers could that 9 the video game was hooked up to a monitor and that the game was being powered by an 10 unoccupied vehicle that was parked in the lot. SFPD officers admonished Kim Mitchell 11 and others. 12 On December 12, 2007, at 4:32 p.m., Kim Mitchell and known DBG member Wallace 13 "Gater/Swally" Pellette were seen on the 1000 block of Mission Street. (Police Report 14 No. 071271993.) ·According to the report, as SFPD officers approached, Kim Mitchell 15 removed a loaded semiautomatic pistol from his jacket. SFPD officers caught up to Kim 16 Mitchell and disarmed him. A search of Kim Mitchell's person revealed that he was in 17 possession of 24 "dime" bags of suspected marijuana, as well as another 72 empty plastic 18 baggies. Pellette was also found to have 36 bags of individually packaged suspected 19 marijuana and $459.00. Both Kim Mitchell and Pellette were arrested. Kim Mitchell 20 was convicted of carrying a concealed weapon. 21 On March 16, 2008, at 10:24 p.m., SFPD officers conducted a traffic stop near the 1900 22 block of Sunnydale Avenue. (Police Incident Report No. 080286333) According to the 23 report, Kim Mitchell was driving the car and known DBG member Aliton "Tiggz" 24 Woodson was the passenger. SFPD officers searched Kim Mitchell, who was on 25 probation and had a warrantless search condition. SFPD officers discovered a stolen 26 loaded firearm tucked into Woodson's waistband. In response, Woodson stated, "Shit, 27 fuck you asshole bitches." Woodson was arrested on weapons charges. 126 28 EXPERT DEC OF OFF KUMLI ISO PI-PEOPLE v. (Police Incident Report No. 080948323) 3 According to the report, Kim Mitchell was the driver and owner of the car. The car 4 initially stopped yet sped away once SFPD officers exited the vehicle. The car crashed 5 on the north side of Mansell, and the three occupants, including Kim Mitchell, fled into 6 McLaren Park. SFPD officers searched the vehicle and found a loaded pistol in plain 7 view in the center console and seized a second pistol near the vehicle. Kim Mitchell was 8 convicted of carrying a loaded firearm in public and participation in a criminal street 9 gang. 10 11 12 On November 6, 2008, SFPD officers served Kim Mitchell with a civil stay away order which prevents him from trespassing on any San Francisco Public Housing property. On March 7, 2010, at 7:33 p.m., Daly City police officers contacted a vehicle at Geneva 13 Avenue and Carter Street with known DBG passengers including Kim Mitchell. Daly 14 City officers found Kim Mitchell to be in possession of 41 individually wrapped bags of 15 crack cocaine. Kim Mitchell was arrested for possession of rock cocaine base for sale. 16 17 EVIDENCE OF GANG ACTIVITY - ASSOCIATION On February 8, 2007, at 6:30 pm, Kim Mitchell was seen loitering with known DBG 18 member Alex "Pee Wee" Price in the area of Santos Street and Blythdale Avenue, in the 19 Proposed Safety Zone. (Field Interview Report No. 07000920.) 20 On July 22, 2007, at 5:55 p.m., Kim Mitchell was observed loitering in the Proposed 21 Safety Zone with known DBG members including Floyd "Freak" Jackson, Joc "Joc" 22 Wilson, Emon "Flav/e" Brown, and Tantrell "Trail Mix" Crawford. (Police Incident 23 Report No. 070740690.) 24 On October 30, 2007, at 12:55 p.m., Kim Mitchell was found at 1755 Sunnydale Avenue 25 in the company of Kevin "Duke" Mitchell. SFPD officers arrested Kevin Mitchell on an 26 outstanding warrant and found a plastic bag containing four live rounds of 9 mm 27 ammunition. Kim Mitchell's father told officers that 7 his son and Pellette had gone into a back room, not readily accessible from the common 8 areas.
