Dear Colorado Dealer:
Preparations are underway for the 2015 Denver Auto Show at the
Colorado Convention Center, Wednesday, April 8 through Sunday,
April 12. But you should mark your calendars and make plans now to
attend all of the 2015 Show Week Denver events, including the Green
Car Parade at the Colorado Capitol on April 5, and Innovative Dealer
Summit, April 7-8, and Charity Preview Party on April 7. Each is going
to be bigger and better than ever!
Thom Buckley
CADA Chair
The 2014 Denver Auto show had the fourth-best attendance and posted almost a quarter-million dollars more
revenue for CADA than the 2013 show. With sales continuing strong in 2015, we’re anticipating an even larger
crowd to see all the new models we have to offer. This year’s Denver Auto Show chairman is Gregg Stone,
President and General Manager of Kuni Lexus of Greenwood Village.
The Denver Auto Show is a great way to bring customers into our businesses. A study released last June, the Auto
Show Immersion Report, showed that auto shows have a definite impact on sales, with 72 percent of the people
attending shows in 2013 planning to shop for a new vehicle. The study pointed out several marketing and sales
advantages of auto shows, including:
1.
2.
3.
Auto show visitors tend to be better educated and affluent.
Auto shows attract influencers and engage buyers
Auto shows continue to influence potential buyers up to eight months after they attended one.
The Innovative Dealer Summit (IDS) will be a two-day event this year: Tuesday, April 7, 8 a.m. – 6 p.m.; and Wednesday, April 8, 8 a.m. – 2 p.m.
The first Charity Preview Party attracted 222 guests and
by last year had grown to 1,367 guests, including some
of Colorado’s most prominent movers and shakers. We
raised more than $83,000 for our charities.
This popular management education event brings together experts in the fields of innovative technologies, and emerging Internet strategies regarding
SEO-SEM, dealer reputation management, social media marketing, lead generation and follow-up, inventory management and other emerging
issues in today’s dealer operations. Dealer principals, senior dealer managers, marketing and sales managers and other key decisions makers in
dealerships will benefit from hearing from the experts about useful, cutting-edge ideas in our industry. Last year we had more than 260 dealers,
managers and presenters who heard from our outstanding lineup of speakers.
Participants in IDS receive a complimentary ticket to the 2015 Charity Preview Party, “Rocky Mountain Riviera” on April 7 from 7 p.m. – 10 p.m. The
seventh annual Charity Preview Party is your chance to have a private viewing of the Denver Auto Show with its 400,000 square feet of gorgeous
new cars and accessories. We’re welcoming back UMB Bank as the Charity Preview Party’s Title Sponsor, and as in previous years, the event will
raise funds for the CADA-supported Clear the Air Foundation, the Denver Post Community Foundation and National Jewish Health.
The first Charity Preview Party attracted 222 guests and by last year had grown to 1,367 guests, including some of Colorado’s most prominent
movers and shakers. We raised more than $83,000 for our charities. I’m sure we can beat those totals this year! In addition to delicious food and
drink, Rocky Mountain Riviera will include Monte Carlo-style casino gambling following an opening Chairman’s Toast and Industry Recognition.
Of course I hope you’ll attend both the Innovative Dealership Summit and the 2015 Charity Preview Party (don’t forget IDS registration gets you into
the party free!). If you choose to attend just the party, or to purchase tickets for your guests, they are available on an early-bird basis for $99 each
through March 24 and then will cost $120 each after March 24 and at the door.
I also want to mention that CADA member dealers will hear from their district directors soon with association updates – and can further expect to hear
from them periodically throughout the year as CADA priority projects and leaderships actions develop.
Additionally, CADA is developing a Next Gen program to help identify and mentor those who hold promise for key leadership positions within yours
and other dealerships, groups and industry support businesses. In the coming weeks we will ask for nominations to this program and will establish
a email address – NextGen@ColoradoDealers.org so that nominations can be forwarded directly to CADA staff. This program is meant to provide
opportunities for leadership development through CADA, including advocacy, relationship-building, community-involvement and project around the
Denver Auto Show, CADA Project DC and more. I hope you’ll join me in working to identify future industry leaders and giving them the professional
resources needed to ensure their success in our field.
Best regards,
Thom Buckley, Chairman

Safer Cars Mean Safer Teen Drivers
Tim Jackson
CADA President
New cars are much safer for teen drivers than are old cars
By Tim W. Jackson
The latest data on traffic accidents and fatalities are a good news, bad news story. The good news is that
the National Highway Traffic Safety Administration (NHTSA) reports that after a brief uptick in 2012,
fatal crashes have started going down again, re-starting a seven-year trend. The bad news is that motor
vehicle crashes continue to be the leading cause of death for young people ages 15 to 20.
Teenage drivers comprise almost six percent of licensed Colorado drivers, but account for more than 11
percent of our state’s traffic deaths. And while the traffic fatalities for Colorado teenagers went down 67
percent between 2004 and 2011, they climbed by 10 percent in 2012, the latest year for which statistics
have been reported.
Inexperience behind the wheel is the main reason for teen traffic accidents and fatalities. Other factors
include not wearing seat belts, alcohol, speeding and what the Insurance Institute for Highway Safety
calls “problematic” behaviors – many related to lack of mature judgment and teenage psychology.
Graduated driver licensing laws improved the picture. Colorado enacted graduated licensing in 1999.
It specifies that teens have a learner’s permit for at least a year, how much supervised driving time they
must have, when they can drive and with whom they can drive for the first couple of years as well as the
number of passengers allowed during the first several months they have a driver’s license.
Newer cars = safer cars:
However, there’s another major factor influencing traffic fatalities, especially among
younger drivers: the safety of their automobiles.
The Insurance Institute for Highway
Safety (IIHS) reports that many
teenagers are driving vehicles that
don’t have good crash protection or
safety technology. The IIHS reports
that in the period between 2008 and
2012, 82 percent of driving fatalities
among 15-17-year-olds were in
vehicles six years old or older.
While new vehicles are more expensive, they also are safest and most fuel-efficient
(which will matter when gas prices rise again). They have longer warranties, better
reliability and are protected by lemon laws. And they have the latest technology.
Besides electronic stability control (mandatory beginning in 2012), newer cars also
have anti-lock brakes (required since 2011) and many have surround airbags, not
just front airbags.
Manufacturers now use safety as a competitive selling point. For inexperienced
drivers they might make a critical difference. Forward-looking sensors such as radar and cameras can monitor distance to the vehicle
ahead and send an alert if the vehicle is too close or even slow it down to maintain a safe distance; some can automatically brake
to prevent or lessen an impact. Adaptive headlights direct headlights around curves allowing greater visibility for the driver. Backup
cameras and reverse backup sensors and side-view assist/blind-spot monitors help detect people and objects not easily visible. Lanedeparture warning lets drivers know if they’re drifting.
In the long run, newer, more technologically advanced cars mean safer teenagers. Technology can’t compensate for inattentive driving
or unnecessary risks, but it can help save lives.
The IIHS has some guidelines for parents to use when choosing a vehicle for their teenage driver:
• Go for lower horsepower. The more power, the more temptation to use it, testing limits that should be off-limit.
• Larger, heavier cars provide more protection in a crash, particularly if teenagers are driving older cars that don’t have the very
latest safety technology.
• Do not invest in a car without electronic stability control (ESC), which helps control the vehicle on curves and slick roads – where a
lot of emergency maneuvers take place. This is especially important in climates such as Colorado’s.
• Pay attention to safety ratings. Go for four or five stars (NHTSA) and “Good” and “Top Safety Pick” or “Top Safety Pick +” ratings
(IIHS).
Whether your next customer chooses a new or used car for their teenage driver, it’s good to keep in mind that old advice: “Safety
first.” Although a new car will likely cost more money, it may be the decision that saves the lives of your customers and important family
members.

Clear the Air Foundation
Colorado Land Rover Dealers Challenge Fellow Dealers to Donate to CTAF
Colorado’s four Land Rover dealers - Land Rover Flatirons, Land Rover Denver, Land Rover Colorado Springs
and Land Rove Roaring Fork - have issued a challenge to their fellow member dealers throughout Colorado.
“Land Rover dealers don’t typically receive the same type of trades that some of our colleagues receive on
trade-ins which make it a bit more challenging for us to identify high-emitting vehicles that we can donate to
Clear the Air,” said Ed Dobbs, General Manager, Land Rover Flatirons. “As a result, all four Land Rover dealers
in Colorado have partnered up to challenge our industry colleagues by offering to donate $100 for every vehicle that is donated to
CTAF in 2015, up to $10,000.”
“This is a very exciting challenge - and significant financial comittment - from our four Land Rover dealer members,” said Mike
Cimino, 2015 CTAF Chair and CEO and Vice President, Phil Long Dealerships. “Some of our members struggle to identify qualified
vehicles to donate for recycling so its wonderful that the Colorado Land Rover contingent have found a fun and interesting ‘contest’
that will engage and encourage the entire dealer body to get more involved with this most worthy program.”

Regulatory & Legal Issues
2015 TOP TWENTY LEGAL TRENDS FOR
AUTOMOTIVE DEALERS
and handbooks designed to aid compliance.
Attached to this bulletin is Eric Chase’s annual Top Twenty article
for 2015, along with his comprehensive 2015 Legal Audit Checklist. The 2015 edition lists and analyzes this year’s top ranked
trends for automobile dealers. The “Regulatory Tsunami” continues in the #1 spot. As noted in his introduction:
Visit www.cadaopenraod.org Feb. 10 issue to view
the FAQ sheet and OSHA compliance information.
By Eric Chase, Bressler, Amery & Ross, P.C.*
For 2015, the regulatory storm for car dealers (as well as
for other businesses) will continue unchecked; the stunning
2014 mid-term Republican wins will offer negligible, if
any, headwinds against this runaway trend. The vast
overreaching sweep and universal applicability of regulatory growth keep this trend in first place. […]
In May 2014, the Center for Automotive Research ("CAR")
completed its study for NADA - "The Impact of Federal
Regulations on Franchised Automobile Dealerships." In
a nutshell, the findings are not pretty. Data from 2012
showed that "the average federal regulatory compliance annual expenditure was $182,754 per rooftop."
That number helped trigger a total loss of "$441,332 per
rooftop," a cost of "$245 for every new and used vehicle
sold, or nearly $8,035 for every dealership employee."
Nationwide, auto dealer loss to the U.S. economy was
$10.5 billion, and "76,000 fewer jobs across all sectors."
And these numbers do not include the negative cost impact of state and local regulations.
Most workers compensation providers will have materials available on this change also. NADA ISSUES NEW COMPLIANCE
GUIDE ON FEDERAL ADVERTISING
RULES
The National Automobile Dealers Association issued a new publication that will assist new-car dealers in complying with federal
advertising requirements on the sale, financing and leasing of automotive products and services. A Dealer Guide to Federal Advertising Requirements provides examples of “bad” ads and “good”
ads and chapters on 41 different federal advertising topics, such
as the use of discount claims, e-mail advertising, green marketing
claims, Internet advertising, satisfaction guarantees and trigger
terms. Readers can access the content quickly by clicking the hyperlinked topics in the table of contents page in the PDF document.
“The guide is user friendly and is a valuable resource for the entire
auto industry,” said NADA Chairman Forrest McConnell. “We are
encouraging dealers to provide the publication to their advertising
agencies, manufacturers, finance companies and others involved
in advertising operations.”
Visit www.cadaopenraod.org Jan. 27 issue to
download a copy of the guide.

REMINDER: OSHA INJURY/ILLNESS
RECORDKEEPING AND REPORTING
NOW APPLIES TO DEALERS
An OSHA rule-change that removed a long-standing OSHA recordkeeping exemption for light-duty dealers became effective
January 1st, 2015. The rule also mandates new serious injury
reporting requirements for all dealers and the use of certain forms
for reporting. In addition to an NADA/ATD FAQ sheet, dealers are strongly
encouraged to access OSHA’s work-related injury/illness recordkeeping and reporting website for forms, instructions, tutorials,

ATD Truck Dealer of the Year
Scott McCandless Named Truck Dealer of the Year for 2015
Prestigious Award Honors Leadership in Truck Operations, Industry and Community Involvement
Scott McCandless, president of McCandless Truck Center, the International®
Truck dealership for the state of Colorado, was named 2015 Dealer of the Year by
the American Truck Dealers (ATD), Heavy Duty Trucking magazine and Procede
Software at the association’s annual convention on January 23rd in San Francisco, California. The prestigious industry award recognizes excellence in dealership
performance, industry involvement, and community leadership. McCandless was
chosen from among six dealers nominated from across the country.
McCandless started his career at his father's International Truck dealership in Las
Vegas in 1972, working in virtually every department to learn the business from
the ground up. “My father showed me that this business is about taking care of
customers, being involved in the community, and developing good working relationships with employees and suppliers,” McCandless said. “It is humbling to be
selected from among such an accomplished group of truck dealers.”
McCandless moved to Colorado in 2000 as general manager of Rocky Mountain International. In 2007, he was approved by Navistar
as the new owner of the dealership. Since then the dealership has expanded to six locations across Colorado. His three sons, Adam,
Zach and Corey, are the third generation of the McCandless family to work in the business. "I’m proud of my sons who continue to
develop and support the McCandless family brand, which is all about having a can-do attitude, whether we are working with a big
carrier or a small operator,” McCandless said. As a member of the International Truck Product Advisory Board, McCandless played a
significant role in the development and launch of the International® ProStar® class 8 truck. As the past Chairman of the International
Truck Dealer Council and a member of the Dealer Executive Advisory Board, McCandless fostered open dialogue with Navistar leaders to create a stronger foundation for collaboration between the manufacturer and its dealer channel. He has also served as Chairman
of the Board of Idealease, Inc., a North American truck leasing and rental organization owned by International Truck dealers. McCandless is currently a member of the Idealease Board.
An active leader in the community, McCandless has served as president of the
Fremont County Rotary Club and a as a member of the Denver Chamber of
Commerce. He is also a vocational volunteer who fosters awareness of the vital
role of trucking, transportation and diesel technician fields in the local community.
McCandless has been recognized with
numerous corporate and industry
awards, including the International
Trucking Circle of Excellence,
Warranty Efficiency Award, Service
Dwell Time Award, Diamond Club
Parts Sales Achievement Award, the
Idealease, Inc. Idealgold award for
truck leasing and rental excellence for
14 years.
Speaking on behalf of Navistar, Bill Kozek, President, Truck and Parts, said,
“We are proud of the McCandless Truck Center team; their professionalism,
dedication to the community and their ongoing commitment to outstanding customer service is what sets them apart. We are thrilled for Scott and his team for
winning this prestigious honor.”
Scott McCandless is the 16th International Truck dealer to win this award since its inception in 1968.

The TIME Dealer of the Year award is one of the automobile industry’s most prestigious and highly coveted
honors. Recipients are among the nation’s most successful auto dealers who also demonstrate a long-standing
2003
commitment to community service. Ehrlich, 52, was chosen to represent the Colorado Automobile Dealers
2002
Association in the national competition – one of only 55 auto dealers from 17,000 nationwide – nominated for
2001
th
the 46 annual award.
2000
1998
“We take great pride in our commitment to our customers and to our neighbors,” nominee Ehrlich said. “We
have honored our motto of ‘We are ladies and gentlemen serving ladies and gentlemen’ for more than 50
1997
years.”
1996
1995
Ehrlich is a 1980 graduate of Greeley West High School in Greeley and attended Western State Colorado
University in Gunnison, Colorado, for two years. He started his automotive career selling Datsun cars and trucks 1994
1993
for his father, Reuben “Swede” Ehrlich, at the family’s Ehrlich Motors, becoming general manager at age 25
and dealer principal two years later.
1992
1991
“Since then, I have successfully completed nine buy-sells and have been awarded two open points, as well as
1990
completing three renovations and new construction on five dealerships,” Ehrlich said. “This is challenging but
1989
rewarding work that requires major decisions in managing real estate, capital and staffing.” He now oversees
1988
five Colorado dealerships located in Greeley, Longmont and Fort Morgan. “In 1987, we had 25 employees
and today we have as many as 230,” he added. “I have asked key managers to be partners, which allows
1987
them to grow within our organization.”
1986
1985
Ehrlich also put his management skills to work for the good of his community. In 2008, he created the College
1984
Promise, a scholarship program that pays the first year’s tuition for Greeley students who want to continue
1983
their education at Greeley’s Aims Community College. With an initial gift from Ehrlich and participation from
other business people and the Monfort Foundation, the program has helped more than 400 students since its
1982
inception.
1981
1980
“We are now looking to expand this program to the entire Weld County and pay for four years of college,”
1979
he said. “To have a vision that every child in my hometown could have the opportunity to attend college and
1978
further his or her education – and see it become a reality – is my most important achievement, personally and
professionally. Then to see the community also join forces in this endeavor is incredibly rewarding.”
1977
1976
In addition to his position as chairman of the College Promise Foundation, Ehrlich is also chairman of the
1975
board of Upstate Colorado Economic Development. He has also served the Weld County School District
1974
(volunteer and mentor), Boys & Girls Clubs of America, and the United Way, earning numerous awards for
1973
his entrepreneurship and community involvement. Additionally, Ehrlich has twice served on the board of the
Greeley Chamber of Commerce.

Data Information
All data represents new and used vehicle retail registrations in Colorado and excludes fleet and wholesale transactions. Used vehicle data only includes vehicles
seven years old or newer and excludes private party transactions. Please keep in mind that monthly registration figures can occasionally be subject to fluctuations,
resulting in over or under estimation of actual results. This usually occurs due to processing delays by governmental agencies. For this reason, the year-to-date
figures will typically be more reflective of market results. Green shaded areas in tables represent the top ten ranked brands.

NADA Director’s Column
2015 NADA National Convention and More
If you didn’t make it to San Francisco and become “Engaged,” the theme of the 2015 NADA
Convention then you missed a great opportunity engage the American Automotive Industry. This
year, NADA experimented with a new convention format – opening on Thursday, closing on Sunday
– which was very well received by the 22,500 attendees who scoured the 300,000 square feet of
Exhibition space. The Convention was again combined with the American Truck Dealers Association,
ATD, and, all together, 17,200 attendees participated in the 144 workshops that were offered. This
was an awesome opportunity to train, network, meet with your manufacturer at the make meetings,
shop, buy, and experience the depth and breadth of your national association. Outgoing Chairman
Forrest Mc Connell was able to have a Q and A opportunity with our keynote speaker Governor Jeb
Bush. His first question was laid out to be the most difficult for the potential Presidential candidate…
Jeff Carlson
Glenwood Springs Ford ”what car do you drive?” Answer: Ford Fusion – a tough answer in a room full of all franchises. His
last question was “are you going to run?” The Governor equivocated a bit and then Forrest told him
NADA Vice Chairman
he had something that would help him make up his mind…the newest political bumper sticker…JEB/
FORREST 2016. You had to be there.
Bill Fox, a multiline dealer from Auburn New York took over the Chairmanship as he spoke to this being the best time in the auto Industry
and that we dealers are a catalyst for change. I was seated as Vice Chairman. Both of us are humbled by the honor and excited to
meet the challenges ahead. Jay Leno followed our new Chairman with an hour of humor as only he can deliver. On Sunday, our very
own Don Hicks regaled the audience with his story of overcoming adversity in our industry that has had plenty of that over the past
decade. Congratulations to Don who will chair the NADA 100th Anniversary Convention in 2017. Mark your calendar now for the 2016
Convention in Las Vegas, March 31- April 3, a new time in a popular place.
In case you missed it, NADA Chief Economist Steven Szakaly predicted 2015 to be another strong year with the industry coming in at
16,940,000, after almost reaching 16,500,000 in 2014.
Last month we reported that the Charles River and Associate study was released reporting that the methodology the CFPB used in
alleging Disparate Impact Discrimination was “deeply flawed.” The hope was that the CFPB would review its method before pursuing
further enforcement actions against lenders and attempting to influence the current indirect lending model of Dealer Participation. It
didn’t happen. Late breaking news is that the American Financial Services Association (AFSA) American Bankers Association (ABA),
Consumer Bankers Association (CBA), Financial Services Roundtable (FSR), and the U. S. Chamber of Commerce have sent a letter
calling on the CFPB to revisit its enforcement approach. NADA, AIADA, and NAMAD are in full support of the letter. Legislation
to rollback the March 2013 CFPB guidance, which was proposed last year but was not taken up in the lame duck session, will be
reintroduced later this month by our friend Congressman Ed Perlmutter (D-CO), who will once again be a co-sponsor of the new
legislation. The best action a dealer can take to protect against allegations of discrimination is the adoption of the NADA Fair Credit
Compliance Program http://www.nada.org/regulatory_affairs/faircreditlanding.
NADA introduced the new Compliance Guide on Federal Advertising Rules in response to several large enforcement actions against
dealers for violations. This is a link to the guide: http://www.nadafrontpage.com/upload/wysiwyg/2015%20Convention/A%20
Dealer%20Guide%20to%20Federal%20Advertising%20Requirements.pdf.
Remember the show the $64,000 question? A TV show from the 50’s is the correct answer. How about the 64,000,000 question
from 2014? The record number of recalls issued by manufacturers. Be sure that your used vehicle department is monitoring recalls in
inventory or review the attached article: http://www.nytimes.com/2015/01/31/business/buyers-of-used-cars-are-left-to-find-recallson-their-own.html?smprod=nytcore-ipad&smid=nytcore-ipad-share&_r=1#story-continues-1.
