Introduction
1.1
This Report is prepared in support of a full planning application by Frame Property for the
Property, 133 Rye Lane SE15 4ST.
1.2
This Report sets out the principle of development case for the conversion of the Property
from a mixed use A1 retail and D1 nursery premises, into a mixed use facility comprising
‘co-work’ workspace (B1), and flexible restaurant/bar/community/event/gym uses
(A3/A4/D1/D2). Specifically, a case is set out to justify the reduction in quantum of D1
floorspace, which is to be replaced with new, more varied, and higher quality flexible
community floorspace.
1.3
This Report should be red in conjunction with the Planning Statement, Design and Access
Statement, Application Drawings and Consultant Reports which make up the application
pack.
2.
Location
2.1
The Property is situated on the east side of Rye Lane and on the south side of the railway
embankment serving the Overground railway line (see Appendix A – Location Plan).
2.2
Rye Lane is one of the busiest shopping streets in south east London and is at the heart
of the Rye Lane Conservation Area.
2.3
The buildings fronting onto Rye Lane primarily consist of retail at street level with ancillary
storage, commercial or residential accommodation above.
2.4
The area to the west of Rye Lane is primarily residential and is characterised by period
housing making up the Holly Grove Conservation Area.
2.5
The area to the east side of Rye Lane is more broken up in character with a combination
of warehousing, creative business premises, restaurant/bar offerings, and post war
housing estates.
Transport
2.6
The Property is within 50m of Peckham Rye train station and numerous bus routes and
as such has the highest PTAL rating of 6b.
2.7
On street parking is restricted everywhere within the vicinity of Rye Lane with the nearest
paid parking over 175m away in the Choumert Grove car park (see Appendix B – Parking
& Drop-off Plan).

There are no drop-off areas available anywhere within the vicinity of the Property.
3.
Accommodation
3.1
The Property consists of a 4 storeys plus basement red brick and stone Edwardian
structure constructed to the site perimeter.
3.2
The original Property is an attractive period building with a good deal of architectural merit
and, with the necessary care and attention, has the capability of making a positive
contribution to the conservation area.
3.3
The accommodation and arrangement on the basis of the current or most recent
occupation is as follows (see also Application Drawings and Design & Access Statement):

The retail space at ground floor has its primary access and frontage on Rye lane and a
secondary service access from Bussey Court to the rear.
3.5
The retail unit has internal access to an ancillary storage space in the basement with a
secondary service access from the side passageway.

Nursery
3.6
The entrance to the nursery is off the side passageway with direct stair access, but no lift,
to the upper 3 storeys.
3.7
The upper storeys are extensively subdivided to provide a number of small and medium
sized rooms and create protected routes to the means of escape.
3.8
The upper storeys have limited windows to the party wall facades resulting in just 56% of
the net internal (i.e. functional), floor area of the nursery receiving any level of natural
light.
Condition
3.10 The nursery has been recently refurbished and is in reasonable decorative condition
internally.
3.11 However externally the building is in relatively poor condition with extensive work required
to repair external brick pointing, resolve issues with water ingress and repair or replace
existing windows.
3.12 Furthermore the proliferation of service ducting and ad hoc signage at ground and first
floor levels to the Rye Lane frontage masks the qualities of the original building at street
level and detracts from the character and appearance of the conservation area.
4.
Use
4.1
The ground floor and basement are leased to Ash Meat and Fish Centre.
4.2
The upper storeys were once in use as offices (B1 use) by Ralph Haeems & Co solicitors,
who sold the site to the previous owners.
Church
4.3
Permission was granted to change the use of the upper storeys to open D1 use in 1998
and the space was subsequently occupied by the Redeemed Christian Church of God
(RCCG – www.rccghouseofpraise.com).
4.4
In 2011 the RCCG decided to move to more suitable premises at 254-272 Camberwell
Road. The primary reasons for moving were as follows:

community
Parking stopped at the Cerise Road multi-storey car park
Poor access for children and the elderly
4.5
The RCCG are thriving in their new location where they have a fast growing thousand
strong congregation and are able to make a more meaningful contribution to the local
community.
4.6
This is supported by their new premises that offer dedicated off-street parking, spacious
level access off the main road and a single large ground floor hall space.
Nursery
4.7
The upper storeys were subsequently taken over by the Gems Nursery who undertook a
complete refurbishment and started taking children in April 2012.
4.8
The nursery did not manage to attract enough children and was quickly forced to close
down in September 2013. The primary reasons for the failure of the nursery were as
follows:

Very poor accessibility i.e. no parking or drop-off area, narrow covered alleyway
access, no ground floor accommodation or lift access to upper storeys
Very poor levels of natural daylight
No playground
4.9
The upper storeys have been left empty since being vacated by the Gems Nursery.
5.
Constraints
5.1
The upper storeys of the Property suffer a number of significant constraints that make it
unsuitable for D1 use as follows:

Planning
6.1
The key planning policy relating to the loss of community facilities is ‘saved’ Policy 2.1 of
Southwark Plan. It states that;
Planning permission for a change of use from D class community facilities will not be
granted unless:
i.
The applicant demonstrates to the satisfaction of the LPA that the community
facility is surplus to requirements of the local community and that the
replacement development meets an identified need; or
ii. The applicant demonstrates that another locally accessible facility with similar or
enhanced provision can meet the identified needs of the local community facility
users.
6.2
It is noted that this policy relates to the use, not the quantum, of community floorspace.
Whilst no loss of use is proposed in this application, justification has nonetheless been
provided against the loss of quantum for the sake of robustness.

To be thorough in its justification, this Report considers not only the loss of the nursery
but also of the fuller range of potential community uses to demonstrate that the facility in
its current condition is surplus to requirements. The application drawings and design &
access statement also submitted as part of this application then set out how the
replacement community facility, co-work space and restaurant/bar uses will meet an
identified need, and provide a significantly enhanced provision to serve the local area.
6.4
The Peckham and Nunhead Area Action Plan Policy 7 (Community Facilities) states that
new community facilities will be focused within Peckham Core Action Area and should be
designed to be flexible.
7.
Supply & demand
Nursery
7.1
The nursery use ended in September 2013 and the few children still attending the nursery
at that point will now have found places in other local nurseries or moved onto primary
school.
7.2
There are 35 nurseries within 1 mile radius of the property (see Appendix D – Nursery
Database).
7.3
Of the surrounding nurseries, as established by Southwark council Family Information
Service database of local nurseries published in March 2016 (see Appendix E –
Southwark Evidence Base Nurseries), all but 6 have surplus capacity with a total of 455
vacancies spread across the following age ranges:

Of the surrounding nurseries all have their primary accommodation at ground floor level,
all but 2 have a drop off area and all but 7 have external amenity space. None suffers
from more than one of these primary constraints and it would be surprising if any suffer
from a similarly poor level of natural daylighting as the Gems Nursery (see Appendix F –
Neighbouring Nurseries Examples).
Church
7.5
The RCCG church decided to move to Camberwell in 2011 due to the exceptional number
of churches in the Rye Lane area.

7.6
This issue is borne out by our research which shows there are currently a total of 17
churches within just 0.1 mile radius of the property (see Appendix G – Church Database).
7.7
Of these churches all that we have been able to speak to have confirmed that they have
capacity and would welcome new members.
7.8
Of these churches 11 have dedicated parking and 11 have their primary accommodation
at ground floor level or accessible by lift.
Other Community Facilities
7.9
There are a total of 31 D1 facilities within 0.5 mile radius of the property (see Appendix H
– Other Community Facilities Database) including as follows:

7 health centres all of which are registering new patients
9 schools all of which are admitting students in the usual manner
7 general purpose community facilities all of which have space immediately
available for short term let
7.10 Of these facilities all but 1 have disabled access and all but a few have dedicated parking
and external amenity space.
Proposed Uses
7.11 The principle of a mixed use, flexible development containing work, events and
community space alongside restaurant/bar uses is considered appropriate given the
support it will bring for the growing small and micro business community in the local area.
It will also offer a range of types and sizes of space for hire, made available to members
of the community, and designed to appeal to a diverse range of users. Both of these,
alongside the proposed food and drink venues, are seen as key parts of Peckham’s
community and economy, driving positive growth and regeneration in the area.
8.
Appraisal
Access
8.1
There is no evident solution to the lack of a drop off area adjacent to the Property.
8.2
There is no way of providing dedicated off street parking without demolishing the existing
building which is deemed undesirable.

8.3
The covered passageway is a public right of way and there are limited options to make it
more user friendly for certain community uses (such as a nursery).
8.4
Access into the building could be greatly improved by undertaking the following
measures, all of which have been incorporated into the proposed scheme:

8.5
Remodelling and relocating the main entrance to face directly onto Rye Lane
Carving an area out of the side of the retail unit to create a ground floor lobby
and reception
Inserting a lift from ground level to the upper floors, to give step free access to all
levels of the building
Reconfiguring the spaces internally to provide rationalised, open floor space
These measures will ensure that all community spaces will be fully accessible, opening
them up to more inclusive use by a wide variety of different groups, businesses, operators
or individuals.
Amenity & Quality of Space
8.6
The deep floorplate and limited fenestration constrains the Property’s access to natural
daylight, and extensive existing internal partitioning further worsens the issue, creating a
myriad of dark, internal, subdivided rooms.
8.7
There is no scope to provide external amenity space in the current configuration. Further,
the nearest green space with a children’s playground is over 600m away.
8.8
Existing daylight levels could be substantially enhanced by undertaking the following
measures, all of which have been incorporated into the proposed scheme:

Replacing the existing damaged and boarded up windows
Breaking out existing brickwork below sills to create enlarged window openings
Incorporating roof lights where possible
Reconfiguring the internal layout to create larger, more open spaces which make
better use of the available daylight
Given the constraints of the site, amenity space could only be provided by creating
terraces at upper floor level. The proposed scheme includes three such external areas;
one small balcony to the rear of the first floor, a terrace to the perimeter of the 4th floor
extension, and a large planted roof terrace with direct lift access.
8.10 Taken together these measures will ensure that the proposed community floorspace will
represent a significantly enhanced provision when compared to the existing, offering

multiple areas of external amenity as well as substantially improved levels of internal
natural light.
8.11 Additional to this, it is proposed to undertake a programme of general repairs to the
existing external fabric to resolve issues of damp and water ingress. This will ensure the
building is in a good state of repair to allow the proposed mixed use facility to operate in a
sutainable and viable manner over the long term.
9.
Conclusion
9.1
The Property is located in an area of significant local heritage and regeneration interest
and therefore the community would benefit greatly if a sustainable use was found for the
building over the long term.
9.2
The last user of the upper storeys, the nursery, closed down very soon after opening
despite significant investment due to the building’s severe physical constraints.
9.3
There is also clear evidence of surplus capacity in far better appointed nurseries in the
surrounding area.
9.4
Similarly the previous user of the upper storeys, a church, moved to a much more suitable
building in another part of the borough due to the exceptional level of competition
between churches in the immediate vicinity of the Property almost all of which occupy
more suitable accommodation.
9.5
The proposed reconfiguration of the building offers a range of different uses, including
community space of various sizes and types. Though this results in some reduction in
quantum of community floorspace, the redevelopment provides an opportunity to address
some of the inherent issues currently faced.
9.6
As such, the quality of proposed community floorspace will be a significant improvement
over the current offering. It will be more accessible through a reconfigured entrance
sequence and direct lift access, more flexible due to the open nature of the spaces, and
more attractive due to the amenity space and improved daylight levels. The spaces will
therefore be more viable and sustainable, and will attract a more diverse and varied
range of users.
9.7
For this reason, the reduction in quantum of community floorspace is deemed to be
justifiable. Further, the proposals will provide other benefits to the local area through
(amongst other things) the provision of a large co-work facility, designed to offer small
and micro businesses the opportunity to be part of an affordable, accessible, collaborative
and professional working community.
