for additional gensets
Fearing the paralysis of
economic
activities
in
Catanduanes,
Governor
Joseph Cua has asked the
Department
of
Energy
(DoE) and the National
Power Corporation for intervention in providing additional power to the island.
Capitol sources told the
Tribune that the governor
will personally seek the assistance of DoE Secretary
Jose Rene Almendras and
NPC
President
Froilan
Tampinco in resolving the
power crisis that hit the grid
and its 35,000 memberconsumers just days after
Pres.
Benigno
Simeon
Aquino III led the ceremonial switch-on of the two minihydroelectric power plants
of the Sunwest Water &
Electric Co.
The rotating six-to-eighthour power outages began
May 4 when the 3.6megawatt bunker-fuel genset of the Catanduanes
Power Generation, Inc.
(CPGI) broke down due to a
defective fuel purifier. This
took out 2.9 MW from the
grid, and along with the
reduced capability of the
three hydro plants due to
low water levels, resulted in
a deficiency of 2 MW during
peak hours and 1 MW during off-peak hours.
The brownouts became
inevitable on May 8 when
CPGI decided to cease operations effective May 11,
invoking Clause 13.1 of the
Electricity Supply Agreement (ESA) with the First
Catanduanes Electric Cooperative, Inc. (FICELCO).
The provision allegedly
states that it cannot be held
liable for ceasing its operation due to force majeure,
or reasons beyond the control of the company.
In his letter to Sec. Almendras, Cua sought intervention for the immediate
provision of three (3) 1.25megawatt
gensets that
could be operated in lieu of
CPGI’s power plant. The
generators, he said, were
originally included in the
2012 budget for the NPC’s
Small Power Utilities Group
(SPUG) but were deferred

Vice Governor Jose Teves Jr. last Monday asked
the Sangguniang Panlalawigan to investigate the
circumstances behind the sudden cessation of operations of Catanduanes Power Generation, Inc.
(CPGI), particularly the its liability for nonperformance under the allegedly one-sided Electricity Supply Agreement (ESA) with the First
Catanduanes Electric Cooperative, Inc. (FICELCO).
In his privilege speech
during the May 14 regular
session, Vice Gov. Teves
raised several issues and
concerns that have to be
answered so that the consuming public would be
able to understand how the
current power crisis developed.

This is the position of
CPGI president Joselito
Abrogar in his May 8 letter
informing the FICELCO
management that due to
the “existence of force
majeure”, the firm is effectively prevented and excused from performing its
obligation to deliver the
contracted
energy
to
FICELCO.
Abrogar stated that its
decision to cease operation
is without exposure to any
claim against it, citing
Clause 13.2 of the ESA
which it said provides that
“no failure or omission by a
party to carry out or observe any of its material
obligations shall give rise to
any claim by the other party, or be deemed to be a
breach of the agreement if
the same shall be cause

from each town will be deputized by the Land Transportation Office (LTO) as
traffic enforcers once their
applications are approved,
following the conduct of a
training at the Catanduanes
PNP
headquarters

week.
The local policemen, including personnel of the
Provincial Public Safety
Company, attended the two
-day Joint LTO and PNP
Land Transportation & Law
Enforcement Deputization
Training held at Camp
Francisco Camacho in Virac last May 9-10.

guarantee to the fuel supplier payment of the bunker
fuel used by CPGI, charged
to collections. He also
urged the cooperative and
CPGI to divulge the other
force majeure conditions in
the ESA, which in itself has
yet to be made public by
both parties.
Teves also criticized
FICELCO management for
not issuing prior advisories
about the load shedding,
particularly in the light of the
President’s switch-on ceremony last May 2. “How
could this have happened?
Was the switching on just a
façade to show to the President that we are doing good
here?” he asked.

Abrogar blamed the Energy Regulatory Commission’s provisional approval
of the Electricity Supply
Agreement (ESA) between
CPGI and FICELCO for
having effectively limited
the cost of fuel that may be
collected and passed on to
the grid’s 35,000 memberconsumers.
“The disparity between
the provisionally approved
fuel and lube oil cost and
the actual cost of purchasing fuel is too much a burden for CPGI to bear, so
much so that other costs
concomitant to operating
and maintaining the power
plant can no longer be attended to by CPGI,” Abrogar stated, adding that the
very low rates approved by
ERC resulted to serious
financial losses for CPGI.
“As a matter of fact, all of
CPGI’s recent collections
from FICELCO were used
almost exclusively to purchase fuel to ensure the
continuous operation of the
power plant for 12 hours
per day,” he stressed.
As such rates are not
sufficient to allow the continued sustainable operation of CPGI’s plant, CPGI
said it has informed FICELCO on several occasions of
its predicament, particularly
the imminent possibility of a
cessation of operations.
Since March 17, the independent power producer
has been operating intermittently and at one time allowed to suspend power
generation. The firm, Abrogar disclosed, has come to
a point that it can no longer
continue on generating
electricity, with its fuel inventory as of May 8 to last
less than 50 hours of operation.
As a result of the CPGI’s
plant being idled, the grid
has a deficiency of 2 megawatts during peak hours
from 6 to 10 P.M. and one
megawatt during the rest of
the day, based on current
demand of 8.4 MW during
peak hours and 6.2 MW
during off-peak hours. With
the three hydro plants at
Solong,
Hitoma
and
Balongbong producing just
25 percent of its total capability of 5.4 MW, the bulk of
the grid’s electrical supply is
now being borne by NPC’s
rented gensets as well as
its power barge and derated diesel power plants.
Under the contract, CPGI is
supposed
to
deliver
22,600,000 kilowatt-hours
annually, which accounts
for 53 percent of the total
yearly demand.
CPGI told the cooperative that it may not be able
to operate normally on May
11, emphasizing that circumstances beyond its control leave it with no choice
but to resort to the decision.
“Exactly how long this force
majeure will continue is
beyond us,” Abrogar said,
adding that CPGI could only
anticipate that ERC will resolve its application soonest
and grant workable rates,
upon which the company
would mobilize critical working capital to resume operations soonest.

Ice Cream
Last week I took my children to a restaurant. My six-year-old son asked if he
could say grace.
As we bowed our heads he said, "God is good. God is great. Thank you for the
food, and I would even thank you more if Mom gets us ice cream for dessert. And
Liberty and justice for all! Amen!”
Along with the laughter from the other customers nearby I heard a woman
remark, "That's what's wrong with this country. Kids today don't even know how
to pray. Asking God for ice-cream! Why, I never!"
Hearing this, my son burst into tears and asked me, "Did I do it wrong? Is God
mad at me?"
As I held him and assured him that he had done a terrific job and God was
certainly not mad at him, an elderly gentleman approached the table. He winked
at my son and said, “I happen to know that God thought that was a great prayer.”
"Really?" my son asked.
"Cross my heart," the man replied.
Then in a theatrical whisper he added (indicating the woman whose remark had
started this whole thing), "Too bad she never asks God for ice cream. A little ice
cream is good for the soul sometimes."
Naturally, I bought my kids ice cream at the end of the meal. My son stared at
his for a moment and then did something I will remember the rest of my life. He
picked up his sundae and, without a word, walked over and placed it in front of
the woman.
With a big smile he told her, “Here, this is for you. Ice cream is good for the
soul sometimes; and my soul is good already.”

THE SPRATLYS
The Spratly Islands, a
group of islands located in
the South China Sea, are
important for a number of
reasons: the Spratly area
holds significant reserves of
oil and natural gas, it is a
productive area for world
fishing
and
commercial
shipping,
and
coastal
countries would get an
extended continental shelf.
In 1968 oil was discovered in
the region. The Geology and
Mineral Resources Ministry of
the People's Republic of
China (PRC) has estimated
that the Spratly area holds oil
and natural gas reserves of
17.7 billion tons (1.60 × 1010
kg), as compared to the 13
billion tons (1.17 × 1010 kg)
held by Kuwait, placing it as
the fourth largest reserve bed
in the world. These large
reserves
assisted
in
intensifying the situation and
propelled the territorial claims
of the neighboring countries.
States staking claims to
various islands are: Brunei,
China (People's Republic of
China),
Malaysia,
the
Philippines, Taiwan (Republic
of China), and Vietnam. All
except Brunei occupy some
of the islands.

China and Vietnam are the
main protagonists in the
dispute.
The
People's
Republic of China (PRC)
claim all of the Spratly
Islands as part of China and
had
a
historical
naval
presence. Recently, they
have had a profound military
impact on the area. China
claims to have discovered the
islands in the Han Dynasty in
2 BC. The islands were
claimed to have been marked
on maps compiled during the
time of Eastern Han Dynasty
and Eastern Wu (one of the
Three Kingdoms). Since the
Yuan Dynasty in the 12th
century, several islands that
may be the Spratlys have
been labeled as Chinese
territory, followed by the Ming
Dynasty and the Qing
Dynasty from the 13th to 19th
Century.
In
1755,
archaeological surveys the
remains of Chinese pottery
and coins have been found in
the islands and are cited as
proof for the PRC claim. The
Republic of China (ROC),
which ruled mainland China
before 1949 and has been
confined to Taiwan since
1949, also claims all of the
Spratly Islands. Today, the
People's Liberation Army and
the Republic of China Armed
Forces are both stationed in
several islands, including the
largest, Taiping Island occupied by ROC. The PRC
and ROC base their claims
on the belief that the islands
have been an integral part of
China
for
nearly
two
thousand years and that
neighboring countries and
European
Powers
took
advantage of China's poor
condition and diversity to
impinge on its sovereignty.

Vietnam’s claims to the
islands--which they call the
Truong Sa islands--are part
of the empire of Annam,
Vietnam's ancestor, in the
l9th century. In 1815, an
expedition sent by king Gia
Long to chart sea lanes
occupied and settled the
islands. The French, who
were
Vietnam’s
colonial
rulers, annexed the Spratlys
in 1933, so Vietnam says the
islands are theirs as the
inheritors of the French
possessions. In September
1973, Vietnam declared that
the Spratlys were part of the
Phuoc Tuy province. Vietnam
currently holds three islands.

The Philippines made its
first claim in the area -- which
it refers to as the Kalayaan
islands -- in 1975 and has
been developing oil in the
region between the Spratlys
and the island of Palawan
since 1976. The Philippines
real history in the region
began in May 1956 when a
private Philippine expedition
surveyed and occupied some
of the islands. In 1968, the
Philippines started to take its
claims more seriously and
stationed troops on three
islands which had been
claimed by the adventurer
Tomas Cloma as part of
Freedomland.
The
Philippines base its claims of
sovereignty over the Spratlys
on the issues of res nullius
(Latin
term,
meaning
nobody’s
property)
and
geography. The Philippines
claims res nullius as there
was no effective sovereignty
over the islands until the
1930s when France and then
Japan acquired the islands.
When Japan renounced its
sovereignty over the islands
according
to
the
San
Francisco Treaty, there was a
relinquishment of the right to
the islands without any
special
beneficiary.
Therefore,
argue
the
Philippines,
the
islands
became res nullius and
available for annexation. The
Philippine claim to Kalayaan
on a geographical basis
argues that all the islands
claimed by the Philippines lie
within its 200-mile Exclusive
Economic Zone according to
the 1982 United Nations
Convention on the Law of the
Sea.

Malaysia has also been
involved in the dispute since
1979. It currently has control
over three of the islands but
claims the whole chain.
Malaysia’s case is based on
the fact that the islands are
part of its continental shelf.
This gives it right to the
islands under the Law of the
Sea Convention. Brunei's
claims to the island also rest
on the Law of the Sea. It
states that the southern part
of the Spratly chain is
actually a part of its
continental
shelf
and
therefore its territory and
resources.

There is no question that
China is bullying everybody
else in the tension in the
South China Sea. It does so
because it can do so. It does
so because no claimant
nation,
except
perhaps
Vietnam, has the courage to
stand up to Beijing, no matter
how feeble the attempt would
turn
out
to
be.
The
Philippines, which does not
have a navy to speak of, and
which owes Beijing huge
loans, could just scratch its
head in embarrassment to
the Chinese bullying. To add
insult to all this, Manila has
looked to the United States
for help, invoking the socalled Mutual Defense Treaty
between the Americans and
the Filipinos. But would the
US choose to side with the
Philippines and risk offending
China? What the Philippines
owes China is peanuts
compared to the trillions of
dollars owed by US from
China. Put another way,
would the US - its global
dominance waning and its
economy increasingly reliant
on China - go to war for the
Philippines? Let us stop
dreaming.

EDITORIAL
Blackmail by brownout
Unofficially, and power industry officials would not admit it, this is
what is happening in the Catanduanes power grid.
As concerned readers may recall, an energy summit was called
March 30 to discuss the “curtailment” of the operation of
Catanduanes Power Generation, Inc. (CPGI), due to huge revenue
losses it blamed on the low fuel heat rate approved by the Energy
Regulatory Commission.
During that summit, which turned out to be a cry for help, the
management of the First Catanduanes Electric Cooperative, Inc.
(FICELCO) appealed to local leaders and businessmen to petition the
ERC for a reconsideration of the rates it provisionally approved.
Unfortunately, the politicians stayed away while the businessmen
declined, saying they had had enough of writing petitions that are
never granted. With the ERC taking forever to hear CPGI’s motion for
reconsideration and the company rapidly using up its remaining
capital, CPGI President Joselito Abrogar decided to stop operation of
its 3.6-megawatt bunker-fuel power plant.
In another luckless day for Catanduanes’ 35,000 memberconsumers, local leaders chose not to pester Pres. Benigno Simeon
Aquino III, who ironically led the ceremonial switch-on of two
hydroelectric plans that now produce only a quarter of their power, to
restore funding for three gensets of the National Power Corporation.
The three new gensets could have taken CPGI’s load at this time.
And now that CPGI has idled its plant for lack of cash, Pres.
Abrogar has the temerity to claim that CPGI cannot be sued for failing
to deliver its contracted power under the controversial but hidden
Electricity Supply Agreement (ESA) with FICELCO.
Clause 13.2 of the ESA allegedly provides that “no failure or
omission by a party to carry out or observe any of its material
obligations shall give rise to any claim by the other party, or be
deemed to be a breach of the agreement if the same shall be cause or
arise out of any circumstance beyond the reasonable control of the
part which effectively prevents it from performing its obligations,
including any other event, matter or thing.”
Never mind that CPGI had reasonable control over the application
for ESA approval it filed jointly with FICELCO before the ERC, which
even saw fit to point out that CPGI did not use actual operational data
for the bunker-fuel genset as its supporting document for the
approval of the fuel heat rate it wanted.
The secrecy with which FICELCO management and its “staunch
partner” has held the ESA prompts sane consumer-members,
including Vice Gov. Jose Teves Jr., to wonder what other clauses
prevent anybody from suing CPGI or even the cooperative for breach
of contract. They are even wondering if the Board of Directors
evaluated the financial capability of CPGI, whether it had enough
money to pull itself out of crises like this.
On the other hand, many would probably understand if CPGI went
further by pulling out of the grid altogether, dissolving the company
and going into bankruptcy proceedings. But no, Pres. Abrogar cited
force majeure and then left the door open for CPGI to be able to
function normally again.
Here are his very words in the May 8 letter to FICELCO: “Even how
long this Force Majeure will continue is beyond us. CPGI could only
anticipate that ERC will resolve our Application soonest and grant
workable rates to CPGI pursuant to our filings and evidence
presented. Immediately upon such final resolution of ERC, CPGI will
mobilize to have critical working capital made available for the
company to resume operations as soon as possible.”
There it is. CPGI will only mobilize to have critical working capital
and resume operations ONLY and ONLY IF the Commission favorably
grants its requested rate. That’s why the company and the
cooperative tried to persuade local leaders to send urgent petitions to
ERC, citing the possibility of island-wide brownouts.
If this is not blackmail, then there are no brownouts in Catanduanes
right now.

A Bill of Rights for passengers
The
move
of
the
Department of Transportation
and Communications (DOTC)
to draft a Passenger Bill of
Rights is very timely.
Last Friday, this writer and
his two sons waited for six
hours at the crowded Manila
Domestic Terminal for our
flight home via Zest Air. It
was just too bad that the
management
decided
to
cancel the flight due to
“sunset limitation” just before
4 P.M., triggering vehement
complaints from passengers,
most of whom were trying to
catch the celebration of the
town fiesta in Gigmoto.
Several called for the
outright refund of their tickets,
as they had purchased them
on-line several months ahead
and would like to find seats in
the similarly chaotic bus
terminal in Cubao. Rebooking
of the tickets was a no-no,
with the airline promising
sure seats not the next day,
but on Tuesday.
In the end, the passengers
had to accept what the
management
offered:
a
measly P150 as “denied
boarding compensation” to
add to the refund of their
P200 terminal fee. Gone, of
course, were their expenses
for the taxi fare and lunch
while waiting for their flight
that never got off the ground.
The lengthy delays and
appropriate compensation for
passengers in case of flight
cancellation are among the
issues which the proposed
Bill of Rights seeks to
address. Clearly, flight control
crew would be able to
determine before lunchtime if
a flight scheduled in the
afternoon
should
be
cancelled
to
save
its
passengers the stress of
trying to make it to their
Q
destinations on time. If the
earliest flight of the plane was
already delayed, surely they
will be able to calculate by
how
much
time
the
succeeding flights could be
delayed, or cancelled due to
“sunset limitation.”
There is also the matter of
ticket refunds. An airline
should have at the terminal
concerned enough cash to be
able to pay passengers who
want refunds of their unused
tickets. While tickets bought
on-line within the 30 to 60day period within which the
passenger’s bank pays the
airline could understandably
be refunded within a similar
period from date of flight
cancellation, tickets bought
on cash basis should be
refunded outright. The airline
can get a refund of the
payment from their sales
agents who issued the
tickets.
Certainly,
most
passengers, especially those
who do not travel so often,
would not have much use of
the so-called “travel fund”
which Cebu Pacific and other
airlines offer passengers
whose tickets were unutilized
due to cancellations. On the
other hand, passengers pay
so much, at least P600 plus,
when they fail to make it to
flight time and have to
rebook.
Airlines
should
likewise be required to
compensate passengers for
delays and cancellations not
due
to
weather,
and
overbooking (issuing tickets
in excess of available seats).

SUMMER SPECIAL PROMO FOR INACTIVE CONNECTIONS
To encourage the inactive concessionaires to reconnect their service
connections, the Virac Water District is offering the following promo:
1. The service connection fee of P3,100.00 for 1/2” water meter shall be
reduced by 50% amounting to P1,550.00 only;
2. The discounted fee must be paid in cash within the promo period (May to
June 2012);
3. Reconnection of water meter can be done only after payment of P1.550.00
- this applies only to inactive concessionaires with arrears;\
4. The arrears may be paid on instalment basis within a period depending on
the amount of arrears and economic status or capacity to pay by the
concessionaires;
5. Inactive connections without arrears may avail a “no reconnection fee.”

The training seeks to establish WASAR Teams at
the barangay levels to empower them in responding to
emergency and first-hand
rescue services. The first
provincial WASAR training
was conducted in November
21-25, 2011, where 57 participants from five municipalities passed the training.
A component of WASAR
is the need to ensure the
seawater safety from oil spill
or any forms of contaminants and toxic substances
which may endanger the
marine’s flora and fauna.
Thus, to institute preparedness and enhance the
emergency response capabilities of the local folks,
MAREP training was also
conducted.
This will bridge the gap of
the spill’s early containment
while proper authorities
mandated to disperse or
intoxicate the area are still
on transit, Engr. Santelices
said.

participants in the first ever
provincial MAREP training
from their respective barangays:

into law. Passage of the Bill
into law will surely bring us,

way to perdition. This is no
light threat – this will happen

The RH Bill: What it says:
The proponents of the RH
Bill may have the most patriotic and noble purpose to
propose the passage of the
Bill. First, they say that it imperative that we have to reduce the population of the
Philippines because overpopulation is the reason why
Filipinos are poor. The Bill

Is the Philippines overpopulated? Will reducing the
population with the use of
contraception eliminate poverty in the Philippines? Or will

Source of Funds: General Appropriations Act (GAA) CY 2011
The DepEd, Division of Catanduanes, through its Bids and Awards Committee (BAC), now invites bids for the above-mentioned
works. Bids received that exceed the ABC per lot shall be rejected. Late bids shall be rejected. Evaluation and award shall be made
on a per lot basis/as one (1) lot. Bidder may bid for one, more than one or all of the lots.
Prospective bidders must have completed a similar contract within the last ten (10) years from the deadline date of submission
and receipt of bids with an amount of at least fifty (50%) of the ABC to be bid.
Bidding is restricted to Filipino citizens / sole proprietorships, organizations with at least seventy-five percent (75%) interest or
outstanding capital stock belonging to citizens of the Philippines, and to citizens or organizations of a country the laws or regulations
of which grant similar rights or privileges to Filipino citizens, pursuant to RA 5183 and subject to Commonwealth Act 138.
Open competitive bidding will be conducted using the non-discretionary pass/fail criterion, evaluation and post-qualification procedures, specified in the Implementing Rules and Regulations (IRR) of R.A. 9184. Information is also available at www.philgeps.net

The DepEd, Division of Catanduanes, reserves the right to reject any and all bids, declare a failure of bidding, not award the
