President (Frank) – Called meeting to order 1935hrs. Conducted the Pledge of Allegiance and moment of silence.
Discussed who is attending the Florida ABATE state meeting on 14 February (Valentine’s Day) Cape Coral (Geno
and ??). Also talked about the Insurance policy meeting and review of current processes.
Vice President (Geno) – wants everyone to be safe with the races and Bike week coming up. Voluteered to attend
the Florida Abate State meeting.
Secretary (Bobby C) – Made motion to accept January’s meeting minutes as published in the newsletter. Motion accepted.
Treasure (John) – Read the financial report regarding the chapter finances for January. Motion made to accept report
as stated. Motion passed.
Membership (Steve) – Membership one new member / six renewals, see membership section for details
Legislative (John) – Legislative special election on 7 April. Minnesota Abate proposed a profiling bill for upcoming
legislative session. John likes the language and thinks it is a solidly written bill. Ongoing legislative actions, for more
information see the legislative updates in this newsletter.
Safety (Mike) – Discussed the Ride Smart Florida website and their FREE products offered to the Florida riders. Has
website www.ridesmartflorida.com and will research getting safety gear and posters.

Old Business – Daytona Abate voted on donating $500 to the Trademark Fund (NCOM) AKA Save the Patch fund.
New Business – Welcome Canadians!! Discussed advertising and selling Daytona Abate T-shirts and setting up
membership booth (we need volunteers during Bike Week). Also suggested adding a t-shirt purchase capability to the
Daytona Abate website. Abate of Florida Inc. needs to generate money.
Profiling and discrimination, if it is happening you need to document the incident. Freedom of Information Act
will give you access to police dash and body cam, as well as radio traffic and reports.

ABATE is involved in. Session begins March 3; all bills should be in drafting; Feb25 deadline for approving final drafts of Senate bills; March 3 deadline for filing Senate bills for introduction. Tentative Rights Rally April 20.

ABATE of Florida supports enhanced penalties for those who injure or kill vulnerable road users.
In 2005, our lobbyist, Doc Reichenbach, was successful in getting an amendment to a bill that changed the following statues so
the word “shall” replaced “may” which means MUST. 318.14 (5) the actual stiffer penalties for those under 318.19. $500 for
causing incapacitating injuries, $1000 for causing death.
318.19 Mandatory hearings for those who are involved in an accident with severe injury or death
(The same year, Doc was able to get the ape hanger law changed to shoulder height.) After the bill became law, it took a letter
to the head 7th circuit court judge to revise the memo dealing with sentencing guidelines, despite DHSMV sending memos to all
circuit courts on new laws. Currently, if judges are aware that an injury or death occurred at all, they usually withhold adjudication if you have a lawyer. In Volusia County reckless driving charges never seem to be used. So now we need more laws. Our
chapter would prefer backing off on enhanced penalties. However, the ABATE state delegation believes that since there is so
much minimum mandatory laws, motorcyclists should get something for themselves. The only area, that legislators are slow
to address, is the killing and maiming of motorcyclists because of stupid driving skills unless drugs or alcohol are involved. There needs to be something between a $122 ticket and vehicular manslaughter to get the attention of those with poor
driving skills. In recent sessions, committee chairmen have sat on this bill.
Tallahassee The yearly massive highway & transportation bill has not been filed yet.
ENHANCED PENALTIES FOR THOSE WHO KILL OR INJURE VULNERABLE ROAD USERS
HB231 Transportation Passidomo
This is not the bill our lobbyist is working on. That bill is still in bill drafting.
Revises provisions relating to the rights & safety of vulnerable users (includes motorcycles) of public rights-of-way; prohibits
assault of bicycle riders; revises provisions for careless driving; provides penalties for specified infractions contributing to bodily
injury of vulnerable users; requires traffic law & substance abuse education courses to include certain instruction; requires driver
license examinations to include test of applicant's knowledge of certain traffic laws; requires driver education courses offered by
school district to include certain information.
Included in this bill are the follow statue changes or additions:
316.0875 No-passing zones.
(3) This section does not apply:
(c) When the driver of a motor vehicle is required to cross pavement striping indicating a no-passing
zone when passing a vulnerable user of a public right-of-way in order to provide at least 3 feet between the motor vehicle and the vulnerable user.
318.142 (1) (a)
In addition to any other penalty imposed for a violation under s. 316.083, s. 316.0833, or s.
316.1925, if the violation contributed to the bodily injury of a vulnerable user of a public right-of
-way as defined in s. 316.003, the designated official shall impose a fine of not more than $2,000
and the department shall suspend the offender's driving privileges for 6 months.
I like this bill. My concerns are that for the no passing zones; perhaps they should replace the vulnerable user with just bicyclist.
On A1A, I am going the speed limit, 40-45 mph, but there is always someone right on my tail that wants to do 60 in an area
where there are people going to the beach. I use that whole lane. (Center oil deposits, depress, raised manholes, sand). Does this
bill allow people to now pass me on the left when I am not expected it? It is bad enough that people will drive pass the shoulder
to pass me on the right, when I am making a left hand turn. I have some questions on how this bill will affect the present FS
318.14(5).
From Darrin, our State Legislative Trustee: Hey Everyone, Our Bills are still in Bill Drafting and I will let you know as soon
as they come out. I have attached the latest House and Senate Bills Watch List. There is one Bill, that I copied below, that is
of great interest to us. It is by Reps. Passidomo and Fitzenhagen from Naples and Ft. Myers. If you read the Bill it has much
of the same wording, almost identical in some places as our Vulnerable Road Users Bill form last year. This Bill is geared
more towards the Bicycles, thus is much more detailed in the bicycle portion of the Bill. But it does include Motorcycles in the
list of Vulnerable Road Users. I spoke with Rep. Passidomo about the Bill, telling her that we are very happy to have more
people interested in the safety of all vulnerable road users. I told her that her Bill is similar to a Bill that Sen. Evers sponsored last year and that the Bill we are supporting this year is in Bill Drafting. I spoke with Rep. Passidomo about how
ABATE of Florida, Inc. will gladly support and fight for ANY and ALL Bills that protect MOTORCYCLES. So, with TWO expected Bills out in this session, we double our chances and are finally getting others to recognize the hard work that Doc and
each and every one of you have done for the past decades…. I look at this a BIG VICTORY for ABATE of Florida, Inc. and
the welcome addition of more allies to help us this session. See you soon, Scribe
CELL PHONES
There are many bills files that expand the penalties for using cell phones. I am not including them in my published legislative
report. Motorcyclists know texting is the worst form of distracted driving. Eating your French Fries after the drive thru window
is also distracting. ABATE of Florida has no position on these bills. We finally got a texting statue last session. Public awareness
is being raised with interstate message boards and TV commercials. But in the Florida tradition of criminalizing America, there
are several bills increasing restrictions and fines.
SPEED TRAPS
HB421 Traffic Enforcement Agencies and Traffic Citations: Designates counties & municipalities as traffic enforcement agencies; prohibits establishing traffic citation quotas; requires county or municipality to submit report of its traffic citation revenue & its
expenses for operating law enforcement agency during fiscal year to Legislative Auditing Committee.
SB264 Traffic Enforcement Agencies and Traffic Citations: Designating counties and municipalities as traffic enforcement
agencies for purposes of the section and prohibiting them from establishing traffic citation quotas; requiring a county or municipality to submit a report of its traffic citation revenue and its expenses for operating a law enforcement agency during a fiscal
year to the Legislative Auditing Committee under certain circumstances, etc.
BODY CAMERAS. Daytona Beach Police Chief Chitwood likes body cameras; however is this a form of an unfunded mandate?
SB248 Recording of Law Enforcement Activities Smith: Citing this act as the "Police and Citizen Protection Act"; requiring uniformed officers assigned primarily to patrol duties to be equipped with body cameras; exempting the recordings of such activities
from specified provisions relating to the interception of wire, electronic, and oral communications, etc.
HB57 Recording of Law Enforcement Activities Jones, S. and Williams, A. (CO-SPONSORS) Van Zant: Designates act "Police
and Citizen Protection Act"; requires uniformed officers assigned to patrol duties to be equipped with body cameras; requires use of
such cameras during specified activities; exempts recordings of such activities from specified provisions relating to interception of
wire, electronic, & oral communications.
(2) Every uniformed law enforcement officer in this state 23 who is primarily assigned to patrol duties
shall be equipped 24 with a body camera while performing such duties. The camera 25 shall be used by the
officer to record activities that take place during motor vehicle stops or other law enforcement actions
taken during the course of his or her official duties.
From the Senate Staff Report:
The outcomes of citizen complaints involving incidents that were videotaped resulted in exonerations for the officers
in 93% of recorded incidents. The immediate supervisors of patrol officers also reported that in at least half of complaints, when the complainant learned the incident was videotaped, the complaint was subsequently withdrawn. The
bill creates a new section of statute requiring law enforcement agencies that permit law enforcement officers to wear
body cameras to develop policies and procedures governing the proper use, maintenance, and storage of body
cameras and recorded data. The policies and procedures must include: General guidelines for the proper use,
maintenance, and storage of body cameras; Any limitations on which law enforcement officers are permitted to wear
body cameras; Any limitations on the situations in which law enforcement officers are permitted to wear body cameras; and General guidelines for the proper storage, retention, and release of audio and video data recorded by body
cameras. Data recorded by body cameras will have to be screened for confidential or exempt data before it
is released pursuant to a public records request.
Something of interest
HB197 Tracking Devices or Applications: Prohibits use of tracking device or application to determine location or movement of
person without person's consent; creates presumption that consent is revoked upon initiation of specified proceedings; provides exceptions.
PROFILING
Abate of Florida is not going to introduce a profiling bill. Before the State Delegation approves support of such legislation, it is MY opinion that the following will need to be done:
Passage of the federal stop checkpoint legislation. This would be a strong talking point. Document incidents of profiling. There are differing opinions on how widespread profiling occurs. Perhaps the use of body cameras might be of usefulness. We are going to need something in print to put in front of our legislators to make them support such legislation, otherwise this will go nowhere.
Minnesota Abate looked at Washington profiling bill (which became law) and here is the
2015 Minnesota HB59 bill which deals with Motorcycle profiling policies.

“Motorcycle-only checkpoints are discriminatory, forcing riders and their passengers to do something not asked of
other citizens, simply because we choose to travel on two wheels, or three, instead of four,” said Wayne Allard,
AMA vice president for government relations. The MRF and AMA have worked together in the past. Each organization has
a different structure it adheres to.

H.R. 21 U.S. Rep. Jim Sensenbrenner (R-Wis.) This bill would repeal the U.S. Environmental Protection Agency’s waiver decision
related to E15 fuel and the authority of the agency to grant further decisions in the matter, until the EPA seeks an independent
scientific analysis of the effects of gasoline containing up to 15 percent ethanol.
