This is a short list of some of the Fallen you may what to Remember at this time: 09 ABATE of Ohio, Inc. COB Corner Jim “SNAFU” Elgin May Is Motorcycle Awareness Month, I hope you were able to join us for the parade from the A.D. Farrow North Star Dealership in Sunbury, Ohio, to the State Capitol building in downtown Columbus, on May 4th for the reading of Governor Kasich’s Proclamation and the list of the rest of the Motorcycle Awareness Proclamations gathered by our members from all over the great state of Ohio. This was truly an event to behold. Great job everyone! Woody has done it again! State Representative Al Landis, offered an amendment to the State operating budget bill, and it is now legal to park 2 motorcycles in 1 non-metered parallel parking spot. If the parallel parking spot is metered, then you may park only one motorcycle in this spot, same as always; Uncle has got to get his ducats. Now, I must say Woody is on the job! We have respect and much support from elected officials in both houses here in the State capital, the likes of which I have not seen since Gary Sellers and Lee Ryan used to pound the pavement in and around the State Capitol Building. Read Woody’s Article so he can bring you up to speed on the rest of our legislative initiatives for the 130th General Assembly. I traveled to Swanton Ohio on April 11th, to the Fulton County Courthouse, and met up with Newsletter Director, Diane Thompson. We were there to observe the earplug trial of a brother rider. Ralph Buss and his legal team were representing the accused in Judge Colin J. McQuade’s courtroom. Dr. Eric Quahley from The Ohio State University, who is conducting research in the clinical practice of hearing enhancement, offered expert testimony. This is testimony we could use at the Ohio Statehouse when we endeavor to get the verbiage in Ohio Revised Code 4511.84 corrected so the statute would allow hearing protection, such as foam type earplugs for operators of any motor vehicle. We believe statute 4511.84 is unconstitutional as it is now written, because it prohibits any person operating a motor vehicle, other than a public service vehicle or highway department vehicle or machinery, from wearing hearing protection devices such as sound deadening foam earplugs. The United States Constitution gives every citizen the right to take steps to protect their personal health and we have proof that a full face helmet only amplifies the high pitched frequencies that cause permanent hearing loss; so, if you wear one of those suckers, you better have foam earplugs in your ears when you ride. This is one more reason why adults should have a choice to wear a crash helmet or not. United We Stand! I was planABATE ning on thanking all of Ohio, Inc. who attended the Awareness Rally Executive Director since this won’t make it to most Ed people’s mail boxes “Enjoyin’ the Ride” until after the rally. Schetter But, the news is coming in on the bombings at the end of the Boston Marathon and I’m having a hard time concentrating there is so much running through my head, but here we go. I want to thank all who showed up and helped kick off motorcycle awareness month by reminding drivers that we are back on the road, look for us and try to work on 'not running over us' into their busy schedule of texting while driving (I know its illegal but you still see it all the time). And extra big thanks to those who took the time to get a proclamation from their local municipality and help spread the awareness message. My thoughts and prayers go out to the people and their families affected by the cowardly act perpetrated in Boston. It is amazing that even after two bombs have gone off, Americans will still rush to the aid of those in need not knowing if there are more bombs planted. Not first responders, the police or fire personnel, simply Americans who care. That gives me a great since of pride. Those affected are innocent victims, people simply out enjoying what they love to do. I wonder how the government will overreact to this. Many of you have heard me say that the government has to speeds: slow and knee jerk reaction. I hope this doesn’t lead to yet one more knee jerk reaction act or law that takes away from our rights with the guise of protecting us. If any of you have questions on how this could happen, do a little research on the Patriot and even the Rico Acts. The media will try to keep us all preoccupied with stories about what they think happened or a professional who tries to explain why bad people do bad things (simple: they are bad people) instead of clearly and precisely giving us a straight forward non editorial version of the news. Don't keep us distracted with voyeuristic reality stories and make us concentrate on a few big, juicy, hot button issues while our rights are slowly eroded away. I have yet to see any big network coverage on the House discussing and approving CISPA (the Cyber Intelligence Sharing and Protecting Act.) This is designed to help protect us from cyber attacks by the sharing of data between private companies May 2013 ABATE of Ohio, Inc By-Laws Now Online! updated Feb 2013 ABATE of Ohio, Inc. Protection, but is it at the cost of personal privacy. I know it’s not directly related to motorcycling, but with the whole Intelligent Transportation System issue is in our future, and it could help start to establish the standard for the protection of, sharing of and use of our personal information between private companies and the government. After data is scanned what happens to it? Pretty scary stuff and might be worth a mention by the news media. Just another example of why I stand with my bothers and sisters of ABATE of Ohio ever vigilant. Once we loose rights, it can take a long time to get them back, if we ever get them back at all. On another note, I would like to take a minute to thank Diane Thompson, our Outspokin’ Editor. She has taken the time to put this great magazine together for the last few years. This is scheduled to be the last issue she assembles. I hope she will continue to help us until a proper replacement is found. Anyone interested in helping with the Outspokin’ in any way please contact the state office. Enjoying the Ride, Ed Schetter Proud Executive Director ABATE of Ohio Inc. OutSpokin’ 6 At this point in the legislative session our legislators are busy working on the operating budget for ABATE the year. Rep. Al of Ohio, Inc. Landis has submitted one of our issues to Government Relations be included in the Director budget. He has included clarification on Scott “Woody” Wood how motorcycles may be parked in parallel parking spaces. Last session the transportation budget allowed motorcycles to back into angled parking spaces. The current law makes no exceptions for motorcycles to park any differently than any other vehicle in a parallel space. Technically motorcycles are permitted to park parallel to the curb in a parallel spot, just like a car would. Rep. Landis has submitted verbiage that permits motorcycles to park perpendicular in a parallel space with either tire towards curb. It also permits more than one motorcycle to park in a non-metered parking space if space is available. We are also working on permitting non-audio hearing protection to be legal while operating a motor vehicle. Section 4511.84 of the Ohio Revised Code prohibits earphones or earplugs to be used by the operator of a motor vehicle. The law appears to be aimed at outlawing headphones for listening devices. There is no exception in the law for hearing protection. There was a case in Fulton County, Ohio last September of a motorcycle rider being ticketed for wearing foam ear plugs while operating a motorcycle. This offense carries a 2 point penalty on the driver’s license. The “offender” is a CDL holder so the 2 points is a very big deal to him or anyone else found guilty of protecting their hearing with ear plugs. Rep. Landis brought this issue up as a possible operations budget issue. There was some debate about including this issue for a couple of reasons. The first reason was that it was not specifically a “budget” issue. The second reason was that motorcyclists could protect their hearing by wearing a full face helmet with a face shield. The decision was to not in- May 2013 clude the ear plug in the budget because of the debates. In the Fulton County ear plug case no judgment has been decided. An expert from the EAR Hearing Protection Company offered testimony that even with a full-faced helmet; the noise level of wind was high enough to require hearing protection to protect the ears. The final ruling in Fulton County case could be critical in clarifying this issue. Rep. Green has submitted to Ohio’s law writing service (LSC) a bill to set up training for certified road guards in Ohio. We will work on this legislation, ear plugs, and increasing penalties for people who seriously injure or kill other motorists after the budget is complete. If you would like to discuss this in person with me, one on one, my email address is legislativedirector@abate.com. My phone is 937-987-2396. You could also attend an ABATE of Ohio, Inc. BOD meeting the second Saturday of the month. I will also be at June Jam this year. I usually end up around the fire discussing the issues with members. Come join in. I want to represent what the members of ABATE of Ohio want. I can only do that if I hear from you. Regards, Scott “Woody” Wood Government Relations Director ABATE of Ohio, Inc. OutSpokin’ 7 Hi Friends, ABATE of Ohio, Inc. Safety & Education Director Mike Stock Start with stats: 2013 Fatalities = 5 Crashes = 66 2012 Fatalities = 16 Crashes = 593 take Rt 424 to Napoleon, taking in the river dams and little parks along the way. Napoleon has several good restaurants. You can then travel on either side of the river to Grand Rapids, a quaint village with unique shops, restaurants, a historic canal boat and an old mill. Along the way there are many spots to stop and go for a walk or just view the river. After leaving Grand Rapids you travel to Waterville. At Otsego Park along the way you can rent canoes. Waterville also has a great downtown area with shops and restaurants. Continuing on you come to Maumee and then Perrysburg, both larger historical towns. Perrysburg is home to Fort Meigs where they have reenactments of battles during different times of the year. You can also go into Toledo along the river and visit the new casino or go to a Mud Hens game. For my safety tip of the month, I think everyone should go to a large parking lot (I do it early in the morning) and practice panic stops, slow riding and figure eights to get your handling down. Don’t forget to get your bike blessed. That always helps also. See you at June Jam! It’s always a good time. We are off to a good start! When this magazine comes out we will all be at the State Awareness Rally. This rally kicks off May as Motorcycle Awareness Month. Everyone needs to get their “Look Twice Save A Life” signs out of the garage and put them in your yard. If you don’t have one or if yours is in bad shape, get a new one. Also make sure the yellow “Look Out For Motorcycles” magnet is on the back of your car. I am headed to Region 5 on Sunday, 4/14, to talk to their Region meeting. I hope to see many ABATE members there. The more we talk about safety the safer we will be. Education is the way to spread awareness. Last month I talked about places to ride in Ohio. In my area of the state, Northwest Ohio, we are kind of flat but we still have some great Ride Within Your Limits, Mike riding areas. The Maumee River gives us some great scenery. Starting in Defiance, we May 2013 OutSpokin’ 8 the NCOM Silver Spoke Award for Government, SB 191 would fast track NDOT to up the speed limit to 85 mph some open stretches of freeways, matching some 85mph speed limits posted in Texas. FEDERAL BILL INTENDS TO STOP MOTORCYCLE CHECKPOINTS On April 15, Congressman Jim Sensenbrenner (R-WI) circulated a “Dear Colleague” letter to fellow members of Congress to garner sponsors for legislation he intends to introduce on May 6, 2013 “To stop motorcycle checkpoint funding.” “In the 112th Congress, I introduced H.R. 904, a bill to prohibit the Department of Transportation (DOT) from providing funds to state and local authorities for the purpose of creating motorcycle only checkpoints,” wrote Rep. Sensenbrenner to his peers. “Section 1 of the Stop Motorcycle Checkpoint Funding Act contains the same language as H.R. 904. However, this bill also contains language to force the DOT to focus motorcycle safety efforts on crash prevention programs, not national helmet mandates.” Under GRANT RESTRICTION, Section 2 reads; “The Secretary of Transportation may not provide a grant or any funds to a State, county, town, or township, Indian tribe, municipal or other local government to be used for any program to check helmet usage or create checkpoints for an operator of motorcycle or passenger on a motorcycle.” In addition, the new legislation amends Section 153 of Title 23 USC by removing “motorcycle helmets” from the title. “This change will prohibit the DOT from providing grants to a State to enforce helmet laws,” according to Sensenbrenner. “This will stop the DOT from manipulating State policies with federal money.” CONGRESSIONAL COMMITTEE APPROVES E15 PROHIBITION The U.S. House Committee on Science, Space and Technology approved H.R. 875 by a vote of 18-17 on April 11, which would revoke the Environmental Protection Agency’s approval of E15 alcohol-laden gasoline for sale to the public. U.S. Representative Jim Sensenbrenner (R-WI) introduced H.R. 875 on February 28, which would require the federal EPA to stop the use of gasoline containing 15% ethanol (E15) until its harmful effects are investigated further. NEVADA CONSIDERS LANE-SPLITTING, FASTER SPEED LIMITS The Silver State may soon adopt the Golden State’s rule on lane sharing, as AB 236 has passed Assembly Committee on Transportation with only two committee members opposing the measure to allow motorcyclists to filter between lanes of slowmoving traffic. California is currently the only U.S. state that allows the practice, though “lane filtering” is commonplace throughout many other parts of the world. Committee Chair and bill co-sponsor Richard Carrillo (D-Clark Co), a long-time rider, laid out one of the best reasons to split lanes -avoiding a rear end collision -- saying “at the end of the day, I want to know that I’m going to come home and not be a part of the pavement or the back of somebody’s truck or car. To me, this really resonates.” Next step – the bill goes before the full Assembly and the Senate. In the meantime, the Nevada State Legislature may raise the maximum speed limit from 75 mph to 85 mph has passed the State Senate 15-6 on April 3 and the measure now goes over to the State Assembly for consideration. Introduced by Senator Don Gustavson (R-Sparks), a longtime advocate of bikers’ rights who was awarded May 2013 MOTORCYCLE CLUB PUBLICATIONS BARRED BEHIND BARS Last month we reported that the NCOM Brothers Behind Bars monthly newsletter was being banned from prisons in Australia, but now word comes from one of our own New England states that biker-related printed materials are being systematically rejected. Referring to a note received from a Connecticut inmate, The Aging Rebel quoted on his website www.agingrebel.com; “Here at our prison, last year they began to bar books about or by motorcycle club members. This includes the book “The Aging Rebel: Dispatches From The Motorcycle Outlaw Frontier” by Donald Charles Davis. These books are purely being banned because their subject matter includes motorcycle clubs. They use the ‘catch-all’ ‘promotes criminal activity’ while still allowing books on the Mafia, murder, kidnapping and corruption of government officials, all of which apparently promote NO criminal activity.” Some people may be surprised to learn that among the other rights prisoners forfeit is the right to read what they want, but as TAR expresses; “The high court began to back track in 1987, in a decision called Turner v. Salley. After that case, the First Amendment right to read could be ‘reasonably regulated’ if prison officials asserted a ‘legitimate neutral interest’ and the Supreme Court ruling established something called the “Turner Test". In a letter from the Connecticut Dept of Correction, the Media Review Board determined that “The aforementioned publication was originally rejected in its entirety on November 9, 2012 under Section 6: It encourages or instructs in the commission of criminal activity. This publication was thoroughly reviewed and is determined to have met the criteria for rejection. The publication will not be allowed inside a correctional facility.” WEIRD NEWS: ILLEGAL ALIEN RULED INCOMPETENT FOR TRIAL An illegal alien in Massachusetts who was drunk driving when he hit and dragged a Mass. motorcyclist to his death has been ruled incompetent to stand trial. Insane? No. Mentally handicapped? Nope… “Unique cultural background”? YES! Despite numerous previous run-ins with the law, Judge Janet Kinton -Walker ruled that Nicolas Guaman’s “unique cultural background” prohibits him from understanding the U.S. legal process. The judge also ruled that Guaman lacks the ability to effectively consult with his attorney, according to FOX 25 in Boston that broke the story. Defense attorneys across the nation will undoubtedly be watching this case very closely, and if Guaman somehow avoids justice you can count on this defense coming to a courthouse near you – “¿me entiendes?” MORE WEIRDNESS: SMART APPS What do Lady Antebellum, Harley-Davidson motorcycles, the beauty store Sephora and the Facebook page "I Love Being a Mom’ all have in common? Well, researchers at the University of Cambridge are claiming that “liking” those things on Facebook may be a sign of a low IQ. According to www.radio.com, researchers in the U.K. took a close look at 58,000 Facebook users between 2007 and 2012, and correlated their “likes” with the strength of their IQ’s. If you’re wondering what “likes” translated to a high IQ, the items include curly fries and thunderstorms, so this is one study nobody is taking too seriously. Carolyn Maloney (D-N.Y.) introduced H.R. 1187, the National Rockies Ecosystem Protection Act (NREPA). This legislation, previously introduced in 2010, would inappropriately designate 23 million acres of land in Idaho, Montana, Oregon, Washington and Wyoming as Wilderness. This Wilderness designation will make the land off-limits to offhighway vehicle riders. The bill’s current sponsor and cosponsors don’t represent the affected areas. In fact, the bill’s sponsor represents residents of New York City. We need your help to stop H.R. 1187 in its tracks. A prewritten e-mail is available for you to send to your representative immediately by following the "Take Action" option and entering your information. We must remain vigilant. If this bill is signed into law, the effect on the OHV community would be devastating. Please contact your representative right away and urge him or her to oppose H.R. 1187. state elected officials and Congress before any proclamations were made pursuant to the Antiquities Act. The designation of a National Monument is significant for recreational opportunities and local economies. While there are cultural and historical landmarks that deserve the designation of National Monument, the AMA believes Congress and the public must be consulted before any action is taken. The AMA urges its members to contact their federal elected officials and request that they oppose further administration attempts to unilaterally designate National Monuments. Send a letter to your senators today by following the “Take Action” option. Urge them to support S. 104, a bill introduced by U.S. Sen. David Vitter (R-La.), which would amend the Antiquities Act of 1904 to require future National Monuments to receive congressional approval before designation. Please join the AMA to help us fight these efforts to restrict responsible motorized recreation. More members means more clout against our opponents, and your support will help the AMA fight for your rights – on the road, trail, racetrack, and in the halls of government. American Motorcyclist Association honors U.S. lawmakers The American Motorcyclist Association, which is the premier advocate for motorcyclists' freedoms in the country, honored 59 current and former federal lawmakers on Feb. 28 for their support of motorcyclists during the just-completed 112th Congress. Sen. Amy Klobuchar (D-Minn.), Rep. James Sensenbrenner (R-Wis.) and former Reps. Roscoe Bartlett (R-Md.) and Denny Rehberg (R-Mont.) topped the list of those honored. They were singled out for AMA Government Relations Department "Hero" awards for their extraordinary efforts to support motorcyclists and motorcycling. They were particularly praised for their successful efforts to save the Recreational Trails Program from extinction, as well as to exempt kids' dirt bikes and all-terrain vehicles from the Consumer Product Safety Improvement Act, which had banned the sale of those vehicles. They were also honored for efforts to end discriminatory motorcycle-only checkpoints, for trying to help forge a compromise between the military and off-highway riders over the use of the popular Johnson Valley riding area in California, and for trying to help protect motorcyclists from the possible negative effects of the new E15 fuel. A woman driver pulled out in front of me from a stop sign and claims she did not see me. I had the right of way and was not speeding. I applied the brakes but still hit her. Sad to say, but I said some mean things to her at the scene as I was in pain and could not believe she did what she did. Now her insurance company is trying to turn my bad language against me and even has the officer testifying against me as to the cause of the accident. My case should be a simple one in that she is the one at fault and now I feel like they are putting me on trial unfairly. Can they do this? And do I need a lawyer? ABATE OF INDIANA MEMBER. (case now concluded and information released) A. A police officer’s testimony as to the expert cause of a crash will be admitted during a trial only when the officer has been qualified as an expert having sufficient knowledge, education and training to express such an opinion, as not all police officers have such expertise. Unless speed or braking is an issue, your case normally would not need an accident reconstruction expert. She failed to yield to your right of way - case should be over. Of course the officer may testify as to what he saw and heard (if relevant and material), but it is up to the trier of fact (usually a jury) to decide the cause of a crash, unless expert testimony is needed. Issues such as speed, braking, coefficients of friction are the areas in which motorcycle experts testify, but it does not appear that the adverse is raising any issue as to speed or braking. Always be mindful that the investigating officer might be able to testify as to statements made by you and witnesses to the crash. These statements could include any names that you thought were appropriate to call the little old lady with blue hair when she missed the stop sign while talking on her cell phone. Of course, some jurors might understand that opportunity to express yourself in the heat of injury and severe pain, then some might not. If this ever happens again, help me - help you, by muffling yourself at the scene. As Sergeant Barnes of the Viet Nam movie “Platoon” said, “Take the pain”. And yes, you need a lawyer. Q: Our chapter is going to sponsor a function in the near future, and we plan on letting the bar hosting the event sell beer. What do we need to do to protect us from liability in case someone has too much to drink and someone gets hurt? ABATE OF ILLINOIS MEMBER. A: Waivers are a must with those attending the function. Take a look at the latest version posted on our web site. If the event is held at a bar and ABATE does not serve the alcohol, ABATE should have no responsibility. The key is that ABATE should not have anything to do with alcohol if we want to avoid that potential liability. We need to make every effort to make sure this responsibility stays with entities that are properly trained, licensed and insured. In most instances, ABATE can be named as an additional named insured on the bar's or provider's liability insurance policy. Ride Safe and thanks for all you do for ABATE. Places to Ride Before You Die - After a Run to the Wall and Ground Zero Besides the above, there are at least two memorials in this great land that I never tire of looking at when I ride around the country. The first is the Statue of Liberty. If you are crazy enough to ride/drive through Manhattan down to the tip (Battery Park), the view and feeling is wondrous, not least for having survived all the yellow cabs on the way down Broadway. It seems that when I am there I can't get enough of looking at the lady. Over on the New Jersey side of her is an RV park - fittingly named Liberty Park. It is just asphalt, but as they say location - location - location. Before it’s over, I am riding over there and setting up camp with a front row seat; getting out my jug and looking at Lady Liberty until my heart’s content. And I am not sure how long that will take. The other memorial that I never tire of seeing is the Iwo Jima Memorial in Washington D.C. Once, when I was there on a “Run to the Wall,” and while staring up at the memorial it occurred to me that I knew hardly anything about those men – actually boys – that served our country so well. Since then, I have looked into what these boys were all about and where they came from. I read the Ambose book that says it all about them. Where did they live and what part of the country grew such great human beings? Here is what I discovered: Harlan Block is the guy closest to the end of the flag pole. He was from around Yorktown, Texas, hill country and not far from the Alamo, Austin, Fredericksburg area. (Admiral ChesSPEAKING OF DISTRACTED DRIVERS ter Nimitz hails from there, and Audie Murphy, the most decorated solDrivers eating french fries, fooling with the radio, yelling at the kids and dier in WWII, was also raised nearby.) Beautiful riding country and it is TALKING ON CELL PHONES killed over 3000 people in 2012. The apparent that heroes are plentiful there. Texan Harlan, a teenager, died numbers say that if you are going to get killed in a traffic accident, 20% with his intestines blown away at the base of Mount Suribachi. He had of the time it will be by a distracted driver. I do not have the stats for been a football star in high school and probably would have gone on to motorcycles only. The guy next to Harlan is Rene Gagnon, a Frenchy from New Hampshire NOTE: Our office requests the cell phone records of the adverse driver in (I will never say anything bad about the French again). He was 18. After cases where that is an issue, and we have learned that in many cases the the war he returned home and promised himself he would live the best driver was on the cell phone at the time of the crash. Some companies prohibit the use of cellphones while driving on company business and this quiet life a person can – and he did. Beside him is Mike Strank, a should always be the case with vehicles in high traffic areas. To put his role with these teenagers in perspective, he told his May 2013 OutSpokin’ 15 MEETING OF THE MINDS 2013 – 5 MONTHS TO GO! (Continued - Ask Our Lawyer) boys “Do what I say and I will get you home to your mothers” mothers? Although, Mike was killed by a mortar while planning an assault, he got three of his boys back to their mothers. The guy behind Mike is Ira Hays from the Pima Indian Reservation in Arizona. He had never been off the reservation until he joined the Marines. While he survived Iwo Jima, many believe that he died drinking - trying to remember his comrades and trying to forget. Across from Harlan on the other side of the memorial is Franklin Sousley, a good ole boy from Hilltop, Kentucky – my kind of guy. A mortar got him shortly after the famous photo was taken. He was raised by a single mom, so you can imagine how close they were in life. Their nearest neighbors were a quarter of a mile away. When the telegram came, they could hear Franklin's mom into the night and next day. She couldn't bear the thought of Franklin being buried so far away in Arlington so he is buried down the road in Elizaville Cemetery. When you are on the way to Bike Week in Daytona, Hilltop Ky. is off exit 154, just south of Cincy. If you have time you should stop and say "hey." Franklin http://en.wikipedia.org/wiki/ never got the Marine_Corps_War_Memorial chance to really drink beer, so a can left there would be just fine. I think he would like that. The last guy is John Bradley from Antigo, Wisconsin, not far from where Hard Tail, our great leader of the MRF, is from - also the land of cranberries. Been through there - good riding country. Bradley survived and raised 8 kids. He only talked about Iwo Jima one time and that was to say the real heroes did not come back. He was a medical corpsman, so you can only imagine what he saw. You might want to clip this article for when you visit the Iwo Jima Memorial next. Makes me feel better when I look at the monument to know something about those boys that died so young. And I think they would appreciate the effort. Where there’s a way, there’s a will Q: Hello, my husband is a member of ABATE. We are wanting to get a simple will. Goodie bags: I received 500 plastic bags from the state of Ohio, so we have that taken care of, now we need ‘goodies’ to fill them, if you know of any company that would donate items for this please contact them or let me know and I will. We are looking for bike wash / windshield cleaner, glasses cleaner and trial size items to put in the bags and also pens, flashlights or other items that companies might be giving away. Center Pieces: I purchased the vases, Kathy Gantner is working on a stencil to etch the vases, JR Gantner is working on a base to hold the vases, once we have all the parts we will be having a build the center pieces party, this should happen sometime in August, so stay tuned for a specific date. It looks like one of our biggest expenses for the MOTM 2013 will be food and refreshments for the hospitality suite. OutSpokin’ - Will Rogers 16 because as passionate riders we want to fight every battle, and hate to give up. The reality is that sometimes the political risk, amount of time and energy, and even the actual monetary cost are sometimes just not justified. We are dealing with a particularity delicate balancing act in the motorized recreation arena right now. Over a year ago we received a pledge from ODNR administration to work with OMTA and OSSA on legislation to create a grant system for accessing the SRV fund. For those that don't know, the SRV Fund, or "State Recreational Vehicle Fund", is a lot like the Motorcycle Safety & Education Fund. Whenever someone purchases a dirt bike, ATV, or snowmobile registration the majority of the money is deposited into the SRV Fund, for the sole purpose of maintaining and expanding trail. It's a big fat fund full of OUR money, with no mechanism for accessing it for non-ODNR projects. Unfortunately it seems that each time we raise the issue we get a reversal of their stance. One month it's "yes we are with you" the next it's "we're not sure this is necessary". Now we are 3 months into this General Assembly of the Ohio Legislature, and have 21 months left. Obviously if ODNR worked with us on this effort it would be much easier to get the job done, but we can't continue to let time slip away. If they actively oppose the bill it will be extremely difficult to get it passed. We need to push forward, and we do have legislators who support the goal. We do need to be truthful about ODNR not supporting the effort, but if we are too vocal it can rub people the wrong way, and we can have a tougher fight on our hands. So how hard can we push before it causes them to push back more? One more balancing act to work on. Matthew Mesarchik Government Relations Director, Ohio Motorized Trails Association Balance. United we ride. In motorcycling it's an important part of our vocabulary. New riders need to learn to balance a bike with confidence at stops, there is endless debate on the best way to balance a tire, and when balance is lacking it can make for a scary ride. Balance is also important in the political arena. For those of us on the front lines of motorcycle issues we are always maintaining a balance between standing up for the riders, and not pushing an issue too far, and this has got to be the toughest balancing act in motorcycling. Sometimes this can be about how to craft language for legislation, or knowing when to not fight a battle that is a lost cause. Those are the ones we hate the most, Matthew T. She fired up on the second kick after a little shot of ether (something ya shouldn’t do too often) and just leaned there on her kick-stand chugging away like a freight-train waiting to break out of the station. I was smiling like a proud new daddy as my wife ran to get a camera, and as soon as we got a few pics of our new baby girl we mounted up and went on that very first ride. I can still remember the firm, hearty “feeling” of the bike; the solid “ker-chunk” of the shifter compared to what I had been riding (they just sorta “clicked” into gear); and that steadfast, throaty, rumble beneath us. For the next few years I rode that Sporty everywhere I went, especially to work each day (when it wasn’t snowing), a 75 mile round trip, mostly because I couldn’t afford to have a bike as a “toy” back then.....but also because the bike got way better mileage than that big old gas-guzzling LTD Brougham I was driving. In contrast to what they build now, a ’73 Ford LTD was HUGE! And since we only had the one car, my wife could putt around our little town in it for groceries and such, but me driving the Ford all the way to work and back twelve months out of the year would have been way too expensive. We were really “nickel and diming it” as we fixed up that old house. The old adage that, “Chrome don’t get ya home” wasn’t true with that bike. Okay, moving on.... most freak-out (in a good way) from all the intense sensory data Is it just me, or does it seem to y’all that these days EVERYyour body accumulates as you speed along, since spring blosBODY either rides, has ridden, or at least closely knows someone soms to its fullest in May as it gets ready to ripen into summer. I can connect so many great memories directly to the month of who rides motorcycles, and rides them often? I mean, bikes are May. For instance: I recall a sunny May afternoon back in the mid- everywhere! On television there might as well be a motorcycle network with 70’s when I rolled out, for the first time, my 1972 XLCH Sportster all the outlaw-club documentaries, biker-bar reality shows, tattoo/ (after rebuilding the top-end). She was my first Harley. When I had purchased her a few months earlier, she wore an body-art series, and chopper-building competition programs. You frequently see piles of ‘em parked at most bars, whereas in the insane paint job and didn’t even run. She had a blown headold days if ya saw just a few scoots parked in front of a tavern gasket, the rockers were way out of adjustment, and two of her very often, ya thought it must be a “biker” hang-out. The phrase push-rods were bent. She also had a few broken cylinder fins, a shot base gasket on the front jug, AND the timing was way off as “biker-bar” that was first coined in the 1960’s and 70’s, now applies to ALL of ‘em. Even high-class yuppie establishments often a result of somebody attempting to ride her home from the accihave scoots hanging from the damned ceilings! dent that broke the fins and had also caused the oil to dump out Many workplaces have separate “bike-parking only” areas onto the road from a busted oil-line, which in turn caused everynow. There are even clothing stores that specialize in just thing else I mentioned to get really messed up. Now, months “Motorcycle Apparel”. Plenty of taverns regularly have “Bike Nites” later, patched up and freshly repainted, she was ready to make each week. There are biker DJ’s. Just about every hard-rock band me some memories. She became my “Hot Rod”. has at least one member who is a “Biker”. And there have been When I rolled her up and out of the cellar of the old farmso many bike-oriented songs written, that those bands could play house I lived in at the time, she literally sparkled in the sunlight. I ‘em all night long. bet the only thing that the previous owner knew to do properly, Scores of books have been written about motorcycling and the was how to pay someone else to take off and send out most of people who are in this lifestyle (ahem). But back when I was the iron to be chromed. I don’t think the guy even owned any younger, there were only a few. In fact, “Zen and the Art of Motorwrenches. And you should have seen that horribly beautiful and cycle Maintenance” by Robert M. Pirsig, and “Hell’s Angels” by expensive “custom” paint job the jerk had someone air-brush on her. It was so x-rated (and not even in a sexual way) that I could- Hunter S. Thompson are the only ones that I can even recall from n’t even describe it in this magazine (if ya ever see me in person, back then. As I’ve also pointed out before, there was a time when if I’d ask me about it). But man she sure was pretty that day, with all that chrome and May 2013 OutSpokin’ 24 hear a bike coming down my road, I’d actually expect it to be somebody I knew coming to see me! And I could usually recognize that person from the way the bike sounded from a distance. Now, just about every bike has a similarly loud and throaty rumble. But am I complaining about any of this? Hell no! It’s just sorta weird to be so damned “normal”! To be completely honest, I kinda miss people looking at me funny when I walk into a room. I guess my point is: What with all these fellow bikers on the road these days, we should have many, MANY more members in ABATE, our organization...THE organization, for all bikers (a statement that has been made over and over again). So help yourselves (and them) out here a little people and sign some of ‘em up. Don’t forget that May is also Motorcycle Awareness Month here in Ohio. Y’all can use that fact as a reason to help promote our “cause” to politicians, news-people and to the public in general. The very best public relations we can possibly have are that which you, the individual members, initiate. It’s the enthusiasm YOU generate that would make others want to join and support our organization, which in turn promotes and defends all motorcycling in general. And in case you’ve been wondering as you’ve read this: Don’t worry, I won’t blab on about “Public Relations” any more than I always have in this column now that I’m one of the state public relations officers LOL. I always have been, and we should ALL constantly be, promoting public relations for ABATE. And speaking of May, this month is when most of us finish deciding which major runs and events we plan on attending during the riding season. This is especially true for vendors of any kind (parts, food, tats, a band, etc.) Remember this fact if your county or region is planning to put something on. The earlier you lock these people in for your events, the better. In fact, vendors should have been at least contacted already. Also, promoting any event is best if it’s begun ASAP. Generally speaking, flyers should be out about two months in advance of the date, any earlier and people will forget about it when the time comes because if they see a flyer hanging on their refrigerator (or on the wall of their favorite bar) repeatedly, it becomes invisible. And make sure you print up and distribute as many of those flyers as ya can. By the way and speaking of flyers (of course this isn’t one, but...) if you’ll remember, last year I had a free (but BYOB) ABATE appreciation blow-out here at my home on July 28th and invited y’all. About fifty GOOD people showed up throughout the day and night from across the state and locally, to swim, hot-tub, sit around a fire, dance on the brass pole and party in my bar, May 2013 which was a good number for this facility. Some pitched tents, and a few others just crashed on the floor or went home. The choice was up to them (of course), but I always urge my guests to spend the night if partying much (we can throw together one helluva breakfast!) Anyway, I’ll be doing that this year again. And when I lock down the date in the next month or so...I’ll let ya know the particulars. My place is VERY easy to find. Keep the shiny side up folks. I’ll be yappin’ at ya next month, OutSpokin’ Bummer 25 0512 Only $16.67/mo. With 12 month Purchase See Page 36 for details! Bummer Website: http://regionzero.abate.com REGION ONE Region Zero Columbiana County Stark County Summit County Trumbull/Mahoning Counties At our regional meeting on March 10th, most of the talk was primarily about upcoming events and Columbiana County’s successful Daytona Party held the night before. Unfortunately, Sam Sarconi will be stepping down as their coordinator (though he pledges to remain available as a contact person). The March 16th Mah/Trum County meeting held at the Dash Inn in Youngstown pulled in about 35 people, eight of whom were from Mahoning County (and most of whom hadn’t been to a meeting for a long while), and we signed up a few more. Representative Ron Gerberry was the guest speaker. The Dash turned out to be a great place for a meeting, and the food was excellent. The next day (the 17th), the Yankee Lake Ballroom had their spring swap, and Bob from Unique Biker Apparel (who puts it on) graciously let us have a spot. A very supportive member named Brandy (Dakota) manned it with me, thankfully with a few members “spelling” us for smoke-breaks. Quite a few of our outdated T-shirts were sold, and lotsa ABATE was spread around, including a few new sign ups. Since that location is so close to the Pa/Ohio border, many Pennsylvania ABATE brothers and sisters stopped by to chat. Bob said that Yankee’s Bike Nite will begin the first Wednesday after Memorial Day, and like always, we’re invited to be there each week to recruit, sell products, or whatever we want to do. I usually get there about 6 PM with at least flyers and applications. Speaking of Bike Nites; Tuesdays I plan on having ABATE info at the Ice House in Austintown like I’ve been doing for the past few years. Like I said, Wednesdays I’ll be at Yankee Lake and thanks to Fast Freddie from 93.3 “The Wolf”, Quaker Steak & Lube (also in Austintown) agreed to let us have a free spot there on Thursdays. Saturdays we’ll probably be at Clancy’s on the Strip (422) in Warren (their Bike Nite will be managed by Dakota). By then I’m sure a few Bike Nites for the other days of the week will pop up, and we’ll see what we can fit into our schedule. Like I keep saying, these things are absolutely FREE (unless ya buy something LOL), they’re usually from 6 to 9 PM, and they’re just a short putt from your home throughout the week. And most of them have food and drink specials...sometimes even a few vendors. I know most of you have been riding already and there are some that already need an oil change, but for some its time. So I hope all is well with everyone and look forward to seeing you all. I've been cooped up in the house for so long and just can't stand it, but it's time to get fired up for May Awareness month. So if you would like to tag along, get a hold of our Deputy Director Paul Rayl @ 417-737-1314 and ride along and enjoy the day and take a stand for your rights as motorcyclist of the open road. The run starts out at Frank's Bar & Grill in Bloomingdale, Ohio on old Route 22. Sign-ups start at 10 am and first bike out at noon and last bike in at 5pm. There are auction items, raffle, and various prizes. We also have a Dave Barnhouse print that is framed and signed that will be auctioned, not many of these prints left, so come out and take a chance, you don't want to miss it. There will be breakfast available for those that want to eat before the run. The run will end at the Hopedale American Legion where there will be food provided and beverages available. Let's make this a record year for attendance; this is our run for our motorcycling freedoms and also to let people know that motorcycles are on the road. Those freedoms that you all enjoy every day are exactly what we will be riding for on May 18 or June 1 (Rain Date). So come one and come all.....
