Barring further legal road blocks, both Air Canada and Luft hansa Airlines may be fighting a class action lawsuit over the description of fuel surcharges on their tickets. It is based on the actions of one consumer who contends that the airline’s ticket terminology is misleading and false. The burgeoning class action lawsuit argues that the fuel surcharges that are added to air-fares were termed as taxes on the tickets, implying that they were being collected for another party – for example, a government office. But this is not the case, as pointed out by in the original complaint by Air Canada passenger 10 cover story Bulent Unlu, who filed 11 on tour a claim for compen12 middle east sation through the Business Practices and 13 classifieds Consumer Protection Act (BPCPA). He is seeking a refund of the $340.40 he paid as a fuel surcharge on an airfare of $870.20, and his argument is based on the fact that the fuel fee was represented as a tax. Since the fuel fee was collected and retained for use by the airline itself, the carrier has misrepresented the fuel surcharge as a tax payable to third party collectors, says Poyner Baxter, the North Vancouver law firm that has taken on the case. The implications for the airlines are huge if Unlu is proven right. Poyner Baxter has broadened the scope of the complaint to include other allegedly misrepresented fuel surcharges, not just at Air Canada/Luft hansa. Proposed class actions have thus commenced against British Air- Karen Stephenson (l) of the Grenada Tourist Board was one of many suppliers on hand at Transat’s Sun Academy road show event in Toronto last week. Myles is one of three who last year started GiveGetGo, which combines volunteer experiences abroad with travel, and insists that type of travel is rewarding for both the vacationers and those in the communities where the holidaymakers lend a helping hand. “Our volunteers become part of a team of fellow travellers and local community builders that create a rich experience filled with laughter and unforgettable friendships,” says Myles, whose company now sends tourists to Tanzania and Guatemala. “Many of our volunteers have life-changing experiences on these trips that is felt and shared by the whole group. “Volunteers gain a first-hand understanding of the people, culture and geography of the areas in which they build and get a sense of living a different way of life.” But Myles says Mississauga-based GiveGetGo isn’t a “voluntourism” organization. “We are committed to creating a positive and sustainable impact on the countries and communities we work within,” she maintains. “Our focus is to build with projects that focus on education, health and orphanages. In all projects, the volunteers will have no doubt as to the substantial contribution and positive impact they have made. Our projects are long term, allowing the volunteer to maintain a connection.” GiveGetGo has been sending clients to the rural Tanzanian community of Majengo, where they’ve been building living quarters at an orphanage and plans call for future groups to help build more accommodations, along with a soccer field and playground, library and a computer room. The other current destination is Chimaltenango, Guatemala, where GiveGetGo clients have been helping add classrooms to Melody School, which provides schooling to poor youngsters from the community. “The impact of the school on the community is evident, as Melody School’s children can read and write by age six – an incredible feat considering that only slightly more than 50% of the Guatemalan population is literate,” GiveGetGo says. “Each partner works at their own skill and fitness level,” Myles adds. “From framing, hammering, wall building to sweeping and keeping the job safe. In situations where 10 TRAVEL COURIER 0829PAGE09-10.indd 10 At the Majengo Orphanage in Tanzania skilled labour is employed, the tasks we perform are often less skilled, as we never want to take jobs away from the local community.” Myles says that accommodations used by GiveGetGo clients during the volunteer portion of a trip are “of a simpler style” than the rest of the journey, with the company shooting for “midscale” and making sure that “safety, cleanliness and comfort are always paramount. “The R&R accommodations are always good to excellent, as we design this portion as the reward for giving back, while in the volunteer stage,” she adds. Tanzania itineraries include a visit to a game reserve, a Ngorongoro Crater safari, a stay at a luxury Rift Valley photography lodge and time at the beach resort of Zanzibar. Once the volunteer aspect is completed in Guatemala, participants on the 10-day trip explore the colonial city of Antigua and climb, hike or bike in the surrounding mountains and volcanoes. GiveGetGo plans to begin sending groups to India, where they will help renovate a primary health centre near New Delhi. Departures are expected to begin in early 2014. Departures for Tanzania and Guatemala are available this year and next, and each will have space for 12 to 14 participants.
