The Foundation Board of
Directors and the Elections
Committee encourage qualified members to run for
the three seats, the terms for
which expire in March,
2008. Board members are
elected for three-year
terms. If you don’t want
to serve yourself but know
someone who is qualified,
please encourage that
person to run.
Director qualifications
The Pelican Bay governing
documents state that a
Director shall be a Member, must be at least 21
years of age, and must
not have been convicted of
any felony by any court of
record and not have had
his or her rights restored
pursuant to law in the
jurisdiction of his or her
residence. Also, a member
who is an employee of the
Foundation is not eligible.
Each Board Director,
other than the Board Chair,
is asked to chair a standing committee. Committee
assignments are determined
following the Annual Meeting, which is scheduled for
Monday, March 31, 2008.
The Foundation conducts
11 Board meetings annually, with no meeting
during the month of July.
Historically the Board has
been comprised of both fulltime and seasonal residents.

During the first week
in October the Strategic
Master Planning Team
arrived in Pelican Bay to
initiate the first of several
community based meetings
related to the seven-step
team’s baseline understanding of Pelican Bay.
The committee work sessions included the following
participants: strategic planning committee; facilities
committee; members of the
master plan process. The
team conducted project
kick-off meetings, site
visits, data collection and
met with the Pelican Bay
Foundation strategic planning committee and standing committees to review
the scope of services related
to the project. During the
visit the team began
gathering background data
needed for the development of the project. Initial
question and answer work
sessions were held with
the various committees
to further develop the
Pelican Bay Services Division (attended in an
informal capacity); Community Center Committee;
beach-titness advisory
group;
tennis-outdoor
advisory group; auditbudget committee; restaurant committee; and
beach-boardwalk-berm
advisory group.

were reviewed by the team
and organized into the

need to be determined
through the strategic master
plan process in order to

The definition of measure,
or actions, shall be determined over the course of
the project study through
the various community
input sessions that will
be conducted in the coming
months by the consulting team.
As with any large-scale
community, there are often
a variety of perspective
viewpoints that must be
considered to fully understand the matter at hand.
As such, the consulting
team has compiled the
following diverging perceptions from committee members (in random order):
• Pelican Bay is not the
exclusive community it
once was.
• The community needs
to enhance its existing
facilities to remain competitive in the market place.
• Communications within Pelican Bay are adequate.
Residents need to take
a more proactive role in
their community.
• Pelican Bay is a retirement community that
may not support the lifestyle of a family oriented
population in the future.
• Today’s planning efforts
need to consider future
redevelopment of single
family developments and
higher rates of density
within these areas of
Pelican Bay.
• Some members of the
community do not want to
be compared or benchmarked with other communities, but rather would
be considered unique.
As a result of the work
session, the consulting team
realized that the strategic
master planning effort
must focus on building
consensus among the many
voices of Pelican Bay. A
communications strategy
has been implemented to
further this objective.
Consensus building will be
based upon community
involvement in order to
be effective.
The communications
strategy will include regular
articles in the Pelican Bay
Post for the duration of the

A series of one-on-one
interviews with representative community leaders was completed by
B.G.Clark during the early
part of November. At the
same time the team is
working to identify focus
group sessions and participants so that we may
further our qualitative
understanding of community needs in Pelican
Bay. This information is
then compiled into the
Community Values Model.
The model is adapted from
the Balanced Scorecard
concept developed by
Harvard Professors for the
private sector. Those values
identified for Pelican Bay
set the framework for
strategic objectives to create
a comprehensive, balanced
plan. The sessions will be
conducted in early January

Following the completion
of the focus groups, the
Team will administer a
random sample survey to
the residents of Pelican Bay.
The purpose of the survey is
to provide the team with
measurable quantitative
data that will be included
in the development Community Values Model. The
survey is a quantitative
mechanism for validating
the values identified during
the earlier stages of the
community input process.
Community Outlook — lecture series
The Pelican Bay Foundation, in partnership with the Greater Naples Chamber of Commerce,
will present a series of four Lectures for the enjoyment of Pelican Bay residents.
A wine and cheese gathering will take place at the Community Center at 5:30pm
and the guest speakers of the evening will begin at 6pm.

New rules concerning after-hours
and weekend meeting room use, food
and beverage, and guest participation in
regular activities were recently passed
at the October Board of Directors
meeting. To see the changes, go to
www.pelicanbay.org. Revised rules are
also available at the Community Center
front desk.
Recycling will be in place this month
at the Community Center and both
tennis centers with highly visible recycle containers located in key public areas.
We will now have a truly green practice in place that will finally deal with recyclables,
which even includes the ever-abundant tennis ball can.
Holiday hours
The Front Desk will be closed Christmas Day and New Year’s Day. The fitness and
tennis centers will close at 1pm.

Work in the Massage and
Aesthetics Studio (M.A.S.) began
November 1 at the site of the old
tennis pro shop. Completion is
expected by the end of January.
During the planning of the
Community Center the old pro
shop was kept intact due to the
importance of tennis restrooms
and a maintenance garage
within the structure. The old pro
shop interior served as a storage
room for the first two seasons.
Upon opening the Community
Center two issues arose: The first was the current location of the massage rooms (in
the locker rooms) resulted in a sub-standard experience due to the small space,
heavy traffic, and sound
transmission. The second
problem was access into
the locker rooms, which
related to door clearance.
With the M.A.S underway,
the second phase of the
project — conversion of the
locker room doors to a
doorless/switchback entry
— has been postponed until
June. Watch closely in
upcoming issues of the
Post for progress reports.

Mentor” clinic the second

or sessions, especially in

receive comes through the
workout, your classmates
and your instructor/trainer.
Our beach fitness classes
offer some of the most
spectacular views Southwest Florida has to offer.
Our trainers make working
out fun by encouraging you
to workout within your
limits safely and effectively.
Making new friends, enjoying the nature on the beach,
listening to music, rejuvenating your body and
soul are all fun things you
can benefit from. Whatever
your interests, from outdoor
activities to indoor, we are

Zumba Kids is based on the
same elements as an adult
Zumba class. Don’t under
estimate kids when it comes
to their “zumbabilities” —

take the kids through a
warm up of free-style
dancing to get their bodies
moving, then they move
from song to song treating each routine like a

Piyo
Piyo is a hybrid class combining both Pilates and
Yoga together in one class.
This is an excellent class
for those looking to make
your core stronger and gain
some flexibility as well. The
class is for all levels and
great for golfers and tennis
players alike. This class
started in November and
takes place on Wednesdays at 9am. For more information contact the

evening of fun
Chinese New Year is a time
of reunion and thanksgiving.
It is celebrated to express
thanks for the coming together of a great community.
What better way to celebrate our community paradise of Pelican Bay than
coming together with all of our
friends for an evening of fun.
We will be entertained
with songs from Night Storm (Gayle and Michael) while
dancing the night away.
Our committee has selected a menu with an oriental flare
and chef Chas as offered delightful suggestions to ensure
a wonderful evening accompanied by great food. Hors
d’oeuvres such as coconut shrimp with mango glaze, vegetable spring rolls with orange ginger sauce, and chicken
satay, followed by a green salad and entrees of grilled
orange ginger chicken presented with grilled vegetables
and grilled salmon with oriental glaze, rice
and dessert/coffee.

Beach gourmet
It was a rainy, dark and
spooky night. Creatures
were afoot, and strange
noises were heard on the
berm...However, as the
trams arrived at the beach,
our Members weren’t
scared. They were ready to

and Mrs. Ketchup attended,
along with the absolutely
divine Miss Minnie Mouse;
Mr. Ukulele came and
brought his entourage of
hula girls, who were later
seen dancing around in
their grass skirts and leis; a
pair of sweet children were

everyone joined in the merriment by clapping enthusiastically for their favorites.

The Pelican Bay tram
system has been designed to
efficiently transport you to
our beach and restaurant
amenities. It may be a surprise to some, but we can
also transport you to any of
our designated eight tram
stations throughout the
Common areas of Pelican
Bay. Some connections can
be made more quickly than
others. Direct routes, from
the Commons to the
Sandbar for example, can
be 10 minutes or less. Trips
between the North and
South beaches can be made
by utilizing our shuttle
tram. Be sure to inform your
driver when you need to use
this service. The driver
will make the appropriate
arrangements to get you to
your destination.
When traveling during
high volume periods, such
as the rush to see our magnificent sunsets, please
prepare for some crowded
conditions at the stations.
Allow yourself a little
extra time before sunset
and/or your restaurant
reservation. Members and
guests are asked to present
their Foundation Identification when entering and
using all Foundation property or amenities.
Normal intervals between
trams are six to 10 minutes.
During peak seasonal times
this interval may be reduced
in order to meet capacity
demands. Our slowest and
lowest use of trams is off
season in September when
we transport 7,800 members one way to the beach
for the entire month. That
number will be 78,000 in
March with the two weeks
that bookend Easter at
45,000 alone!
Please be aware that
safety rules require that
strollers be folded and all
items kept within the tram
roofline when in motion.
Children under the age of
12 are to be accompanied
by an adult age 18 or older
when sitting on the rear
seat. Allow tram to come to
a complete stop before
boarding or unloading.
Information for
members with disabilities
We have a special needs
tram to better serve members with disabilities that
require the use of a wheelchair. It is available for use
by appointment through
the Commons Office. Those
making a reservation will
need to provide a pickup
time, location and approximate return time. We request one hour advance notice, assuming the tram is
available, to better position
drivers to continue service
to all our members.

We’re starting the holiday
season off with Breakfast
with Santa on Saturday,
December 15 from 911:30am. This will feature
a special children’s menu
of pancakes, waffles, juices
and hot chocolate with
marshmallows. There will
be the usual buffet served
for the “bigger” kids: pancakes, waffles, sausages and
bacon, Eggs Benedict, an
omelet station, fresh fruit,
oatmeal and grits, dried
cereals, granolas, muffins,
bagels, juices, tea and
coffee. Prices for children
will be $7.95, and $13.95
for adults. There will also
be Mimosas, offered at a
special price of $5.
On Wednesday, December 19 , Christmas carols
will be sung from 6-7pm at
the Sandpiper. There will be
a special menu featuring a
choice of: Stuffed Grouper
(with Jumbo Lump Crabmeat with Saffron rice, and
fine julienne of vegetables)
for $24 - OR - Grilled Filet
Mignon Oscar (tri-colored
pepper crusted filet, topped

On Thursday, December
20th, the carolling will move

and the later Fireworks Seating at 8:30pm, which will be
$95, inclusive. Please note
these times have been moved
up a bit from last year. That
is because several diners
were still being served at
midnight last year. So as the
revelry began, they had not
finished their meals. Thus,
we are facilitating the dining
by beginning a little earlier.

She will personally oversee

Community Center and the
beach restaurants. The

Odds and ends
Feedback indicates our
new wine selections have
been well-received. Your
feedback is important, as
this is an on-going effort to
upgrade our wine. We have
had numerous requests to
serve our house wine in
carafe sizes. The restaurant
committee is presently
discussing that option. We
will follow up with any new
decisions made in that area.
At our November meeting, we talked about some
new desserts — also an ongoing project. We can’t wait
to tell you about them
when we get all the new
choices finalized. (Your

And last, but certainly not
least, we’d like to send a huge
thank you to all those on our
staff who worked countless
hours to bring our restaurant

It’s that time of year —
snowbirds, the holiday
hustle and bustle, and the
ensuing crowds. The beach
staff will be asking for
Pelican Bay identification
in order to insure the
legitimate use of this popular
amenity. We strongly
encourage guests to be in
the presence of the cardcarrying member in order to
expedite service from the
neach staff. We apologize
for the redundancy of being
asked for your ID so often,
i.e., trams, restaurant,
security, etc. We do this to
protect your use of Pelican
Bay amenities. Because they
are spread out over a large
geographic area, exposure
of our private resources
is increased to public
intrusions, whether they are
intentional or accidental.
The beaches of Pelican
Bay are especially vulnerable because Collier County
beaches are public, and
therefore are accessible and
usable by non-Pelican Bay
persons, who may gain
entry either from the
Vanderbilt Beach access or
south of Clam Pass. These
two areas are very popular
beach locations for visiting
tourists, and for local

Naples residents
and their guests,
who have legal
opportunity to
walk and use
the beach area
that fronts the
Pelican Bay facilities, both North
and South. They
do not have the
right to use our furniture,
umbrellas, cabanas, etc., or
trespass onto the restaurant facilities, boardwalks
and beams.
Given Pelican Bay’s vested interest in maintaining
and securing the private
use of the amenities, and
the resultant obligation of
Foundation Staff to “make
this happen” by checking
IDs, our challenge is to
educate the community
that the presentation of
Pelican Bay ID is mandatory for access and use of
Pelican Bay amenities. The
redundancy of card checking by our staff is therefore
a necessity, because when
we are busy it is often difficult to determine where
you came from, i.e. from
public access or legitimately from a tram. It is
even possible for a security
breach to originate from
the berm or boardwalk,
allowing unauthorized
individuals to access the
beach facility and attempt
to use our equipment.
To conclude this discussion, the employees of
Pelican Bay collaboratively
request your patience and
cooperation to assist us in
our effort to keep Pelican
Bay exclusive by willingly displaying your ID
when asked.
Please feel free to call

following policy — The
Foundation has a tipping
policy of “appreciated, but
not expected” and therefore

morning, November 7 th .

Chairman Coleman Connell
reported that he has resigned from the Foundation
strategic planning committee (FSPC) for personal reasons, and has appointed Ms
Mary Anne Womble to be the
new liaison member. The
Board approved this action.
We were also informed
that the Foundation incorporation steering committee (FISC) has entered
into a contract with LaRue
Planning to help them on
this possible step. The expenses are born equally by

will be discussed at the next
sub-committee meeting to
consider amending the renewal application of our TenYear Mangrove Maintenance
Program. Such recommendations will then be submitted
to the Board for action.
He also pointed out that
at least seven homes in the
Oakmont area have been
affected by the dodder vine
and suggested that owners
keep a sharp look-out for
this invasive vine which
can grow rapidly and eventually kill a tree.

The Foundation has
adopted a Resolution for an
education program to
promote the “Florida Best
Management Practices for
the Protection of Water
Resources”. The Board
thanked the Foundation for
this initiative which is in
line with recommendations
contained in the PBS&J
study of Outer Clam Bay
and adjacent waters.
Budget
The Chair of the budget
sub-committee reported
that the committee met on
October 23rd to commence
work on the 2008-2009
budget. Discussions regarding the options available on
ad-valorum vs. assessment
funding opportunities will
be held in the future.
Further, the committee is
working on changes in the
monthly financial reports
in order to make them more
comprehensible and meaningful. One problem stems
from the fact that the
County budgets on a yearly
basis — not on a monthly
basis. It was also stressed
that a complete review will
be made on an item by item
basis to see where savings
may be accomplished.
Government relations
The Government Relations
Chair briefed the Board on
on-going discussions with
the County regarding the
County’s desire to put all
coastal zone activities
under one “roof”. We feel
that Pelican Bay’s storm
water system is exemplary
and are happy to share our
experiences with the County
or the City of Naples.
The Chair also informed
us that the rumors of
closing of the Vanderbilt
Beach Road library are
premature, but that in the
event of budget cuts, the
library would benefit with
the assistance of volunteers,
to substitute (possible) reduced staffing, or reduced
hours of operations. If you
are interested in volunteering at the library please contact Jim Burke (598-3140).

Homeowners may transfer their SOH benefits to a
new homestead anywhere
in Florida within two years
of leaving their former
homestead, retroactive to
January 1, 2007.
If “upsizing” to a home of
equal or greater value, the
homestead owner can transfer 100% of the SOH benefit
to the new homestead,
up to a $500,000 transferred benefit.
If “downsizing” to a
home with a lower value,
the homestead owner
can transfer a SOH benefit
that protects the same
percentage of value as it
did the former homestead, up to a $500,000
benefit.
• Creates an additional
homestead exemption worth
$25,000, applied to value
above $50,000 (not applicable to school taxes)
• Provides an assessment growth limit of 10%

installation of ballard lights
along Vanderbilt Beach
Blvd., will soon go out for
bidding and permitting,
a process that takes a
few months.
And, finally, we have
received $82,500 from
FEMA relating to Hurricane
Wilma storm damages. We
are, however, still awaiting
$66,156 claimed from
FEMA for damages relating

Cultural practices
for healthy landscapes
Plant selection and location
are the most important
factors in planning a
lawn and landscape. After
weather, cultural practices
are the biggest factors in
determining how well an
agronomic or horticultural
program performs. The
amount of pesticides, fertilizers, and water required
often directly correlates
with cultural practices and
how well they are carried out.
Landscape professionals
have a responsibility to
supply their customers
with educational material
on their role in keeping turf
and other landscape plants
healthy. This includes (as
appropriate) information
on irrigation, mowing,
plant selection, aeration,
and traffic control. Educating clients about wise
cultural practices is of the
utmost importance.
Cultural practices are a
management tool to reduce
pesticide use. Use plant
varieties that are less susceptible to insects, nematodes, and diseases in order
to reduce pesticide use.
Care should be taken to
select turfgrass species and
cultivars best adapted to
the environmental conditions of the site and geographic part of the state.
Proper cultural practices
include mowing, fertilization, irrigation, pruning,
and supplemental cultural
practices such as aerification and dethatching. These

and enhance its fruiting,

that may be more susceptible to insects, weeds, and

should be included in the
management plan to take
advantage of every aspect
of the cultural control of
pest problems. Cultural
practices are a part of IPM
and help to produce a
healthy, vigorous stand of
turf that is more resistant to
pest problems.

can occur in turf maintained under low-nutrient
conditions. Overfertilization can also enhance plant
susceptibility to pests and
diseases. Several pesticide
applications may be required to alleviate problems
that would not have been
as prevalent under a proper
nutrition program. Proper
fertilization can alleviate
these conditions.
Fertilization of plants can
result in additional growth
and production of leaves,
stems, branches and roots.
In turn, additional growth
can result in more maintenance and yard trimming,
so it is important to determine if growth is the desired result. Fertilization is
usually desirable when
trying to establish newly
installed landscape plants.
Also, adding fertilizer
can help plants get off to a
quick start to fill in the
planted areas.
Time fertilizer applications to maximize plant use
and minimize adverse
environmental impacts.
Frequent light applications
or “spoon feedings” of turf
and landscapes are ideal.
Underfertilized landscape
plants may require a higher
than normal rate of nitrogen or other nutrients in
order to return to a healthy
condition. Both quick- and
slow-release fertilizers have
a place in a sound management program.
Remember that plants
don’t waste water, people
do. Supplemental irrigation
is necessary for the survival

periods of severe moisture
deficiency. Overwatering
may increase insect, weed,
and disease pressures. For
example, overwatering
during cooler months encourages dollarweed growth.
Conversely, other pests
thrive under extremely dry
conditions and compete
with desirable plants.
Chinch bugs and spurge
are examples of pests that
attack turf when the soil is
too dry. A proper balance is
necessary to keep the landscape strong and healthy.
The average amount of
rainfall in Florida ranges
from nearly 52 inches
annually in the central and
northern peninsula to almost 65 inches in the Panhandle west of Tallahassee
and along the southeast
coast below Lake Okeechobee. More than half of
Florida’s total annual rainfall is concentrated in the
central and southern peninsula between June and
September. During the
winter and spring, the lack
of rainfall may seriously
com-promise plant health.
Land-scape plants growing
in soils with a limited
capacity to retain moisture
can benefit from supplemental irrigation during
periods of low rainfall.
Even during the rainy
season, evapo-transpiration
(water loss from plants
and soil) occurs between
showers and may mandate
supplemental watering
while plants are becoming
established.
Determining and controlling the rate, amount,
and timing of irrigation can
minimize soil erosion,
runoff, and fertilizer and
pesticide movement. The
irrigation system should
be designed to have an
application rate that is
less than the infiltration
capacity of the soil so that
no surface pooling occurs
and water percolates with
maximum efficiency. Rain
sensors or soil moisture
sensors eliminate irrigation
when nature has supplied
sufficient water.
The use of pesticides for
controlling pests remains an
important part of landscape plant management in
Florida. The key to reducing
pesticide use is to combine
genetic, cultural, and biological management practices into an IPM program
that focuses on the prevention of pest problems.
When suppression is necessary, it is easier to suppress
a pest when conditions exist
that discourage its development. One defense against
the movement of pesticides
and fertilizer nutrients offsite or through the soil is a
thick, vigorously growing
stand of turf or other
landscape plants.
BMPs to protect water
quality can be affordable
and easily implemented,
and are effective in reducing the off-site transport
of sediment, nutrients, and
pesticides. Select pesticides

Pesticides must be correctly applied. Spray when
conditions for drift are
minimal, avoid application
when heavy rain is imminent, and irrigate with
appropriate volumes of
water. Granular applications should be kept away
from impervious surfaces
and bodies of water. The
landscape manager should
check the proper calibration
of equipment before every
pesticide application.
Always follow the label
directions for disposing of
pesticide containers.
Employee training
The effectiveness of any
program is only as good as
the understanding of the
personnel responsible for
final application. BMPs are
no exception. For BMPs to
be effective, the technicians
choose to develop their own
training programs administered by their own professional training staff.
Smaller firms may choose
to avail themselves of training available through professional associations or the
county’s IFAS Cooperative
Extension Service.
Employees should also be
given pertinent information
relating to their job duties,
especially job safety. For
instance, do your employees
know that if drivers carry
less than 8 gallons of either
diesel fuel or gasoline, they
are exempt from Department of Transportation
(DOT) or Occupational
Safety and Health Administration (OSHA) regulations concerning fuel cans?
If they carry over 8 gallons
combined (exception: 9
one-gallon containers), they
must use OSHA-approved
fuel cans. Plastic cans are

in the field must understand their role in protecting our water resources.
This understanding can
only come from the development and implementation of employee
training programs.
The Green Industry is very
diverse. Companies range
in size from one or two
individuals to very large
corporations. Large companies or corporations may
not in compliance with the
regulations. Any petroleum
product should be kept
secured on the vehicle.
Employees whose job
duties include activities
related to BMPs should be
properly trained to perform
those activities before going
in the field. Applicable
personnel at all levels of
responsibility should receive refresher training
annually on the general
components and goals of
the BMPs, job safety, and
the specific BMPs that
apply to their jobs.
Documenting an employee’s participation is
important to the success of
a training program. Employee training should be
documented in an employee training log. This
documentation provides
the business with a tool to
ensure the effective delivery
of BMPs. It not only allows
the company to track an
employee’s education and
competence, but also provides a record in case of
accident to show that the
company provided the
employee with the proper
training to do his or her job.
Records should have the
name and signature of the
employee, the provider or
trainer, subject, date, and
hours (time in/time out).
As time goes on, more
and more local governments are passing ordinances to regulate the
Green Industry. Many of
these ordinances may require education in order to
obtain an occupational license or to provide services
to the public. Maintaining
training records shows that
your business meets these
requirements.
Remember . . .
• Train employees about
BMPs and job safety.
• Retrain annually and
when changes are made.
• Train employees to document and retain records
of activities.

Our mascot bear (who
still remains nameless) had
center seat at the Toys for
Tots Kickoff, held November 1, at our Community
Center. Holding court, he
commanded the presence
of the many residents who
attended representing their
associations, the bevy of
gentlemen attending for
the Marine Corps League of
Naples who are the driving
force behind this annual
event, and even gave pause
to the two firefighters
who were in attendance
representing the North
Naples Fire Central and
Rescue District. Our bear
is almost as tall as Jim
Hoppensteadt, Foundation
President, who was seen
eyeing this bear as a
possible competitor for
winning a height challenge.
After enjoying a delicious,
light breakfast buffet provided by Chas and Joel, this
year’s Toys for Tots Chair,
yours truly, briefly addressed the assembled group
with the more important
dates and instructions they
needed to know. Bob Kearns,
Marine Corps League of
Naples Toys for Tots “commandant” also spoke to the
group, reviewing past successes and stating goals the
Marines hope to make this
year throughout Collier County.

Property tax reform
By Donna D. Berger, Esq., Community Advocacy Network Executive Director
The Florida House and
Senate approved a pareddown tax reform package
recently. It will now be up
to all of you as to whether
or not these proposals
become part of the Florida
Constitution when you are
asked to vote at the January
29th special election.
The property tax reform
package includes both a
general bill, SB 4-D and a
proposed constitutional
amendment, SJR 2-D. Experts
predict that the average
homeowner will see a $220
annual tax break as a result
of the following measures:
1. $50,000 Homestead
Exemption — The proposed constitutional amendment provides for an additional $25,000 homestead
exemption for the value of
homestead property above
$50,000. The exemption will
not apply to school taxes.
2. Portability — The plan
leaves the current Save
Our Homes provision intact
but now allows property
owners to transfer their
Save Our Homes benefit (up
to $500,000) to a new
homestead within two
years of giving up their
previous homestead. If the
value of the new home is
more than the value of the
previous home, the entire
differential can be transferred. If the new home has
a lower value, the amount
of the accumulated benefit
that may be transferred is
proportional to the value
of the new home. The
portability provision applies
to all taxes, including school
taxes. (For those who gave
up their homestead in
2007 before the amendment
was passed, the differential
may be transferred if they
apply for a new homestead
January 1, 2008 or January
1, 2009.)
3. Tangible Personal
Property Exemption — A
$25,000 exemption is
provided for each tangible
personal property return.
The new exemption applies
to all taxes.
4. Assessment Cap for
Non-Homestead Property
— All non-homestead
property will have a 10%
assessment cap (similar to
Save Our Homes), but the
new cap will apply only
to non-school levies. The
10% cap sunsets after
10 years, at which time
it will be submitted to
the voters for re-approval.
Most residential properties
will be reassessed at
just value when they
are sold; commercial
property and residential
properties with 10 or
more units will be
reassessed after a significant improvement or a
sale. This provision will not
take effect until the 2009
tax roll, and it does
not apply to school taxes.
5. Fiscally Constrained
Counties — SB 4-D also
requires an annual appropriation to fiscally constrained counties to make
up for revenue reductions
resulting from the adoption
of the constitutional
amendment by the voters.

when you are asked to
vote on the proposed
constitutional amendment
in January.

Tax reform — Not!

“Congratulations! We
passed a bill! Does it save
you money? No, but we
had a very nice press conference.” (A comment by
Marco Rubio, Speaker of the
House, in response to a
remark by an unidentified
woman from Ft. Myers after
the legislature passed
the first tax reform constitutional amendment.) The
June amendment was tossed
out by a circuit judge, who
determined that its language
was “misleading”. Now in a
second stab at tax reform,
the legislature adopted a
replacement bill in the 11th
hour of the legislative special
session just concluded. The
Senate handed the House a
“take it or leave it” bill and
the House ultimately passed
it. You will have the opportunity to “take it or leave it”
in January when the constitutional amendment
appears on the ballot in the
Presidential Primary.
Do we need tax reform?
Yes. The present code has
proved to be inequitable
and contains no protection
for homeowners against
inflated valuations or market speculation.
Does this amendment
represent genuine tax reform?
The simple answer is “no”.
What does it offer?
• To homesteaded property owners — an additional $25,000 exemption —
although this second exemption does not apply to
school levies.
• To homesteaded people
moving within the state —
some portability; up to
$500,000 of the Save Our
Homes benefit when a more
expensive home is purchased, and a proportionate amount when the move
is to a lower priced home.
• To businesses — a
$25,000 personal property
exemption.
• To non-homesteaded
properties — a 10% cap on
annual assessments on all
but school levies. (Most
residential property will be
reassessed at just value
cut. How much revenue loss
will we experience here
in Collier County if the
amendment passes? Our
schools anticipate loss of an
additional $5.7 million.
County government expects a loss of nearly $17
million in revenue. Net
result: Collier County government alone will struggle
to balance a budget that
will have lost just under $85
million in revenue in less
than 2 years. Aside from
MSTUs, the revenue cuts
will force the County to run
all of its operations on
$245.5 million.
Finding ways to keep our
essential services intact will
be challenging. The BCC
will be forced to make some
very hard choices if the
voters approve the amendment on January 29th. Every
area of County Government will get additional
scrutiny with focus on our
primary mandate: the
health, safety and welfare
of the citizens. We will
strive to make sure that
essential services continue –
police, fire, EMS, water,
waste disposal, public
health protection — but the
“fluff and buff” — many of
the much-loved amenities
we all have come to expect
as a matter of right — will
no longer be affordable.
Do not forget, the county
budget covers the costs of all
the offices and personnel
of our five constitutional
officers (Sheriff, Clerk of
the Courts, Tax Assessor,
Property Appraiser, and
Supervisor of Elections) as
well as all county-provided
services. Last June, the
unexpected mandate we
received from the legislature decimated a carefully
planned budget. We managed, but it was not easy.
When the state took away
our revenue, they did not
take away our service
mandates - nor did they give
us any flexibility to shift
earmarked revenue into
other areas where there
was major need. They
when it is sold; commercial
property and residential
properties with 10 or more
units will be reassessed after
a significant improvement
or a sale. This provision will
not take effect until the 2009
tax roll and sunsets after 10
years unless reapproved by
the voters.)
• To fiscally constrained
counties (those already
bordering on bankruptcy)
— the promise of an unspecified State appropriation to help balance
their budgets. (The legislature refuses to see that
one-size-fits-all is not
a concept that can be
applied to counties. Each
of us is unique.)
One need not be a mathematician to see that the
gap between homesteaded
and
non-homesteaded
property
taxes
on
properties of similar value
will continue to widen.
This is not tax reform. It is
a small tax cut.
The average savings to
property owners in Collier
County is estimated to be
approximately $140 per
year — more if we are moving
to another homestead in the
state. What will this cost?
The legislature expects the
revenue loss to countydelivered services statewide
to be about $9,623,000,000
and the impact to our
schools — already 48 th
in the nation — a loss of
about $ 2 , 7 5 7 , 0 0 0 , 0 0 0 .
That’s billions, folks.
You may recall that
Collier County voluntarily
rolled back taxes last year
(FY 2006-07) by lowering
the millage rate. To do that,
we cut some $23 million
from our budget. It took
some belt tightening but we
were proud to be able to do
it. Then in June of this year,
the legislature, as part of
their statewide tax initiative, mandated a further
rollback. The formula they
imposed reduced county
revenue an additional
$44 million+, roughly an
additional 11% revenue
continued to pass down
from their budget various
mandates — like Medicaid — without sending
along any funding to pay
for them. And, they upped
their concurrency requirements for expanded public services required to
meet growth.
Result? We have a hiring
freeze on new employees
and we are not back-filling
positions that become
vacant. Specifically, we
fired 35 employees in July
and we have 167 additional
unfilled employee vacancies presently. We have cut
back operations in every
county department including the Sheriff’s office.
Now, with the potential of
an additional $16.8 million
or greater revenue loss, the
situation becomes dire. We
are at bare bones — there is
no fat. Worse, we face the
probability of reduced
property values as last
year’s market adjustments
hit upcoming tax assessments. It is not pretty.
I did not want future
service cuts to come as a
surprise to you. As taxpayers you are entitled to all
the information we have.
As of yet, we have made no
decisions on where cuts will
be taken, but they will
have to be made. I wanted
to make sure that you all
realize what the Commissioners and County
management are facing.

work together to find
creative ways of addressing
critical needs.
