If your development
application is refused:
When applying for a
Development and Building
Permit for a deck, please
provide:
• Municipal address and legal description (lot,
block, plan number) of the property.
• Five (5) copies of a site plan or Survey including a
drawing showing the proposed location of the
deck and the distance from the deck to property
lines and other structures.
• Dimensions of deck including length, width,
height and location of proposed steps. Distance
from side and rear property lines, existing
structures, easements and utility right of ways
must also be included in the drawing.
You may have the right to appeal the decision
within fourteen (14) days of the date of notice of
decision to:

Processing your application
• We receive your Building and Development
permit application and ensure it is complete.
• A Development Officer reviews the Development
Permit Application and site plan to determine
conformance with the appropriate Land Use
Bylaw Regulations in place, and a decision will be
rendered on your application.
• The plans/drawings of the deck are reviewed by a
Building Inspector to determine conformance
with the Alberta Building Code Regulations and
process the Building Permit application.
• Incomplete applications will not be accepted.
• Construction cannot commence until permits
have been issued.

Decks must be constructed within
your property and within the required
setbacks (distance to property lines).

If any portion of the deck will be greater than 0.6m
(2 feet) from grade level to the top of deck surface,
or if it will be covered, it must comply with the City
of Fort Saskatchewan’s Land Use Bylaw setback
requirements and will require Development and
Building permits.

Your proposed deck is subject to Alberta Building
Code Regulations, and your building permit
includes an inspection by a Safety Codes Officer.
The following form is a example of the information
required to submit with your building permit (both
available for printing on our web site):
Deck "Guardrail requirements"
Guardrails: The requirements for guardrails on
uncovered decks depend on the height of the
deck:
•
On decks 0.6m to 1.8m (2ft to 6ft) above
grade, guardrails must be at least 900mm
(36 inches) tall.
•
On decks more than 1.8m (6 ft) above
grade, guardrails must be at least 1070mm
(3 ft 6 inches) tall.
All guardrails must be:
Decks cannot be located over an
easement, utility right of way, gas
meter and/or gas shut off.
•
Built with a space between vertical
spindles of less than 4 inches (100mm)
•
Designed with no horizontal rails, fixed
benches or other items that would provide
a foothold
•
Handrail must be smooth and easily
graspable
You DO NOT need a Building or
Development Permit if the uncovered deck
you are planning is less than 0.6m (2 feet)
from ground elevation.
UNCOVERED DECK – Permit Application Information
When applying for an Uncovered Deck over 0.6m high, please ensure that you submit the following to
avoid processing delays:

Building and Development Permit Application Forms complete with required fees
Please include Signature and indicate whether you are/represent the owner of the property
□
Uncovered Deck Details of Construction form – with complete information and signature
□
Three copies of Site Plan
The easiest and most reliable site plan would be to use a copy of your most recent Real Property
Report Survey, sketching on the proposed location of the deck.
• Site Plan must show the dimensions of the proposed deck and the distances from the
deck to the property lines and any other structure on the property (such as a shed)
□
Decks may not obstruct Gas shut-off valves and meters so they can be accessed for regular
maintenance and emergency crews.
□
Decks cannot be constructed in Utility Right of Ways or Easements.
□
Decks over 0.6m high may project a maximum of 2.4m into the rear yard setback but may not
project into the side yard setback. If you are uncertain of the setback requirements in your
residential district, a copy of the Land Use Bylaw regulations for your district can be found on
the City website at www.fortsask.ca, or can be picked up at the Planning and Strategic Initiatives
Department.
Please ensure that you call Alberta One-Call at 1-800-242-3447 to locate any buried utilities on
your property. If there are overhead power lines located on or adjacent to this property please
also contact Fortis Alberta regarding your proposed development before submitting this
application.

IMPORTANT NOTICE: This Application does not permit you to commence any development until
such time as the Development Authority has issued a Development Permit. If a decision has not
been issued within 40 days of the date of this Application being deemed complete, the applicant may
file an appeal to the Subdivision and Development Appeal Board (SDAB). Please contact the
Secretary of the SDAB at (780) 992-6236 for appeal information.

ISSUANCE OF A PERMIT AND THE EXAMINATION OF PLANS AND SPECIFICATION SHALL NOT BE CONSTRUED TO BE AUTHORITY TO VIOLATE ANY OF
THE PROVISIONS OF THE SAFETY CODES ACT OR PURSUANT REGULATIONS.

A BUILDING SAFETY OFFICER IS PROHIBITED FROM ISSUING A PERMIT TO AN APPLICANT IF THE APPROPRIATE ARCHITECTS AND/OR PROFESSIONAL
ENGINEER’S SEALS OR STAMPS ARE NOT ON THE PLANS AND SPECIFICATIONS IF REQUIRED.

THE OWNER OF THE BUILDING IS FULLY RESPONSIBLE FOR CARRYING OUT THE WORK OR HAVING THE WORK CARRIED OUT IN ACCORDANCE WITH
THE REQUIREMENTS OF THE SAFETY CODES ACT AND PURSUANT REGULATIONS.

THIS PERMIT APPLICATION IS NOT FOR ZONING/DEVELOPMENT, GAS, PLUMBING OR ELECTRICAL WORK. PERMITS FOR SUCH WORK MUST BE
OBTAINED SEPARATELY.
5)
BEFORE ANY EXCAVATION OR CONSTRUCTION IS STARTED, THE FOLLOWING SHOULD BE CHECKED:
A)
UTILITIES
LOCATION, HEIGHT, OR DEPTH, AND PROTECTION FROM DAMAGE OR ALL
UTILITIES. I.E. SEWERS, WATER, POWER, GAS, TELEPHONE, ETC.
B)
LEVELS
RESPECTING PROPOSED ELEVATIONS OF FINISHED LANES, STREETS OR
AVENUE, SANITARY OR STORM SEWER CONNECTIONS.
6)
REVIEWED DRAWINGS AND SPECIFICATIONS SHALL BE KEPT ON THE BUILDING SITE AT ALL TIMES DURING WHICH THE WORK AUTHORIZED BY THE
PERMIT IS IN PROGRESS, AND SHALL BE AVAILABLE FOR INSPECTION BY A BUILDING SAFETY OFFICER.
7)
A BUILDING SAFETY OFFICER MAY SUSPEND OR REVOKE A PERMIT ISSUED IN ERROR OR ISSUED ON THE BASIS OF INCORRECT INFORMATION OR IF
THERE IS A CONTRAVENTION OF ANY CONDITIONS UNDER WHICH THE PERMIT WAS ISSUED OR THE PERMIT FEES HAVE NOT BEEN PAID.

ISSUANCE OF A PERMIT BASED UPON PLANS AND SPECIFICATIONS SHALL NOT PREVENT A BUILDING SAFETY CODES OFFICER FROM ISSUING ORDERS
UNDER THE SAFETY CODES ACT.
9)
ISSUANCE OF A PERMIT SHALL NOT PREVENT A BUILDING SAFETY CODES OFFICER FROM STOPPING CONSTRUCTION OPERATIONS THAT ARE IN
VIOLATION OF THE SAFETY CODES ACT OR PURSUANT REGULATIONS.

EVERY PERMIT SHALL AUTOMATICALLY EXPIRE BY LIMITATION AND BECOME NULL AND VOID IF THE WORK AUTHORIZED BY THE PERMIT IS NOT
COMMENCED WITHIN 90 DAYS FROM THE DATE OF ISSUE, OR IF THE BUILDING AUTHORIZED BY THE PERMIT IS SUSPENDED OR ABANDONED FOR A
PERIOD OF 120 DAYS AT ANY TIME AFTER THE WORK IS COMMENCED. BEFORE WORK CAN BE STARTED AGAIN, A NEW PERMIT SHALL BE OBTAINED
OR ON RECEIPT OF A WRITTEN APPLICATION, A SAFETY CODES OFFICER FROM THE AGENCY, MAY IN WRITING, EXTEND A PERIOD OF TIME ONLY
ONCE FOR UP TO AN ADDITIONAL 90 DAYS, IF THE PERMIT HAS “NOT EXPIRED” (ONE YEAR FROM DATE OF ISSUANCE) WHEN THE APPLICATION FOR
EXTENSION IS MADE.
11)
EXCEPTIONS MAY BE MADE, AT THE DISCRETION OF A BUILDING SAFETY OFFICER IN CASES OF SUMMER OR RECREATIONAL HOMES OR UNDER
UNAVOIDABLE CIRCUMSTANCES.
12)
THE APPLICANT GRANTS PERMISSION FOR NECESSARY INSPECTIONS TO BE CONDUCTED WITH THE SIGNING OF THIS APPLICATION.
13)
AN ORDER OF A BUILDING SAFETY OFFICER MAY BE APPEALED TO THE SAFETY CODES COUNCIL. FOR FURTHER INFORMATION, CONTACT ANY
BUILDING SAFETY CODES OFFICER AT THE CITY OF FORT SASKATCHEWAN AT 780.992.6248.
14)
SHOULD A PERMIT BE CANCELLED, THE HOLDER OF THE PERMIT MUST SUBMIT A WRITTEN REQUEST TO THE CITY OF FORT SASKATCHEWAN. THE
CITY OF FORT SASKATCHEWAN WILL REFUND AS FOLLOWS:
i)
TO THE PERMIT HOLDER, IF THERE HAS NOT BEEN A CONSTRUCTION DOCUMENT REVIEW – HOLDBACK OF 25% OR $25.00 – WHICHEVER
IS GREATER. SAFETY CODES FEE IS ONLY REFUNDED IF THE PERMIT IS CANCELLED IN THE SAME MONTH IT WAS REVIEWED.

TO THE PERMIT HOLDER, IF THERE HAS BEEN A CONSTRUCTION DOCUMENT REVIEW – NO REFUND.
