Dangerous Substances (Safe Handling) 31 March 2010 Living Marine Resources Living Marine Resources Management Act 1995 Non-Commercial Scallop Fishery - Minimum Size of Scallop I, Kim Ronald Evans, being and as the Secretary of the Department of Primary Industries, Parks, Water and Environment, pursuant to the Fisheries (Scallop) Rules 2010 Schedule 5 (1), that the minimum size for the following types of scallop in relation to the part of the non-commercial fishery taken or possessed in the D’Entrecasteaux Channel is taken to be : (a) for a queen scallop (Equichlamys bifrons), a scallop that is 110 millimetres at its widest part; and (b) for a commercial scallop (Pecten fumatus), a scallop that is 110 millimetres at its widest part. For the purposes of this notice the D’Entrecasteaux Channel is taken as the area described in the Fisheries (Scallop) Rules 2010 Schedule 3. Kim Evans, Secretary, Department of Primary Industries, Parks, Water and Environment. Dated this 26th day of March 2010. OTHER INFORMATION (b) a dangerous substances emergency at the facility could pose a risk to persons, property or the environment outside the facility. • The 2010 open scallop season for the non-commercial fishery is from 27 March 2010 until 31 July 2010. • The D’Entrecasteaux Channel will only be open for a limited season from 1 July 2010 until 31 July 2010 with a minimum size limit of 110 mm for commercial and queen scallops. The aim is to fish this area conservatively and leave stock for spawning and future seasons. You can not possess scallops below this minimum size in the D’Entrecasteaux Channel at any time. •There is no change to the minimum size for doughboy scallops of 80 mm. In State waters other than the D’Entrecasteaux Channel the minimum size limit of 100 mm for commercial and queen scallops remains in place. • Making multiple trips in a single day and taking the daily bag limit each time is not only illegal but puts scallop stocks at risk for future seasons. • Only holders of a fishing licence (recreational scallop) and Aborigines engaged in an Aboriginal activity may take scallops, and scallops must only be taken by hand or diving. •Scallop Measuring gauges are available from Service Tasmania shops, however these are not indicative of the minimum size for the limited fishery in the D’Entrecasteaux Channel. Fishers may choose to alter these gauges to a 110 mm measure or use the ‘110 mm’ male rock lobster measuring gauge as a measuring guide when participating in the limited fishery. Recreational scallop licences can be purchased from S e r v i c e Ta s m a n i a s h o p s o r o n l i n e a t t h e w e b s i t e http://www.fishing.tas.gov.au/licence. TASMANIAN GOVERNMENT GAZETTE 31 March 2010 Living Marine Resources Management Act 1995 Order declaring Noxious Fish (Didemnum vexillum) I, Kim Evans, Secretary of the Department of Primary Industries, Parks, Water and Environment, acting pursuant to my delegated power under Section 20(1) of the Living Marine Resources Management Act 1995 ("the Act") and pursuant to Section 127 (1) of the Act, by this my order declare Didemnum vexillum to be a noxious fish for a period of six months, being satisfied that an emergency exists which requires the order to be made, further particulars of which being set out in the following paragraph. A biosecurity emergency exists as a result of the suspected identification of Didemnum vexillum in New South Wales, and the potential for the species to be translocated to Tasmanian state waters. If introduced into Tasmanian waters, this species represents a significant threat to the marine environment and marine industries (in particular, shellfish aquaculture) due to its ability to smother marine life. Kim Evans, Secretary, Department of Primary Industries, Parks, Water and Environment. Dated this 25th day of March 2010. Information Didemnum vexillum is commonly known as Colonial Sea squirt and has not been recorded in Tasmanian waters. Sea squirts suspected to be of this species have been recently discovered in waters in southern New South Wales. Didemnum vexillum prefers artificial structures such as wharf piles, jetties and mussel lines. As a result of this order, unless otherwise authorised, a person must not possess Didemnum vexillum in Tasmania. 657 The Tasmanian Government Gazette and Tasmanian State Service Notices are subject to the Copyright Act.
