The Voice Of StillWaters Message from SWRA President I take this opportunity as the new President to welcome our two new Board members, Buck Stevens and Cal Johnson. They will be great new team members for our Board. They join Dr. Jim Williams, last year’s President, Wayne Washburn, Penny Alexander and Debbie Nigh. Buck Stevens will serve as Vice President and Penny will continue as Secretary where she has done a brilliant job. Debbie will also continue as Treasurer where we have made important financial improvements including record collections of past due accounts. And we rely on our great staff headed by Sallie Mason, Community Manager, aided by Susan Thames, Administrative Assistant, and Travis Fincher who is the Covenant and Maintenance Manager. This new Board will start quickly to identify and begin work on the continuing challenges SWRA faces. And we do so building on the outstanding work of the prior Boards. We welcome continuing input from our members, and other Still Waters residents. Last falls informal members’ meeting at the Executive Center on Gate policies gave the Board the strong feelings of the residents. We plan to do more of that. As everyone knows Gate 34 has been the focal point of many problems. Starting with a lightning strike a year ago the Board struggled to keep the Gate 34 entry operational and to keep contractor traffic within permitted time periods. After great effort the equipment has been fixed and upgraded and the cameras are operational at gate 34. Presently Gate 34 has limited morning and afternoon manning to control contractor entry. The Board will continue to work on the Gates and security issues, which are so important for our community. We want to gain control over the great number of outstanding entry cards. To do so we are requiring all residents to re-register their entry cards. The form to do so is attached to this newsletter, which also has the fax and mailing address to return them to SWRA. Forms will be available at the SWRA office, Gate 34, and Gate 49 as well. Please help us on this important project. SWRA is working with our local State Representative Betty Carol Graham, County Commissioner Emma Jean Thweatt and Sheriff Jimmy Abbot on special state legislation, which would authorize the sheriff to help with security inside StillWaters. Sheriff Abbot has been most helpful in trying to identify exactly what functions his office can perform to help StillWaters internal security. The legislation would be introduced at the upcoming regular session. Our new budget would also include funding for roving patrols, which could check on residents’ homes when on vacation if requested. We also hope to continue to work in a positive way with the contractors within StillWaters while at the same time protect the interests of the residents. We have a good team to do just that. The goal is to have this bill introduced in the upcoming regular legislative session. Collection of past due association fees are continuing to improve through several programs. We are working diligently through our office to notify owners of monies owed. We also have filed in small claims court on 25 properties to collect $ 30,745 in past due association fees. We continue working with Holloway Credit Solutions and the Deed for Debt program had brought in five properties for resale. We are gaining on the past due debt amounts because of the hard work of Sallie Mason, Susan Thames and Debbie Nigh. Construction Hours: The SWRA Board denied a request for an exception to the building permit hours that was made by the Project Manager of EAS Contractors at Stoneview Summit. The Budget Year for the association has been changed to April 1st to March 31st so that the Board will have the opportunity to listen to input from members at the annual meeting and the actual income amount for the year from dues will be accurate in order to set the budget. Thanks to the many committee volunteers who have served this past year, your time is appreciated. Many of you will continue to serve in the coming year and we are looking for new volunteers to work with us. If you are interested in getting involved please contact the SWRA office and let us know. 1987 Covenant Violations – Travis Fincher continues to meet with property owners to explain and clear up violations. The Board agreed that the covenants should be enforced even in the case of having to file suit against those who will not comply if other avenues have been exhausted. Fire Department Issue on Gate – Jim Williams reported that he had spoken with Ted Caudill, President of the Fire Department Board who was emphatic that the Fire Department did not want to file on their insurance. Tom Handley suggested that we invite the Fire Department Board to meet with the SWRA Board to resolve this issue amicably and to get it settled as soon as possible to improve the situation. Jim Williams stated that he had verbally agreed to wait until the Fire Department Board meets in March to discuss this issue per Ted Caudill’s request. The Board agreed to wait for a response from the Fire Department after their meeting. ANNUAL MEETING WAS HELD FEBRUARY 24th Welcome Buck Stevens and Cal Johnson to the SWRA Board of Directors. Both were elected to serve 3-year terms. Our thanks to the Elections Committee, Paul Gross, Bob Bradshaw, Charles Darwin, Linus Fiely, Betty Litsey for their time and excellent work! There were 1271 ballots mailed with only 966 eligible to vote (due to non payment of fees at time of voting) 363 votes: Home owners—160, Lot owners-133 and Condo owners-70 19 ballots disqualified due to: 17 ballots with unpaid fees and 2 for improper votes Total of 382 ballots Approximately 90 people attended the annual meeting Saturday. Thanks to those who attended the meeting; the input received will be seriously considered by the Board on several issues discussed. We are always interested in your input. (continued next page) 2 March 1, 2007 Community Manager, Sallie Mason reported that currently there are: Covenant 1—1971 have 54 properties Covenant 2—1974 have 381 properties Covenant 3—1987 have 1271 properties Waters Edge Covenants have—11 properties In 2006, there were 18 Permits for new homes, 12 Permits for additions to homes, 20 permits for docks/seawalls or other and 1 building permit for condos—The Pointe @ Sunset Point 142 new accounts added in 2006 which consisted of 134 condos and 8 lots in the Highlands Peter Van Parys, Chairman of the Roads Committee reported that in 2006 the following was accomplished: Repaved 1.2 miles +/- of neighborhood streets Repaved an additional 1/2 mile of StillWaters Drive (1.2 miles total paved) Patched 33 damaged areas of pavement Striped and provided reflectors on one mile of StillWaters Drive and 1/2 of Vista Wood Drive Repaired and reconfigured drainage ditches Standardized and place signage for 35 MPH speed limits on main roads 25 MPH speed limits for vehicles over two axles Enhanced the lighting at both Gates 34 and 49 and directional lighting Replaced metal signage posts with wood 4” X 4” posts to enhance appearance Reached agreement with Walnut Hill Water Authority regarding road damage SWRA INCOME Maintenance fees and assessments from property owners are the main source of SWRA revenues. The collection process for those funds is as follows: December 15/31 – Invoices prepared and mailed for dues and/or assessments January 31 – Due date for receipt in SWRA office February 10- Non-payment fee of $50 per property owner account/parcel added February 15 – Statement mailed to property owners with an outstanding balance March 15 – Collection fee added to each property owner account/parcel and collection is turned over to a collection agency. June 1 – Accounts receivable list (Customer Summary) which shows all unpaid dues will be reviewed by the SWRA Board of Directors (BOD) and a course of action will be determined (place liens, get judgments, etc) December 1 – SWRA BOD will review the accounts receivable list to decide further course of action on each account. Write-offs will be determined for accounts that are deemed uncollectible $100 Assessment We continue to get calls for information on the legal assessment from last year. The Board very reluctantly made that assessment after noting that our budget could not include legal fees of any magnitude. While we have no litigation pending and we continue to work as closely with the many developers, the Board felt that it should be prepared should we become involved in a substantial legal proceeding which can be so expensive. Hopefully that will not happen and the money put to better use. 3 March 1, 2007 SECURITY verses GATE ACCESS Some of the questions and comments at the annual meeting concerning security made it clear that there is some confusion in the community about the responsibilities of our Gate Personnel. They are on the job primarily to monitor and control Gate access. They are not security guards and are not trained to confront criminal activity. Of course, SWRA personnel will assist the sheriff by providing access to our video of the gates and records of entry when needed. In the past the developers or owners of the StillWaters resort had hired trained security people or off duty sheriff’s deputies. This is no longer true. As reported by our Gate Captain, Bill Sevy he checked with Sheriff Abbot and the program of deputizing individuals no longer exists. We will be adding a roving patrol person back this spring to be visible and to assist in monitoring the property. They will also check on homes when people are out of town upon request. So please remember, residents should Call 911 for medical or fire emergencies and should call the Tallapoosa County Sheriff’s department or 911 for criminal issues. Gate Captain, Bill Sevy, Sue Page, Tommy Bowen, Albert Perry, Mary Nielson, James Eubanks, Jantzen Hughes and Marvin Still NEIGHBORHOOD COUNCIL REPORT: Judson Edel, board liaison, reported to the council that Tallapoosa County Engineer and Commissioner Emma Jean Thweatt came to the board meeting to discuss improved channels of communication between StillWaters and Tallapoosa County. A committee has been selected to design a new StillWaters Logo. If you are interested in submitting something it’s not too late. Please turn your ideas into the SWRA Office. The board is continuing talking to our State Representative Betty Carol Graham concerning proposed legislation to give the Sheriff authority to offer traffic citations within the gates of StillWaters. The Council thanked Judson for this past years work as our liaison to the board. Judson has done a terrific job of carrying issues from the Council to the board. We will miss Judson and wish him the best in the future. Covenants and Maintenance Manager, Travis Fincher reported a continuing problem with trash on our streets. We encourage everyone in StillWaters as you drive or walk our streets that you pick up the litter you see. We all want a clean neighborhood. If you would like to help with the social gatherings of StillWaters please call Nancy Washburn 825-3070. We all enjoy our socials and we need more people to work on them. Some of the representatives reported that the roaming and barking dogs continue to be a problem in their neighborhoods. If you are not sure of what the covenants say about dogs, please get yours out and read up on this issue. Or call one of the board members for more information. Covenants are also available on the website at www.stillwatersra.com We are looking into the possibility of a United Postal Mail Box being in side the gates of StillWaters. If you have any problems in your area please call your representative. If you are not sure who you representative is please call Nancy Washburn or the SWRA Office. The council needs a representative from the Holly Ridge neighborhood. If you live in this area, please call and volunteer. Most of the residents of StillWaters are aware that in an emergency you need only call 911 to get assistance for fire or medical emergencies. The 911 operators will then page out the department using pagers and radios. It might be surprising to some to know the number of property owners and part-time residents who believe our area of coverage is strictly within the gates of StillWaters. Nothing could be further from the truth. In fact, the department was originally the Red Ridge Volunteer Fire Department. In l971 while creating the resort we know as StillWaters, Mr. Cecil Duffy recognized the public relations value of having a fire department visible as soon as you entered the property. Using his influence he had the department renamed and moved to the location we still occupy. The boundary of the department was developed jointly by Paces Point, Dadeville, Camp Hill, Union and StillWaters Fire Departments to insure everyone was covered. The StillWaters Fire District covers approximately 36 square miles, from Sandy Creek to Blue Creek and from just west of the 34 gate to the 4400 block on County Road 34. To better serve those outside the gates of StillWaters a second station was built on Barrons Bridge Road and is maintained with an engine and a tanker. Finally, the district was legally established by an act of the state legislature. We have mutual aid agreements with each of the above-mentioned departments whereby in the event of an emergency, they will respond as needed to provide assistance. We are on automatic aid with Paces Point so anytime we are paged for a fire in StillWaters they are also paged. This is a critical agreement for volunteer organizations as we never know how many will be available to respond in the event of an emergency. By helping each other we are assured of adequate manpower and equipment. SWVF&R also operates an ambulance transport service which is state certified. We have a mutual aid agreement with Tallapoosa EMS (TEMS) operating from Lake Martin Hospital that provides coverage in the event our unit (MED-4) is either on a call or out of service for maintenance. To continue our state certification we maintain a duty roster with a Paramedic and/or an Emergency Medical Technician and a driver 24/7. SWVF&R and New Site are the only departments to do so this side of the river. TEMS provides coverage from north of Dadeville to the Macon County line south of Reeltown and from Paces Point east to the Chambers County Line, exclusive of StillWaters. Our mission is to provide the best service possible in both fire and EMS to those whom we serve. In order to do this we have training each Tuesday evening to stay current as well as to insure all equipment is operational. We cruise the roads of the district after storms looking for downed trees, flush culverts that have become blocked due to construction or debris, and wash roads that are mud covered. Our primary reason for doing so is to be sure they are passable in the event of an emergency. Our goals are prevention and containment, to first try through education and observation to prevent fires in the district and when one does occur to contain it as quickly as possible. In short, when we identify something that can negatively impact our response time we attempt to correct it. We do not like to wait until an emergency occurs and then resolve issues that should have been corrected previously. All of this is accomplished with volunteers and part-time Paramedics. As with most volunteer organizations we are always in need of new members. I would ask each of you to consider devoting a few hours per month to assist us in protecting our lives and homes. Ted Caudill President 6 March 1, 2007 From the Covenants & Maintenance Manager I know that you are tired of me harping on the same old subjects but this one is really getting out of hand. I am talking about the trash and rubbish that is dumped at the end of our vacant streets and along our right-of-way. Those tossing beer cans and pop bottles are the worst offenders. I am sure that a lot of the trash on the right-ofway is from the construction crews and I will be contacting each contractor to see if I can get them to talk with their crews about this problem. The dumping of large amounts of trash on the vacant streets is another matter. I have found large bags of trash and even an old hot water heater. One reason we live here is for the beauty of the resort and this trash is not a welcome sight to us or to future homeowners. Please do your part and put your trash in a proper receptacle. Also if you see anyone tossing anything on the right-of-way please try to get their tag number and get it to me. Another thing to keep in mind is that there is a $1,000.00 dollar fine for dumping. I also know that you are probably tired of me writing you letters concerning boats and trailers stored on your parcel out in the open. You must put it in a garage or carport or find somewhere else to store them. I have sent many of you several letters and most of you have complied. When you get your third letter it will explain to you that the fourth letter will let you know that we are filing suit against you the following week. This happened this past week with a violation that had been going on for over two years. The violation was finally cleared three days before the filing date. This can get fairly expensive when you tack on all of the legal fees and court costs. Please don’t let it go this far. If, when you get your first letter, please come in to talk with me if you have a temporary problem, don’t just ignore the letter. Another reminder in case you either forgot or never knew, the covenants strictly prohibit any type of sign to be placed on a parcel in StillWaters. Even little “for sale” signs in your window are prohibited. Permits for real estate information boxes may be obtained at the SWRA office for $5.00. This permit is good for a year. On a nicer note, with spring just around the corner, our right-of-ways will start growing again and our landscape contractor will be back on the job. Please slow down when they are close to the edge of the road especially when they are trimming the edge. Travis Fincher From the Red Tees: The February 21st Auburn University CC "Opening Ladies Day" was postponed because of rain, and will be held Wednesday, February 28th. All golf clubs are invited. The following monthly Ladies Day will be held Wednesday, March 21st. SWLGA will hold their opening day Scramble Tuesday, March 13th, followed by a luncheon/meeting at Poplar Dawgs. A sign-up sheet is posted in the ladies locker room. Tee times on Tuesdays and Thursdays will be at 9:00 AM starting on opening day, however until then, they will continue to be at 9:30 AM. The tour leader is Dr. Wayne Swindall of Stillwaters. An organizational and informational meeting for all those interested will be held at his home, 400 Holly Ridge, on Saturday, March 17, at 7:00 pm. Dr. Swindall is an experienced tour leader having led many tours to the UK and Europe. He lived in the UK for three years, and has visited many times. The tour will be complete with air fair, accommodations, entrance to all attractions, and local transportation included in the cost. Hopefully, this will be the first of many tours to come when trips all over the world will be planned. Come to the meeting March 17th and find out all the particulars, and have all you questions answered. MARCH GARDEN TIPS SHRUBS - Fertilize shrubs (except azaleas and camellias) according to a soil test. Late plantings may be made, particularly if they are container-grown. Watch shrubs for harmful insects. LAWNS - Plant bermuda, zoysia, and centipede in South Alabama. Seed bluegrass and grass mixtures in North Alabama. Fertilize established lawns. ROSES - Watch new growth for aphids. Begin a spray or dust program. Begin fertilizing. ANNUALS AND PERENNIALS - Tender annuals may be planted in South Alabama. Check garden centers for bedding plants. BULBS - Plant gladiolus every two or three weeks if a long blooming season is desired. Plant tuberous begonias in pots. Plant dahlias. MISCELLANEOUS - Check and repair sprayers, dusters, and lawn mowers. Control lawn weeds with chemicals.
