The Voice Of StillWaters From the President As we look at the events of July, 2008, we are thrilled with several more major accomplishments, to include a solid financial status for the first half of the year, settlement of 7 legal collections cases, awarding of the 2008 Road Paving Project, Phase I, and final resolution of the boat ramp debate in StillWaters. Let’s start from the top with a look at the Road Paving Project. I signed the awards contract to D & J Enterprises of Auburn in mid-July, with a plan to commence around the first of this month. At this writing, the project totals approximately $145,000 in both paving overlays and patching of much-needed portions of some streets. As some additional revenues become available, and that is a distinct possibility, we will add the other prioritized road paving items to D & J’s list. The Board wants to thank the Roads Committee, Pete Arnold, Philip Grant, Jerry Heath and Patti Richardson, for preparing us so well with a list of repairs and overlays. That group, led by Travis Fincher, will continue to provide the oversight and quality control we need to ensure the job meets our specifications. We contacted six companies to bid, two declined due to the small size of our contract and one declined because SWRA requires liability and Worker’s Compensation insurance; with which they could not comply. We sent out three packets with specifications for bid, and received two fully qualified responses. We selected a new SWRA contractor as the lowest bidder. Congratulations, D & J Enterprises! We also had a misstep or two this past month. The Hwy 34 exit gates, both bar and sliding, were severely damaged by private motor vehicle contact while exiting. The good news is that the driver’s insurance has covered the total cost for replacement, repairs and labor. That bill was significant, over $10,000, plus labor and installation. We have completed a drainage contract problem and removed it from the legal case list. Thanks to those parties involved, including several Board and staff members, who turned this negative into a positive for SWRA! We all benefited! On the boat ramp debate, I will say that the Board has finally put the cap on the necessary administrative protections to ensure residents’ needs are met and property values protected. See the article in this newsletter for all the background and conclusions. SWRA is becoming better administered, as we continue to work to create a solid accounting system, create a backup set of digital files of all SWRA documents since our inception, and procure enhanced copier/scanner capabilities, so that we may complete many projects in-house. Amazingly, I updated the gate cards last week using the new Procedures Notebook that Susan and Penny are putting together! Our new and improved accounting system is truly marvelous, as attested to by Susan’s big smile! The Board wants to thank all the residents for their continued support! Like every homeowner, we aim to keep our home beautiful, so the Hwy 34 Gatehouse reconstruction is complete, on budget. Unfortunately, another “driver in a hurry” has damaged the gate again, so that driver’s insurance will be paying over $10,000 or more in repairs. We have the barrier arm operational, so all is functioning correctly. New flags are up, and the new lights are on! Road Damage Compensation: We incurred some new road damage due to a malfunctioning trailer being towed toward Hart Lane. The company involved will make compensation by paving Hart Lane as an alternative to repairing the other road scrapes. We will complete the repairs later. Quiet Hours: The Board reaffirmed the “quiet hours” from 10pm to 7am cst daily. Please be courteous neighbors and be sensitive to the need to maintain the peace and serenity of the best community in Alabama! FYI: Construction quiet hours are slightly different, from 7pm to 7am cst daily, and no work allowed on Sundays. Collections/Deed for Debt, Legal Proceedings: Some neighbors of SWRA-owned properties have been contacted in the past to inquire about their interest in buying lots, acquired from the Deed for Debt program or through legal proceedings. Board sale policy is simply stated: The Board gives any adjoining property owners the first option to purchase a property before it is offered to the public or other SWRA members through the public sector. Once declined, the Board lists the property for sale at the market price using standard media, the Multiple Listing Service (MLS) and the SWRA newsletter. Of course, the standard rules for evaluation of offers are price, terms and conditions as they apply to the sale. There are four lots for sale currently. (Lot 16 & 17 Turkey Roost, Lot 28 Beach Island, Addition I and Lot 78 Chinquapin Cove.) Contact the SWRA office if you are interested in purchasing. Safety Awareness Program - Golf Carts / Motorized Vehicles: Other noteworthy Board actions involve the implementation of a motor vehicle safety awareness program and violation notification procedure for drivers of motor vehicles on StillWaters streets. You may recall the previously advertised “golf cart policy” passed by the Board in January. See a related newsletter article. Condo & Private Home Rental Update: Boat trailer parking, the location of temporary storage, use of garbage dumpsters, and amenity use (pool, tennis courts) are all hot items this summer, as more new visitors come to view our beautiful community. If you are renting out or loaning out any property, a private home or condo, please ensure that your tenants & guests are briefed on the appropriate amenities that they are entitled to use. Also, it is recommended that a sign, placard or Homeowners Notebook be used to remind tenants and guests of those properties. We want them to feel welcome and not be embarrassed by visiting the wrong pool. Thanks for your help! Roads Patching / Paving: Gasoline prices are hurting everyone, even the SWRA contracts for 2008 and beyond. As a result of increased cost for a gallon of gasoline, both the landscaping contracts and the road paving contracts have seen a significant increase in the past few months in the cost of doing business. The Committee built an achievable 2008 road-paving budget; prioritizing the streets in two categories, spot patching and complete overlay work. Out-year road paving budgets will be more of a challenge. The Roads Committee will do as much as possible, as soon as possible, in order to moderate the cost increase. StillWaters Legislation: Judge Gloria Sinclair has assured us that the StillWaters Legislation for law enforcement is scheduled for the November ballot. 2 August 1, 2008 A StillWaters Boat Ramp—a History The Marina boat ramp was recently closed to all except those who store boats. How long this will last is uncertain. This has required StillWaters residents to use the public boat ramps on Highway 34, and Highway 50. Exactly how many StillWaters residents are affected by this closure of the Marina’s ramp is uncertain but it has been an inconvenience for some. While the Board agrees that a StillWaters Boat Ramp would be a desirable facility, there is no suitable place for one other than the one at the Marina. That fact is supported from many Board actions over the years and the summarized documentation that follows. Cardinal Heights Power Line Property: Recently the Open Forum published several suggestions that the Cardinal Heights area at Red Bird should be developed as a Boat Ramp. This SWRA owned narrow corridor of land runs under the Alabama Power High Transmission lines to the lake. It also is in the middle of the Cardinal Heights and Lakeview Ridge residential areas, surrounded by homes and undeveloped residential lots. Some residents’ comments have mentioned that the area had a dock and boat ramp in prior years. Inquiries revealed that sometime during the 1980’s a small dock was installed by a local property owner in the Cardinal Heights area and used primarily for fishing. It had no permit from the Developer or Alabama Power and after a few years was torn down by the Developer. There was never a boat ramp. Development of the Cardinal Heights “Power Line Property” has been considered by the Board before. Between March and June of 2006 the Board considered a proposal to place a beach, swimming area or docks for boating in this Cardinal Heights area. This would have required parking and bathroom facilities. A total of 48 property owners in the surrounding area filed a strongly worded petition urging the Board to reject the proposal, citing the covenants and extreme damages they would suffer in economic loss of property value and quality of living. Also a letter from an Alabama Power Company Transmission Lines Supervisor was reviewed which questioned such development. After extensive debate and discussion, the SWRA Board, at its meeting June 27, 2006 passed a resolution which stated: “the property in question (Cardinal Heights power line property) may not be used for any commercial or public use.” Following that meeting the Board reviewed and then rejected a longstanding offer from adjacent property owners to buy the property and in doing so stated: “the property in question will stay as is. The property will not be sold and no development will take place. The Board fully agreed this is a dead issue.” (July 11th, 2006 Letter, Jim Williams President SWRA) Following these actions the SWRA Board, on November 27, 2007, voted to place all SWRA owned “Power Line” property, including the Cardinal Heights area, under the 1987 Residential Covenants. That action ratified previous Boards’ decisions and stated intentions as early as December 15, 2003. That final action would ensure that no development could be made of any property under power lines since they run through residential areas. That would include any boat ramp, boat or trailer storage, dumpsters, beach or swimming area or similar development. The 2007 Board felt this action was necessary to protect its members from repeated efforts to develop the Power Line property. Several years prior to this case the Board was presented with a proposal to locate the Boat Storage facility in the middle of the SWRA Power Line Property in the Vista Wood area. Approval of that proposal would have adversely affected those homeowners on both sides of the power lines. The Board voted against that proposal, with encouragement from the Neighborhood Council. In February, 2005, the SWRA Board voted to purchase three residential lots in order to build an office building. In March 2005, they voted to place a dumpster under power lines on the north side of Vista Wood Drive. 3 August 1, 2008 The Neighborhood Council opposed both of these initiatives in an effort to preserve StillWaters residential areas and after review the Board agreed. (Note: a file has been established for member’s review with documents to support these prior actions including documents from Alabama Power). It is important to note that the Neighborhood Council in its most recent meeting on Tuesday, July 15th, overwhelmingly passed a resolution. They agreed that the Board had researched, discussed and addressed the boat ramp issue thoroughly and that the Neighborhood Council would discuss this issue no further. The Council also discussed, as has the past and current SWRA Boards, the cost of adding to our infrastructure, which includes not only the building of a facility but the cost of management, insurance, taxes and maintenance that would be passed on to all property owners regardless of whether they use the facility or not. The Tennis Courts Area: The strip of land on the lake immediately behind the tennis courts has also been considered as a site for a StillWaters boat ramp on more than one occasion. That property is not subject to any of the Covenants. But just like Cardinal Heights area, this property is surrounded by a residential area and situated in a confining, shallow cove. Almost ten years ago the Developer, Baptist Foundation of Arizona, (BFA), proposed to put a Boat Ramp behind the tennis courts at a cost estimate of some $200,000. After much discussion, and a petition by adjacent homeowners against the proposal, including threats of legal action against SWRA, the matter was dropped. The current SWRA Board would also not approve a Boat Ramp at that site any more than it would at Cardinal Heights—for the same reasons. That resolve was communicated to all residents in the From the Board article in SWRA’s July newsletter. The Legal Issue: There is a doctrine in the law called “Inverse Condemnation”. While federal and state-governing bodies can take property directly under Eminent Domain through a process called “Condemnation” it must compensate the owners when it does so. When governing bodies take actions, which do not directly take property but cause severe economic and quality of life issues, it is called “Inverse Condemnation” and the same rule applies—i.e. the governing body must compensate for those losses. SWRA does not have Eminent Domain but has many similarities in its function to local governments. Should the SWRA Board ever decide to place a commercial or public activity such as a beach or boat ramp in the middle of a residential area – Cardinal Heights or behind the Tennis Courts- it would without question dramatically harm home values of surrounding property owners and severely affect the enjoyment of their property. Those actions would undoubtedly lead to litigation brought against SWRA, which would use the theory of “Inverse Condemnation” which might well result in damages against SWRA. There are also issues of whether existing insurance would cover such a case or the large damages that might result. Conclusion The Board would like nothing better than to replace the amenities that disappeared when BFA went Bankrupt. That includes the placement of a wonderful Beach and a Boat Ramp. The simple fact is that all lakefront property in StillWaters is fully taken up by residential lots, and there are no suitable, and legally acceptable, places to locate such activities. Even if there were a suitable location, it would be very costly. The SWRA Board has taken a consistent position that it will maintain the infrastructure and through administration of the Covenants protect home and property values and ensure, as far as possible, quiet enjoyment of members’ property. It will not allow commercial or public development in residential areas, thus ensuring protection of its members’ property values and peaceful enjoyment. That is what the Covenants call for, and that is why StillWaters is a special place to live. Thank you, The SWRA Board 4 August 1, 2008 Treasurer’s Report--July 31, 2008—Debbie Nigh As of July 31, 2008, SWRA has met our income projections for this year. As most of you know, the maintenance fees and assessments of the properties provide the major source of these funds. Although most property owners pay their bills by the January 31st deadline, it is unfortunate that we also have those who do not pay their fees. A very aggressive collection program for past due accounts has been a major part of our success in meeting income projections. Holloway Credit Solutions, our collection service, collected $7,958 in June and July. Don Harrison, our local collection attorney, collected $7,952 in July for seven legal cases. Unfortunately, our accounts receivable balance still exceeds $100,000 for 130 accounts. You may hear some people complain, but we intend to collect all monies owed in order to keep your costs as low as possible. e will continue our collection program to result in each property owner paying “their fair share” as provided by the SWRA covenants. Marina Boat Ramp There has been discussion concerning the desire for a boat ramp by some Stillwaters residents. Recently I had a conversation with Billy Johnson, manager of Harbor Pointe Marina, about usage of Harbor Pointe Marina boat ramp. First and foremost, Mr. Johnson and Harbor Pointe Marina have always enjoyed, and currently enjoy a good relationship with Stillwaters, the Residential Association, and its members. Initially, understand that Harbor Pointe Marina is privately owned and is a separate entity from Stillwaters. Along with working with and contributing to Stillwaters community, they like any other ongoing concern operate as a business. The Harbor Pointe Marina boat ramp services people who pay for wet/dry storage and the residents of the Harbor Pointe Condominiums. The ramp is closed to all who are not patrons of dry/wet storage or are not residents of HP Condominiums for these reasons: The main reason is a Safety issue for the Harbor Pointe personnel and others. Often people, after launching their boat, would park their vehicle and trailer in the Harbor Pointe parking lot which is a small parking lot, not designed for vehicle and trailer storage for any period of time. Harbor Pointe personnel would find it impossible to pull from, or set boats in dry storage for their paying customers because vehicles and trailers were blocking the way thus causing safety issues for personnel and property. A second reason was the misunderstanding of some Stillwaters residents that they were allowed to use the Harbor Pointe boat ramp for free because of their residential standing. Not only were they expecting to use the ramp for no charge, but also would tie their boats up in a slip using these slips for hours, weekends, and weeks at a time again at no charge. The slips at Harbor Pointe are rented, assigned to condominium owners, and maintained for paying customers. Harbor Pointe Marina has available to all, dry storage, wet slips, and a Ship’s Store which is well stocked with reasonably priced items, soft drinks, beer, snacks, pizza, boat supplies and loads more. Some more helpful information is that boats and trailers can be stored at the old Conference Center parking lot next to the Harbor Pointe Marina. Call 825-2060 and ask for Don. Prices vary on duration of storage time and what’s to be stored. Hope you all will find this helpful and won’t hesitate to make arrangements convenient to yourselves from all opportunities that these two gentlemen and their business concerns have to offer Stillwaters. Tom Dyne, Neighborhood Council representative, Water’s Edge 5 August 1, 2008 Fire Action Photography The SWRA Board would like to personally thank Mr. Jeff Barrick for his very professional color photography of the recent fire at the Sunset Point condos. Those photos proved useful to the Fire Marshall and other investigators, as well. Anyone wanting a set of fire action photos on a CD should contact Jeff through the SWRA office. Thanks again, Jeff. Golf Cart Safety Campaign Recent statewide publicity on the hazards associated with the use of golf carts on public and private highways has caused us to repeat an article from the January 2008, The Voice of StillWaters. There have been several near misses between golf carts and vehicles on StillWaters streets. Most involve children driving carts (golf carts and all-terrain four wheelers), with some incidents being at night with no lights on the cart. The Board of Directors has passed a resolution: All motorized vehicles (golf carts, ATVs, etc.) operated on StillWaters roads and streets must be operated by a licensed and insured driver as required by Alabama law. A UAB researcher, Gerald McGwin, says that the use of golf carts is encouraged by communities due to their low pollution levels, quiet operation, and presumed safety. He further stated that the carts are quite dangerous, especially when used on public roads. The SWRA Board members recognize the inherent hazards of golf cart use in StillWaters and are intent on implementing some aspects into a safety program to include publicity of recommended safety features. In the near future, the Board will identify violators who practice unsafe operation, specifically stopping unlicensed, uninsured golf cart/ATV drivers and giving the vehicle owners written notice of their violation. Other unsafe practices will not be identified, but owners may expect future stops by Alabama law enforcement officers as the new traffic law enforcement activities begin in StillWaters late in 2008. We hope to head off accidents and future citations with our promotion of common sense operation and public awareness. According to a recent Montgomery Advertiser article, those other “unsafe practices,” such as the lack of helmets, no seat belts, and no lights/reflectors, should be taken seriously by cart owners. McGwin recommends that owners incorporate all three safety features on their own carts, coupled with an added restriction that there be no child passengers under 6 years of age. This is a LOT of new information, but as traffic counts inside StillWaters continue to climb, we do not want an accident or death as a result of golf cart use. That would NOT be good, so let’s stay safe by driving golf carts responsibly! Large Dumpsters Near Condos Are Private! Once again, we want to remind all property owners that there are lots of private dumpsters around the community. Those are not for public use. If you are a weekender who does not have trash pickup service, then the old adage, it is time to “pack your trash,” is still the best policy. For those with trash pickup service, large limbs or oversize items should be handled by your using the county dumpster (for a fee) or by paying a local contractor. We appreciate your cooperation on this issue. 6 August 1, 2008 From the Covenants and Maintenance Manager I hope that everyone using the pool has enjoyed it this year. The cloudy water on Monday afternoon is from the cleaning and treatment of the pool in the morning. The chemicals used will not hurt you and the cloudiness usually dissipates by mid afternoon. Please put all of your trash in one of the three trash receptacles. The pool is not the place to dispose of your uneaten pizza. A whole pizza was found in the pool several weeks ago. We empty the trash receptacles on Thursday evening and also the restroom is cleaned at that time. I will try to inspect these items on Monday after a busy weekend. If you see a deficiency that needs taken care of, please notify me. Also, I have had several complaints of older children being very discourteous and rambunctious in the pool area while families are there with their small children. Please notify me when this happens. Please call the office during the week at 825-2990. On Saturday, call the gate house at 825-0208 and they will send the roving patrolman to take care of the disturbance. On Sunday, call the gate and leave a message with the attendant and this will be given to me the next day. The pool is for all to enjoy, residents and their guests, please obey the posted rules and all will have a safe and enjoyable time. We have done some repair work on the tennis courts. The cracks in the playing surface have been filled and painted. A new head band on the back court net has been installed and the center hold down straps have been replaced on both nets. Please help us keep the courts as clean as possible by placing all of your trash in the receptacles. We will attempt to keep the courts blown off as necessary. As you know, with Fall approaching, the leaves are always a problem. We will do the best that we can. If you see something that needs my attention, please call me. A few people are very good at letting me know when something needs to be fixed and I appreciate their assistance. You all can help. The 2008 road paving and patching work will start this month. Please be aware of the workers and avoid driving through the work zone if possible. If you must drive through, please drive very slowly and be prepared to stop. If the weather cooperates, the work should be finished by the end of the August. Don’t forget that the new trash pick up day is Monday. If at all possible for weekenders, please ask a neighbor or hire a kid to move your trash cans back into your storage area so that they will not have to stay on the street for the entire week or until you return again. They are very unsightly to the folks who live here full time and visitors who may be here for the first time. The boat and trailer parking at residences is being abused again. More residents are violating their covenants that prohibit parking trailers and boats on your parcel unless they are in a car port or a garage. All condo and villa parking lots have been posted with signs prohibiting boats and trailers. The parking of trailers in the parking areas at Poplar Point is a problem. Enforcement of the covenants prohibiting parking of trailers inside of StillWaters will be applied. Since there is no practical way of knowing who the various trailers belong to, we will be forced to have the trailers towed to an impound area located in Dadeville and if your trailer is towed, you will be responsible for the fees to the towing company and the also the storage fees. We will start enforcing the NO Trailer Parking ordinance the middle of this August. If you need to temporarily park you trailer in your driveway or on your parcel to do maintenance on it, please call me and let me know so that I won’t have to write you one of my famous letters. Remember there are several public storage areas in the vicinity now including one inside StillWaters where you can rent a space short or long term very reasonably and have unlimited in and out privileges. Sunset Point 1 Pool/Clubhouse The pool and clubhouse that is located on Sunset Point 1’s property is a member’s only facility. Just because you live in or own land in Stillwaters, does not make you a member of this facility. If you are not a member, and are using the facility, then you are trespassing and are subject to arrest. It costs to run this facility and we cannot afford to allow everyone to use the facility without paying for a membership. We would like to invite you to become a member of Sunset Point 1 Pool/Clubhouse. Annual memberships are available to anyone who lives in or owns land in Stillwaters. The membership fee is $600.00 a year. If you are interested in becoming a member, please contact Stan Gillies at 256-825-0059. Sunset Point 1 BOD 7 August 1, 2008 From the Red Tees Some of our hardy lady golfers are playing Tuesdays and Thursdays despite the "HEAT" We have tee times at 9:30 AM and all ladies are welcome. On July 1st we held our "Flag Tournament". Your handicap plus 72 equals the number of strokes you get by planting your flag when reaching your total. The person carrying her flag the furthest wins!! Mary Oakes was 1st, Sandy Mathis 2nd, Vickie Oda 3rd and Robbie Black 4th. A "Par 3" tournament originally scheduled for June has been put on hold. Agendas will be published at much as possible in advance of the regularly scheduled meetings as possible. Attendance: All Board members and staff will attend Open Meetings as needed. StillWaters property owners may attend Open Meetings with prior notice to Community Administrator identifying the agenda item of interest. If more than one agenda item is claimed of interest the Board must approve. Minutes will be kept by the Secretary and made available after approval to the SW community on request by email and other means. Executive Meetings: Will be used only for matters of a confidential nature such as personnel, litigation. To go into Executive Session a motion must be made and seconded followed by affirmative majority vote. At the call of the chair an Executive session may be set. All matters considered and discussed in Executive Sessions are confidential and privileged. Board members may not reveal those matters in any way to non Board members. Violations may subject Board members to expulsion from the Board if found guilty by majority vote of the Board. Minutes from Executive Session will be confidential and privileged and retained by Board Secretary separately from the regular Board minutes.
