Offering a unique and eclectic mix of women’s clothing (sizes 2-22), heirloom children’s clothing and accessories, fashion artwork and framing, one-of-akind custom made jewelry, hand-crafted leather bags, custom designed clothing and so much more, Geraci Condello has something for everyone. Owner and St. James resident Madeline Grudens, a Fashion Institute of Technology alumni with a background in pattern making and design, has created a wonderful environment sure to please the shopper in all of us! According to Madeline, “We make and can customize most of our products. We encourage our cliental to come in, experiment with our make-up, try on clothes and chat – with absolutely no sales pressure. Our goal is to have our customers feel like they have a fashion home. A place to discover new things. A place to decompress.” Inspired by the great fashion houses of Paris, Geraci Condello’s fashion art handbags are created by making hand sketches, layering the sketches on the computer and then printing the design on heavy canvas. Handbags are then embellished and lined with luxurious satin which can also be personalized with your name and even a short story or message. Beautiful Italian patent leather, brass closures and leather wrapped chains complete your very own one of a kind fashion accessory. Hand tooled leather bags are made from soft tooling leather and are hand stained to bring out the detail in the carving. Each bag is hand stitched and finished with brass chains and closures. Chains can be lengthened or shortened according to your preferences. Looking for a special occasion dress? Why not have Madeline custom design and fit you for your special event. Exquisite fabrics, expert fabrication and superb fit will make your individualized fashion art inspired garment a piece that is uniquely you. Hand crocheted wraps, made from the finest yarn imported from Italy are the perfect finishing touch for your spring and summer wardrobe. Be sure not to miss Geraci Condello’s growing collection of vintage clothing and vintage inspired pieces. Geraci Condello has also designed a custom line of jackets, available in the fabric of your choice, meticulously executed to your measurements. Experience the difference that custom tailored clothing can make to your wardrobe. Leisure wear, fabulous undergarments, cashmere blend socks, sweaters, slacks and dresses round out the choice offerings at this exceptional boutique. The Memorial will be constructed on the property of the St. James Fire District, located at 221 Jefferson Avenue in St. James. The centerpiece of the memorial site will be a steel column that was originally located in the lobby of the North Tower (One World Trade Center). The steel column was donated by the Port Authority of NY & NJ and is re- ferred to as the “bowtie section” of the column. The design plan for the memorial site will consist of the steel column installed on a reinforced concrete foundation, as it was originally erected in The North Tower. The site will also contain lighting, miscellaneous landscape features, a commemorative plaque, and benches. On September 11, 2011, there will be a Dedication Ceremony to formally open the 9/11 Memorial Site, and to remember and honor the 2,973 people that lost their lives as a result of the terrorist attacks on September 11, 2001. At that time all those who played a role in the construction and successful completion of the St. James 9/11 Memorial Site will be acknowledged. Donations are being sought in labor, materials and money. For more information and to be a part of this project honoring all the people who lost their lives on 9/11, please call 584-5799. He has dedicated almost four decades, to the towns, hamlets, and villages he represents; and listens to and truly cares about, his constituents. He has demonstrated that he is a knowledgeable, eloquent speaker, who has participated in numerous events throughout the years. His ‘prayer breakfasts’ are, and have been, indicative of his acknowledgements; and dignify his recognition of the importance of ‘belief’ in his daily life. OUR TOWN • MARCH 2011 ViSiT www. ourtownstjames.com – 17 – BLADE & BRANCH HINTS, TIPS & GREAT IDEAS FOR KEEPING YOUR PROPERTY BEAUTIFUL SPRING IS THE TIME TO GROW GREAT LAWNS! Spring is finally here! This is the time to get some fresh air. It is also a time to take care of your lawn to prepare it for the spring and summer months. Prevent spring weeds or crabgrass from attacking your lawn. A beautiful lawn takes a little bit of effort, but is well worth the time and money spent. Crabgrass is a weed that grows as the weather warms, but the time to control it is now. Its invasive growing habits are very damaging to desirable turf. Crabgrass basically smothers the good grasses that surround it and forms a crabgrass scar as it dies in the fall. These scars fill in again with crabgrass next year and the cycle continues. If not prevented or controlled, crabgrass can literally take over your entire lawn. The best weed control is healthy lawn! This would require improving the soil so the grass will thrive. How do you do this? Start with a soil test and get an early start. You will get better results by seeding, liming, fertilizing and watering early in the spring before crabgrass begins to germinate. Be sure to get a quality seed blend right for your growing conditions. Keep in mind, it’s not magic. If you can grow weeds there you can grow grass. If you are having a difficult time growing weeds or just have dirt or moss, this is a sign of soil or shade problems that will need to be addressed. Go to our website to see Helpful Tips-Shade Lawns for more useful info. Some people choose to use herbicides to control the outbreak of crabgrass. This should be applied two weeks prior to the germination of crabgrass. The timing for this coincides with bloom drop of forsythia bushes. If you are not sure when this would be, contact a professional horticulturist for advice. Spend time in the yard and garden this year. A little work goes a long way and it’s great exercise too! You and your family will enjoy the benefits and rewards of a beautiful lawn and landscape all year long. If you feel that you do not have the time to take care of your lawn and landscape always feel free to contact Emerald Magic for a Free Evaluation and Estimate. While crabgrass is a nasty weed that can take over your lawn, there are other spring weeds that can overrun your flower beds. Here are some tips to help prevent and eliminate weeds from growing. • Turn the soil with a trowel or hoe. This will help to uproot young weeds and expose their roots. • If pulling those weeds by hand, make sure to pull the roots too. • Plant your vegetables and flowers closely together. This will help shade-out weed seedlings. Look on our website under Helpful Tips to learn about weed resistant shrubs, perennials and flowers. First-time author Robin Rosenberg’s ideas about diversity, acceptance, and bullying recently blossomed into published form via Brookie Cookie Bookie, a children’s book now available from Amazon.com and Rosenberg’s website, www.BrookieCookieBookie.org. “I think in general every parent has that fear of their child being bullied or not being accepted,” Rosenberg said. “Writing this book, I was looking for a way to encourage conversations with children about acceptance.” The author, who worked in college admissions for 10 years, hopes Brookie Cookie Bookie will serve as a discussion starter that helps parents and caregivers speak to toddlers about diversity and celebrating individuality. Adults might read the book aloud to children, then ask and answer questions about the book’s message and its characters. Featuring Rosenberg’s poetic verse, the words in the story are highlighted by the drawings of her own daughter, Brooke, and several of Brooke’s close friends and extended family; meanwhile, the book’s characters, a colorful goup of toddlers, discuss each other’s likes and dislikes. In this fictional conversation, differences are not only acceptable, the book seems to say, but important: they have the potential to bring us closer together. “It’s about finding common ground with people they may not feel they have much in common with,” Rosenberg emphasized. “I just want to get this message out there.” A portion of proceeds from sales of the book will be donated to charities assisting children facing different types of adversity. They belong to the organization Proud girls on the move. Each month they plan a community service event to help out in the community. In the past they have made 1,000 sandwiches for a soup kitchen, decorated a less fortunate family’s house for the holidays and lavished them with donated gifts; put on a fashion show in collaboration with Old Navy and the girls of the Little Flower Orphanage. For the month of March, they are holding a PROM DRESS DRIVE for girls who are unable to attend prom because they cannot afford a dress. The event will be held in late March where girls in need from all over Long Island will be able to pick a dress free of charge. Many Long Island boutiques have shown their support by donating dresses to the “Prom Dress Boutique.” The more dresses they receive the more girls can be served. So please do your part and help them out with this month’s give, “The Prom Dress Boutique,” and donate a dress that you think deserves a second dance! Don’t just let your old dresses sit in your closet, give it to a girl who will be happy to wear it. Help make a girl’s dream come true and let her have an amazing night at prom, just like you did. All dresses are needed, long or short, at any size. Please be sure that it is gently used. You can drop off your dress at Daniel R. JAMES: Willie Collier’s Villa, the Heart of the Actors’ Colony in St. James.... by Bradley Harris, Smithtown Historian Especially for Our Town, I am writing a series of short stories about people who made St. James their home not so long ago. I hope that these stories will add to your knowledge and appreciation for the wonderful history of our town, St. James. At the turn of the last century, the little country village of St. James became a favored spot where many theatrical personalities of the day gathered to frolic and gambol their summers away. By the summer of 1903, over 100 theatrical performers – actors and actresses, comediennes, dancers, singers, jugglers, acrobats, vaudevillians, and managers – were making a pilgrimage to St. James to spend a few months of relaxation in the sunlight. In St. James, this assemblage of performers gathered in an area they called “Collierville,” a little community that was located in the wooded hollow where Three Sisters Road and Harbor Hill Road intersect in today’s incorporated village of Head-of-the Harbor. It was here that Willie Collier’s villa was to be found, on the northeast cor- ner of Three Sisters Road and Harbor Hill Road. To the theatrical folk who flocked to St. James for summer relaxation, St. James was known as Collierville. They knew it as Collierville because of its association with “Willie” Collier, an actor, playwright, and comedian, who had made St. James his summer residence in 1889. “Willie” Collier was the son of Hattie and Edmund Collier. Edmund Collier was at one time one of the best-known actors in the country and he married Hattie Engel after meeting her when she was performing as a dancer on stage. This marriage of theatrical greats produced a family of theatrical greats. There were four children: “Willie” who became famous, Helena Collier Garrick who was an actress, John Collier who did not pursue a career in theater, and Catherine Collier Campbell who was also an actress. From this theatrical family, Willie Collier got an “itch” to be in the theater. (“Mrs. Collier Died Yesterday,” New York Telegraph, July 2, 1898.) Born on Nov. 12, 1864 on Varick Street in Manhattan, Willie headed for “the stage as soon as he was old enough to know the location of the neighborhood theater.” Starting as a youngster, sUNNy roadEst.rUG CLeaNers 1948 Powerful Truck mounted On location cleaning • Area rugs Picked up • Washed In our Plant • upholstery Cleaning • repair • Binding • fringing Tile Grout Cleaning & restoration 584-5160 anne marie lisa cErtIFIEd NutrItIONAL cOuNSELOr Nourish the body, mind & Spirit with • Expert nutritional advice for adults and children • guided meditation classes • 104 Lake Avenue., St. James email us at: sunnyrugcleaner@optonline.net he worked as a “call boy” for Augustin Daly’s theater company and was given minor parts in several theater productions. Shortly after leaving Daly’s theater, Collier appeared as a star on Broadway. At the age of 22, he co-starred with the famous actor Charles Reed and, in his thirties, he appeared as the lead in “The Man From Mexico,” “On the Quiet,” “The Diplomat,” “Twirly, Whirly,” “Are You My Father?,” “The Dictator,” “A Fool and His Money,” and many other light comedies. His prominence on the stage brought him into association with another famous actor of his day, George M. Cohan. Collier and Cohan became fond friends and the foremost actors of their day. (This information about Willie Collier came from an undated, un-attributed newspaper article that is part of a scrapbook on file in the William Collier collection of the New York Public Library on 42st and 5th Avenue.) Fame brought fortune to Willie Collier, and in 1889, using his new found wealth, he purchased a small farmhouse on 15 acres of land on the northeast corner of Three Sisters Road and Harbor Hill Road in St. James. Willie was drawn to St. James because continued on page 42 REIKI - a Japanese technique for stress relief and tranquility! (“Blissful Summer Life of Colony of Clever Men and Handsome Women Who Have Solved The Problem of Social Contentment,” un-attributed newspaper article from 1902 contained in the Willie Collier scrapbook on file in the Willie Collier Collection of the New York Public Library on 42nd St. and 5th Avenue.) The original farmhouse on the property was small and Willie “spent considerable money improving his place” and gradually extended the house into a handsome villa, “surrounded by extensive and well cared for grounds.” The house as it looks today is considerably changed since at one time it had three stories with an attached turret and a porch that ran across the full front of the house. It was said that the house contained a “billiard room” and “all the appointments of a country gentleman’s establishment.” In this house, Willie Collier and his wife Louise Allen, and numerous guests, spent their summers from 18951905. (“Stage Favorites Loaf the Summer Away,” The Morning Telegraph, July 13, 1903.) Willie purchased a farm and he continued to run it as a farm. On the property he had a vegetable garden, two stables, with associated outbuildings, three pig pens, a hen roost, an icehouse and a windmill. The pride of the farm was a prize-winning Yorkshire pig named “Willie” who was kept in the pig pen along with “Mrs. Pig and a lot of little porkers.” Apparently nothing delighted “’Farmer’ Collier so much as to lean over his pig pen and talk” to his favorite pig “Willie.” The hen roost with its “big cackling aggregation of chickens” was located near the windmill and the hens were carefully tended by Mrs. Collier. The Colliers also kept a milk cow which could be found grazing the Collier meadow. The cow supplied the family and friends with fresh milk. In the stables, Willie had two horses. One was Louise Allen’s “saddle horse, a blue ribbon animal,” and the other horse was a “thoroughbred” named “Bunker” that Willie Collier occasionally raced. The menagerie would not have been complete without the six fine English setters that were housed in the farm’s kennel. Willie Collier had almost every appliance needed to run a wellregulated farm and he had even St. James Dog Grooming DUE TO A FIRE at our facility, we have temporarily suspended all services. gone so far as to install “a main for acetylene gas and a waters system.” All this made the Collier farm one of the finest properties owned by any member of the actors colony, and the Colliers welcomed many of their friends to the their villa. (“Blissful Summer Life of Colony of Clever Men and Handsome Women Who Have Solved the Problem of Social Contentment,” un-attributed newspaper article from 1902 contained in the Willie Collier scrapbook on file in the William Collier Collection of the New York Public Library on 42nd St. and 5th Avenue.) The Collier villa became the heart of the actors colony. It was here that one could find other actors and discover what was happening in the community. Because of this, many actors rented houses nearby and the Collier villa became the geographic center of the colony that the theater people called “Collierville.” This was the place to be while enjoying the summer in St. James. Admission is free, but call ahead to reserve at 862-6575. Visit www.stacarts.org for directions and further information. This presentation is a musical survey of the history of women in America. By looking at the popular songs of the past – the ballads, love songs, suffrage anthems, work songs and dance tunes – we can trace the perceptions and realities of women’s lives. The music of the day shows the role of women in 18th and 19th century American society. Accompanying herself on mountain and ham- mered dulcimers, pennywhistle, guitar and limberjack, Linda Russell explores the images in the songs, interspersing the music with lively commentary that includes excerpts from diaries and letters in which the women tell their stories in their own words. Balladeer/musical historian Linda Russell has explored America’s past through song for over 30 years. She has performed at many venues including Carnegie Hall, Lincoln Center Out-of-Doors and The Metropolitan Museum of Art’s American Wing and has recorded eight albums of traditional and historical music. Choosing the right Pillow with so many choices, choosing the right cervical pillow can be challenging. However, it is one of the best investments you can make for the health of your spine. there are three normal curves in the spine that need to be maintained. If not, abnormal stresses are applied to the spine and over time can lead to neck, shoulder, upper back, mid back and possibly lower back pain. A good cervical pillow will help maintain your neck curve and lessen the stress to your cervical spine. the spaces created between your body and the mattress varies depending on the position you sleep in. cervical pillows are designed specifically to support your neck in a neutral position when sleeping on your back or on your side. Sleeping on your stomach is by far the worst position, and not recommended, as you have to turn your head to the side thus creating a torsional stress to the cervical spine. cervical pillows come in differ- ent sizes. It is important for you to choose the correct size pillow, which will vary depending on whether you are a back or side sleeper. An improperly sized pillow will not maintain proper alignment and potentially cause discomfort. when sleeping on your back you should use a pillow that cradles your head and fills the small void created from the back of your neck to the mattress. when sleeping on your side, your shoulder width plays a roll in deciding the size of the pillow. Obviously this distance will be different amongst us and you should be measured for it, but ultimately you want to maintain a neutral posture without your head bending down or being kinked up. For those who find themselves sleeping on both their side and back throughout the night, there are pillows designed to accommodate both positions within a single pillow. On a side note, the added benefit to maintaining good cervical posture with sleeping is that it re- MEMBEr: • AMErIcAN cHIrOprActIc ASSOcIAtION • INtErNAtIONAL cHIrOprActIc ASSOcIAtION • cOuNcIL ON dIAgNOStIc IMAgINg duces snoring as your breathing passage is better aligned and not obstructed. when considering the average person sleeps approximately one third of their life, choosing the right cervical pillow to maintain good posture is a wise investment. OUR TOWN • MARCH 2011 – 64 – P O S T A L C O R N E R New Stamp Issues Latin Music Legends On March 16, 2011 the Postal Service issued a latin music legends commemorative stamp (Forever priced at 44¢), in five designs in a pressuresensitive adhesive pane of 20 stamps. With this stamp the U.S. Postal Service honors five musicians and performers of the Latin sound whose contributions have had a lasting impact on American music – Tito Puente, Carmen Miranda, Selena, Carlos Gardel, and Celia Cruz. Among the distinctive musical genres and styles represented are latin jazz, samba, tejano, tango, and salsa. For these stamps, artist Rafael Lopez, San Diego, CA, painted semi-realistic portraits of each musical artist designed to evoke their personality, their vitality, and even their sound. He used a warm palette of colors – from bril liant yellows, pinks, and lime green to rich shades of purple and blue – to suggest the flavor and energy these artists brought to their work. Each musician is depicted in midperformance. Art Director Ethel Kessler says, “My goal was that when you see the stamp, you hear the music.” The latin music legends stamp is available at St. James Post Office. Neon Celebrate! On March 25, 2011 the Postal Service will issue a neon Celebrate! special stamp (Forever priced at 44¢), in one design in a pressure-sensitive adhesive pane of 20 stamps. Inspired by a visit to the Museum of Neon Art in Los Angeles, Art Director Phil Jordan began to think about the possibility of using neon to depict a stamp subject. He decided that a “neon Celebrate!” stamp, with its imagery of vivid colors, fit the bill. The black background of the stamp is reminiscent of a night sky. Like a fireworks display on a summer evening, brilliantly colored images of swirls, circles, and dashes in pink, blue, orange, yellow, and green seem to erupt from the ground to illuminate the darkness. Each letter of the word “Celebrate” and the exclamation point that is part of this stamp’s official title, are highlighted in bright white light. The neon Celebrate! stamp will go on sale at the St. James Post Office on March 25. Jazz On March 26, 2011 the Postal Service will issue a Jazz commemorative stamp (Forever priced at 44¢), in one design in a pressure- sensitive adhesive pane of 20 stamps. The U.S. Postal Service is proud to pay tribute to jazz, America’s musical gift to the world, and to the musicians who play it on festival stages as well as in studios, clubs, and concert halls. Art Director, Howard Paine, designed the stamp to showcase the work of Paul Rogers, an artist living in Pasadena, California. In creating the art for the stamp, originally using ink on paper and then finishing his work digitally, Rogers explored the way images could become a visual equivalent of jazz music. He was inspired by the cover art from vintage jazz record albums – work that captured the music’s improvisational quality while built on a clear understanding of its underlying structure. The Jazz stamp will be available at the St. James Post Office on March 26. Herbs On April 7, 2011 the Postal Service will issue a 29¢ Herbs stamp in five designs in a pressure-sensitive adhesive pane of 20 stamps and a coil of 100. These stamps will be denominated at the postcard rate. Are we there yet? How much longer? If you, like me, yearn for a greener world, (literally and figuratively) now’s the time to make it happen. Soon enough we’ll be involved in outside activities and interior home projects will be put on the back burner. While I’m all for getting the outside green and ready for spring and summer fun, let’s think of “greening” the interior. Green projects, large and small, benefit you, your family and the environment. The following are some things you can do before the great outdoors becomes too tempting. All that is needed is a new mindset and the willingness to change old habits. Think of it. If we each changed 10 things we’ve always done, replacing them with 10 healthier and more planet friendly actions, what strides we could make! Here are simple suggestions from a great little resource called “Just Green It!!” authored by Lisa and Ron Beres. 1. Consider green cleaners instead of Windex or better yet, try vinegar (2 cups of water to 1 cup white distilled vinegar) and use newspaper instead of paper towels to clean glass without residue. 2. Use essential oil scented candles or a diffuser to scent your home instead of conventional air fresheners that only mask odors. Try toothpaste, not silver polish, olive oil, not Pledge and wool dryer balls, not Bounce to limit the toxins in your home. 3. Use plants for air purification, not ionic air purifiers. Some of those that remove formaldehyde, benzene and carbon monoxide are bamboo palm, Chinese evergreen, English ivy, corn plant, pot mum and peace lily. 4. Use high efficiency pleated filters, not fiberglass, and change at least 4 times a year or when dirty. 5. Use energy star appliances not older models to reduce your bills and avoid wasting energy. 6. Instead of tap water use a home water filtration system for drinking and showering to keep your family safe and healthy. specialist, Maureen Calamia along with professional organizer Cynthia Braun and closet and garage specialist Augie Carbone for a special event to not only inspire you to make a new beginning in your home, but to give you concrete “how to’s” to get there. Refreshments will be served. Free to club members; $10 for non-members 7. Use stainless steel containers not plastic bottles to help recycling and your own health. 8. Use a coffee mug not paper cups and save cups from going into the landfill (Starbucks gives you back 10¢ if you bring your own cup!). 9. Try surge protectors not wall outlets which protect your electronics and makes it easier to turn off your equipment at the end of the day. 10. With innovations and tax credits, maybe it’s time for you to think solar and conserve on electricity. Check it out. On the forest floor look for the bright green ferns with their fronds unfurling. Notice the many shades of green all around. New life is everywhere. April is National Gardening Month so get out there and get your hands into the warm soil. Plant something, anything. As your perennials start to grow, put the plant supports in place. There are many styles available at your local nursery. You can also use your old tomato cages, cut to size, bamboo sticks, or just the branches you have left from your prunning job. The idea is to get them in place so the plants grow up through them. You can prune roses and rose of Sharon now, and azaleas as they finish flowering. Do not cut foliage from spring-flowering bulbs, cut flower stalks only. Cut your ornamental grasses if you haven’t already. Towards the end of April you can direct-sow zinnia, cosmos or California poppy seeds. In the vegetable garden, plant potatoes, onions and shallots. Direct-sow carrots, beets, kale, and more lettuce, spinach and radishes. Make sure you save a space for your child’s garden. Your child will love planning, planting, harvesting and eating his/her own vegetables. It’s spring – time to clean out the gutters, tune up the lawnmower and wash down the windows. But as you attend to these types of tasks around your home, why not take the time to do some financial “spring cleaning” as well? Specifically, consider these moves: “Dust off” your investment strategy. If there’s an area in your home that you haven’t looked at for a while, you may need to dust it off in preparation for the new season. And the same principle may apply to your investment strategy – if you haven’t examined it for a while, it may be time to clean it up to prepare for a new season in your life. After all, since you initially designed your invest- ment strategy – that is, the total amount you invest, the percentages going into “growth” and “income” vehicles, the dollars going into taxable versus tax-deferred accounts and so on – many things may have changed for you, such as your employment situation, the number of children in your household and even your long-term goals. Consequently, you may need to revise your investment strategy in consultation with your financial advisor. “De-clutter” your portfolio. The chances are pretty good that if you look around your house, you’ll find many things that are actually duplicates, such as those five coffeemakers you’ve accumulated over the years – so you decide to “purge” a few. And when you take a close look at your portfolio, you might find several investments that you’ve added over time and that are similar to each other. If that’s the case, you might help yourself by selling the “redundant” investments and using the proceeds to buy different ones continued on page 72 autonomousdesign, ltd. specializing in green design since 1973 design new homes constr. management kitchens bathrooms development alterations historical restorations roofing siding construction landscape design swimming pools decks • patios office interiors stephen cinco 22 stonegate, st. james, new york 11780 OUR TOWN • MARCH 2011 (631) 724-7726 – 71 – TAKE CHARGE OF YOUR FUTURE. In this uncertain climate, many people are anxious to try to find a safe place for their savings. Two popular options are certificates of deposit (CDs) and deferred fixed annuities#. Both are considered low-risk vehicles for building wealth; yet they differ in important ways. Which choice is better? The answer depends on your goals and priorities. The following information will help you determine which of these two products is best suited for your needs at this time. • Safety of Principal: Both CDs and deferred fixed annuities are considered low-risk investments. CDs are generally issued by banks and, in most cases, are insured by the Federal Deposit Insurance Corporation (FDIC) for up to $250,000* per depositor. Should the bank fail, the FDIC guarantees CDs up to this amount. Deferred fixed annuities are issued by insurance companies and are not insured by the U.S. government. In later years, they usually offer more flexibility if you need access to your money.*** They can even be used to provide a legacy for your heirs. • Distribution Options at Maturity: When a CD reaches its maturity, you can take the CD’s lump sum value in cash, renew the CD for the same or different maturity period or examine other investment alternatives (such as a deferred fixed annuity). In a deferred fixed annuity, you may elect to withdraw your money in a lump sum*** or you may want to select a lifetime income option, which provides you with a flow of income that you cannot outlive. You could also elect to let your funds continue to accumulate until a need arises. • Taxes: Federal law treats these two savings options quite differently. If taxes are a concern, a deferred fixed annuity may be the more attractive choice. CD earnings are taxable the year the interest is earned, even if you don’t withdraw the money at that time. In contrast, earnings from deferred fixed annuities are not taxed until they’re withdrawn, giving you some control over when and how much tax you’ll pay. This week I will explain the benefits of grieving your own taxes and why you need a certified appraisal. The Time Benefits: If you are thinking of selling your home this spring and considering having your taxes reduced as a selling tactic to lure in prospective buyers in this sluggish real estate market then consider this: If you wait until tax grievance day, and file with a tax grievance company, chances are you won’t have an answer from the Board of Review until the end of July. If your grievance goes as far as a small claims action, you won’t get relief, if at all, until six months to a year. Yes, the courts are that backed-logged. But if you have an informal meeting with the Smithtown Tax Assessor, it is my experience that homeowners have an answer from the Assessor before tax grievance day. No waiting! You can brag about your tax reduction on your listing and you won’t miss the classic “Real Estate Selling Season” waiting for a tax reduction. I urge you to contact The Smithtown Tax Assessor’s Office to learn the procedures for an informal assessment review before contacting a tax grievance company. a few examples of saving: • A homeowner on The Tuck in St. James saved $3,800 last year. • A homeowner on Fifty Acre Rd. South, St. James saved $5,000 last year. • A homeowner on River Hollow Lane, Nissequogue saved over $6,000 last year. All of these homeowners used the informal assessment review process and all had great success on their own. By the way, these homeowners only paid for a small nominal appraisal fee, and not half of their savings like they would have been forced to by a tax grievance company. It does work. No tricks, no schemes, just an appraisal. The Monetary Benefits: You may be wondering, will I be getting the most savings by grieving my own taxes? Here are Why a Certified Appraisal? OUR TOWN • MARCH 2011 – 78 – L E G A L - E A S E More Power to the Power-of-Attorney by Joseph a. Bollhofer, Esq. Almost everyone has at least heard of a Power-of-Attorney, and many people have them. A Power-of-Attorney (“POA”) is simply the written authority to act on someone else’s behalf. The concept has been around for a long time. Ancient writings show that they were in use by Babylonian and Persian rulers during the fifth and sixth centuries B.C. Along with a Last Will and Testament, Health Care Proxy and Living Will (instructions to withdraw life support), a POA is part of a basic estate plan. Under POAs signed before September, 2009, the person authorized to act is known as an “attorney-in-fact.” This person does not have to be an attorney, and often is not. The law in New York and the statutory form POA were dramatically changed effective September 1, 2009. The person authorized is now known as an “agent.” The person giving the POA is known as the “principal.” The law was fine-tuned effective September 12, 2010 and, of course, a new form was created. If the correct form was signed and notarized during the applicable period, it is still valid. This is true no matter how old the POA is. However, you may have a problem convincing third parties to honor a POA that is many years old because they might not believe it is still valid, and they might not believe that it was the correct form in existence when it was signed. The statutory form has changed several times in the past 20 years. POAs are often used for convenience, such as when one person is acting on behalf of another at a house closing. However, a comprehensive POA, which provides additional powers beyond those listed in the statute, can be worth more than its weight in gold if the need arises. A good POA is “durable,” that is, it is still valid if the principal is incapacitated. In fact, the statutory POA forms in existence since September 1, 2009 contain a presumption that they are durable unless they state otherwise. A comprehensive POA, together with a Health Care Proxy, can avoid the need for the appointment of a guardian by the Court on behalf of an incapacitated person. Guardianship proceedings are expensive, time consuming and often emotionally draining. A comprehensive POA will permit an agent to act on behalf of a principal to do virtually everything that the principal could do. The following should go without saying, but I’ll say it anyway: The agent has a legal, ethical and moral obligation to act in the best interests of the principal. Although a POA can be written to authorize the agent to make gifts of the principal’s property, including gifts to the agent himself, the agent always has an undivided obligation to the principal. This is a concept that, unfortunately, more than a few agents do not understand, or refuse to recognize. A glaring abuse of authority by an agent who essentially stole his uncle’s money inspired New York’s legislature to dramatically change the law and the basic form in 2009. Under the new statute, if the principal desires to give to his agent authority to make gifts of any type in excess of $500. in the aggregate per year, that authority must be spelled out in a separate Gift Rider to the POA. There are other optional safeguards in the POA, such as the right to appoint a third party to monitor the agent’s actions. All in all, under the new statute, the POA has become a considerably more complex document. These complexities are designed to make people think more carefully about the authority that they give. The standard statutory form POA contains a list of categories under which the agent can act. The law allows the POA to be OUR TOWN • MARCH 2011 modified in various ways. The most common modifications provide for the addition of various powers to suit a particular person’s circumstances. For instance, in a comprehensive POA, commonly certain powers are added, such as the authority to create trusts, both revocable and irrevocable, and to transfer assets into those trusts. Also, the power to modify or revoke trusts often becomes important, as does the power to make applications for benefits to various agencies, such as the Social Security Administration, Veterans Administration and Department of Social Services. Some important limitations to remember: 1. The agent under a POA does not have the authority to act until he or she signs the document. 2. The authority automatically ends when the principal dies. 3. The principal may revoke the authority at any time. 4. The agent under a POA has no authority over property of the principal held in a trust. That authority belongs to the named trustee. The potential importance of a POA can not be overstressed, especially the usefulness and flexibility of a POA with expanded powers. Of course, the trustworthiness of the agent, and his or her willingness to get proper advice, are absolutely necessary. I could list many circumstances under which POAs are needed, but just one probably will suffice: If two persons, even husband and wife, own real property together, and one is incapacitated (that is, can not convince a notary public that he knows he is signing a deed) the house can not be sold without a POA or the appointment by a court of a guardian. Belford, Jr., Esq. The safekeeping of your will is serious business. If a decedent’s will cannot be found, the law presumes that the decedent destroyed the will. In that case, the laws of the state would determine the distribution of the decedent’s estate and that distribution is often not what the decedent would have wanted. For example, if a decedent dies without a will leaving a spouse and a child, each would receive one-half of the decedent’s assets. If a decedent leaves a spouse and two or more children, the spouse would receive one-third of the estate, and the children would receive equal shares of two-thirds of the decedent’s estate. The safest place to keep a will is in Surrogate’s Court in the decedent’s county of residence. Only the testator can remove it from the court. If another will is submitted to the Surrogate’s Court upon death, the Surrogate’s Court would check its files and if the will on file with the Surrogate's Court is the most recent will, and if so, it would be validated by the Court. The second safest place to maintain a will is a safe deposit box in a bank. Upon receiving notice of the death of the holder of the safe deposit box, the bank will deliver the will directly to the Surrogate’s Court. That avoids any loss of the will whether by mistake or on purpose. In the past, lawyers who prepared wills would often hold the wills in a “will safe” in his or her office. The downside to that is that upon the lawyer’s retirement or death, the lawyer or his or her es- tate may not be able to locate the client or the client’s beneficiaries may not be able to locate the lawyer who is holding the will. If the will is not found, the estate would be distributed as described above. The foregoing has two lessons. Firstly, everybody should have a will and, secondly, wills should be deposited with the Surrogate’s Court or maintained in a safe deposit box. Editor’s Note: John l. Sleep deprivation has become widespread in North America as people try to squeeze more and more activities into each day. One consequence is, more vehicle crashes are attributed partly or wholly to sleepiness. The National Highway Traffic Safety Administration (NHTSA) says about 1 million crashes a year are thought to occur because of driver inattention or lapses – and fatigue makes such inattention more likely. In a survey by the National Sleep Foundation, 57% of those interviewed said they had driven while drowsy and 23% admitted to having fallen asleep behind the wheel. NHTSA reports that sleep-induced crashes typically involve a driver who is alone and driving late at night or in mid-afternoon on a high-speed road (so the crash is more likely to be serious). Most of the time, it’s a single-car crash because the vehicle leaves the roadway. Leave the driving to those who are wide awake! In other words, many of us may be susceptible to driving while sleepy, but there are some things we can do to avoid doing so. The National Sleep Foundation and other experts suggest: straight ahead at all times; scan the road and nearby areas. run in place, jump up and down. • Avoid alcohol and medications that may make you sleepy; read the label on the container or ask your physician. continued on page 92 • Stop for a rest every 100 miles or two hours. • If you need one, take a short nap. Neck Pain by dr. marc Taczanowski, C.C.S.P., C.S.C.S., a.r.T.c. This monthly educational column, “WHErE doES IT HurT?” will focus on different areas of the body, the symptoms associated with that area, the potential causes and your choices for treatment. Since my speciality is sports medicine, the angle from which I will be approaching the areas of complaint will be from a sports medicine, soft tissue perspective. The second installment of this series finds us at the neck. Neck pain can be multi-facetted and complex, easily turning this article into a novel. Only certain aspects will be highlighted and discussed. Neck pain can loosely be categorized into two types. Pain that starts and remains in the neck proper and pain that stems from the neck but radiates elsewhere. This month’s article focuses solely on the former. In the upcoming article we will begin to explore the potential referral pain patterns for the neck. When I first started practicing I would try to diagnose the specific muscle that was causing the symptoms and focus my treatments on that one muscle. I quickly realized that my treatments were not as successful as I had hoped. It turns out that rarely, if ever, do muscles work alone. It is more like a concert of muscles working in synchronous fashion. With that being said, let’s get down to business. Nine times out of 10, patients present in our office complaining of symptoms which stem from a musculoskeletal origin. By definition this is “anything relating to the musculature (soft tissue) or skeleton.” Soft tissue can also be defined as ligament, tendon, fascia, or nerve. More than 50% of all injuries are to the musculoskeletal system. Sprains, dislocations, and fractures account for nearly 65% of all musculoskeletal injuries, which can frequently lead to posttraumatic osteoarthritis. Probably the most common type of neck issue we see is the patient that wakes up with a stiff neck because they “must have slept wrong.” I’m not sure what the rules are concerning improper sleeping but I am sure that neck pain does not result from breaking them. The spine is a complex creature, and as previously stated, there are few muscles that work alone. There are approximately eight (8) muscles that work as the deep stabilizing structures of the spinal column. They include the multifidi (2), the intertransversarii (2), rotatores (2) and the interspinalis (2). Traveling superficially from this deepest layer, you hit the next layer of muscles called the erector spinae. The spinalis, longissimus and iliocostalis muscles form the erector spinae. All of these muscles work together to help create spinal stability. There will be a quiz. OUR TOWN • MARCH 2011 Now that you have been introduced to the deep stabilizing musculature, let’s discuss the prime movers. Your prime movers are your “sexy” muscles or the muscles that you see. These are the ones you usually work when you are at the gym. Prime movers do exactly what their name implies: they move the body. The prime movers of the neck include the Trapezius and the SCM (Sternocleidomastoid). The relationship between the stabilizing musculature and the prime movers is extremely important. When there is miscommunication between them, injuries result. They can occur in the following manner: • when a prime mover has to act as a stabilizer. • when a stabilizer has to act as a prime mover. • when a prime mover acts before the stabilizer engages. Injuries also occur when the load on a muscle exceeds its capacity. Here is a concept that permeates throughout many of the issues we see in the body and was discussed in our previous article. A very good example of a load vs. capacity injury is one that begins with poor posture. Someone who sits at a computer for 8-hours-a day is likely to wind up with shortened muscles in the front of their neck. In order to keep the head situated neutrally, the muscles in the back of the head, neck, upper back and mid-back are perpetually engaged in an attempt to create balance or neutrality. This “load” on the posterior neck muscles will eventually exceed their capacity leading to all sorts of pain and dysfunction. Unfortunately, most of us are not aware of the battle that takes place between the muscles of the front and back of the body until the damage is done. Preventative measures can be taken, although continued on page 86 – 85 – Innovative treatments. Optimal results. Most people will respond to pain and attempt to alleviate it as quickly as possible. To be discussed is a proactive approach that does not necessarily require the attention of a medical professional. Attempt to gently stretch the area. A frequently asked question is when to stretch. The answer is always the same: warm it up – stretch it out – ice it down. Increasing blood flow to an area prior to stretching is always beneficial and can be achieved in various ways, ie; light cardio just to the point of perspiration, a hot shower, etc. The utilization of ice afterwards will aid in the reduction of inflammation and discomfort. Another common question regarding stretching refers to the presence of pain during the activity: Is it ok? The answer is relatively straightforward: If the discomfort abates with a 30-second stretch, continue the cycle of progression. If not, stop. The inter- vention of a medical professional may be useful at this point. Certain types of soft tissue techniques are extremely effective for neck pain that stems from a musculoskeletal origin. Due to my affiliation with the Active Release Technique and the Graston Technique, the following information is slightly biased, although peppered with factual statistics accrued via direct (personal) and indirect (patient) experience. 4050% relief of symptoms immediately following the first treatment and complete resolution of the problem in as few as 2-3 treatments is not an uncommon finding following these aggressive soft tissue techniques. Due to their high degree of effectiveness and specificity, we are very comfortable explaining to patients that if there is not a marked improvement within 2-3 treatments, the techniques are not going to be effective (to our satisfaction). At this point the patient would be referred out for further diagnostic OUR TOWN • MARCH 2011 testing or consultation with the appropriate medical professional. Next month there will be a break down of symptoms and more specificity in an effort to limit (my) ramblings on more general topics. Bocchichio If you have been involved in a car accident, no matter how severe it was, you know the fear that immediately follows. You often feel completely out of control of the situation. But being aware of what can possibly happen and knowing what to do at the scene of the accident can alleviate some of the fear and provide you with a sense of control that will allow a clear head and could save time, money and possible medical expenses. In an accident in which you are moving at speeds below 10mph, injuries are likely to be the result of unexpected, rapid movement of the body at the moment of impact. These injuries can include muscle strain and bruises from the seat belt. Symptoms from these injuries, like pain and stiffness, might not appear for 12 to 36 hours Dr.LindaM.Bocchichio CHIROPRACTOR 105 Lake Ave, Nesconset, NY 11767 979-9854 after the accident. Accidents that occur at speeds greater than 10mph involve more rapid body movement and possible impact with objects inside the car, such as the steering wheel, windshield or dashboard. Common injuries in these situations include shoulder, head or knee hematomas (bruises), neck sprain, wrist fractures, concussion and contusions. People with these injuries usually know where and how badly they are hurt right away, but in some instances, shock masks the symptoms. Perhaps the most common and most infamous automobile injury is whiplash – a cervical acceleration/ deceleration injury in which the head is whipped backward from an inexpected force from behind, the head then recoils and continued on facing page REDUCE STRESS & IMPROVE YOUR LIFE … ~ *5 WEEK MEDITATION COURSE ~ Begins Tuesday 3/29/11 ~ Now Registering ~ *ONGOING MEDITATION GROUP ~ Newcomers Welcome ~ Achieve Inner Peace, Understanding *Tuesdays 3/22, 4/26/11 ~ 7:30-9:30 PM ~ Smithtown ASTROLOGICAL Insights ~ CHART Interpretation Birth data required Discounts available. Whiplash can also occur when you are hit from the front or the side, in which case the head jerks forward (or to the side). In all of these instances, the injury is incurred when the neck is forced to exceed its normal range of motion and muscles, tendons, ligaments and joints stretch beyond their limits, sometimes to the point of tearing. N O T E S Symptoms of whiplash can include restricted range of motion, neck tenderness, muscle stiffness, trouble swallowing, loss of voice, jaw problems, nausea, vomiting, headache, dizziness, short-term memory loss, insomnia, visual disturbances like blurred vision or flashing lights and of course, pain. There are very important reasons to seek chiropractic care immediately after an accident. First and foremost, you have to make sure you are not seriously injured. Also, some minor injuries can become chronic if not taken care of properly. Timely attention to your traumatized body will insure that you heal properly. Editor’s Note: dr. linda m. The children can help you with this project. Collect some nice, smooth stones at the beach. They can paint each stone with a specific color assigned to each type of flower. For instance, red is tulip, yellow is daffodil, etc. or you could use a letter to identify each flower or just place the stones, plain, at the base of each plant and leave them undisturbed throughout the season. Why not add a butterfly garden next to your patio this year? Choose a spot that will get at least six hours of direct sunlight. Flowers with short tubes are best as are flat-topped or small clustered flowers. Also flowers with long, flat petals like daisies. Tax Grievances continued from page 76 based on an equalization rate and the assessed value of your property. If you can prove your market value is below the Assessor’s estimate of market value, then you will be entitled to a tax reduction. A certified appraisal will determine the market value on your property. The market value of your property is generally defined as what your property would sell for under normal conditions. The most common way to determine the market value of a residential property is to use the sales comparison approach. This is the primary method used by professional appraisers to determine the market value of residential properties. An experienced tax grievance appraiser should be able to determine the Tax Assessor’s current estimate of market value on your property and, therefore, if you would benefit from having an appraisal performed. It is important to hire an appraiser who is certified and specializes in valuations in your market area and who is experienced in tax grievances. Drew, Jr., a long time resident of Smithtown, NY, passed away Saturday, January 15, 2011 at the age of 81. Archer (Archie) grew up in St. Albans, Queens, and moved to South Ozone Park when he married. He and his wife, Thelma (Cooper) of Corona, Queens, subsequently lived in Springfield Gardens for several years. He and his family moved to Smithtown, NY in Archer S. Drew, Jr. the early 60’s. Archer was an (Army) Air Force Veteran and experienced the trauma of the desegregation of the armed forces while in service. He later worked for the US Government and retired from the Federal Government, Department of Defense, with 30 years of service, the recipient of several meritorious awards. He was considered by some to be the bionic man having had both hips replaced as well as both knees replaced and a back disc fused. Still he managed to umpire (USSSA), a number of years, for Smithtown’s many softball leagues. Well regarded in this capacity, Archer was known as a knowledgeable and fair umpire – he would throw anyone out of the game, if so warranted, including spectators. As a sports lover, he was a participant as well as an observer and instructor. Whether it was racquetball or volley ball, he was a champion. While president of the Smithtown Majors bowling league, he taught youth bowling sessions for the Town Recreation Department and participated in the parent/child leagues with each of his children. He played basketball and softball for St. Andrews Lutheran Church in the town adult leagues and then coached and managed teams in both sports for the church. An active member of St. Andrews Lutheran Church, Archer served on the altar and was also a head usher and a counter as well as president of the church’s bowling league and the Couples Club. He was a long time member of the Smithtown Senior’s Golf Association, the one sport that he could not claim as a “champion” although he did have a hole-in-one and managed to win a number of tournaments with great prizes! Archer was a delight to know and beloved by many. Endearingly called “crabby” by his oldest daughter, Joanne, the term caught on and others affectionately termed him the “old crab” or “grouchy” as some lovingly called him. His activities included membership in NAACP, NARFE (National Association of Federal Employees), OIC (Opportunities Industrialization Commission) and a volunteer with SCMLK (Suffolk County Martin Luther King Commission). Pre-deceased by two daughters, baby Karin Elizabeth and Joanne Michelle (Johnson), Archer is mourned by his wife of close to 60 years, Thelma; sons, Richard Michael (Maria Grace), Kenneth Edward (Mary Ann); daughters, Sheryln Liane (Christopher Allen) McKittrick and Kimberly Terese (Charles Timothy) Council. In addition to his children, he also leaves his loving grandchildren, Felicia (William Patterson), Ariana (Ed Mowton), Tabitha Pearl (Johnson), Brittany Ann and Drew Archer (McKittrick), Erick Jamel and Jade Elizabeth Michelle (Council); great grandchildren, Quadarius and Santina (Patterson) and a host of beloved in-laws, many family and numerous friends.
