The membership of the Swiss Arbitration Association (ASA) is graced not only by Swiss arbitrators but also by many of the world's best-known arbitration practitioners. The Statistical Report of the International Chamber of Commerce (ICC) has repeatedly ranked Switzerland first for place of arbitration, origin of arbitrators and applicable law. z Kluwer Law International is proud to assume the publication of the ASA bulletin, an official quarterly journal of this prestigious association. Since its inception in 1983, the Bulletin has carved a unique niche for its detailed focus on arbitration case law and practice worldwide as well as for its judicious selection of scholarly and practical writing in the field. Its regular contents include: • Articles H • Leading cases of the Swiss Federal Tribunal, which has exclusive jurisdiction over all appeals against international arbitral awards rendered in Switzerland; 0 < U h-I • Relevant leading cases of other Swiss courts; • Selected landmark cases from jurisdictions worldwide; • Arbitral awards and acts of procedure rendered both in ad hoc arbitration and in administrated arbitrations under various auspices, including ICC, ICSID, CCIG and NAFTA; • A complete list of forthcoming arbitration conferences; • Notices of publications important for arbitration practice, including articles in other reviews and • An annual index in English, French and German Each case and article is published in its original language with a comprehensive head note in English, French and German. The ASA Bulletin is among the most refreshing, original and international of all international arbitration reviews. It has become an indispensable reference tool for all practitioners involved in international arbitration. z Kluwer Law International 2002 - Volume 20 (4 issues) ISSN: 1010-9153 Price: 135 EUR Please contact our office at one of the following addresses or order from your bookseller: For Europft and Rest of World: Order Department, Kluwer Law International, Distribution Centre, PO Box 322, 3300 AH Dordrecht, The Netherlands Tel: +31 (0)78 654 6454 - Fax: +31 (0)78 654 6474 Freephone in the UK: 0800 963 955 email: sales@kli.wkap.nl For USA, Canada, Central and South America: Kluwer Academic Publishers 101 Philip Drive, Norwell, MA 02061 USA Telephone toll-free in the US: 866 269 WKAP All other customers: + 1 781 871 6600 Fax: + 1 781 681 9045 E-mail: Kluwer@wkap.com Visit our website at http://www.kluwerlaw.com kJ '1 K L U W E R LAW INTERNATIONAL International investments ami Protection of Mlf OT 1 » ! > I H H The present volume of T/>e Permanent Court of Arbitration/Peace Palace Papers series reproduces the papers presented at the Second International Law Seminar held on May 17, 2000. Inspired by the convergence of two recent developments: a rapid growth in direct foreign investment, and a sharp increase in environmental consciousness, this seminar addressed a topic of compelling interest to both practitioners and students of international law: the role of dispute resolution mechanisms in the field of international investment and protection of the environment. o h < u In this publication, prominent experts examine the inherent conflicts between the norms that underpin both areas. This relatively unexplored field of international law is likely to become a permanent and expanding feature of the international agenda, as well as a challenge to national and international courts and tribunals. This volume also includes an analytical French language summary of the seminar papers, an elaborate set of guidelines for negotiating and drafting dispute settlement clauses for international environmental agreements, and an article examining the arguments for and against the establishment of an international court for the environment. This groundbreaking study explores a range of possible approaches, both within the established legal infrastructure, and through alternative, not only arbitration, but also non-confrontational means such as negotiation and mediation/conciliation. 0 H < u The Japanese experience in dispute processing is taken as a means of exploring the ways in which international harmonization efforts such as the UNCITRAL Model Law impact on individual nations. As an Asian nation which has adopted and adapted a variety of Western practices under modernization and democratization, Japan is in a unique position to offer a balanced global example - a model for a more comprehensive approach to disputes as an integrated multi-layered system. The book will be of interest to the scholar and practitioner of transnational/cultural commercial dispute processing as well as those who are involved in the law reform technical cooperation. 0 Contents Foreword. To make the growing case law on this subject matter readily accessible, the UNCITRAL Secretariat in Vienna has set up a reporting system for national court decisions relating to the CISG. The extensive documentation already collected there and elsewhere will surely have a lasting impact on the ongoing scholarly debate on this topic. The present book is intended to contribute to this debate by addressing controversial issues relating to the interpretation and application of some important provisions of the new sales law. In addition, several authors also deal with the development of international principles of contract law, such as the Principles of European Contract Law, the UNIDROIT Principles and the lex mercatoria. In view of the increasing number of such rules, a discussion of the CISG would be incomplete without taking account of the relationship of the Convention to these principles as well.
