The District will need a temporary right of entry over the subject parcel for the purpose of a staging area for tree removal equipment, tree removal, and tree replanting. The remainder ofthe work for the project will take place within the County right of way. The attached right of entry agreement (copy) provides for the necessary property rights for the tree removal portion of the project. The proposed settlement amount is considered fair and reasonable for the real property rights being acquired and represents fair market value for said property rights. The acquisition costs for this right of entry agreement total $2,000. To cover the cost of the agreement (including overhead), it will be necessary to transfer appropriations in the amount of $2, 170 from the Small Line Rehabilitation Project to the Minto, Meidl, Behler, Hastings Sewer Replacement Project within the Freedom Sanitation Expansion Construction Budget. In a separate letter on today's agenda is a request for authorization to re-bid the subject project. It is therefore recommended that the Board of Directors take the following actions: 1. U.','l ~J., '::, \) \,,~ 0487 Minto, Meidl, Hastings Sewer Project The Minto, Meidl, Hastings Sewer Project is planned for construction in summer 2012. The project involves the replacement of approximately 3,300 feet of gravity sewer main and sewer manholes in Minto Road, Meidl Avenue, Behler Road, and Hastings Lane, east of Green Valley Road. The existing 6-inch and 8-inch asbestos cement pipes have cavities and high groundwater infiltration. It is the Freedom County Sanitation District's (FCSD) responsibility to supply and maintain the sewer lines within their limits. As part of this responsibility, the replacement and upgrade of these lines are necessary to maintain the effciency of this system. The areas trenched in Behler Road and Hastings Lane wil be paved to County standards. There are two large eucalyptus trees located across from the property at 25 Behler Road that wil be impacted by the replacement of the sewer main. The trunks of the trees are within 2 feet of the existing sewer main. The sewer main wil be replaced by open cut method and the trench wil be approximately 5 feet deep and 4 feet wide. The FCSD wil apply for a permit from the Santa Cruz County Planning Department for the removal of the trees. All expenses associated for the removal of the trees wil be borne by the FCSD. The Minto, Meidl, Hastings Sewer Project is scheduled to bid May 31,2012 and construction to begin July 16, 2012. This project is exempt from the California Environmental Quality Act (CEQA) 84
