ADJOURNMENT 3 EXHIBIT 1 The 2922'" Regular Meeting of the Board of Trustees of the Village of Mundelein was held Monday, August 27, 2007 at 1000 North i\Jidlothian Road, Mundelein. Mayor Kessler called the meeting to order at 7:05 pm. 2922'" Regular Meeting Clerk Dahlstrom took the roll. It indicated these members present: Trustees Cancelli, Nutschnig, Schedler, Semple, Sullivan, and Voss. Village attendance: Village Administrator Lobaito, Assistant Village Administrator Flynn, Chief Rose, MPD; f\cting Chief Adams, MFD; Finance Director Hatton, Engineer Emmerich, Public \'(Iorks Director Miller, and Attorney Marino. Absent: Director of Building Department Schubkegel, Sr. Attendance Mayor Kessler led the Pledge of Allegiance. Pledge of Allegiance Motion by Semple, seconded by Sullivan to approve the Minutes of the Regular Village Board Meeting of Angust 13, 2007. Upon roll call yote, the vote was as follows: Ayes: Semple, Sullivan, Cancelli, Nutschnig, Schedler, and Voss; nays: none; absent and not voting: none. l\Iotion Motion to Approve the Minutes of Regular Board Meeting of August 13, 2007 carried. Mayor Kessler opened the meeting was opened to the floor. Floor Opened to Public Mr. Brad Denz, 201 Maplewood, Mundelein stated he has been a resident of the Village for over 10 years. Mr. Denz stated the Village, the Plan Commission, and Village Staff took inappropriate actions regarding Jacob's Way Subdivision, specifically inadequate public notification and the potential taking of part of his property. Mr. Denz stated earlier this year, Director of Planning Barrera stopped by his office and showed him a crude map of the plan Ms. Jaeckel had given the Village. After Director Barrera described what the Village and Ms. Jaeckel wanted to do, he told Director Barrera he was not interested. After that meeting, Mr. Denz contacted his attorney and his attorney stated until Mr. Denz received something in writing from the Village with the Village letterhead, it was not a formal proposal. A few weeks ago, Mr. Denz was at Village Hall and ran into Director Barrera and was asked again if he was still interested in selling his property. Mr. Denz told Director Barrera he was never interested in selling his property and is still not interested in selling his property. July 23, 2007 an ordinance was passed for this subdivision, without tree protection, Ms. Jaeckel can remove any and all trees. Mr. Denz has spoken with several neighbors, and not one of them has received any type of notification. Per the Village's ordinance any and all property owners within 250 feet are required to be notified. Also, signs were required to be posted on Simpson as well as Maplewood and none were posted. At the July 23" meeting, it was indicated the property owners were negotiating with Ms. Jaeckel for the needed property owner, however his name was never mentioned because there are no negotiations. The Village Staff and the developer mislead the Village Board and the audience and Trustee Schedler was the only one who asked if the property should be acquired Jacob's Way Subdivision Concerns 136 Floor Opened to Public (Continued) Jacob's Way Subdivision Concerns (Continued) prior to approving the preliminary plat. Mr. Denz stated he understands other residents are concerned with the inappropriate actions regarding Rubloff and he is next in line. The Village will be hearing from his attorney. Mayor Kessler stated Mr. Denz should direct his attorney to contact the Village's attorney, Mr. Marino. Mr. Curt Denz, 201 Maplewood, Mundelein agreed with his brother Mr. Brad Denz and stated one of the main reasons for buying the property 10 years ago was because it was at the end of a dead end road. For anything to happen to the subdivision, it must go through their property. Mr. Denz stated there are villages that abuse eminent domain, and this has the earmarks for eminent domain. Mr. Denz stated they have partnered with the Institute for Justice, an organization that Mr. Denz defends property owners against eminent domain. distributed two photos of their property. Trustee Voss asked what the bottom of the signs said. Mr. Denz stated he was not sure of the website, however it was the Institute for Justice's website. Ivanhoe Ponds Mr. Ted Booden, 21864 Bay Hill Court, Ivanhoe stated there had been extensive rain recently and there is much run off from the Pulte/Del \Vebb development. Ivanhoe has expressed their concerns prior to the development. They were assured the mitigation would not adversely affect Ivanhoe, however the waters run into the ponds higher, faster and arc receding slower due to the continuous mn off from Del Webb. Meetings have been held with Storm \Vater Management, the Village Engineer, and a Pulte Representative. There is something wrong. They have been told they will look into this problem, but nothing is done. Something needs to be done. Only one third of the Del Webb development is complete. As the rest of the development is complete, more water will run off, and the problem will only get worse, and with the Rubloff development, it will get even worse. It has been 72 hours since the rains have stopped, and the water has not recessed. Please help us. Mayor Kessler asked Engineer Emmerich to comment. Engineer Emmerich stated it was difficult to synthesize everything in a couple of minutes. Meetings have been held. The project was designed by engineers, reviewed by engineers, approved by engineers, and is being built according to the plan. The developer has not submitted asbuilts yet, but performance guarantees have not been released. There has not been a claim in writing, or a defined problem other than there is a problem. Mayor Kessler asked Administrator Lobaito to work with Engineer Emmerich and follow up with Ivanhoe. Mr. Booden stated the Pulte representative would respond within six to eight weeks to several action points. One was the rate at \vhich water is released, whether the retention ponds are functioning appropriately. Mr. Booden stated at prior meetings, perhaps the engineering looks wonderful, but something went wrong. He is representing citizens that are seeing the rise in water, increase in erosion and the potential for a flood event. They are asking for a comprehensive evaluation from Pulte, the Village and Storm Water Management. The written claim was sent to Storm 137 Water Management, and concerns have been expressed in the meetings, and the lllillutes arc written and recorded. Floor Opened to Public (Continued) Mr. RanI Vivero, 125 Maplewood, Mundelein stated in Spanish he had not received any type of notification regarding the Jacob's way subdivision. Mr. Den2 was his translator. Ivanhoe Ponds (Continued) i\Is. Debbie Jacobson, 411 North Lakeshore Drive, Mundelein stated four years ago resurfacing was done on her street and almost immediately if began to flood. She was told tllls was a 100-year flood, and since then there have been four 100-year floods. They have had to move cars to avoid flooding, but sometimes the rain happens at night and their cars have flooded. She has called because water comes out of the sewer. The biggest issue is the water gets stuck and has nowhere to go once it gets to Fort Hill. Ms. Jacobsen asked what would be done with this problem. Mayor Kessler stated this is correct; this is a large and expensive project. Trustee Semple will be calling a Public \V'orks Committee meeting to look onto these issues. Jacob's Way Subdivision Concerns (Continued) Flooding on Lakeshore Drive Ms. Cecilia Burke, 1011 Wrens Gate, Mundelein stated she too had water problems coming from the Donllnick's development. It was determined the calculation was off by a decimal point, and the water issue was not resolved until the calculation was corrected. Floor Closed to Public No other comments were made. The public commentalY was closed. Mayor Kessler stated S1!1ce Director of Building Department Schubkegel, Sr. was absent, the Del Webb Inspection Management Presentation would be postponed until the next meeting. Motion by Voss, seconded by Cancelli to approve Committee of the Whole Meeting Minutes of August 13, 2007. Upon roll call vote, the vote was as follows: Ayes: Voss, Cancelli, Nutschnig, Semple, and Sullivan; nays: none; abstain: Schedler; absent and not voting: none. Motion carried. Mayor Kessler stated he would be holding interviews for new cOllunissioll l11clnbers, one for Business Dcvelop111cnt and one for Police Pension Commission. Memos will be distributed and any questions or concerns should be directed to him. Trustee Semple asked Director Miller to recap the recent rainfall events. Director Miller stated the wet weather period began August 4'" and lasted for 21 days with a total of 12.26 inches of rainfall. There were less than 25 calls for service. Assistance outside of the Village was provided. Lake County requested a Disaster Declaration for the entire County, which has been approved by the State. Highlights of the Expense Report Trustee Sullivan recapped the highlights of the expense report. Income Tax Per Capita l\rtic1e Trustee Sullivan stated the Illinois Municipal Review is a monthly ncwsletter and in the recent issue an article regarding lllco111e tax bascd per capita; Motor Puel Tax and State Use Tax, this year $126.06, and it is estimated $130.75 will be received next year. C0111tnunity Devcloptnent Trustee Voss announced a Project List was distributed with 24 projects listed. Pennits COlnl1uttee Trustee Nutschnig reported the Permits Committee Meeting held at 6:45 regarding Mundelein Dental Center, 328 North Lake Street. Motion to Authorize Staff to prepare an Ordinance for the Approval of a vallation, with conditions, per Section 903.2.3 of the 2000 Int'l Fire Code as amended by the Village for Mundelein Dental Center, 328 North Lake Street Motion by Nutsehnig, seconded by Sullivan to authorize staff to prepare an Ordinance for the Approval of a variation, with conditions, from the requirement of a fire sprinlder system or the construction of a 3-hour firewall per Section 903.2.3 of the 2000 International Pire Code as amended by the Village for Mundelein Dental Center, 328 North Lake Street. Trustee Voss stated there are many other businesses in the same position and the Village will set precedence. Trustee Sullivan stated a fourth condition be set. The original plan submitted a few years ago should be the same plan being considered tonight. The plan submitted was a major improvement in architecture along with significant fire detection and prevention system. Mayor Kessler stated Attorney Marino's recommendation was to get consensus from the Board to add the fourth condition. There was consensus to the fourth condition. Trustee Sullivan stated Dr. Sullivan is no rclation to the Trustee Sullivan, so there is no conflict of interest. 139 Upon roll call vote, the vote was as follows: Ayes: Nutschnig, Sullivan, Cancelli, Schedler, Semple, and Voss; nays: none; absent and not voting: none. Motion carried. Mayor Kessler presented the Omnibus Vote Agenda asking for any Omnibus Vote Agenda additions, deletions or corrections. Trustee Semple removed Item 2. There were no additions, deletions or Items Removed from Omnibus Agenda corrections. Motion by Semple, seconded by Sullivan to approve the following Omnibus Vote Agenda, excluding Item 2. Motion to Approve Omnibus Vote Agenda 1. Motion to approve the Departmental Purchase Request in the amount of $37,740.00 from T.P.I., 7N262 W. Whispering Trail, St. Charles, IL 60175 for Del Webb Inspections. (Omnibus Vote) 2. REMOVED 3. Motion to approve an Agreement for Professional Services with Smith Engineering Consultants, Inc. for the inspection of certain subdivision improvements within Grand Dominion Phase 2 Subdivision in the amount of $17,565.00 and authorize the Village Administrator's signature on the Agreement. Motion to approve the payment of bills, as indicated in the Governing Body Report, for the period 08/14/07 through 08/27/07 in the amount of $551,075.71. Trustee Semple asked Engineer Emmerich to explain the elimination of the lift station and providing individual, private sewer service for seven properties. Engineer Emmerich stated the existing lift station is failing and they will be providing a sewer connection in the front of their homes. ITECH Grant Reallocated Administrator Lobaito stated a memo regarding the ITECH Grant for a streetscape improvement, which the Village declined dne to the increase in cost to the Village. A notice from IDOT was received advising the Village to reallocate the grant with another downtown streetscape. Administrator Lobaito recognized Assistant Administrator Flynn for his efforts monitoring tllls gran t. U-Haul Property Update Administrator Lobaito stated Director Barrera distributed a memo regarding U-Haul property. U-Haul has decided to stay in the County and not annex into the Village and pursue development. Staff will monitor the progress and may at some point ask the Village Board if it should be in the Village or stay in the County. Nothing formal has been submitted. Village Clerk's Report Clerk Dahlstrom stated confIrmations should have been received for the 94'" Annual Illinois Municipal League Conference scheduled for Thursday October 18 - Sunday October 21. Midlothian Road, Mundelein, Illinois, Exhibit 2 MAYORAL PROCLAMAnON ESTABLISHING SEPTEMBER II, 2007AS A VILLAGE-WIDE DAY OF VOLUNTARY SERVICE, CHARITY AND COMPASSION WHEREAS, people of all ages and walks of life across American and around the world collectively witnessed an event of immense tragedy on September II, 200 I; and WHEREAS, the events of that day instantly transformed nearly everyone's lives, some through personal loss, and many others through an unfamiliar sense of individual and national vulnerability; and WHEREAS, an unprecedented, historic bonding of Americans arose from the collective shock, unifying the country in an outpouring of national spirit, pride, selflessness, generosity, courage and service; and WHEREAS, many brave people heroically, tirelessly and courageously participated in an extraordinarily difficult and dangerous rescue and recovery effOti, in some cases voluntarily putting their own well being at risk; and WHEREAS, September II th will never, and should never be just another day in the hearts and minds of Americans; and WHEREAS, the creation of memorials and monuments honoring those lives lost on September II, as well as the efforts of those who participated in rescue and recovery efforts, are necessary, proper and fitting, but alone cannot fully capture the country's desire to pay tribute in a meaningful way; and WHEREAS, many citizens may wish to memorialize September II th by engaging in, or making a plan to engage in personal and individual acts of community service, or other good deeds, as part ofa national day of recognition and tribute; and WHEREAS, to lose this opportunity to bring people together for such an important endeavor would be a tragedy unto itself. In response to the claim of not being notified of the Boards action granting a variation to the right-DE-way width, they are correct. No notification wns provided to the adjoining property owners nor does the State law or local ordinance require notification. The only variation requested was a reduction in the minimum width of right-DE-way f1"01'n 60 ft. to 40 f t, Currently there exists a 30 ft. right-DE-wayan Simpson Avenue. \Ve have asked the developer to convey to the Village an additional 10 feet along the entire west right-DE-way line of Si.mpson Avenue to inci"case the current width from 30 feet to 40 feet. This is not a zoning variation but rather a vnriatioll to the municipal code. Onl}' zoning variations arc subject to notification requirements. \'(Iith l'cspect to llction on a prelimin:u)' subdivision plat, here again no noticing of adjoining property owners is required by state law or by local ordinnnce. Additionally. the preliminary plat does not incorporate the Denz property. A decision was made at the time of the Prelitninaty Plat prep,u'ation to not include the Denz's property on the Plat since Mr. Denz had not agreed to scll the Village the pro pert)'. After Board action on the PInt> it was the staff's intent to provide :rvlr. Denz with a copy of the Plat that accurately reflected the land area needed. If :rvfr. Denz agreed to the land sale. then the Pinal Plat would reflect the full right-of-way. If lvLr. Dellz chose not to sell his propcrty then the !vIaplewood proposed right-of-way in the proposed Jacob's Subdivision Final Plat would only reflect the land owned by the developer. Acquisition of the 750 sq. ft. would be put off to a later time when there may be a willing seller. The extension of rvfaplewood Avenue is 110t an essential component to the proposed Jacob's Subdivision. It simply provided a good opportunity to improve access to the arca for our public safety personnel. In response to Mr. Denz's chtltacterization of our discussion with him regarding the purchase of appwximately 750 sq. ft, of his property, staff simply has a different understanding of where we were at with the acquisition of the property. At no time did we represent that we would use our eminent domain powers to acquire the property. Because there has been a previous profession~lrelationship with Mr. Dcnz as one of the land planners for Lake County, we approached lvk Denz on an informal basis to determine the level of interest in securjng this small piece of property. St~ff was guite surprised at the comments and the characterization by Mr. Denz at the Board meeting of Ollr convers~cion regarding tIus matter. The idea of acquiting this land was driven by ViUage staff. \\le expressed a strong desire to the developer that we would like to eliminate the dead end on lvraplewood Avenue. Each of these locations is a major crossing point for children walking to school. Each location needs a more visible waming system. The Police Department and the Public Works Depal1ment have researched devices that improve crosswalk safety. The bcst system on the market, in their combined view, is a product produced exclusively by R. D. Jones, Stop Expel1s Inc. of Venice, Florida, known as the Enhancer. This system uses a patented flashing beacon that makes the warning signal more visible to the motorist. General Notes All items not specifically mentioned in the scope of these specifications that are necessary to provide a calcium chloride delivery system shall be furnished by the successful bidder. The dispensing system pump and electronics shall be the manufacturer's current production model and shall be of domestic manufacturing concern. These specifications shall be construed as minimum. Should the manufacturer's current published data or specifications exceed these, they shall be considered minimum and furnished. The contractor shall be responsible for locating existing utilities and protecting them from damage during construction operations. General LIability and Automobile LIability Coverages 1, The member, its officials, agents, employees and volunteers are to be covered as addiUonal insureds as respects: liability arising out of the Contractor's work, including activities performed by or on beh'alf of the Contractor; prodUCts and completed operations of the Contractor; premises owned, leased or used by the Contractor; or automobiles own!=d, leased"hired or borrowed by the Contractor. Public Act 94-0515 stipulates that effective August 10,2005, contractors and sub-contractors on public works projects must submit certified payroll records on a monthly basis to the public body in charge of the construction project, along with a statement affirming that such records are true and accurate, that the wages paid to each worker are not less than the required.prevailing rate, and that the contractor or sub-contractor is aware that filing records that they know to be false is a Class BMisdemeanor. The certified payroll records must include for every worker employed on the public works project; a name, address, telephone number, social security number, job classification, hourly wage paid in each pay period, number of hours worked each day, and the starting and ending time of work each day. These certified payroll records are considered public records and public bodies must make these records available to the public under the Freedom of Information Act, with the exception of the employee's address, telephone number, and social security number. In addition, Publl~ Act 94-0488, which becomes effective on January 1, 2006, increases the penalties from 20% to 50% of the underpaid amounts for second or subsequent violations in relation to violation to the Prevailing Wage Act. This act also increases the debarment period during which contractors would be ineligible for public work project work, and a new monetary penalty for contractors who retaliate against employees who report violations or file complaints under the Prevailing Wage Act. Page 2 Certified Payroll Requirement The above is only a summary of the two recently passed laws. It would be recorrunended that your company and any sub-contractors who work with you review these two laws ill more detail to ensure compliance. As a result of the above, the Village of Mundelein Public Works Department hereby is required to request and to receive tWo copies of your certified payroll records, along with two copies of your written statement affirming that the records are true and accurate for any and all payroll periods beginning on August 10, 2005, and monthly thereafter until the project has been completed and the final payment has been released by the Village of Mundelein. The department is not responsible for, and has no obligation to verify the payrolls for compliance with the Prevailing Wage Act. LANDSCAPING Landscaping work falls under the existing classifications for laborer, operating engineer and truck driver. The work performed by landscape plantsman and landscape laborer is covered by the existing classification of laborer. Qualified consultants will be invited to interview with the selection committee. The Village of Mundelein is located in central Lake County, 35 miles northwest of downtown Chicago. With a population of 32,774 (US Census 2005 population estimate), the Village has grown from just over 21,000 in 1990. The Village has seen both commercial and residential development projects recently, including Cardinal Square, a luxury condominium and townhouse development under construction; Mundelein Town Center, a proposed commercial development of approximately 600,000 square feet of retail on approximately 94 acres; and an approved PUD for Del Webb's Grand Dominion active adult community is under construction. The Village sees the downtown and the 24-acre PUD at the train station to be critical immediate initiatives that will have a large impact and shape the image and character of the Village. A Mayor and a six member Board of Trustees govern the Village. A Plan Commission and Zoning Board of Appeals advise the Board, along with a full time Village Administrator. The Community Development Division's Planning & Development staff consists of an experienced Director of Community Development and two Planners. The Comprehensive Plan was written in 1990 and last updated in 2004 with the TOD plan. The Comprehensive Plan has been partially updated recently but is, overall, outdated. The Village intends to update this plan in the coming fiscal year, and would like respondents to include information about their ability to work with the Village on this update. The Zoning Ordinance was adopted in 1966 and received several amendments over the years. Other ancillary Ordinances such as the Subdivision Ordinance may also need attention. The current zoning ordinance is a conventional ordinance written in the 1960s. In 2004, the Village successfully completed and adopted a transit-oriented development (TOD) study for the area around the Metra commuter train station in the Village's downtown. Just as the study and plan envisions, it's the Village's intent to create a progressive, mixed-use downtown. The current zoning ordinance makes implementing this plan difficult and - in some cases - impossible. It's the Village's goal to write a revised ordinance that works for the newly envisioned downtown and the entire municipality. The Village of Mundelein is using a conventional zoning ordinance with several amendments. The result creates a patchwork quilt of regulations that does not reflect the Village's current vision for new development. In addition, the code is not as up-to-date, well organized, clear, consistent, or customer friendly as is desired. The codified development standards and procedures do not reflect current community values or unique community development opportunities as expressed in the recently adopted 24-acre PUD at the train station. Especially complicated is the application of modern development standards to property that has established "vested rights" under the existing zoning. As a result, many of the recent zoning cases have been processed through Planned Unit Developments to assure high development standards and amenities for large developments not detailed in the zoning ordinance. The other application for zoning issues has been Use Variations to address situations not covered in the present zoning ordinance. A comprehensive re-write of most of the existing ordinance is needed. The consultant is expected to re-draft the zoning map, provide a comprehensive amendment to the zoning text, provide supporting tables, and provide necessary and supplementary graphics. A comprehensive and thorough code analysis is needed to identify potential areas for improvement. The revised code must consider: • The relationship to the existing zoning code especially the reorganization, clarification, and streamlining of the present code. • The Comprehensive Plan and its updates (West Side Update, Southside Commercial Corridor Plan, and TOD Plan). • Community values. • The option to create a Land Development Ordinance in the future. • Existing land economics and potential for redevelopment. • Judicial decisions. • Existing PUD standards. • An examination of bulk standards. • Local requirements such as the 2000 International BUilding Code (IBC) and existing Subdivision regulations. • Special study areas such as the TOD area and southside commercial corridor. • Current in-progress projects, including Downtown Design Guidelines. • Regional laws and policies such as the Lake County stormwater or street access policies. • Applicable state and federal regulations - zoning enabling laws, ADA regulations, and EPA rules. • Zoning incentives for housing diversity, improved design, and economic development. • Urban design enhancements, especially buffers, parking, and landscaping. • Neighborhood protection measures (especially transitions from commercial uses) • The potential for infill development. It is anticipated that the consultant will work with the Plan Commission and Zoning Board of Appeals who will serve as the touchstone for the community. Additional Public Workshops / Hearings with the community will be required. The present ordinance provides a basic framework for zoning decisions and administration over an extended period of time. The Village is willing to explore innovative new zoning techniques such as formbased codes, neo-traditional design, cluster or mixed use zoning, smart growth zoning, context based zoning, "green" zoning, etc. Other considerations include formatting the new ordinance for electronic use and inclusion on the Village's website. The goal is to create a user-friendly interface between potential development groups and the Village. The Village Board and Plan Commission have an interest in the future development of the Village. It will be important that the final document reflects their collective vision. The Village is also interested in exploring new avenues for citizen participation in the zoning process that go beyond the traditional standard legal notification procedures and hearings required by state law. The existing floor finish is peeling in many locations down to bare concrete, and has been found to provide minimal slip resistance. The current finish is wafer thin whereas the new floor would be approximately 1/8" thick and provides twice as much slip resistance. The new floor will include a ten-year warranty for labor and materials. Waiving of the bidding process is being sought as the contractor, Archem, Inc. of Carol Stream, IL completed this same work at Fire Station #1 in FYE 2006. This work was completed on schedule, at the bid price and the quality of workmanship was outstanding. This project has been included in the Department's capital projections for the past 3 years. This Agreement constitutes a contract between the OSFM and Local Authority which permits the Local Authority to operate an a Elevator Safety Program ("Program") in conformity with Section 140 of the Elevator Safety Act (225 ILCS 312/140) and the Administrative Rules adopted at 41 III.
