The 2922'" Regular Meeting of the Board of Trustees of the Village of
Mundelein was held Monday, August 27, 2007 at 1000 North
i\Jidlothian Road, Mundelein. Mayor Kessler called the meeting to order
at 7:05 pm.

Clerk Dahlstrom took the roll. It indicated these members present:
Trustees Cancelli, Nutschnig, Schedler, Semple, Sullivan, and Voss.
Village attendance: Village Administrator Lobaito, Assistant Village
Administrator Flynn, Chief Rose, MPD; f\cting Chief Adams, MFD;
Finance Director Hatton, Engineer Emmerich, Public \'(Iorks Director
Miller, and Attorney Marino. Absent: Director of Building Department

Mayor Kessler led the Pledge of Allegiance.

Motion by Semple, seconded by Sullivan to approve the Minutes of the
Regular Village Board Meeting of Angust 13, 2007. Upon roll call yote,
the vote was as follows: Ayes: Semple, Sullivan, Cancelli, Nutschnig,

Mayor Kessler opened the meeting was opened to the floor.
Floor Opened to Public
Mr. Brad Denz, 201 Maplewood, Mundelein stated he has been a
resident of the Village for over 10 years. Mr. Denz stated the Village,
the Plan Commission, and Village Staff took inappropriate actions
regarding Jacob's Way Subdivision, specifically inadequate public
notification and the potential taking of part of his property. Mr. Denz
stated earlier this year, Director of Planning Barrera stopped by his
office and showed him a crude map of the plan Ms. Jaeckel had given
the Village. After Director Barrera described what the Village and Ms.
Jaeckel wanted to do, he told Director Barrera he was not interested.
After that meeting, Mr. Denz contacted his attorney and his attorney
stated until Mr. Denz received something in writing from the Village
with the Village letterhead, it was not a formal proposal. A few weeks
ago, Mr. Denz was at Village Hall and ran into Director Barrera and was
asked again if he was still interested in selling his property. Mr. Denz
told Director Barrera he was never interested in selling his property and
is still not interested in selling his property. July 23, 2007 an ordinance
was passed for this subdivision, without tree protection, Ms. Jaeckel can
remove any and all trees. Mr. Denz has spoken with several neighbors,
and not one of them has received any type of notification. Per the
Village's ordinance any and all property owners within 250 feet are
required to be notified. Also, signs were required to be posted on
Simpson as well as Maplewood and none were posted. At the July 23"
meeting, it was indicated the property owners were negotiating with Ms.
Jaeckel for the needed property owner, however his name was never
mentioned because there are no negotiations. The Village Staff and the
developer mislead the Village Board and the audience and Trustee
Schedler was the only one who asked if the property should be acquired

prior to approving the preliminary plat.
Mr. Denz stated he
understands other residents are concerned with the inappropriate
actions regarding Rubloff and he is next in line. The Village will be
hearing from his attorney. Mayor Kessler stated Mr. Denz should
direct his attorney to contact the Village's attorney, Mr. Marino.
Mr. Curt Denz, 201 Maplewood, Mundelein agreed with his brother Mr.
Brad Denz and stated one of the main reasons for buying the property
10 years ago was because it was at the end of a dead end road. For
anything to happen to the subdivision, it must go through their
property. Mr. Denz stated there are villages that abuse eminent domain,
and this has the earmarks for eminent domain. Mr. Denz stated they
have partnered with the Institute for Justice, an organization that
Mr. Denz
defends property owners against eminent domain.

Ivanhoe Ponds
Mr. Ted Booden, 21864 Bay Hill Court, Ivanhoe stated there had been
extensive rain recently and there is much run off from the Pulte/Del
\Vebb development. Ivanhoe has expressed their concerns prior to the
development. They were assured the mitigation would not adversely
affect Ivanhoe, however the waters run into the ponds higher, faster
and arc receding slower due to the continuous mn off from Del Webb.
Meetings have been held with Storm \Vater Management, the Village
Engineer, and a Pulte Representative. There is something wrong. They
have been told they will look into this problem, but nothing is done.
Something needs to be done. Only one third of the Del Webb
development is complete. As the rest of the development is complete,
more water will run off, and the problem will only get worse, and with
the Rubloff development, it will get even worse. It has been 72 hours
since the rains have stopped, and the water has not recessed. Please
help us. Mayor Kessler asked Engineer Emmerich to comment.
Engineer Emmerich stated it was difficult to synthesize everything in a
couple of minutes. Meetings have been held. The project was designed
by engineers, reviewed by engineers, approved by engineers, and is
being built according to the plan. The developer has not submitted asbuilts yet, but performance guarantees have not been released. There
has not been a claim in writing, or a defined problem other than there is
a problem. Mayor Kessler asked Administrator Lobaito to work with
Engineer Emmerich and follow up with Ivanhoe. Mr. Booden stated
the Pulte representative would respond within six to eight weeks to
several action points. One was the rate at \vhich water is released,
whether the retention ponds are functioning appropriately. Mr. Booden
stated at prior meetings, perhaps the engineering looks wonderful, but
something went wrong. He is representing citizens that are seeing the
rise in water, increase in erosion and the potential for a flood event.
They are asking for a comprehensive evaluation from Pulte, the Village
and Storm Water Management. The written claim was sent to Storm

Water Management, and concerns have been expressed in the meetings,
and the lllillutes arc written and recorded.

Mr. RanI Vivero, 125 Maplewood, Mundelein stated in Spanish he had
not received any type of notification regarding the Jacob's way
subdivision. Mr. Den2 was his translator.
Ivanhoe Ponds (Continued)
i\Is. Debbie Jacobson, 411 North Lakeshore Drive, Mundelein stated
four years ago resurfacing was done on her street and almost
immediately if began to flood. She was told tllls was a 100-year flood,
and since then there have been four 100-year floods. They have had to
move cars to avoid flooding, but sometimes the rain happens at night
and their cars have flooded. She has called because water comes out of
the sewer. The biggest issue is the water gets stuck and has nowhere to
go once it gets to Fort Hill. Ms. Jacobsen asked what would be done
with this problem. Mayor Kessler stated this is correct; this is a large
and expensive project. Trustee Semple will be calling a Public \V'orks
Committee meeting to look onto these issues.

Flooding on Lakeshore
Drive
Ms. Cecilia Burke, 1011 Wrens Gate, Mundelein stated she too had
water problems coming from the Donllnick's development. It was
determined the calculation was off by a decimal point, and the water
issue was not resolved until the calculation was corrected.

No other comments were made. The public commentalY was closed.
Mayor Kessler stated S1!1ce Director of Building Department
Schubkegel, Sr. was absent, the Del Webb Inspection Management
Presentation would be postponed until the next meeting.
Motion by Voss, seconded by Cancelli to approve Committee of the
Whole Meeting Minutes of August 13, 2007. Upon roll call vote, the
vote was as follows: Ayes: Voss, Cancelli, Nutschnig, Semple, and
Sullivan; nays: none; abstain: Schedler; absent and not voting: none.
Motion carried.
Mayor Kessler stated he would be holding interviews for new
cOllunissioll l11clnbers, one for Business Dcvelop111cnt and one for
Police Pension Commission. Memos will be distributed and any
questions or concerns should be directed to him.
Trustee Semple asked Director Miller to recap the recent rainfall events.
Director Miller stated the wet weather period began August 4'" and
lasted for 21 days with a total of 12.26 inches of rainfall. There were
less than 25 calls for service. Assistance outside of the Village was
provided. Lake County requested a Disaster Declaration for the entire
County, which has been approved by the State.
Trustee Semple called a Public Works meeting September 24, 2007 at
6:00 pm.

Trustee Sullivan recapped the highlights of the expense report.

Trustee Sullivan stated the Illinois Municipal Review is a monthly
ncwsletter and in the recent issue an article regarding lllco111e tax bascd
per capita; Motor Puel Tax and State Use Tax, this year $126.06, and it is
estimated $130.75 will be received next year.

Trustee Voss announced a Project List was distributed with 24 projects
listed.

Trustee Nutschnig reported the Permits Committee Meeting held at 6:45
regarding Mundelein Dental Center, 328 North Lake Street.

Motion by Nutsehnig, seconded by Sullivan to authorize staff to prepare
an Ordinance for the Approval of a variation, with conditions, from the
requirement of a fire sprinlder system or the construction of a 3-hour
firewall per Section 903.2.3 of the 2000 International Pire Code as
amended by the Village for Mundelein Dental Center, 328 North Lake
Street.
Trustee Voss stated there are many other businesses in the same position
and the Village will set precedence.
Trustee Sullivan stated a fourth condition be set. The original plan
submitted a few years ago should be the same plan being considered
tonight. The plan submitted was a major improvement in architecture
along with significant fire detection and prevention system. Mayor
Kessler stated Attorney Marino's recommendation was to get consensus
from the Board to add the fourth condition. There was consensus to the
fourth condition.
Trustee Sullivan stated Dr. Sullivan is no rclation to the Trustee Sullivan,
so there is no conflict of interest.

Trustee Semple asked Engineer Emmerich to explain the elimination of the
lift station and providing individual, private sewer service for seven
properties. Engineer Emmerich stated the existing lift station is failing and
they will be providing a sewer connection in the front of their homes.
Trustee Sullivan added the homeowner would be responsible for their

ITECH Grant Reallocated
Administrator Lobaito stated a memo regarding the ITECH Grant for a
streetscape improvement, which the Village declined dne to the increase in
cost to the Village. A notice from IDOT was received advising the Village to
reallocate the grant with another downtown streetscape. Administrator
Lobaito recognized Assistant Administrator Flynn for his efforts monitoring

U-Haul Property Update
Administrator Lobaito stated Director Barrera distributed a memo regarding
U-Haul property. U-Haul has decided to stay in the County and not annex
into the Village and pursue development. Staff will monitor the progress and
may at some point ask the Village Board if it should be in the Village or stay
in the County. Nothing formal has been submitted.
Village Clerk's Report
Clerk Dahlstrom stated confIrmations should have been received for the 94'"
Annual Illinois Municipal League Conference scheduled for Thursday
October 18 - Sunday October 21. If you registered but have not received
confIrmation, please contact Marie.

VILLAGE-WIDE DAY OF VOLUNTARY SERVICE, CHARITY AND COMPASSION
WHEREAS, people of all ages and walks of life across American and around the world
collectively witnessed an event of immense tragedy on September II, 200 I; and
WHEREAS, the events of that day instantly transformed nearly everyone's lives, some
through personal loss, and many others through an unfamiliar sense of individual and national
vulnerability; and
WHEREAS, an unprecedented, historic bonding of Americans arose from the collective
shock, unifying the country in an outpouring of national spirit, pride, selflessness, generosity,
courage and service; and
WHEREAS, many brave people heroically, tirelessly and courageously participated in
an extraordinarily difficult and dangerous rescue and recovery effOti, in some cases voluntarily
putting their own well being at risk; and
WHEREAS, September II th will never, and should never be just another day in the
hearts and minds of Americans; and
WHEREAS, the creation of memorials and monuments honoring those lives lost on
September II, as well as the efforts of those who participated in rescue and recovery efforts, are
necessary, proper and fitting, but alone cannot fully capture the country's desire to pay tribute in
a meaningful way; and
WHEREAS, many citizens may wish to memorialize September II th by engaging in, or
making a plan to engage in personal and individual acts of community service, or other good
deeds, as part ofa national day of recognition and tribute; and
WHEREAS, to lose this opportunity to bring people together for such an important
endeavor would be a tragedy unto itself.
NOW, THEREFORE, I, Kenneth H. Kessler, Mayor of the Village of Mundelein, do
hereby proclaim September 11, 2007 as a Village-wide day of voluntary service, charity and
compassIOn.

In follow up to the August 27, 2007 Board meeting, I had asked the Village Administrator to
review the circumstances surrounding Mr. Denz's comments. Attached is a memorandum from
Administrator Lobaito outlining the facts surrounding the approval of the preliminary plat for
Jacob's Way Subdivision.

In follow up to last :rvfonday night's Board meeting, I have discllssed with Charue tvCarino the clai.ms made by
the Denz brothel"s. In response to the claim of not being notified of the Boards action granting a variation to
the right-DE-way width, they are correct. No notification wns provided to the adjoining property owners nor
does the State law or local ordinance require notification. The only variation requested was a reduction in the
minimum width of right-DE-way f1"01'n 60 ft. to 40 f t, Currently there exists a 30 ft. right-DE-wayan Simpson
Avenue. \Ve have asked the developer to convey to the Village an additional 10 feet along the entire west
right-DE-way line of Si.mpson Avenue to inci"case the current width from 30 feet to 40 feet. This is not a
zoning variation but rather a vnriatioll to the municipal code. Onl}' zoning variations arc subject to
notification requirements.
\'(Iith l'cspect to llction on a prelimin:u)' subdivision plat, here again no noticing of adjoining property owners
is required by state law or by local ordinnnce. Additionally. the preliminary plat does not incorporate the
Denz property. A decision was made at the time of the Prelitninaty Plat prep,u'ation to not include the
Denz's property on the Plat since Mr. Denz had not agreed to scll the Village the pro pert)'. After Board
action on the PInt> it was the staff's intent to provide :rvlr. Denz with a copy of the Plat that accurately
reflected the land area needed. If :rvfr. Denz agreed to the land sale. then the Pinal Plat would reflect the full
right-of-way. If lvLr. Dellz chose not to sell his propcrty then the !vIaplewood proposed right-of-way in the
proposed Jacob's Subdivision Final Plat would only reflect the land owned by the developer. Acquisition of
the 750 sq. ft. would be put off to a later time when there may be a willing seller. The extension of
rvfaplewood Avenue is 110t an essential component to the proposed Jacob's Subdivision. It simply provided a

In response to Mr. Denz's chtltacterization of our discussion with him regarding the purchase of
appwximately 750 sq. ft, of his property, staff simply has a different understanding of where we were at with
the acquisition of the property. At no time did we represent that we would use our eminent domain powers
to acquire the property. Because there has been a previous profession~lrelationship with Mr. Dcnz as one of
the land planners for Lake County, we approached lvk Denz on an informal basis to determine the level of
interest in securjng this small piece of property. St~ff was guite surprised at the comments and the
characterization by Mr. Denz at the Board meeting of Ollr convers~cion regarding tIus matter.
The idea of acquiting this land was driven by ViUage staff. \\le expressed a strong desire to the developer that
we would like to eliminate the dead end on lvraplewood Avenue. '[he elimination of a dead end street would

improve our public sflfety personnel access to the area. Considering the develope!" was willing to provide
Mundelein, at no cost, the additional 10 feet of private property parallel to Simps~n Avenue for use as rightof-way. we thought it was reasonable for the Villnge to purchase the small amount of land necessary to
complete the rjght-of~\Vay for rvfaplewood. The details of this agreelnent would be outlined in a
Development Agreement and subject to Board approval.
Going forward, Village staff will not initiate any further contact with the Mr. Dcnz. \YJe wilt direct the
developer to prepare a Final Plat consistent with the Preliminary Plat approved by the Board. If
cu:cumstances change in the future, we can then recol1sidct extending tvfaplewood Avenue.

Summary
The Police Department has recommended improving the crosswalk safety at Atwater and Hawley Street,
Idlewild Ave. and Midlothian Road and Killarney Pass Drive and Midlothian Road. Each of these
locations is a major crossing point for children walking to school. Each location needs a more visible
waming system. The Police Department and the Public Works Depal1ment have researched devices that
improve crosswalk safety. The bcst system on the market, in their combined view, is a product produced
exclusively by R. D. Jones, Stop Expel1s Inc. of Venice, Florida, known as the Enhancer. This system
uses a patented flashing beacon that makes the warning signal more visible to the motorist. The Enhancer
has recently been approved as an experimental device for inclusion in the MUTCD by the Federal
Highway Authority. The Police Department has also recommended the acquisition of the Enhancer speed
control monitor, for installation on North Rl. 45. The Administration Division has recommended that the
3 crosswalk systems be upgraded to the ornamental design, which is more befitting the standard in the
area. The total purchase price would be $65,245. Funding would be from three sources: $20,000 for
crosswalk safety improvement contributed by Pulte as part of the Hampton Reserve subdivision, and
reserved for this purpose in this year's budget; and $25,245 from the police Department's DUI Fund, a
fine-based fund for traffic safety improvements, and $20,000 from Del Webb impact fees.

WHEREAS, Illinois Compiled Statutes 65 ILCS 5/8-9-1 provides that a contract in
which the expense to be incurred by a municipality exceeds $10,000 may be entered into by the
proper municipal officers without advertising for bids if authorized by a vote of two-thirds (2/3)
of all the Trustees then holding office; and
WHEREAS, the Village of Mundelein has identified a need to improve crosswalk safety
at the following locations near Mundelein High School and Mechanics Grove Elementary
School: Hawley Street and Atwater Drive; Midlothian Road and Idlewild Avenue; and
Midlothian Road and Killarney Pass Drive; and
WHEREAS, the Village of Mundelein has identified a need to control the speed of

(Exhibit A); and
WHEREAS, R. D. Jones, Stop Experts, Inc. has confirmed that the Rectangular
Flashing Beacon System has been granted an experimental permit by the Federal Highway
Administration; and
WHEREAS,
the Village of Mundelein Police Department and Public Works
Depmiment has researched crosswalk and speed control systems and have concluded that the
Enhancer Crosswalk Systems with the Rectangular Flashing Beacon are the most effective
systems for the proposed locations; and
WHEREAS, a proposal has been received from R. D. Jones, Stop Experts Inc. of Venice FL
dated August 31, 2007 in the amount of $65,245 for equipment, installation and shipping of:

SPECIFICATIONS
It is the intention of these specifications to describe one (1) Calcium Chloride Delivery
System with a 5,000 gallon vertical polyethylene tank, controls and installation in
accordance with these specifications.
General Notes
All items not specifically mentioned in the scope of these specifications that are
necessary to provide a calcium chloride delivery system shall be furnished by the
successful bidder. The dispensing system pump and electronics shall be the
manufacturer's current production model and shall be of domestic manufacturing
concern. These specifications shall be construed as minimum. Should the manufacturer's
current published data or specifications exceed these, they shall be considered minimum
and furnished.
The contractor shall be responsible for locating existing utilities and protecting them from
damage during construction operations. Any utility damage shall be repaired by the
contractor to the satisfaction of the owner at the contractor's expense. All construction
debris and all excess excavated material shall be disposed of off site at the contractor's
expense.
The bid submitted, either on a delivery system and tank to be ordered or that is in stock,
must meet the specifications as provided. Deviations from the specification that can be
shown to be as a result of the manufacturer's design revision must be noted and could be
found to be acceptable.
Each line must indicate by checking on the YES/NO line adjacent to each item on the

GENERAL INSTRUCTIONS AND REOUIREMENTS TO BIDDERS
1.
All items contained in the "Instructions to Bidders" are applicable to this call for bids.

The lowest three bids may not be withdrawn after the scheduled closing time for receipt of
bids for at least thirty days, and thereafter must be done so in writing indicating the
reasons for the withdrawal to the Village of Mundelein.

An authorized officer or employee of the company must sign and date the bid. The firm
name shall appear on all bid proposals. All parties involved shall follow all bid submittal
instructions contained within the bid packet.

The Village Administrator (Finance Director, City Clerk, etc.) upon request will execute
the exemption certificates in connection with all orders when Federal Excise Tax would
otherwise be due.

Bid price is to be F.O.B. Village of Mundelein (Municipality) with delivery to the Village
being Public Works Complex located at 440 E. Crystal Street, Mundelein, Illinois. Prices

Parts and materials must be of current date (latest model) and meet the specifications

Bids will be considered on equipment or material complying substantially with the
specifications provided each deviation is stated and the substitution is described, including
technical data when applicable, in a letter attached to bid. The Village of Mundelein
(Municipality) reserves the right to determine as to whether such substitutions or
deviations are within the intent of the specifications and will reasonably meet the service
requirements of the using department. In addition to price and applicability, consideration
for award may be given to engineering design, which adds safety, convenience or
adaptability for use intended. Brand name, which may be mentioned in specifications,
does not indicate a preference and is used only as a reference to the type and quality of

Time of delivery/completion is a part of the bid award consideration, and must be stated in
definite terms, as this may be a factor in making the award. If time varies on different
items, the bidder shall so state.

Unless otherwise specified, services, materials, and equipment purchased will be inspected
by the Department of Public Works as to meeting the quality and requirements of all call
for bids. When deemed necessary, samples of supplies or materials will be taken at
random from stock received for submission to a commercial laboratory and other
appropriate inspection agency for analysis and tests as to whether the material conforms in
all respects to the specifications. In cases where this action is required, the expense of
analysis is to be borne by the vendor and the order of balance thereof may be canceled if
necessary by the Village of Mundelein (Municipality). (As Applicable)

The vendor shall hold the Village of Mundelein (Municipality), its officers, agents, and
employees, harmless from liability of any nature of kind on account of use of any
copyrighted or un-copyrighted composition, secret process, patented or un-patented
invention, article or appliance furnished or used under the bid call.

Successful bidder is specifically denied the rights of using in any form or medium the
name of the Village of Mundelein (Municipality) for advertising unless express permission
is granted by the Village of Mundelein (Municipality).

The Village of Mundelein reserves the right to reject any or all bids, or any part thereof, or
to accept any bid, deemed to be for the best interest of the Village of Mundelein.

If there is a trade-in consideration, trade-in will not be released until the new
vehicle/equipment is delivered and accepted. In addition, there is no warranty expressed

materials, and supplies in order to complete the program, project, and work associated with

INSURANCE REQUIREMENTS
Contractor shall procure and maintain, for the duration of the contract, insurance against claims for
injuries to persons or damages to property, which may arise from or in connection with the
performance of the wor'~ hereunder by the Contractor, his agents, representatives, empioyees or
subcontractors.

Contractor shall maintain limits no less than:

Any deductibles or self-insured retentions must be declared to and approved by the
member, At the option of the member, either: the insurer shall reduce or eliminate such
deductibles or self-insured retentions as respects the member, its officials, agents,
employees and volunteers; or the Contractor shall procure a bond guaranteeing payment of
losses and related investigation, claim administration and defense expenses,

OTHER INSURANCE PROViSIONS
The policies are to contain, or be endorsed to contain, the following provisions:
A.
General LIability and Automobile LIability Coverages
1, The member, its officials, agents, employees and volunteers are to be covered
as addiUonal insureds as respects: liability arising out of the Contractor's work,
including activities performed by or on beh'alf of the Contractor; prodUCts and
completed operations of the Contractor; premises owned, leased or used by the
Contractor; or automobiles own!=d, leased"hired or borrowed by the Contractor.
The coverage shall contain no' spedal limitations on the scope of protection
afforded tei the member, its officials, agents, employees and volunteers.
2, The Contractor's insurance coverage shall be primary as respects the member,
its officials, agents, employees and volunteers. Any Insurance or self-insurance
maintained by the member, Its officials, agents, employees and volunteers shall
be excess of Contractor's Insurance and shall not contribute with it.
3, My failure to comply with reporting provisions of the policies shail not affect
coverage provided to the member, its officials, agents, employees and
volunteers,
4. The Contractor's insurance shail contain a Severability of Interests/Cross
LIability clause or language stating that Contractor's Insurance shail apply
separately to each Insured against whom claim is made or suit is brought,
except with respect to the limits of the insurer's liability,
5. If any commercial generalliabiHty insurance Is being prOVided under an excess
or umbrella liability policy that does not '1ollow fomn," then the Contractor shall
be required to name the member, its officials, agents, employees and volunteers
as additional Insureds, A copy of the actual additional Insured endorsement
shall be provided to the member,

employer or contractor to name the member as an Alternative Employer
under their Workers' Compensation and Employer's Liability coverage and
have an NCCI Alternate Employer Endorsement (We 000301). This wiff ensure
that the Workers' Compensation coverage applies under the Contractor's
coverage, rather than the member's.]
C.
Professional Liability (if required)'
1. Professional liability insurance with limits not less than $1,000,00 each claim
with respect to negligent acts, errors and omissions in connection with
.. prof!'Jss!~l1al,services to_be provided under the contract, with adeductiqle not-toexceed $50,000 without prior written approval.
2. If the policy is written on a claims-made fonn, the retroactive date must be equal
to or preceding the effective date of the contract. In the event the policy Is
cancelled, non-renewed or switched to an occurrence form, the Contractor shall
be required to purchase supplemental extending reporting period coverage for a

Professional liabIlity insurance that provides indemnification and defens~ for

a. Praparing, approving or failure to prepare or approve maps, drawings,
opinions, report, surveys, change orders, designs or specifications;
b. Providing direction, instruction, supervision, Inspection, engineering services
or failing to provlde them, if that Is the primary cause of Injury or damage.

D.
All Coverages
Each insurance polley reqUired by this clause shall be endorsed to state that
coverage shall not be suspended, voided, cancelled, reduced in coverage or in
limits except after thirty (30) days prior written notlce by certified mail, retum receipt
requested, has been given to the member.

least as broad as the coverage stated on the attached endorsement (EXhibit A), such as
ISO Additional Insured Endorsements CG 2026 or CG 2010, The member reserves the
right to reguest full certified copies of the insurance policies and endorsements.
Vll.
SUBCONTRACTORS
Contractor shall include all subcontractors as insureds under Its policies or shall furnish
separate certificates and endorsements for each subcontractor. All coverages for
subcontractors shall be subject to all of the requirements stated herein,

ASSUMPTION OF LIABILITY
The ,contractor assumes llab\lity for all injury to or death of any person or persons including
employees of the contractor, any SUb-contractor, any supplier or any other person and
assumes liability for all damage to property sustained by any person or persons occasioned
by or In any way arising out of any work performed pursuant to this agreement.
IX.
INDEMNITf/HOLD HARMLESS PROVISiON {Note to Member: Include as separate

To the fullest extent penmitted by law, the Contractor hereby agrees to defend, indemnify
and hold harmless the member, its officials, agents and employees, against all. injuries,
deaths, loss, damages, claims, patent claims, suits, liabilities, judgments, cost and
expenses, which may In anywise accrue against the member, its officials, agents and

employees, arising in whole or in part or in consequence of the performance of this work by
the Contractor, its employees, or subcontractors, or which may in anywise result therefore,
except that arising out of the sole legal cause of the member, its agents or employees, the
Contractor shail, at its own expense, appear, defend and pay all charges of attomeys and
all costs and other expenses arising therefore or incurred In connections therewith, and, if
any judgment shall be rendered against the member, its officials, agents and employees, in
any such action, the Contractor shail, at Its own expense, satisfy and discharge the same,
Contractor expressly understands and agrees that any performance bond or insurance
policies reqUired by this contract, or otherwise provided by the Contractor, shail in no way

CERTIFIED PAYROLL REQUIREMENT
The lilinois legislature has passed and the Governor has signed two laws recently, which revises
the prevailing wage act.
Public Act 94-0515 stipulates that effective August 10,2005, contractors and sub-contractors on
public works projects must submit certified payroll records on a monthly basis to the public body
in charge of the construction project, along with a statement affirming that such records are true
and accurate, that the wages paid to each worker are not less than the required.prevailing rate,
and that the contractor or sub-contractor is aware that filing records that they know to be false is
a Class BMisdemeanor.
The certified payroll records must include for every worker employed on the public works
project; a name, address, telephone number, social security number, job classification, hourly
wage paid in each pay period, number of hours worked each day, and the starting and ending
time of work each day. These certified payroll records are considered public records and public
bodies must make these records available to the public under the Freedom of Information Act,
with the exception of the employee's address, telephone number, and social security number.
In addition, Publl~ Act 94-0488, which becomes effective on January 1, 2006, increases the
penalties from 20% to 50% of the underpaid amounts for second or subsequent violations in
relation to violation to the Prevailing Wage Act. This act also increases the debarment period
during which contractors would be ineligible for public work project work, and a new monetary
penalty for contractors who retaliate against employees who report violations or file complaints
under the Prevailing Wage Act.

Certified Payroll Requirement
The above is only a summary of the two recently passed laws. It would be recorrunended that
your company and any sub-contractors who work with you review these two laws ill more detail
to ensure compliance.
As a result of the above, the Village of Mundelein Public Works Department hereby is required
to request and to receive tWo copies of your certified payroll records, along with two copies of
your written statement affirming that the records are true and accurate for any and all payroll
periods beginning on August 10, 2005, and monthly thereafter until the project has been
completed and the final payment has been released by the Village of Mundelein.
The department is not responsible for, and has no obligation to verify the payrolls for compliance
with the Prevailing Wage Act. This responsibility solely rests with the contractors and/or subcontractors.
Payment for any current or future project work may be withheld, should the copies identified
above not be provided to the department as is legally required on a timely and routine basis.

ILLINOIS, ASCERTAINING THE PREVAILING RATE OF WAGES
WHEREAS, the State of Illinois has enacted "An Act regulating wages of laborers,
mechanics and other workers employed in any public works by the State, County, City or any
public body or any political subdivision or by anyone under contract for public works," approved
June 26, 1941, as amended, being a Section 39s-12, Chapter 48, Illinois Revised Statutes; and
WHEREAS, the aforesaid Act requires that the Board of Trustees of the Village of
Mundelein investigate and ascertain the prevailing rate of wages as defined in said Act for
laborers, mechanics and other workers in the locality of said Village of Mundelein employed in
performing construction of public works for said Village of Mundelein, exclusive of
maintenance work; and
WHEREAS, the State of Illinois Department of Labor, Conciliation and Mediation
Division has revised the prevailing wage rate for June 2006.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MUNDELEIN, LAKE COUNTY, ILLINOIS as follows:
Section 1:
To the extent and as required by "An Act regulating the wages oflaborers,
mechanics and other workers employed in any public works by the State, County, Village or any
other public body or any political subdivision or by anyone under contract for public works,"
approved June 26, 1941, as amended, the general prevailing rate of wages in this locality for
laborers, mechanics and other workers engaged in the construction of public works coming under
the jurisdiction of the Village of Mundelein is hereby ascertained to be the same as the prevailing
rate of wages for construction work in the Lake County, Illinois area as revised by the
Department of Labor of the State of Illinois for the period June 1, 2006 through May 30, 2007, a
copy of that determination being attached hereto as Exhibit A and herein by reference. The
definition of any terms appearing in this Ordinance which are also used in aforesaid Act shall be
the same as in said Act.
Section 2:
Nothing herein contained shall be construed to apply said prevailing rates
of wages as herein ascertained to any work or employment except public works construction of
the Village of Mundelein to the extent required by the aforesaid Act.
Section 3:
The Village Clerk shall publicly post or keep available for public
inspection by any interested party in the main office of the Village of Mundelein this
determination of such prevailing rate of wage.
Section 4:
The Village Clerk shall mail a copy ofthis determination to any employer,
and to any association of employers and to any person or association of employees who have
filed, or file, their names and addresses, requesting copies of any determination stating that
particular rates and the particular class of workers whose wages will be affected by such rates.
Section 5:
The Village Clerk shall promptly file a certified copy of this Ordinance
with both the Secretary of State and the Department of Labor of the State of Illinois.
Section 6:
All contracts entered into by the Village which provide that the contractor
shall pay the prevailing minimum wage rates for the various classes oflaborers and mechanics to
be engaged in work on the project shall be subject to the provisions of this Ordinance.
Section 7:
The Village Clerk shall cause to be published in a newspaper of general
circulation within the area, a copy of this Ordinance and such publication shall constitute notice
that the determination is effective and that this is the determination of the public body.

Explanations
LAKE COUNTY
The following list is considered as those days for which holiday rates
of wages for work performed apply: New Years Day, Memorial/Decoration
Day, Fourth of July, Day, Veterans Day! Thanksgiving Day, Christmas
Day.
Generally, any of these holidays which fallon a Sunday is
celebrated on the following Monday.
This then makes work performed on
that Monday payable at the appropriate overtime rate for holiday pay.
Common practice in a given local may alter certain days of
celebration such as the day after Thanksgiving for Veterans Day.
If
in doubt, please check with IDOL.
EXPLANATION OF CLASSES
ASBESTOS - GENERAL - removal of asbestos material/mold and hazardous
materials from any place in a building, including mechanical systems
where those mechanical systems are to be removed.
This includes the
removal of asbestos materials/mold and hazardous materials from
ductwork or pipes in a building when the building is to be demolished
at the time or at some close future date.
ASBESTOS - MECHANICAL - removal of asbestos material from mechanical
systems, such as pipes, ducts, and boilers, where the mechanical
systems are to remain.
CERAMIC TILE FINISHER
The grouting, cleaning, and polishing of all classes of tile, whether
for interior or exterior purposes, all burned, glazed or unglazed
products; all composition materials, granite tiles, warning detectable
tiles, cement tiles, epoxy composite materials, pavers, glass,
mosaics, fiberglass, and all substitute materials, for tile made in
tile-like units; all mixtures in tile like form of cement, metals, and
other materials that are for and intended for use as a finished floor
surface, stair treads, promenade roofs, walks, walls, ceilings,
swimming pools, and all other places where tile is to form a finished
interior or exterior.
The mixing of all setting mortars including but
not limited to thin-set mortars, epoxies, wall mud, and any other
sand and cement mixtures or adhesives when used in the preparation,
installation, repair, or maintenance of tile and/or similar materials.
The handling and unloading of all sand, cement, lime, tile,
fixtures, equipment, adhesives, or any other materials to be used in
the preparation, installation, repair, or maintenance of tile and/or
similar materials.
Ceramic Tile Finishers shall fill all joints and

voids regardless of method on all tile work, particularly and
especially after installation of said tile work.
Application of any
and all protective coverings to all types of tile installations
including, but not be limited to, all soap compounds, paper products,
tapes, and all polyethylene coverings, plywood, masonite, cardboard,
and any new type of products that may be used to protect tile
installations, Blastrac equipment, and all floor scarifying equipment
used in preparing floors to receive tile.
The clean up and removal of
all waste and materials. All demolition of existing tile floors and
walls to be re-tiled.
COMMUNICATION TECHNICIAN
Low voltage construction, installation, maintenance and removal of
telecommunication facilities (voice, sound, data and video) including
outside plant,
telephone, security systems and data inside wire,
interconnect, terminal equipment, central offices, PABX, fiber optic
cable and equipment, micro waves, V-SAT,
bypass, CATV, WAN (wide area
network), LAN (local area networks), and ISDN (integrated system
digital network), pulling of wire in raceways, but not the
installation of raceways.
MARBLE FINISHER
Loading and unloading trucks, distribution of all materials (all
stone, sand, etc.), stocking of floors with material, performing all
rigging for heavy work, the handling of all mateiral that may be
needed for the installation of such materials, building of
scaffolding, polishing if needed, patching, waxing of material if
damaged, pointing up, caulking, grouting and cleaning of marble,
holding water on diamond or Carborundum blade or saw for setters
cutting, use of tub saw or any other saw needed for preparation of
material, drilling of holes for wires that anchor material set by
setters, mixing up of molding plaster for installation of material,
mixing up thin set for the installation of material, mixing up of sand
to cement for the installatin of material and such other work as may
be required in helping a Marble Setter in the handling of all material
in the erection or installation of interior marble, slate,
travertine, art marble, serpentine, alberene stone, blue stone,
granite and other stones (meaning as to stone any foreign or domestic
materials as are specified and used in building interiors and
experiors and customarily known as stone in the trade), carrara,
sanionyx, vitrolite and similar opaque glass and the laying of all
marble tile, terrazzo tile, slate tile and precast tile, steps, risers
treads, base, or any other materials that may be used as substitutes
for any of the aforementioned materials and which are used on interior
and experior which sare installed in a similar manner.
MATERIAL TESTER I:
Hand coring and drilling for testing of materials;
field inspection of uncured concrete and asphalt.
MATERIAL TESTER II:
Field inspection of welds, structural steel,
fireproofing, masonry, soil, facade, reinforcing steel, formwork,
cured concrete, and concrete and asphalt batch plants; adjusting
proportions of bituminous mixtures.
TRAFFIC SAFETY - work associated with barricades, horses and drums
used to reduce lane usage on highway work, the installation and
removal of temporary lane markings, and the installation and removal
of temporary road signs.

Terrazzo work, floors, base, stairs, and wainscoting by hand or
machine, and in addition, assisting and aiding Marble, Masonic, and
Terrazzo Mechanics.
Other Classifications of Work:
For definitions of classifications not otherwise set out, the
Department generally has on file such definitions which are available.
If a task to be performed is not subject to one of the
classifications of pay set out, the Department will upon being
contacted state which neighboring county has such a classification and
provide such rate, such rate being deemed to exist by reference in
this document.
If no neighboring county rate applies to the task,
the Department shall undertake a special determination, such special
determination being then deemed to have existed under this
determination.
If a project requires these, or any classification not
listed, please contact IDOL at 618/993-7271 for wage rates or
clarifications.
LANDSCAPING
Landscaping work falls under the existing classifications for laborer,
operating engineer and truck driver. The work performed by landscape

EXPLANATION:
The Village Zoning Ordinance was created in the 1960s and has had few updates. The
Zoning Ordinance no longer fits with many of today's development trends. The Village
Board approved' funds in the 2007-2008 budget to hire a consultant to help write a new
Zoning Ordinance that fits with the needs and expectations for current and future
development in Mundelein.

The Village of Mundelein is soliciting proposals to update the Village's Zoning Ordinance through this RFP
invitation. Qualified consultants will be invited to interview with the selection committee.
The Village of Mundelein is located in central Lake County, 35 miles northwest of downtown Chicago. With
a population of 32,774 (US Census 2005 population estimate), the Village has grown from just over 21,000
in 1990. The Village has seen both commercial and residential development projects recently, including
Cardinal Square, a luxury condominium and townhouse development under construction; Mundelein Town
Center, a proposed commercial development of approximately 600,000 square feet of retail on
approximately 94 acres; and an approved PUD for Del Webb's Grand Dominion active adult community is
under construction. The Village sees the downtown and the 24-acre PUD at the train station to be critical
immediate initiatives that will have a large impact and shape the image and character of the Village.
A Mayor and a six member Board of Trustees govern the Village. A Plan Commission and Zoning Board of
Appeals advise the Board, along with a full time Village Administrator. The Community Development
Division's Planning & Development staff consists of an experienced Director of Community Development
and two Planners. The Comprehensive Plan was written in 1990 and last updated in 2004 with the TOD
plan. The Comprehensive Plan has been partially updated recently but is, overall, outdated. The Village
intends to update this plan in the coming fiscal year, and would like respondents to include information
about their ability to work with the Village on this update. The Zoning Ordinance was adopted in 1966 and
received several amendments over the years. Other ancillary Ordinances such as the Subdivision
Ordinance may also need attention.
The current zoning ordinance is a conventional ordinance written in the 1960s. In 2004, the Village
successfully completed and adopted a transit-oriented development (TOD) study for the area around the
Metra commuter train station in the Village's downtown. Just as the study and plan envisions, it's the
Village's intent to create a progressive, mixed-use downtown. The current zoning ordinance makes
implementing this plan difficult and - in some cases - impossible. It's the Village's goal to write a revised
ordinance that works for the newly envisioned downtown and the entire municipality.
The Village of Mundelein is using a conventional zoning ordinance with several amendments. The result
creates a patchwork quilt of regulations that does not reflect the Village's current vision for new
development. In addition, the code is not as up-to-date, well organized, clear, consistent, or customer
friendly as is desired. The codified development standards and procedures do not reflect current
community values or unique community development opportunities as expressed in the recently adopted
24-acre PUD at the train station. Especially complicated is the application of modern development
standards to property that has established "vested rights" under the existing zoning. As a result, many of
the recent zoning cases have been processed through Planned Unit Developments to assure high
development standards and amenities for large developments not detailed in the zoning ordinance. The
other application for zoning issues has been Use Variations to address situations not covered in the
present zoning ordinance. A comprehensive re-write of most of the existing ordinance is needed.
The consultant is expected to re-draft the zoning map, provide a comprehensive amendment to the zoning
text, provide supporting tables, and provide necessary and supplementary graphics.
A comprehensive and thorough code analysis is needed to identify potential areas for improvement. The
revised code must consider:

The relationship to the existing zoning code especially the reorganization, clarification, and
streamlining of the present code.
• The Comprehensive Plan and its updates (West Side Update, Southside Commercial
Corridor Plan, and TOD Plan).
• Community values.
• The option to create a Land Development Ordinance in the future.
• Existing land economics and potential for redevelopment.
• Judicial decisions.
• Existing PUD standards.
• An examination of bulk standards.
• Local requirements such as the 2000 International BUilding Code (IBC) and existing
Subdivision regulations.
• Special study areas such as the TOD area and southside commercial corridor.
• Current in-progress projects, including Downtown Design Guidelines.
• Regional laws and policies such as the Lake County stormwater or street access policies.
• Applicable state and federal regulations - zoning enabling laws, ADA regulations, and EPA
rules.
• Zoning incentives for housing diversity, improved design, and economic development.
• Urban design enhancements, especially buffers, parking, and landscaping.
• Neighborhood protection measures (especially transitions from commercial uses)
• The potential for infill development.
It is anticipated that the consultant will work with the Plan Commission and Zoning Board of Appeals who
will serve as the touchstone for the community. Additional Public Workshops / Hearings with the
community will be required.
The present ordinance provides a basic framework for zoning decisions and administration over an
extended period of time. The Village is willing to explore innovative new zoning techniques such as formbased codes, neo-traditional design, cluster or mixed use zoning, smart growth zoning, context based
zoning, "green" zoning, etc. Other considerations include formatting the new ordinance for electronic use
and inclusion on the Village's website. The goal is to create a user-friendly interface between potential
development groups and the Village.
The Village Board and Plan Commission have an interest in the future development of the Village. It will be
important that the final document reflects their collective vision. The Village is also interested in exploring
new avenues for citizen participation in the zoning process that go beyond the traditional standard legal
notification procedures and hearings required by state law.

Resurfaced Bay Floors at Station #2
EXPLANATION:
The apparatus bay floors at Mundelein Fire Station #2 need to be resurfaced to provide
for a more durable floor finish with improved slip resistance. The existing floor finish is
peeling in many locations down to bare concrete, and has been found to provide
minimal slip resistance. The current finish is wafer thin whereas the new floor would be
approximately 1/8" thick and provides twice as much slip resistance. The new floor will
include a ten-year warranty for labor and materials.
Waiving of the bidding process is being sought as the contractor, Archem, Inc. of Carol
Stream, IL completed this same work at Fire Station #1 in FYE 2006. This work was
completed on schedule, at the bid price and the quality of workmanship was
outstanding.
This project has been included in the Department's capital projections for the past 3
years.

A RESOLUTION WAIVING THE FORMAL BIDDING PROCESS
FOR THE FLOOR RESURFACING AT FIRE STATION #2,
1300 SOUTH LAKE STREET, MUNDELEIN, ILLINOIS AND ACCEPTING
PROPOSAL FROM ARCHEM, INC., CAROL STREAM, ILLINOIS
WHEREAS, Illinois Compiled Statutes 65 ILCS 5/8-9-1 provides that a contract in which
the expense to be incurred by a municipality exceeds $ I0,000 may be entered into by the proper
municipal officers without advertising for bids if authorized by a vote of two-thirds (2/3) of all
Trustees then holding office; and
WHEREAS, the Mundelein Fire Department has budgeted $24,150.00 for floor
resurfacing at Fire Station #2; and
WHEREAS, resurfacing was performed at Fire Station #1 in 2006 to reduce slips and
falls, and is recommended at Fire Station #2; and
WHEREAS, the Fire Department received bids for the floor resurfacing work at Fire
Station #1, at which time Archem, Inc., Carol Stream, Illinois was the low bidder; and
WHEREAS, Archem, Inc. completed the work at Fire Station #1 on schedule and
performed an excellent job; and
WHEREAS, Archem, Inc. submitted a proposal for the resurfacing work at Fire Station
#2 in the amount of $24, 150.00.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the
Village of Mundelein, County of Lake, State of Illinois, as follows:
The formal bidding process provided in Illinois Compiled Statutes
65 ILCS 5/8-9-1 is hereby waived and approval is granted to accept
the proposal for the floor resurfacing project at Fire Station #2, 1300
South Lake Street, Mundelein, IL, from Archem, Inc., Carol Stream,
Illinois, in the amount of $24, 150.00.

AN ORDINANCE GRANTING A CONDITIONAL VARIATION TO THE MUNDELEIN
FIRE CODE FOR MUNDELEIN DENTAL CARE, 328 NORTH LAKE STREET,
MUNDELEIN, IL
WHEREAS, on November 24, 2003 the Village of Mundelein passed Ordinance 03-1151 adopting the 2000 International Fire Code, as the fire code for the Village of Mundelein; and
WHEREAS, Chapter Nine of the 2000 International Fire Code was amended by
Ordinance 03-11-51 to require either of the following for any building addition a) a complete fire
suppression system in the addition and the existing building, or b) the installation of a fire
suppression system in the addition and the construction of a three-hour fire wall between the
addition and the existing building; and
WHEREAS, Mundelein Dental Care is proposing to construct an addition of 300 square
feet for a patient waiting area; and
WHEREAS, this addition will add minimal fire load to the existing structure; and
WHEREAS, the expense associated with the installation of the fire suppression system,
and the three-hour fire wall in accordance with the Mundelein Fire Code is cost prohibitive
relative to the size of the addition; and
WHEREAS, at a public meeting on August 27, 2007 the Village of Mundelein Pennits
Committee reviewed a petition from Mundelein Dental Care for a variation to the fire
suppression requirement of the Mundelein Fire Code; and
WHEREAS, at a public meeting on August 27, 2007 the Village Board accepted the
recommendation of the Pennits Committee and authorized preparation of an ordinance granting a
variation to Section 16.16.080, sub-section 903.2.3 of the Mundelein Fire Code to Mundelein
Dental Care, 328 N. Lake Street, Mundelein, IL from the requirement of installation of a fire
suppression system and the construction of a three-hour fire wall, with conditions:

Establishing Inspection Requirement for Elevators
EXPLANATION:
The State of Illinois now requires all elevators to be registered and inspected by the Office of the
State Fire Marshal. Municipalities that have current inspection programs such as Mundelein are
allowed to continue its progress with the approval of the State Fire Marshal's office. We have
received that approval, and with the adoption of the elevator codes mandated by the State and
execution of the "agreement", the Village of Mundelein can continue with its inspection
program.

AN ORDINANCE ESTABLISHING INSPECTION REQUIREMENTS
FOR ELEVATORS AND CONVEYANCE SYSTEMS IN THE VILLAGE OF MUNDELEIN,
ILLINOIS
WHEREAS, Section 140 of the Elevator Safety Act (225 ILCS 312/140) (the Act)
permits a local authority to operate an elevator safety program in conformity with the Act and the
administrative rules adopted at 41 IL Administrative Code 1000; and
WHEREAS, the Village of Mundelein has an elevator inspection program, in which
elevators are inspected twice per year; and
WHEREAS, the Act permits the Village of Mundelein to continue its existing elevator
inspection program with the approval of the Office of the State Fire Marshal following execution
of an Illinois Elevator Safety Program Agreement with the Office of the State Fire Marshal (the
Agreement) attesting that it has adopted the safety standards and administrative rules required by
the Act; and
WHEREAS, the Village of Mundelein elects to continue its elevator inspection program
and sign the Agreement, attached hereto as Exhibit A, for inspections of elevators in the Village
of Mundelein.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MUNDELEIN, COUNTY OF LAKE, STATE OF
ILLINOIS as follows:
SECTION I.
The Village of Mundelein hereby adopts, by reference, 225 ILCS
312/140 and the Administrative Rules adopted at 41 IL Administrative Code 1000.
SECTION II.
The Director of the Building Department is authorized to
Illinois Elevator Safety Program Agreement (Exhibit A).

SECTION III.
Ordinance 03-11-50, the Mundelein Building Code, is hereby amended
to delete Chapter 30, Elevators and Conveying Systems.
SECTION III.
Severability. If any provision of this Ordinance is held invalid, such
provision shall be deemed to be excised from this ordinance and the invalidity thereof shall not
affect any of the other provisions of this ordinance. If the application of any provision of this
Act to any person or circumstance is held invalid it shall not affect the application of any
provisions of this act to such person or circumstances other than those to which it is held invalid.
SECTION IV.
This Ordinance shall be in full force and effect from and after passage,
approval, and publication, as required by law.
SECTION V.
This Ordinance shall be published in pamphlet form and available in the
Village Clerk's Office.

EXHIBIT "A"
ILLINOIS ELEVATOR SAFETY PROGRAM AGREEMENT
This Agreement is made between the Office of the State Fire Marshal ("OSFM") and the
municipality or county ("Local Authority") as hereinafter identified.
This Agreement constitutes a contract between the OSFM and Local Authority which
permits the Local Authority to operate an a Elevator Safety Program ("Program") in
conformity with Section 140 of the Elevator Safety Act (225 ILCS 312/140) and the
Administrative Rules adopted at 41 III. Adm. Code 1000. In that regard, the Local
Authority agrees to the following:
1.
This Agreement will become effective on the date it is accepted by the OSFM.
2.
The Local Authority shall submit to the OSFM, along with this Agreement
executed by an officer of the Local Authority, the following information and shall
notify the OSFM in writing of any changes to subsections "A" and "B" thereafter
during the term of this Agreement:

A.
The name and contact information of your Program administrator.
B.
The name and contact information of any third party inspection company
under contract with the Local Authority to conduct inspections for you or
the name and license number of the inspector(s) employed by the Local
Authority to perform such inspections.
C.
The total number and type of conveyances (excluding residential
conveyances) that you currently inspect.
D.
The total number and type of residential conveyances that you inspect, if
any.
The Local Authority by signing this Agreement attests to the OSFM that it has
adopted by ordinance or resolution, or will do so within 30 days of the date of its
signature hereto, the following Standards:

Safety Code for Elevators and Escalators (ASME A17.1-2005),
A17.1 (a)-2005, and A17.1 (s)-2005;
2)

Should the Local Authority desire to amend any of the Standards, the Local
Authority must submit to the OSFM, for approval by the Illinois Elevator Safety
Board ("Board"'), a copy of the amendment and its reason for the change. The
Board shall review the amendment and notify the Local Authority no later than 30
days after the Board meeting at which the variance request is heard of its
approval or denial.
5.
With respect to ASME A17.3-2005, Safety Code for Existing Elevators and
Escalators, upgrades required by this Standard must be completed no later than
January 1, 2009 except that upgrades to the hydraulic cylinder system and
firefighter control system must be completed by January 1, 2011.
An Existing Elevator is an elevator contained in a building for which a building
permit was issued prior to the effective date of the Administrative Rules or a
conveyance for which a permit was issued for that conveyance prior to the
effective date of the Administrative Rules adopted in conformance with the
Elevator Safety Act.
6.
The Local Authority by signing this Agreement agrees:
A.
To operate its Program in compliance with the Elevator Safety Act and
Administrative Rules.
B.
To ensure that all inspections and maintenance is performed by
personnel properly licensed by the State and notify the OSFM of any
instances of non-compliance it becomes aware of.
C.
To amend its Program within 30 days of receipt of notice from the OSFM
informing them of changes to any form, document, the Standards and/or
rules that affect the Program.
D.
To provide to the OSFM by February 15th of each year, an annual report
of the previous calendar year that shall identify:
1)
The number and types of Inspections performed during the past
year;
2)
The number of certificate of operations issued during the past
year;
