MOTION TO VACATE AND/OR TO RECONSIDER ORDER AND FOR A REHEARING
Come now the plaintiffs through their attorneys and respectfully
request that this Honorable Court vacate and/or reconsider the judgment filed
and entered on July 5, 1979, denying plaintiff's request for expert witness,
attorney fees, and costs against the defendant, Tennessee Valley Authority,
and in support thereof, state:

That the award of costs and fees in this matter is appropriate.

That the request for costs and fees in this matter was timely

Further, plaintiffs would like to point out to the Court
that, far from having an adverse impact upon the public weal,
plaintiffs' lawsuit under the Endangered Species Act has actually
saved the taxpayer's money.
Because of the legal rulings in this
suit, the General Accounting Office as well as the University of
Tennessee,.were asked to reevaluate the Project.

most beneficial alternative.

against normal civil litigants, but against'those who violate
Federal Statutes.
The request for attorney fees in this case by Professor
:• Plater and Hr. Dougherty is extremely reasonable under the
circumstances.

appellate attorney in Knoxville, Tennessee, has practiced before
this Court upon many and varied occasions and is one of the

achieveme nt in these areas.
As noted in plaintiff s' Verified Bill of Costs, the
vast majority of Professor Plater's time to this case has been
donated pro bono.

which the Tennessee Valley Authority will be permitted
to engage relative to construction of the Tellico project
and that from which they will be enjoined.
