FINES LEVIED ON NEIMAN MARCUS FOR FALSE ADVERTISING Neiman Marcus, Inc. has agreed to pay a $25,000 judgment after a court found them to be falsely advertising two coats as being “faux fur” when the items had Asian raccoon dog fur. This awaits final court approval. Saks Inc. & the HSUS reached a $6,500 out-of-court settlement. Lord & Taylor settled a similar dispute last year. Macy’s, Inc. remains a defendant. ANIMALS in the NEWS IMPORTED QUALITY GUARD DOG CO. CITED FOR MANY DECEPTIVE PRACTICES ASPCA VET ALLEGEDLY KICKED/PUNCHED ROTTWEILER BEFORE IT DIED; OWNER FILES SUIT Rafael Lopez has filed suit in federal court after discovering that his dog Bullet was allegedly kicked by an ASPCA Bergh Memorial Hospital vet before it died. Veterinarian John Morehead was accused by 3 colleagues of kicking the sickly 10 year old animal. Lopez was contacted by ASPCA investigators who dug up Bullet's remains that had been buried in Highbridge Park near the Bronx home of Lopez. The body was exhumed & taken to Cornell Veterinary School for a necropsy but the body was too decomposed. According to the Daily News, Morehead kicked the dog hard in the torso the day before he died & a witness said Morehead punched Bullet. Morehead refused to be questioned & has since left the ASPCA's Bergh Memorial Hospital. According to the NY Education Department's Division of Professional Licensing, there is no record of disciplinary action against Morehead. The Daily News states that he now works at Animal Kind Veterinary Hospital in Park Slope, Brooklyn POLICE OFFICER CLEARED IN DEATH OF K-9 – HUSBAND PLEADS GUILTY New York Attorney General Andrew Cuomo announced that Imported Quality Guard Dogs, based in Queens, New York & its Animal Rescue Unit sold unfit dogs, violated charities law & engaged in deceptive business practices & false advertising. Robin Schulder & husband Perry Reich falsely claim to be dog breeders, make numerous misrepresentations & Schulder practices as a veterinarian without a license & makes improper use of the title “veterinarian technician”. Over a dozen complaints have been made to the Better Business Bureau, the ASPCA & the Agriculture Dept. One of their many websites state that the puppies are born in their home. The couple allegedly re-sells dogs that they obtain from third parties. Many of the dogs have parvo, coccidia, mange, respiratory infections, pneumonia & more. One of their websites claims that the puppies are imported from a family-owned kennel in Europe – they have no kennel in Europe. They claim that their rescue unit is a “no-kill animal shelter” but admits that the unit is “inactive”. Cuomo is seeking an injunction, accounting, restitution & civil penalties. Police Officer Kara McIntosh was cleared in the death of her K-9 partner, Patton, a 5 year old Golden Retriever who died of heatstroke, after he was left in a parked vehicle in Mount Holly. Her husband, Robert Mc Intosh, an emergency medical technician, said his wife left the dog in the car & he was to pick it up shortly but was supposedly delayed. Her husband pleaded guilty to civil complaints of animal cruelty & was ordered to pay $2,224 in fines & restitution. CANADA SEAL SLAUGHTER RESUMES AFTER OLYMPICS Patton, on the day the Society donated a K-9 vest. More Good News on Animals in Research! ◆ The Heartland Regional Medical Center will no longer have hard plastic tubes repeatedly forced down their throats – putting them at risk for severe pain, bleeding, swelling & scarring, as well as collapsed lungs & even death. According to PETA, the facility is investing in sophisticated & humane medical training mannequins to teach the course without harming animals. ◆ The University of California-Irvine announced it has replaced the use of rats & frogs with computer simulations according to PETA. The sophisticated new, & humane approach will spare hundreds of animals’ lives every year including replacement of a cruel procedure in which students drilled into the heads of healthy rats, inserted chemicals in order to damage their brains, injected the animals with drugs (including amphetamines) & forced the rats to perform in behavioral experiments. ◆ PETA arranged for the donation of $5,000 for V-Frog virtual dissection software to Johnston Community College (JCC) to help the school integrate non-animal learning methods into science labs. This donation will completely replace the use of fetal pigs in all 37 sections of JCC’s general biology & online courses. PHOTO COURTESY OF: FONDATION BRIGITTE BARDOT, FRANCE The largest slaughter of Canada's seals is scheduled to begin after the Olympics end. Tens of thousands of baby harp seals, in their first weeks of life, will be bludgeoned, shot to death, skinned for their coats as their helpless mothers mourn in front of them. Once they are skinned, the bodies are left to rot on the ice. There has been public outrage on the mass killing which has been going on for years. The European Union recently banned the importation of Canadian seal products & they are now looking for new markets. www.ahscares.org 3 ANIMALS in the NEWS Food & Vegetarian News FOOD FOR LIFE CELEBRATION ON MAY 22ND BY ANIMAL PROTECTIVE LEAGUE OF NJ Sat. FoodforLife@aplnj.org MALE CHICKS TOSSED ALIVE INTO GRINDER domestic violence NJ Assembly Bill 1633 (Wagner) would encourage judges to include animals in domestic violence restraining orders in an effort to stop abusers from harming or threatening to harm pets. Currently, animals are not addressed in NJ's domestic violence law. It is in the Assembly's Judiciary Committee: Assemblywoman Linda Greenstein is the Chair. MOM ORDERS SON TO KILL HAMSTER WITH A HAMMER Warm Springs, Georgia - Lynn Middlebrooks Geter forced her 12 year old son to kill his pet hamster with a hammer as punishment for earning a bad grade. The boy told his teacher about this horrific incident & the teacher reported it to the Division of Family & Child Services who then contacted the police. Geter was charged with animal cruelty, child cruelty & battery. Tragically, this traumatized & scarred child was made to kill his own pet. No doubt, there are lasting mental health issues associated with this incident. A pet to a child is more important than one would think. MAN FATALLY TERRORIZED CAT WITH UMBRELLA WHEN TOLD TO GET A JOB Brooklyn, N Y – On Oct. 12th, Lord Tyshon Garrett, 31, terrorized & stabbed with an umbrella a 4 year old cat belonging to Deborah Bender, his mother-in-law. Reports indicate that the injuries were as severe as if she had fallen off a high-rise building or been hit by a car. Reports indicate Garrett lured the cat into the bathroom, shut the door & shortly thereafter, the cat came out of the bathroom wet & had difficulty breathing. During the attack, Madea scratched & bit Garrett. His DNA was found on the umbrella. His mother-in-law believes that Garrett went “ballistic” when she told him to find a job & move out. His mother & wife defend his innocence. In mid-December, Garrett was charged with felony animal cruelty which carries a maximum 2 years in jail. WOMAN SLITS DOG’S THROAT DURING ARGUMENT WITH FIANCEE Union Beach, N J - Michele Milford, 35 of Scranton, PA slit the throat twice of Penelope, the 2 year old Jack Russell Terrier, at her fiancee’s home in Union Beach, NJ. The dog was immediately sent to an emergency vet hospital to undergo surgery. Milford was charged with animal cruelty. Mercy for Animals, based in Chicago, IL, took undercover videos of unwanted chicks being tossed alive into a grinder at a hatchery in Spencer, Iowa owned by West Des Moines-based Hy-Line North America. The video also shows a chick dying on the floor and one seen lying on the floor after getting scalded by a wash cycle. It is a standard practice supported by the animal veterinary & scientific community. It is estimated that over 200 million male chicks are killed each year. There is no federal law that ensures the humane euthanasia of animals on farms or hatcheries. HSUS PURCHASES STOCK IN RESTAURANTS The HSUS has purchased shares in 38 food-related companies in an attempt to influence their purchasing decisions with regard to chicken, eggs & pork. Steak ‘n Shake Co., Jack in the Box, Cracker Barrel Old Country Stores, Burger King, The Cheesecake Factory, Domino’s Pizza, Tyson Foods, Inc., Wal-Mart Stores, Wendy’s/Arby Group, General Mills, Hain Celestial Group, Sonic Corp., Costco, Campbell Soup, Royal Caribbean Cruises & about 25 more. 4 HUMANE NEWS April 2010 BROADWAY ACTRESS’ BOYFRIEND PUMMELS 6 LB. YORKSHIRE TERRIER New York, N Y - When Broadway actress Ashley Yeater had to leave New York to do a show, she left her 6 pound Yorkshire Terrier with her boyfriend, Joseph Graves, 30. He flew into a rage and beat Emmit with his belt. The dog suffered 6 broken ribs and lost his left eye. Emmit was recovering at a Manhattan vet hospital & Graves was arrested by the ASPCA & charged with aggravated animal cruelty & criminal mischief. The Society operates a “Safe Haven Project” for pets in situations where domestic violence has been clearly identified, and who need immediate transfer/placement for their safety. Sadly, many owners are terrified of leaving their pets behind for fear of retribution to the animals. Statistics have shown that abusers commit violent acts against pets to control or punish another in the household. Social workers or others involved in cases of domestic violence who have concerns for the pets in the home should contact Roseann Trezza at the Society at (973) 824-7080. WELSH CORGI STOLEN FROM SAYREVILLE, NJ BACKYARD Corgi was recently rescued from a Florida puppy mill & came to Sayreville, NJ with her family to help her owner’s parents get back on their feet after a fire devastated their home & claimed the lives of their 2 dogs. Corgi’s owner’s left the dog securely tied to a tree for a bathroom break & when they went outside to retrieve their pup, Corgi was gone. The leash was found elsewhere in the yard. It appears that Corgi has become part of a growing statistic – one more of many stolen purebred dogs. There is no central agency to keep records; however, it is estimated that more than 12,000 dogs, mixed breeds & purebreds, are stolen in NJ annually & more than 2 million nationwide. Many pets reported as lost or ran away may have actually been stolen. To keep pets safe, do not leave your dogs unattended in backyards, cars, outside of stores, etc. Invisible fencing will not protect your dog. It will not keep intruders away, nor will it stop stray dogs and wildlife from coming on to the property. Have your pet microchipped. Immediately notify police, animal shelters in the area, rescue groups, breed rescues, etc. If you witness a stranger putting a neighbor’s dog in a car or van, obtain the license plate number & contact the owners and police. If your pet is lost or stolen, be wary of people who may call or contact you asking for money to return the dog as either traveling expenses or even a ransom. AS WE GO TO PRESS, the Society has been advised that the dog was found wandering on March 1st in the Sayreville area. We sent out a media alert offering a $1,000 reward and the dog was found immediately thereafter. According to a vet at the Sayrewood Animal Hospital, Corgi was too well kept to have been out in the elements for that time. This further supports the Society's belief that once a theft is published by the media, the animals are usually let go. Pet theft is a felony. Pet T heft PHOTO SUPPLIED Corgi was rescued from a miserable life at a Florida puppy mill and was adopted to a loving family. She was stolen from a Sayreville, NJ backyard. ANIMALS in Entertainment HOLLYWOOD ACTOR ACCUSED OF “SLAMMING HEAD” OF DOG AGAINST FENCE According to K9 Magazine, Hollywood film star Gerard Butler’s pug dog, Lolita, was involved in an squabble with a greyhound called Mayfly. Butler’s dog was off of its leash when it was approached by the greyhound. The greyhound was on leash with its owner, Fred Varecka. Although the dogs never came in contact, Butler yelled that the dog should be put down & “smacks Mayfly on the head without any warning the dog crashed into a fence before yelping in pain”. Butler has appeared in THE UGLY TRUTH, ROCKNROLLA, PS, I LOVE YOU, LARA CROFT, TOMB RAIDER & many more. AHA PUBLISHES LIST OF FILMS USING DECEPTIVE & UNAUTHORIZED END CREDITS The animal loving public always looks for “No Animals Were Harmed” in credit disclaimers at the end of films. The American Humane Assoc. (AHA) is supposed to monitor film action or approve scripts to ensure that no animals were killed or injured in any way during production. Some production companies are falsely using the disclaimer even though there was no oversight by AHA. The following films were designated as using deceptive & unauthorized end credits: • ADAM by Olympus Pictures, Deer Path Productions, Serenade Films, Vox3 Films • DISTRICT 9 by Wing Nut Films Ltd., Key Creatives & LLC/QED Intl. • EASY VIRTUE by Ealing Studios, Fragile Films, Endgame Ent., Odyssey Ent. • HOW TO LOSE FRIENDS & ALIENATE PEOLE by Number 9 Films • SHRINK by Ignite Entertainment, Ignite Productions, Ithaka Entertainment & Trigger Street Productions Unfortunately, many films that have used animals that were killed, injured, etc. still can be seen on television. They include “PATTON”, “JEREMIAH JOHNSON” & more. For information on what rating is assigned to films, based on their use of animals, log on to AHA’s website: www.americanhumane.org/film SEA WORLD ORCA WHALE KILLS TRAINER The tragic incident of a trainer who was killed at SeaWorld in Orlando by a killer whale has been covered by every media outlet. The news reported that the trainer was the third to be killed by Tilikum. Helicopter videos of the area in which this whale lived patently revealed how small an area it is and which had to be shared with other killer whales. According to Joyce Tischler of the Animal Legal Defense Fund, she "compares an orca's life in captivity in a tank to keep a human being in a bathtub for his entire life". These animals are unbelievably ill-suited to the prison that man has made for them to entertain the public. We urge our readership to send a letter or e-mail to your local paper that marine mammals should not be kept captive for man's entertainment. “DISTRICT 9” HAD UNAUTHORIZED USE OF ‘NO ANIMALS HARMED’ CREDIT The film “District 9” has been nominated in the Best Picture category for an Academy Award. The use of “No Animals Were Harmed” end credit was not authorized by the American Humane Association (AHA) to be used in that film. The AHA did not monitor the safety of animals and the use of such a film credit was unauthorized. Sony Pictures purchased the completed film which was “locked” & Sony was unable to remove the credit. The co-producer of “District 9” was advised of the proper process. However, in a subsequent instance for Jackson’s film, “The Lovely Bones”, the AHA disclaimer was taken from the film “King Kong” – even though the AHA did monitor the use of animals in the “Bones” picture. You can check the AHA website to see what rating was assigned to films based on their use of animals: www.americanhumane.org/film www.ahscares.org 5 Happy Endings GLENDA THE MINI POT-BELLIED PIG HAS FOUND A FAIRY TALE EXISTENCE Faith rubs Mia’s belly on a pillow in the sunroom telling her to nap & she’ll be home from school to play later. Glenda the Miniature Pot-Bellied Pig was the most viewed on our Petfinder site. She garnered many, many offers for adoption. Found in a crate by a heavily-traveled road, we discovered that she was intelligent, trainable & very sweet. Samantha Hoos of the Chester, NJ area visited our Tinton Falls shelter. After spending some time with this sweet lass, arrangements were made to have Glenda spayed & then she was off to her new home & a new adventure. According to Samantha, they never thought that they would find a pig that would work out well in their active & “fully stocked home of kids & animals”. Glenda has been named Mia & now answers to it when called. She snorts when she has to go out, sleeps in front of the fireplace, & has the whole family in TOTAL LOVE with her personality. Everyday is fresh veggies, canned pumpkin, fruit, piggie food & lots of fresh water & watery food. Her yawns at bedtime are a great sign that she’s content, too, says the dozen books that they have read up on. Samantha says: “THANK YOU ALL for keeping our piggie safe until God put us all together!! She’s a blessing & daily delight for our family; And we will ALWAYS adore her!!” PHOTOS SUPPLIED Katie is a 150 lb. Great Dane & a true gentle giant. Faith is 10 years old & before school each morning, Mia & Faith share a bowl of oatmeal & fruit for breakfast. PHOTOS SUPPLIED “DESIGNER DOGGIE” FINDS LOVE IN THE BIG APPLE Sharlene Spingler of New York City with her newly-adopted Ori Pei. Mugsy shows his loving gratitude to Sharlene Spingler by cleaning her ears! Mugsy at the Society. When people speak of “designer breeds” – it is not a purebred dog – it is a mixed breed and unfortunately, the Society as well as thousands of other shelters, receive them as homeless waifs. In mid-December, the Society took in a stray, road-weary, thin & hungry dog – an Ori Pei – a Shar Pei and Pug hybrid mix. The breed was created in the 1970’s by a Shar Pei lover who did not like the problems of that breed, i.e., eyes, skin problems & hip dysplasia. Our temperament evaluator, Linda Goodman of Pet Paws for Love, kept passing “Mugsy” by because he was so barrier aggressive & then she finally relented. The tough guy image is just a front & he is soooo playful & cute. After almost 2 months at the Society, he was adopted by Sharlene Spingler of New York City. Sharlene was invited to a Westminster promotional event at Saks 5th Avenue & took Mugsy. Mugsy walked away with FIRST PLACE in the BEST PERSONALITY show!!! He garnered a $50 coupon for grooming at the Ritz Carriage House. Mugsy went from total obscurity & neglect to a lively & lovefilled future within a week! 6 HUMANE NEWS April 2010 Happy Endings PHOTOS SUPPLIED A VERY HAPPY ENDING FOR SIX NEWARK DOGS Okay, you made us put these sweaters on - can we play now? Pictured - Boone, Jack, Bennett,Vida and Belle. Scott and Amy Crawford of Dunellen, N.J. first visited the Society in December of 2008 looking for a companion for their older dog, Shorty. They found Bennett, a mixed pit with an amazing personality, an eagerness to please and a mellow disposition, making him a perfect choice. In fact, Bennett was such a fantastic dog, the Crawfords decided to visit the Society again. In February of 2009 Vida Rose was found tied to a fence and starved. Every bone in her body showed and she was so weak she was brought in on a stretcher. We treated her in our medical department and as her body healed a distinctly sweet manner emerged. We asked Scott and Amy to meet Vida and another match was made. Vida and Bennett proved such a hit that the Crawfords came back again and again and again adding Boone, Grace, Belle and Jack. This wonderful couple keeps us updated with e-mails and pictures. We could not ask for a better life for these remarkable dogs who came out of the shelter to form a very special family. When a Brittany Spaniel & her very young pups were brought to the Society’s Newark shelter, the entire family was sent to the Forked River facility for the chance at a new life. Within a very short time, we realized that each pup had serious congenital defects and they needed operations & close PHOTO SUPPLIED monitoring – each one Taffy and her canine companion reside with Linda & for a different problem. Dave Sharpe & Rusty, a Golden Retriever, who is also Mom was adopted out a therapy dog! quickly & her offspring stayed for several weeks until they were ready for adoption. Taffy, who looked like her Mom, was adopted out to Linda & Dave Sharpe (also known as Ranger Dave to his WOBM Radio audience & to Popcorn Park visitors). A “Graduation Announcement” recently arrived from the Sharpes! After 5 weeks of obedience training & 8 weeks of Therapy Dog training both Taffy and their 9 year old Golden Retriever, passed final exams with perfect scores for both AKC Canine Good Citizens test and the Therapy Dog test. They have plans for 1 ½ year old Taffy to work as a Library dog & to a variety of facilities. Rusty may go to help where needed in Pediatrics, Oncology & Hospice. The graduation party was ice cream & now they can order a license plate frame that reads: “MY THERAPY DOG IS SMARTER THAN YOUR HONOR STUDENT”. FORKED RIVER ORPHAN FINDS FOREVER HOME IN QUEENS VILLAGE, NY PHOTO SUPPLIED SOCIETY ORPHAN GRADUATES TO THERAPY DOG Boone, Belle, Jack, Bennett,Vida and Grace (peeking out at the end) settle in for a nap.Vida and Bennett can also be seen in our 2010 calendar (February) along with Shorty, who has since passed away and is sorely missed. Joan Silaco of Queens Village, NY has been a long-time supporter of the Society. In August 2007, Joan visited the Forked River facility & adopted a gorgeous German Shepherd named Abigail. Now 4 years old, the shepherd loves her yard & her tree limb. She navigates with the tree limb in her mouth. Small, grape-size pumpkins are meant for the squirrels … but Abigail carries them around. Every year, Joan celebrates Abigail’s birthday by taking a picture of her with a birthday hat on & licking an ice cream birthday cake. When Joan calls out: “Hug time”, Abigail runs over to her so she can get a big hug. According to Joan: “She is by far the most beautiful dog I ever saw. She has the eyes that are almost wolf-like. It’s like an unspoken look of communication. The eyes say it all. She is my forever dog”. What a great dog … and what a great owner! ahscares.org 7 Join! the POPCORN PARK WILDLIFE CLUB If you haven’t yet been to Popcorn Park, now is a great time to visit! GILLIGAN THE MACAQUE I’m not a bad guy ... but I did make a mess; kept as a “pet” in a cage caused me distress! One day I figured how to get free; then I went on a trash-the-house spree! No longer was I wanted, but should I be condemned? Wild animals as pets? The blame is on them! Now I play as monkeys should do. I’d love it if I could have a friend in you. BONNIE THE MACAW My owner was moving but I couldn’t go along. “You’re too big!” she said. Now that was just wrong! Luckily for my buddy Clyde & me, Popcorn Park offered us a nice place to be. Sadly, he passed away, leaving my heart broken. Could you give me yours & your love as a token? CHARITY FROM PENNSYLVANIA Kind people rescued her from going to slaughter. She was just a little lamb so they went & bought her. Charity brought her friend Stella & they grew up happy ewes; but 2 years later, they were singing the blues. They could no longer stay at their rescuer’s place. Does she have regrets about moving??? Nope! Not a trace!! NJ LEGISLATION Senate Bill 1506 (Van Drew) would provide that an insurer shall not deny, cancel or non-renew a homeowners insurance policy solely on the type or breed of dog harbored on the property; an insurer may offer/issue a policy wgich contains an exclusion against any liability for a dog; shall prohibit the use of underwriting guidelines, risk classifications, or other rules of any rating system which establishes rates & premiums for that coverage on the basis of the type or specific breed harbored on the property. NJ Senate Majority Leader Stephen Sweeney will introduce a bill that will allow students with disabilities to bring professionally-licensed service dogs to school. According to Sweeney: "Trained dogs can make a major difference in the developmental progress of students with autism spectrum disorders or developmental disabilities. The decision should be up to the parents & their physicians & not left for debate in the schools". The idea is to give children with disabilities the same rights granted to students who are vision impaired & require a Seeing Eye dog. New Jersey became the 10th state to make antifreeze unpalatable. The bill calls for an additive to make it a bitter agent. Ethylene glycol is a problem in coolant also. Arizona, California, Maine, New Mexico, Oregon, Tennessee Virginia, Vermont & Washington already have such legislaton. Senate Bill 1239 (Ciesla) would require certain veterinarians to provide written notification to an animal owner if a boarded animal will not be subject to 24 hour supervision by a person physically on the premises. It would be known as “Betsy’s Law” which involved an incident in the death of a dog in which an animal, left for a minor procedure, was boarded at a veterinary facility. On the following morning the veterinarian advised Betsy’s owner that the dog had hung herself as a result of a lack of animal supervision & requested payment for his services. Senate Bill 1228 (Bucco) Imposes a fine on owner of dog which attacks or otherwise interferes with guide or service dogs. On September 8th, 2009, Gov. Jon Corzine signed into law Assembly Bill 2513 which provides for voluntary contributions by taxpayers on gross income tax returns to the Animal Population Control Fund (Cat and Dog Spay/Neuter Fund) and the Community Food Pantry Fund. Helping Animals, Helping People .... The Waltham Centre for Pet Nutrition has committed more than $2 million to the Eunice Kennedy Shriver National Institute of Child Health & Human Development to help fund research over the next 4 years on how the human-animal bond impacts psychological & physical well being. According to PETA, A COPY OF Digital Frog 2.5 software was donated to a 5th grade teacher at St. Mary Magdalen School in Camarillo, California after budget cuts had threatened to derail his efforts to eliminate animal dissections. Before you have had a chance to take a breather from the holidays, spring cleaning is challenging us! Instead of moving those items from the basement to the garage, you might decide to donate any new, unused items for the Society's Annual Chinese Auction. It will rid your house of the clutter...and you will receive a tax deductible donation! LEGAL RULINGS NEW YORK STATE On Dec. 11th, the NY Racing Association announced it would bar from competition any horse owner or trainer caught selling horses for slaughter, according to ANIMAL PEOPLE. The Association urged horsemen who are part of the racing circuit to support rescue & adoption efforts & to find humane ways of dealing with horses who are unable to continue racing. The association crackdown came after more than 170 starving horses were found in April 2009 at Center Brook Farm in Climax, New York. Property owner Ernie Paragallo was barred from racing in New York & last August, he was charged with 35 counts of cruelty. It was discovered that Paragalloowned horses were earmarked for slaughter in kill pens. Efforts were pursued alleging that Ringling Bros. and Barnum & Bailey Circus violated the U. S. Endangered Species Act. The case was filed by Tom Rider, a circus handler, and four animal advocacy groups & to win the case, the plaintiffs had to establish that they were in some manner sufficiently harmed by Ringling's use of elephants to have right to bring the suit. U. S. District Judge Emmet G. Sullivan wrote in his opinion, that groups lacked standing "on technical grounds" -- i.e., that they had no direct material interest in the outcome. According to the Animal Welfare Institute (AWI), there was an overwhelming amount of evidence to establish the severe physical, emotional & behavioral harm inflicted upon endangered Asian elephants by the circus. Owner of the circus admitted under oath that ALL elephant handlers "strike" the elephants with bull hooks. General Manager of the circus' breeding farm in Florida testified that most of the female elephants are kept chained by 2 legs at elast 16 hours a day and some are chianed 23.5 hours a day. The groups plan to appeal the federal court ruling to the U. S. Court of Appeals for the District of Columbia Circuit. According to a spokesperson for the AWI, "The public now knows that Ringling Bros.' Asian elephants are systematically abused on a daily basis". Congress has expressed a desire to end the use of Class B dealers as a source of animals for research funded by the National Institutes of Health (NIH). The subject came up when discussing funding of the NIH. The forceful language of the Senate "expects the NIH to phase out, as quickly as possible, the use of any of its funds to purchase or research on dogs or cats obtained from Class B dealers. The Senate went on to state that it "should not award any new grants or contracts that involved such animals & immediately begin supporting alternative sources of random source animals.” In the past, documents have shown that many of these animals are stolen and live under filthy, horrendous conditions -- of which the Society rescued over a dozen dogs living at Martin Creek Kennels in Arkansas. The Pennsyvlania Supreme Court reversed a 2008 ruling by the State Superior Court that pet keepers cannot be prosecuted for killing their own animals. Wendy Kneller, 37, gave her boyfriend Randy Miller, 28, a handgun & asked him to shoot Bouta, a 6 year old pit bull mix whom she said had bitten her son. Miller tied Bouta & beat her with a shovel before shooting her. Miller was convicted of animal cruelty & Kneller was convicted of conspiracy to commit cruelty. The facts revealed no immediate need to kill the dog & the unquestionable malicious beating of the dog. The Supreme Court sent the case back to Superior Court with directions for it to follow Superior Court Judge Correale F. Stevens' who had been the lone dissenting vote. The NY State Supreme Court Justice Martin Shulman threw out 23 lawsuits brought by breast cancer victims against Pfizer, Inc., the makers of hormone supplements synthesized from pregnant mare's urine. According to ANIMAL PEOPLE, the number of pregnant mares kept confined for 6 months a year in urine collection stalls is believed to have dropped to about half. Breeders are now trying to produce foals who have market value other than just for slaughter. About 10,000 PMU supplement cases are reportedly pending. Millions have already been paid in compensatory damages to women who contracted breast cancer after taking the products. Subsequent research also linked PMU-based products to a higher rate of death from lung cancer. www.ahscares.org 9 NEWARK DOGS Meet Midget, a 1 ½ year old who is short & sweet. Her owner passed away in October but good Samaritans kept her fed. During a recent snowstorm, she was taken in by the Atlantic County Animal Shelter in Pleasantville where the 8 year old German Shepherd mix waited again…. An alert was posted on the internet concerning Baby. Either her owner let her out and he passed away or emergency rescue who was alerted to the resident may have let the dog outside. In any event, Baby waited for her owner to let her back in the house. Local residents would feed her now & then. The big snow storm came and she kept coming back to her owner's porch and sitting there. The alert that was posted gave her just a few days before she would be euthanized. The Society's Director contacted the group and advised that we would be happy to take Baby until she finds a forever home. (Forked River) His chain trailed behind him as he wandered aimlessly in the frigid winds & icy snow – released by a young man who didn’t want the responsibility of a pet and simply let him go. Barely out of puppyhood, Street had the misfortune of belonging to a 20 year old Neptune fella who liked the idea of having a dog....but none of the responsibilities that went along with it. When relatives and neighbors complained about the horrendously neglectful situation, the young man went into hiding for a few days .... leaving the dog under the same conditions in the backyard. When he returned, he removed his dog from the yard -- allegedly finding someone to whom he could give the dog. Within a day, a Society staffer found the pathetic pooch with the chain still attached wandering in the streets in the icy cold winds, in the middle of the recent blizzard. Street is at the Society and hoping that he can find a "new leash on life". File TF-58822-M (Tinton Falls) Baby still waits for a lifetime commitment at our Forked River Animal Care Center. If you are concerned about the future of your pets, please see our story on page 23. VICTIM OF DOMESTIC VIOLENCE NEEDS A FOREVER HOME Like many pets that come through the doors of the Associated Humane Societies, Tiffany’s story is one of domestic violence. The 4 year old female long-haired tortoise shell was adopted to an Ocean County resident in December who then gave the cat as a holiday present to her daughter and 4 year old granddaughter in Middlesex County. Following a visit from the daughter’s ex-husband, Tiffany was taken to a veterinarian after she had been beaten so severely that she lost an eye, suffered head trauma, a fractured tooth, pneumothorax (air within the chest) and anorexia. It was the plans of the family to take possession of the cat to bring her to a specialist for eye removal after veterinary care to stabilize the cat. When the Society’s Director became aware of the situation, we immediately took action for the original owner’s violation of the terms of our Adoption Contract and in order to keep Tiffany away from possible future domestic violence, AHS immediately had our attorney successfully obtain an injunction from her returning to the family. Tiffany is now resting comfortably at the Society’s Forked River facility and is waiting for a forever home. CALIFORNIA A Superior Court judge has agreed with the Audubon Society & other bird & wildlife groups who took the City of Los Angeles to court of its support for a trap-neuterrelease program. The groups argued that it violated state environment laws & isn’t effective at reducing the number of feral cats which feed on many bird species. The judge issued an injunction barring the City of L.A. from subsidizing or promoting the program. It is estimated that there are at least 1 million feral cats in Los Angeles. DELAWARE The State Dept. of Agriculture has adopted new regulations regarding selling & owning exotic animals. Effective January 11, 2010, they established a permit system for owning or selling exotic animals. They also provide enclosure & welfare requirements that permit holders must meet. “Exotic” animals are defined as a live wild mammal, hybrid of a wild mammal & a live reptile not native to or generally found in Delaware. Businesses seeking to sell exotic animals must obtain an exotic animal sales permit, renewable every year. Exotic animal permits are required for zoos, exhibitors & those who provide short-term care & rehabilitation of exotics. With the exception of zoos, all other permit holders are not permitted to breed exotic animals. MASSACHUSETTS New to the scene of "blood sports" is bird-fighting rings. More than 20 finches & 40 cages were confiscated from the basement of a historic farmhouse in Ashland. No arrests were made & it is difficult in finding events where a fight is going on. Last summer, police in Shelton, Conn. arrested 19 people in a raid. Finch fighting is hard to detect. The home has been under foreclosure and it is believed to be auctioned off in mid-March. ILLINOIS A new law prohibits convicted dogfighters from owning unsterilized or vicious dogs. NEWS FROM NEW JERSEY CARTERET Carteret Police responded to a call concerning animal cruelty & found 3 caged dogs in a filthy basement. The dogs had gone to the local shelter where they were treated for injuries, wounds & infections. Authorities arrested 21 year-old Caesar Hussein. He advised that one of the dogs had a litter of puppies and police advised that one of the puppies had died & had been thrown in the garbage. A subsequent visit located another dog in the house & evidence consistent with dogfighting. Hussein faces 12 counts for fighting, training and/or baiting animals. HOWELL Wesley Shourt, 45, was charged with animal abuse after authorities say he put containers of antifreeze on his front lawn in an attempt to poison animals. It takes very little antifreeze to kill an animal. RANDOLPH Dennis Zeglin, 67 years old, was indicted on shooting & killing his 20 year old African Grey Parrot by shooting Mikey 3 times with a BB gun. Zeglin faces 3-5 years in prison & up to $15,000 in fines. NORTH CAROLINA Starting January 1, 2010, Durham County dog owners will no longer be able to tie their pet outside with any type of chain or runner. If the dog is tied out & left unattended, it could result in fines from $50 and up including criminal charges. If the dog must be left outside, you will be required to have a fence with minimum dimension requirements per dog. UTAH The killing of hundreds of wolves in IDAHO and MONTANA has prompted UTAH Senator Allen Christensen to seek a law requiring the killing of ALL wolves that migrate into Utah. According to the Center for Biological Diversity (CBD), "backed by a posse of hunters & cattlemen, Christensen thinks wolves are out of control in Utah (that would be all TWO that have entered the state since 1975)". Said Christensen: "We would like them not to immigrate into here". The CBD is now in court to earn back federal protections for all Northern Rockies gray wolves, including those in Utah. TENNESSEE The Metro Nashville Council approved a measure which bans the sale of animals along the roadside. People cannot now legally sell or give away dogs, cats, rabbits, chickens & other animals with few exceptions. This does not include people selling or giving away pets at their homes or businesses & non-profit organizations whose main purpose is the care & adoption of animals. PASSAIC COUNTY The Freeholders have abruptly suspended a controversial deer culling on Garrett Mountain. The NJ Division of Fish & Wildlife (DFW) has begun an investigation into how the United Bow Hunters had handled the hunt to allow it to continue. The DFW has begun an investigation to determine whether all the deer taken from Rifle Camp Park & Garret Mountain Reservation had been properly tagged as bow hunters were required to tag each deer killed. The deer meet was supposed to be donated to a Paterson food pantry but it is alleged that many deer were sent to a butcher in Roselle Park not authorized by the state. The County was to pay the bow hunters $5,000 to run the culling & $100 for each deer processed. MOVING?? Put your OLD address or mailing label below, and fill in you new address. Authorities took custody of about 20,000 animals after finding a huge amount of dead animals in with living ones. Turtles were basically in a “toxic soup of water & other dead turtles. Veterinarians from around the country & one from Great Britain were flown in to provide their expertise in treating the animals which included snakes, wallabys, tarantulas, turtles & hedgehogs. NEWS FROM NEW YORK NEW YORK STATE New York State’s Gov. David Paterson signed S.4962 (Paulin & Oppenheimer) into law. Shelter animals in New York can only be euthanized in the most humane of fashions & not through carbon monoxide poisoning or gassing. The Act also stipulates that only a certified euthanasia technician, a licensed veterinarian or a licensed veterinary technician, can perform intra-cardiac euthanasia, & that intra-cardiac injections can only be performed on an animal if it is heavily sedated, anesthetized or comatose. The Act calls for any animal gas chambers located within the state to be dismantled within 90 days of enactment which was signed into law on Oct. 9th. No animals should be left unattended between the time the euthanasia procedure begins & death is confirmed. New York joins 16 other states that have a ban on gas chambers. NEW YORK STATE. On Dec. NEW YORK CITY On Sept. 9th, Manhattan Supreme Court Justice Marilyn Shafer of New York stated that the City of New York and the Dept. of Health & Mental Hygiene were ordered to submit a plan for the immediate implementation of their compliance with the statutory directives of the Animal Shelters & Sterilization Act, Local Law 26 of 2000 within 60 days of the date issued. Further, the Petitioner, Stray From The Heart, is entitled to recover damages which are “incidental to the primary relief sought by the petitioner & are based on the “same set of facts”. It as argued that the City’s neglect has resulted in the “needless suffering & death” of homeless cats & dogs and put undue strain on the groups resources. Said Justice Shafer: “Respondents have blatantly failed to comply with mandatory requirements of the act which unambiguously requires shelters in each borough; not three out of the five; open 24 hours per day, not 12 or ‘as needed’. The City is preparing to appeal the decision. NEW YORK CITY The New York City Housing Authority (NYCHA) has reduced the weight limit on dogs from 40 pounds to 25 pounds & restricted certain breeds including Pit Bulls, Rottweilers & Dobermans -- either pure or mixed. There is also a one-cat, one-dog rule. Some housing managers failed to advise a resident of their rights to keep a dog including if their dog was eligible to be grandfathered in or qualified as a service dog. Tenants’ rights lawyer Darryl Vernon of Vernon & Ginsburg is urging NYCHA tenants with a disability to inquire about three laws set up to protect them. If you have a disability that substantially interferes with a life activity, then you're allowed to have a dog. NEW YORK CITY The NYC Police contacted the ASPCA after they discovered a Manhattan woman caught on video kicking & leash-choking her 9 lb. Pomeranian. The incident occurred in the Grant Houses in Morningside Heights where a surveillance video captured an unrelated dog beating 2 weeks before. The inelevator video captured 31 year old Tiara Davis beating Sparky her 4 year old Pom. Davis can be seen punching, kicking & swinging the small dog by the neck. HLE Agents visited Davis who works as a vocational counselor for ex-offenders & she cooperated by signing custody of Sparky to the ASPCA. Tiara was arrested & charged with torturing & injuring an animal . NEW YORK CITY According to Companion Animal Network, the “Vet Mobile” has added the new low-cost laser therapy so that animals may not require sedation or anesthesia. The capability for laser treatment includes ear infections, wounds, arthritis, sprains, ligament tears, anal gland infections, etc The low cost laser option is available every Wednesday in front the NYCACC’s Brooklyn shelter located at 2336 Linden Blvd. between 10:30 a.m. & 3:30 p.m. Due to an overwhelming demand for vet services, the Vet Mobile has added a second day in Manhattan. Every Friday & Saturday at noon, they are at the NYCACC Manhattan shelter, 326 East 110th St. Appointments are only required for elective surgery. Other medical issues are triaged first come first serve. STATEN ISLAND Brooklyn Federal Judge Raymond Dearie cut a break to Mamie Manneh, 41, who was smuggling in hacked-up primate meat - animal heads & haunches – from Africa. She was sentenced to probation because she suffers from mental illness & has 11 children at home! SALINA Over 30 dogs and puppies were taken from the home of Mallory Paetow who said she was a “rescue”. The dogs were caged in the basement and several were euthanized as they were too ill to be saved. Paetow said she had sold some 125-150 dogs in the last year. The 24 year old has been charged with three misdemeanors under state agriculture laws. WOLCOTT State Police arrested David L. Swan, 62, & Virginia E. Swan, 36, after animal control found 2 emaciated horses, a dead goat & a dead duck. Three dogs were found inside a barn suffering from emaciation & dehydration. When police obtained a search warrant for their trailer home, they found 11 dogs & 2 cats – all of which showed signs of neglect & a dead dog was found inside a bedroom. The two were also charged with endangering the welfare of a child. Cherry & a 14 year old accomplice trashed a former roommate's apartment & then the 14 year old stuffed the roommate's cat into an oven. Cherry was barred from owning a pet for 3 years & the young accomplice was given 18 months at a juvenile facility. The HUMANE NEWS has been publishing this paper for over 40 years. Sadly, we have found that we cannot change the world ... even though we’ve tried. It is our hope that the information printed herein will have a ripple effect on you, your family, your friends, your coworkers. If we can help one person to get involved, to rescue one animal from a cruel situation, to adopt a lonely pup from your local shelter, to consider a vegetarian lifestyle, then the HUMANE NEWS is achieving its intent. If this is the first issue that you have received and would like to be placed on our mailing list, all that is required is a donation - the amount we leave up to you. Anyone caught eating cat or dog meat would face a fine & face up to 15 days in jail. Groups involved in the sale of either meat could be fined. Animal rights groups are trying to halt the mass shipments of animals squashed into wire cages & taken to markets & restaurants. Animals are also raised for their fur. What misery these animals must endure! As of the end of January, the bill had been watered down & a revised draft will probably be considered in April 2010. The Forest Protection Departments decided to close down the bear farm for not meeting regulations. The Animals Asia Foundation rescued the bears and they were taken to the group’s Moon Bear Rescue Centre near Hanoi. The bears were used for extracting bile with needles which endangers the bears. The bile is used in traditional Chinese medicine as a health tonic, a cure for liver/heart ailments, etc. SERBIA This is one of the last countries in the Balkans to adopt animal protection laws. Last summer, they adopted the Animal Wellbeing Law and the new Criminal Law in 2006 and the Veterinary Medicine Law in 2005. The Criminal Law defines not only killing but also abuse of an animal. The Animal Wellbeing Law orders all local governments to build shelters for abandoned cats & dogs which will hopefully end the horrific torture of homeless animals in rural areas. The law on raising awareness of animal rights went into effect in Sept. 2009 & has been implemented in Serbia’s school system. AUSTRIA The medical faculty of Innsbruck University & the emergency medicine centre at Bolzano, Italy took 29 live pigs to be buried under masses of snow to study human survival chances in avalanches. Scientists claimed that the pigs were sedated before being buried alive. But 10 of the 29 pigs were killed in the two weeks that the experiment ran before being shut down due to public outrage. The local mountain rescue group pointed out the obvious: we already know avalanches are dangerous & deadly. CHINA Statistics show that Beijing now has around 900,000 registered dogs. A proposal has been forthcoming to forbid dogs from certain areas of Beijing to reduce noise pollution & animal waste. And in the city of Guanghzhou, a new rule was introduced by the government which limits dog ownership to one per family. This is part of a campaign to clean up the city before next fall when they will host the 16th Asian Games. Many people have given dogs to the Public Security Bureau while others have smuggled their pets to the countryside or hidden them with relatives. NEW ZEALAND Hans Kurt Kubus, 58, of Germany was caught attempting to board a flight with 44 geckos & skinks in a hand-sewn package concealed in his underwear. He must spend 14 weeks in jail & pay a $3,540 fine before being deported to Germany. He could have faced up to 6 months in prison & a fine of $355,000.The geckos were worth about $2,800 each on the European market. It is troubling to note that Kubus had been to New Zealand in 2001, 2004, 2008 & 2009. In 2008, he had been with a Swiss reptile dealer. ENGLAND Famous by way of the internet was Casper who would catch the same bus every day for 4 years. He would hop on the bus around 10 a.m. every morning & sit in the back seat through the entire 11 mile route. Casper was killed on Jan. 18th while crossing the road to catch his daily ride. A motorist hit him & did not stop. His owner wanted to thank all who befriended him – he was a much-loved pet who had so much character. He would queue up in line - it’d be person, person, person, cat, person, person. FEDERAL LEGISLATION According to PETA, a bill will soon be introduced in Congress that will reform the way hazardous substances are tested & regulated in the U.S. It will REQUIRE the use of hundreds of thousands of animals in lab experiments without providing improved environmental or human health protection. Senate Bill 373 (Nelson-FL) & House Resolution 2811 (Meek) would add pythons to the federal list of “Injurious Wildlife” making it illegal to import pythons or ship or sell the snakes across state lines. This issue gained attention after a tragic incident in which a Burmese python kept inside of a home as a pet escaped its glass aquarium & strangled to death a 2 year old girl. The exotic pet trade is at the root of the problem & it is easy to purchase them. Many of these animals live in deplorable conditions or are abandoned after they become too expensive to care for. H.R. 615 would require adding a bitter tasting agent to ethylene glycol antifreeze. Order here! Cosmos fom Hazlet Trailer Park When a trailer park resident had passed away, the Society was notified to send an Animal Control Officer to pick up the deceased owner’s cat. It was a sad revelation to see the circumstances in which the owner lived and died. Large holes in the ceiling established that there was no heat and he may have frozen to death. What meager resources & food he had was to help his cat. The 80 year old man had no blanket, but there was a little coverlet next to him for his precious cat. Life will never be the same for this aging cat but we want it to be comfortable, peaceful and without anxiety. File TF-58878-NM (Tinton Falls). Linda Blair of Newark For 5 years, Goofy led a dismal existence of being the proverbial junkyard dog. He was large & appeared to be intimidating – but he was too kind & too gentle to scare anyone. And so he was fired. The owner was going to have him euthanized but a truckdriver rescued the big boy & brought him home to be with his little dogs. Sadly, the little ankle biters made life very unpleasant for Goofy. He was brought to the Society and he was hired as Meet ‘n Greet until a better offer comes along. Would you share a part of your heart with this fella? File TF-58857-NM (Tinton Falls). On March 6, 2004, she was just a kitten and was discovered abandoned at our Newark shelter’s door. She was taken in, given all necessary inoculations, and then put into a cage with food & water. When we went to check on her, we found that she could rotate her head nearly 360 degrees! She had a stiff rear leg from an old injury or defect. After we watched a few weeks of her waiting for adoption, we decided to send the unique lass to Kitty City where she enjoys all of the accoutrements for this young lady.
