METROPOLITAN WASHINGTON AIRPORTS AUTHORITY Report to the Board of Directors Recommendation to Approve Loudoun County Sanitation Authority Request for Easements across Washington Dulles International Airport Property October 2015 METROPOLITAN WASHINGTON AIRPORTS AUTHORITY PURPOSE The Strategic Development Committee approved and recommends that the Board of Directors authorize the President and Chief Executive Officer to execute the temporary and permanent easements as depicted on Exhibit A in favor of the Loudoun County Sanitation Authority (LCSA) for the installation of a 30” water transmission main. METROPOLITAN WASHINGTON AIRPORTS AUTHORITY BACKGROUND • LCSA is installing a 30” water transmission main between Willard Road at Route 50 and the Loudoun County Parkway (Route 606), crossing a portion of Dulles International. • The new water main is designed to improve reliability of service to customers south and west of Dulles International. • LCSA has requested temporary grading and construction easements across 11.0697 acres of Airports Authority property and a 15 foot wide permanent easement over 3.534 acres. The easement areas are shown on Exhibit A and the details of the alignment of the water main are shown on Exhibit B. METROPOLITAN WASHINGTON AIRPORTS AUTHORITY Ronald Reagan Washington National Airport Dulles Corridor Metrorail Project Dulles Toll Road Washington Dulles International Airport REPORT TO THE BOARD OF DIRECTORS RECOMMENDATION TO APPROVE LOUDOUN COUNTY SANITATION AUTHORITY REQUEST FOR EASEMENTS ACROSS WASHINGTON DULLES INTERNATIONAL AIRPORT PROPERTY OCTOBER 2015 ACTION REQUESTED The Strategic Development Committee approved and recommends that the Board of Directors authorize the President and Chief Executive Officer to execute temporary and permanent easements across Metropolitan Washington Airports Authority (Airports Authority) property located at Washington Dulles International Airport (Dulles International) in favor of the Loudoun County Sanitation Authority, d/b/a Loudoun Water (LCSA), for the installation of a 30” water transmission main. A depiction of the easement route is shown on the document identified as “LCSA 30” Waterline 15 Feet Wide Proposed Easement Area,” dated July 2015, which is attached as Exhibit A. BACKGROUND LCSA currently maintains a water transmission main along Route 50 that provides service to the area south and west of Dulles International. LCSA is undertaking a construction project that is designed to improve reliability of service and water pressure to its customers in that area by installing a new 12,992 linear foot 30” water transmission main between the Loudoun County Parkway (Route 606) and Willard Road at Route 50. A portion of this new transmission main – approximately 10,015 feet – is proposed to be installed along the southern border of Dulles International on Airports Authority property. This proposed installation requires a 15-foot-wide permanent easement from the Airports Authority along the 10,015-foot length of the transmission main; the total area of this permanent easement is 3.5134 acres. In addition, LCSA seeks a temporary grading and construction easement, which will become null and void upon completion of the construction project, consisting of 11.0697 acres. The permanent and temporary easement areas are depicted on Exhibit A. DISCUSSION In June 2014, LCSA submitted a request to the Airports Authority for preliminary approval of the construction of this project on Airports Authority property and for a 20foot-wide permanent easement and temporary grading and construction easements for laydown and staging areas. Staff reviewed the request and identified some concerns, including (i) coordination with the Virginia Department of Transportation (VDOT), since a portion of the project will encroach on an existing VDOT easement granted by the Airports Authority; (ii) a desire to minimize the effects of this installation on Airports Authority property by narrowing the width of the requested easement; and (iii) providing for the Airports Authority’s ability to have a future connection for its Live Fire Training Facility(LFTF) to the water transmission main. Over the past several months, staff has worked with LCSA to address each of these concerns and to develop solutions which will allow the project to progress largely as planned. After discussions with LCSA, the Airports Authority has confirmed that VDOT does not object to the encroachment on its existing easement and that VDOT will provide LCSA’s contractor with appropriate permits to access VDOT’s right-of-way. The original request for a 20-foot-wide permanent easement has been revised to a 15-foot-wide permanent easement, with the right for LCSA to use abutting land in the case of emergency repair. In addition, upon completion of the project, the Airports Authority will be able to connect to the new transmission main near the LFTF. Currently, the Airports Authority uses bulk water tankers to fill the LFTF’s water storage tanks and connection to the LCSA system will make it easier to fill these tanks. LCSA has worked with Airports Authority staff to locate and install a fire hydrant near the LFTF to more easily facilitate this future water connection. When the Airports Authority is ready to connect to the new water main, LCSA has agreed to waive its application review and processing fees. LCSA will not be assessed a charge for the easement. The Airports Authority’s longstanding practice has been to provide easements on its land to governmental entities at no cost. CONCLUSION The Strategic Development Committee approved and recommends that the Board of Directors authorize the President and Chief Executive Officer to execute temporary and permanent easements as depicted on Exhibit A in favor of the Loudoun County Sanitation Authority for the installation of a 30” water transmission main. Prepared by: Office of General Counsel October 2015 Attachment EXHIBIT A Proposed Resolution Authorizing the Conveyance of Easements to the Loudoun County Sanitation Authority for the Installation of a Water Transmission Main at Washington Dulles International Airport WHEREAS, The Loudoun County Sanitation Authority is undertaking a project to improve reliability of service for its customers south and west of Washington Dulles International Airport (Dulles International), which includes installing a new 30-inch water transmission main; WHEREAS, The proposed water transmission main installation is between Willard Road at Route 50 and the Loudoun County Parkway (Route 606) and crosses a portion of Dulles International; WHEREAS, In order to complete this installation, Loudoun County Sanitation Authority has requested temporary grading and construction easements across 11.0697 acres of Airports Authority property and a 15-foot wide permanent easement over 3.534 acres; WHEREAS, Loudoun County Sanitation Authority will waive application review and processing fees for the Airports Authority’s connection to the new water main; and WHEREAS, The Strategic Development Committee has reviewed the proposed easements, as presented by staff at its September 2015 Meeting, and recommended that they should be granted at no cost; now, therefore be it RESOLVED, That the President and Chief Executive Officer is authorized and directed to execute the easements to the Loudoun County Sanitation Authority as identified in detail in the documents presented to the Board of Directors at its October 2015 Meeting.
