of this injury, i had to have surgery on my knee. Although the doctor did
a good job with the surgery, i still have a lot of problems with my knee, and i cannot do the job i did before constructing pole barns because i have been restricted from climbing on
ladders and being on roofs. The doctor has provided me with a rating of 7% to the leg for the injury, but that was only about 15 weeks of benefits. I have lost my job as a result of the
injury. Is there anything else i can do?
ANSWER: He benefits that you can obtain from an injury to the knee are, as a practical matter, limited to the schedule of benefits contained in the workers’ compensation law.
In the case of a leg, the maximum number of weeks is 220 weeks, which means that a 7% injury to the leg would only get you 15.4 weeks of benefits. Other evidence can be used to
increase this amount, such as your testimony and the testimony of witnesses.
In certain cases, where you have had an injury to what is termed a “scheduled member” (your feet, legs, hands, arms or eyes), you may have a claim against the Second Injury Fund of
Iowa if you have had an earlier injury to a different foot, leg, hand, arm or eye. In your situation, if you had an earlier broken wrist, and this caused a permanent injury, the first injury

to the wrist could be combined with the work injury to the right knee to allow for a claim.
The first injury does not have to be related to work, although the second injury does.
When you have a claim against the Second Injury Fund, the question that needs to be
asked concerns your loss of earning capacity as a result of the two injuries that you have
suffered. In your case, the fact that that you cannot do your former work may increase the

Beautiful edibles part of summer-long exhibition at Botanical Garden
A blend of artful exhibits, educational opportunities and dining
experiences sets the tone for the Botanical Garden’s first summer
exhibition that launches in late May. The resurgence of interest
in growing food has focused the cultural conversation about
gardening closer to the land, encouraging sustainability and
awareness about where food comes from. But celebrating the
aesthetics of edible plants is just as important as celebrating
where they come from. The edible gardens being designed
highlight plants humans consume that also happen to boast
beautiful flowers, alluring leaves and dazzling fruits. The amber
combs of flowering sorghum, the purple fringed blades of kales
and the kaleidoscopic kernels of heirloom corn are but a few of
the hundreds of possibilities, some surprising and unexpected that
will be on display throughout the three-month exhibition.
Eat your roses
Transforming the Botanical Garden’s front yard rose garden is first
on the horticulture team’s agenda this spring.
“Most people don’t realize that roses are edible, including their
petals and hips,” says Kelly Norris, horticulture manager for the
Botanical Garden.
All of the roses in the front yard garden were bred by Dr. Griffith
Buck, an Iowa State University horticulture professor made famous
by the nearly 100 shrub rose varieties he introduced throughout
his career. The Botanical Garden collection includes 76 of these
varieties.
“Roses are wonderful, but their season of interest is so often
limited to June,” says Norris. “We want to plant a beautiful
garden full of roses, lavender, decorative herbs and sages that
might surprise people when they learn it’s entirely edible.”
In addition, the rose garden will feature several dozen different
heirloom vegetables, like Rosa Bianca eggplant, a purple streaked
variety long prized by Italian chefs. A recipe guide is being planned
that will inspire visitors with ideas for how to transform their own
beautiful edibles into delicious plates.
Playing with food
Botanical Garden horticulturist Tyler Johnson plans to encourage
visitors to grow vegetables in creative ways, like in containers.
“Surprisingly, vegetables make great accent plants in any mixed
container,” says Johnson. “Varieties of Swiss chard (Beta vulgaris)
and Bull’s Blood beet add bright splashes of color with their
vibrant leaves.”
It’s not all left to greens, though. Common veggies like tomatoes
and peppers also add interest as their fruits develop prior to
harvest.
“For urban gardeners short on space, it just makes sense,” says
Johnson.
Growing vegetables in containers has obvious benefits,
including elevating plants so they are easier to grow and harvest.

for any recipe. Given a little support,
the plant’s flowers and pods offer
plenty to look at. Staking them up
also makes harvest easy.
New strategies, new institution
The summer exhibition is part of the Botanical Garden’s regular
season programming, a new strategy launched last year as part of a
new vision for the institution. Flower show-style gardens and exhibits
pop up every six weeks throughout the year in the conservatory
and Gardeners Show House. Descriptions of the show concepts

The Botanical Garden reopened its doors to 2,700 visitors in
September last year after a three-month closure, as construction
continued on Phase I exterior gardens. Those gardens will be
completed this fall, with an anticipated grand opening in early
October. The $6.2 million “We Are a Garden Now” campaign
continues to raise money to fund the development of two
additional gardens and expansion of the Botanical Garden’s
curatorial and educational programs and its endowment.
Progress of the capital campaign follows on a new beginning
for the Botanical Garden. On Jan. 1, 2013, after years of planning,
a bold vision, generous community support and new staff, the
Botanical Garden assumed operatorship of the iconic geodesic
conservatory and 14 acres of land on the east side of the Des
Moines River. Armed with a mission of exploring, explaining and
celebrating the world of plants, the Botanical Garden is a 501(c)
(3) privately governed, not-for-profit institution with 10 years
of operating support at $645,000 per year from the City of Des
Moines, Des Moines Water Works and Bravo Greater Des Moines.
In addition, Phase II fundraising will grow the total endowment to
$3.6 million.
The Botanical Garden is located at 909 Robert D. Ray Drive and
open daily from 10 a.m. to 5 p.m., except major holidays. Regular
admission is $5 for adults, $4 for adults 65 and older, $3 for children
ages 4-17 and free for members and children 3 and younger. Q

How many years have you been in business?
Smokey Row has been in operation since 1998,
with the most recent addition to the family
being the location on Cottage Grove, off of
Martin Luther King Jr. Parkway, in October of
2009.
What cuisine do you offer? We serve coffee
and espresso drinks as one of our main attractions. These are complemented with a line of tea (hot or cold) and other cold drinks, such
as soda, juice and bottled cola. We also have a good selection of hard-packed ice cream that we will use to make shakes and malts. We

What made you want to
open your business? We’ve
each enjoyed rescuing items
(junk) from landfills and
making them useful and
beautiful again to use in our
own homes. Sheila recently
retired from her career with
the State of Iowa and Rene’
was recently displaced from
her career. A mutual friend introduced us a few months ago, and
we decided to open a business doing what we love to do.
What do you and your business bring to the community? We
offer unique pieces for the home and garden. We give other
repurposers/upcyclers a place to market their creations. We do
custom work for people. In a sense, we provide a service by putting
old pieces back in homes instead of the landfill. Q
