RESOLUTION 98-8174
A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NO. 1 TO TASK
ORDER NO. HMA 1-96, IN SUBSTANTIALLY THE FORM ATTACHED HERETO BETWEEN HOLE,
MONTES AND ASSOCIATES, INC., AND THE CITY OF NAPLES, FOR PROFESSIONAL SERVICES
ASSOCIATED WITH THE CITY OF NAPLES WASTEWATER TREATMENT AND RECLAMATION FACILITY
CONSTRUCTION PHASE; AND PROVIDING AN EFFECTIVE DATE.
On January 17, 1996, Hole, Monues and Associates, Inc., was retained
to provide professional engineering services during the
construction, startup, one year operation, and warranty inspection
phases of the upgrade to the City of Naples Wastewater Treatment and
Reclamation Facility; and
WHEREAS,
WHEREAS, the current expansion and upgrade project, awarded to Wharton-Smith,
Inc., on February 6, 1996 is behind schedule due to unexpected site
conditions, additional repairs, personnel shortages delays; and
Hole, Montes and Associates, Inc., submitted a task order to provide
a scope of services for assistance during the final construction
phase of the project; and
WHEREAS,
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NAPLES, FLORIDA:
Section 1. That the City Manager is hereby authorized to execute Amendment No.
1 Task Order No. HMA 1-96, in substantially the form attached hereto
between Hole, Montes & Associates, Inc., and the City of Naples, for
professional services associated with the City of Naples Wastewater
Treatment and Reclamation Facility construction phase.
Section 2. This resolution shall take effect immediately upon adoption.

FLORIDA, THIS 21ST DAY OF JANUARY, 1998.

SCOPE OF SERVICES
The specific services which the ENGINEER agrees to furnish are summarized on the
attached statement entitled AMENDMENT NO. I. TASK ORDER NO..HMA 1-96.
"SCOPE OF SERVICES". The "Scope of Services" defines the work effort refe:Ted to as
"the project".
B.
TIME OF COMPLETION
Work under this Task Order will be2in immediatel y fo1lowin2 acceptance and completed
expeditiously subject to coordination with City of Naples Utility Department staff.
Estimated level of effort expressed in labor requirements for work task is shown on the
attached statement entitled AMENDMENT NO. 1. TASK ORDER NO. HMA 1-96
"SCOPE OF SERVICES".
C.
COMPENSATION
Professional fees for AMENDMENT NO. I. TASK ORDER NO. HMA 1-96 will be
based on rates and chances as stipulated in the ALiteernent between HOLE...MONTES
AND ASSOCIATES. INC. and CITY OF NAPLES to provide professional services. The
estimated amount of compensation is shown on the attached statement entitled
AMENDMENT NO. 1 TASK ORDER NO. HMA 1-96. "SCOPE OF SERVICES".
D.
ACCEPTANCE
By signature, the parties each accept the provisions of this AMEND NIE:\FT NO. I. TASK
ORDER NO. HMI 1-96 and authorizes the ENGINEER to proceed at the direction of the
CITY OF NAPLES representative in accordance with the "Scope of Ser-vice,".

AMENDMENT NO. 1
TASK ORDER HMA 1-96
SCOPE OF SERVICES
CITY OF NAPLES
WASTEWATER TREATMENT AND RECLAMATION FACILITY
CONSTRUCTION PHASE SERVICES
SECTION 1 - INTRODUCTION
The City of Naples awarded a contract for construction of a 520.4 million expansion' and upgrade
to their Wastewater Treatment and Reclamation Facility to Wharton-Smith. Inc. on February 6.
1996 with a two year construction period. At this time. it is estimated that completion of
construction is approximately seven months behind schedule. The reason for this dela y in
completion is a combination of additional repair items, unforseen site conditions. and genera!
delay by the contractor. The contract included bud g et allowances for repair of existin g facilities
which were not able to be taken out of service for evaluation of their condition until construction
was under%vay. These items have added some time to the project. althou g h the contract
.---contained funds to cover the cost of the work. In other instances, the buried existin g facilities
N..ere not alway s what was anticipated which in some cases necessitated delays to completion of
:he work. In addition, the contractor has worked at a pace which has not allowed timely
completion of construction of this project.
This Amendment to Task Order HMA 1-96 provides the scope of services and associated work
for continued assistance durin g the construction of this project. In addition. this Task Order
Amendment provides the basis for compensation of the scope identified herein.
SECTION 2 - SCOPE OF SERVICES
The CONSULTANT will continue to provide assistance durin g construction of this project on
behalf of the OWNER. These services are for
•
Construction Contract Administration. and
•
Site Observation of Construction
durin g the period of time beyond the ori ginal two year contract period.
The scope of work for these services remains the same as indentific...-d in Task Order HMA 1-9

SECTION 3 - METHOD OF COMPENSATION
For services rendered in accordance with Paragraph 2 above, OWNER shall pay CONSULTANT
on a Standard Hourly Rates Method in accordance with the provisions of Article 6 of the
AGREEMENT. Standard Hourl y Rates to be used in this project are provided in Attachment A.
The estimated budget for these services are provided in Attachment B.
SECTION 4 - OWNER'S RESPONSIBILITIES
OWNER assumes the same responsibilities contained in Task Order HMA 1-96 for this
continuation of work effort by CONSULTANT.
