The 2965'h Regular Meeting of the Board of Trustees of the Village of
Mundelein was held Monday, July 27, 2009 at 1000 North Midlothian
Road, Mundelein. Mayor Kessler called the meeting to order at 7:00 pm.

Trustee Voss stated the Village owns some of the streetlights but not all
of the streetlights, and asked if the Village pays for the electricity on all
of the streetlights. Director Miller stated that was correct, some of the
streetlights were owned by the Village and the Village pays for the
electricity for all of the streetlights. Trustee Voss asked why some of
the streetlights are on during the day. Director Miller stated the Village
owned streetlights get tested from time to time during the day, and the
others may have a photocell issue.

Poker Toumament fundraiser would be held at Santa Maria and asked for
volunteers to bartend, bankers, waiters/waitresses and other functions,

Organization of Black Law Enforcement Executives (NOBLE) conference

Tmstee Meier stated the motion was to replace a squad car totaled in an
accident and added no officers were injured. Trustee Meier added half
would be paid by insurance and the other half would be paid by the
Prisoner Review Agency (PRA) account, at no cost to taxpayers.
Tmstee Voss asked if a hybrid vehicle had been considered. Chief Rose
stated hybrids are being tested in a police setting, but results have not been
determined.

Trustee Voss announced Voices of Mundelein Monday July 13, 2009 at

Trustee Voss stated the Building Department Customer Satisfaction Survey
was distributed and asked Director Schubkegel to explain the survey.
Director Schubkegel stated the Village received a 4.5 out of 5 score on the
surveys handed out to each permit applicant to contractors and
homeowners.

Assistant Administrator Flynn repolted Mundelein MainStreet is reviewing
their bylaws regarding their name change requested by the State. Mundelein
MainStreet announced they had reduced their line of credit to
approximately $6.500, and Assistant Administrator Flynn gave a brief
update regarding Mundelein MainStreet.

Zoning Ordinance and Development Agreement Amendment
At the July 13, 2009 Village Board meeting, the Village Board approved the requested zoning variation and
Development Agreement Amendment for Diamond Cove Condominiums and directed staff to prepare an ordinance
and Resolution for consideration at its next regularly scheduled meeting.
Staff recommends approval of the following motions:
1.
Motion to approve an ordinance granting a variation to section 20.32.090 (4)(b) of the Mundelein Municipal
Code allowing the lot area per dwelling unit to be reduced from not less than 3,600 square feet to 3,283 square
feet for the property at 728 Diamond Lake Road, Mundelein, Illinois; and
2.
Motion to adopt a resolution approving and authorizing the execution of the third amendment to the
development agreement for Diamond Cove Subdivision at 728 Diamond Lake Road, Mundelein, Illinois.

RESOLUTION APPROVING AND AUTHORIZING THE EXECUTION OF
THE THIRD AMENDMENT TO THE DEVELOPMENT AGREEMENT FOR DIAMOND
COVE SUBDIVISION
WHEREAS, on or about April 9, 2007, the Village of Mundelein and Diamond Cove,
LLC entered into a Development Agreement (the "Development Agreement"), regarding the
property at 728 Diamond Lake Road legally described on Exhibit A attached hereto and made a
part hereof; and
WHEREAS, the Development Agreement was previously amended by the First
Amendment made as of December I, 2007 and the Second Amendment made as of December I,
2008; and
WHEREAS, a copy of the proposed Third Amendment to the Development Agreement
between Diamond Cove, LLC and the Village of Mundelein is attached hereto as Exhibit B.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MUNDELEIN, COUNTY OF LAKE, STATE OF
ILLINOIS, that said Third Amendment to the Development Agreement between Diamond Lake
LLC and the Village of Mundelein, attached hereto as Exhibit B, is hereby approved and the
Mayor and Village Clerk are hereby authorized to execute and attest said Third Amendment on
behalf of the Village of Mundelein upon the Village receiving the sum of $8,000.00 for the
balance of the downtown fee, and the sum of$107,160.00 for the capital development fee, the
transportation fee and stonn water fee within 45 days from the passage of this Resolution as
provided in Paragraph 5 of said Third Amendment.

THIRD AMENDMENT
to the
DEVELOPMENT AGREEMENT
(DIAMOND COVE SUBDIVISION)
THIS THIRD AMENDMENT TO THE DEVELOPMENT AGREMENT (the
"Amendment") is made as of the __ day of June, 2009, by and between the VILLAGE OF
MUNDELEIN, an Illinois municipal corporation and home rule unit of local government (the
"Village") and DIAMOND COVE, LLC, an Illinois limited liability company (the "Owner")
PREAMBLES
A.
On or about April 9, 2007, the Village and the Owner entered into that certain
Development Agreement Diamond Cove Subdivision (the "Original Development Agreement"),
as amended by that certain First Amendment to the Development Agreement made as of the 1st
day of December, 2007, as further amended by that certain Second Amendment to the
Development Agreement made as of the 1st day of December, 2008 for development of certain
property (the "Property") legally described in Exhibit A-I to the Original Development
Agreement and on Exhibit A attached hereto and made a part hereof.
B.
Village and Owner desire to enter into a binding Third Amendment to the
Development Agreement, as previously amended, pursuant to the Village's home rule powers,
the Illinois Municipal Code, and any and all other applicable laws and regulations.
C.
The corporate authorities of the Village, after due and careful consideration, have
concluded that the development of the Property in accordance with the Original Development
Agreement, as amended by the previous amendments and this Third Amendment, will enhance,
promote, and serve the best interests and general welfare of the Village and its residents.
NOW, THEREFORE, in consideration of the foregoing preambles and in consideration
of the mutual covenants, agreements and conditions hereinafter contained, and the benefits
anticipated to inure to each ofthem, the parties hereto do hereby agree as follows and agree to
amend the Original Development Agreement, as previously amended, as follows:
1. Preamble G(vi). Preamble G(vi) of the Original Development Agreement shall be
and is hereby amended such that Exhibit B-6, is replaced with Architectural Elevation Plans
prepared by Filoramo/Talsma Architects, dated April, 2009, and attached hereto as Exhibit B-6
(the "Architectural Elevations").
2. Preamble G(vii). Preamble G(vii) of the Original Development Agreement shall be
and is hereby amended such that Exhibit B-7, is replaced with the floor plans prepared by
Filoramo/Talsma Architects, dated April, 2009, and attached hereto as Exhibit B-7 ("Floor
Plans").
3. Section 2.1. Section 2.1 of the Original Development Agreement shall be and is
hereby amended by adding new subsection (c) as follows:
"(c) Notwithstanding Section 20.32.090 (4) (b) of the Mundelein Municipal Code, the
maximum number of dwelling units in the development shall be 24. The property consists of
78,812 sq. ft. Based on the current zoning there is a requirement of 3,600 sq. ft. per dwelling
unit, which would result in 21.89 dwelling units allowed. A variance is approved by separate
ordinance to allow 24 instead of21 dwelling units.
4. Section 2.2.
Section 2.2 of the Original Development Agreement shall be and is
hereby amended such that the number "16" shall be replaced with the number "24".
5. Section 7.1.
Section 7.1 of the Original Development Agreement shall be and is
hereby amended such that each of the Impact Fees, as defined and identified in Section 7.1 (a)-(h)
inclusive shall appear as follows:

* This reflects the $24,000 Downtown Fee, $16,000 of which was paid in August,
2008, and $8,000 of which is due and payable within 45 days after approval of this Third
Amendment by the Village Board of Trustees. The above further does not reflect the
$6,500.00 paid by Developer as a tree replacement fee on April 2, 2007.
The above fees shall be due and payable on the earlier of (a) December I, 2009; and (b) issuance
by the Village of Mundelein of a building permit for the vertical construction of the development
(pouring offoundations). Notwithstanding the above, the following fees shall be due and
payable within 45 days after the approval of this Third Amendment by the Village Board of
Trustees:

Since the payment of the above impact fees is not secured by a letter of credit, the Owner agrees
that this Amendment shall not be executed by the Village and shall not be effective until the sum
of $8,000.00 for the balance of the downtown fee is paid to the Village and the sum of
$107,160.00 for the capital development fee, transportation fee and storm water fee is paid to the
Village.
6. Exhibits H, I and K. Exhibits H, I and K attached to the Original Development
Agreement are replaced with Exhibits H, I and K attached hereto.
7. Site Stabilization. If Owner has not commenced vertical construction on or before 60
days after approval of this Third Amendment by the Village Board of Trustees, then the Owner
shall, within 30 days thereafter, stabilize the site, in a way approved by the Village Engineer, so
as to prevent run off, erosion and other waste at the site. In the event the Owner fails to complete
such stabilization work within the above time period, the Owner agrees and hereby consents to
the Village, in its sole discretion, electing to do all or so much of such stabilization work as the
Village Engineer deems appropriate. The Owner also agrees that the Village and/or its
contractors may enter the property to do such stabilization work and the Owner agrees to
indemnify and hold harmless the Village and its contractors from any liability arising therefrom.
The Owner further agrees to reimburse the Village for the cost of such stabilization work and, in
the event that the Owner fails to do so within ten (10) days following a written request therefor,
the Village may draw upon the irrevocable letter of credit securing the construction of site
improvements on the Property to reimburse itself for the cost of such stabilization work.
8. General Provisions. Capitalized terms used but not defined herein shall have the
meaning ascribed to such terms in the Original Development Agreement. The Original
Development Agreement is hereby ratified and confirmed by the Village and Owner except only
as previously amended and amended herein. This Amendment may be executed in multiple
counterparts, each of which shall be deemed to be an original.
IN WITNESS WHEREOF, the parties hereto have executed this Third Amendment to the

AN ORDINANCE GRANTING A VARIANCE TO SECTION 20.32.090 (4)(B) OF THE
MUNDELEIN MUNICIPAL CODE ALLOWING THE LOT AREA PER DWELLING UNIT
TO BE REDUCED FROM NOT LESS THAN 3,600 SQUARE FEET TO 3,283 SQUARE
FEET FOR THE PROPERTY AT 728 DIAMOND LAKE ROAD, MUNDELEIN, ILLINOIS
WHEREAS, an application has been filed by Diamond Cove, LLC requesting that a
zoning variance be granted to Section 20.32.090(4)(b) of the Mundelein Municipal Code to
reduce the lot area per dwelling unit from not less than 3,600 square feet to not less than 3,283
square feet for the property at 728 Diamond Lake Road, Mundelein, Illinois, which is legally
described on Exhibit A attached hereto; and
WHEREAS, pursuant to notice as provided by statute and ordinance, a public hearing
was held on May 13,2009, by the Mundelein Plan Commission; and
WHEREAS, the Plan Commission submitted its findings of fact and its recommendation
to the Village Board of Trustees that the zoning variation be denied;
WHEREAS, the Village Board of Trustees considered this matter at its regular public
meeting on July 13,2009, at which time it voted to not accept the Plan Commission's findings of
fact and recommendation with four trustees voting aye and two trustees voting nay; and
WHEREAS, at its July 13,2009 public meeting, the Village Board of Trustees
detennined that it would be in the best interests of the Village to grant said variance and
authorized the preparation of this Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MUNDELEIN, COUNTY OF LAKE, STATE OF
ILLINOIS as follows:
SECTION I. A variance to Section 20.32.090(4)(b) of the Mundelein Municipal Code
is hereby granted to Diamond Cove, LLC allowing the lot area per dwelling unit to be reduced
from not less than 3,600 square feet to 3,283 square feet for the property at 728 Diamond Lake
Road, Mundelein, Illinois.
SECTION II. This Ordinance shall be in full force and effect from and after its passage,

Road Improvemen t Referendum

The following information regarding voter referenda is presented in accordance with the Board's direction
following the July 13, 2009 Committee of the Whole meeting.
There are two types of referenda that are applicable to this situation: the binding referendum and the
advisory referendum. A binding referendum is one in which the results of the referendum are enacted into
the law. For example, if the road improvement tax increase referendum was a binding referendum, and the
residents voted for it, the tax increase would take place regardless of the opinions of the Village. In contrast,
the results of the advisory referendum are non-binding. It is a way to gauge public opinion to aid the Village
Board in the decision making process, For our purpose, an advisory referendum has been suggested to help
the Board weigh its options and evaluate the community's stance on the topic.
Essential to a properly configured advis01Y referendum is the framing of the question. It is very important
that the question is content neutral and stated in common terms that can be understood by all voting
residents. The court case Lehman v. Cook County concluded that a municipality initiating a referendum has
the obligation to set forth the question in as neutral and non-argumentative a fashion as possible. For this
reason, our question would be phrased as such:
"Shall the Village of Mundelein, Lake Counry, Illinois (for the purpose of constructing road
improvements and expenses incidental thereto) increase the property tax by a rate of xx% for
the purpose of paying for additional road improvements for the annual Village Street
Improvement Program?"
The next election will be February 2, 2010. In order to include the referendum on this ballot, certain
deadlines must be met. A Board resolution must be adopted by November 30, 2009 stating the question and
that the referendum will be included on the February 2, 2010 election ballot. The resolution must be
provided to the Lake County Clerk by December 3, 2009.
An alternative to conducting an advisory referendum is to conduct a survey of the community. Traditionally,
the Village has not utilized surveys to assess public opinion; however, public surveys have been conducted by
the Police Department for a number of years, and are a widely utilized form of obtaining feedback for policy
development and program success. Surveys have several advantages over referenda: (1) A survey can be
targeted to a specific segment of the population; or, (2) Obtain input from a wider segment of the
population. Referenda are limited to the voters, an extremely small percentage of the residential population.
A survey can reach a wider array of local taxpayers and public service users-voters, non-voters,
homeowners, renters, business and commercial property owners, etc.; (3) Referenda are Limited to a very
narrow, very specific question, which can be problematic when trying to obtain meaningful guidance with
respect to a complex issue. Surveys can cover a broader range of options and identify a broader range of
preferences.
In order to be valid, both the referendum question and the survey questions need to be carefully formulated.
However, developing a survey requires more care in formulating questions, selecting a representative sample,
and evaluating the results, which consequently adds more cost. Consulting services are generally utilized
when preparing, conducting, and analyzing a community survey. The Police Department has used Quality
Computer Professionals Inc. of Lake Bluff to assist with surveys it conducts for CALEA certification. The
last such survey in 2006 cost $1,200. Additional research would be required to determine the scope, options,
and cast of a community survey on road improvements.

In the current budget, $36,000.00 has been approved for a replacement pickup truck for the
Street Division. The pickup truck to be replaced is Street #410, which is a 1997 Chevy 4 x 4 with
93,610 miles.
After researching through the Illinois State Joint Purchase Program we have found that there is a
pickup truck available that will meet our needs. Although the State Purchase Program also has
many accessories available, we find that the Snowplow, power lift gate, and lighting systems that
we find more desirable, are not available through the program.
The State Purchase Program for pickup trucks is through Bob Ridings Inc. of Taylorville, IL. We
have received a price quotation from Monroe Truck Equipment of Monroe, WI for the desired
snowplow, power lift gate and lighting that we desire.
Attached you will find 3 items. Attachment #1 is the order sheet for a replacement pickup truck
from Bob Ridings Inc for the amount of$23,725.00. Attachment #2 is a trade-in offer sheet for
truck #410 showing their offer of $1 ,200.00. Attachment #3 is a price quotation sheet from
Monroe Truck Equipment of Monroe, WI for the furnishing and installation of a Boss 8'
snowplow, a Tommy Lift power lift gate, a Federal Signal warning Light, a Unity spotlight and a
step bumper for the amount of $1 0,3 89 .00.
The total amount for the pickup truck with options minus the trade-in allowance from Bob
Ridings plus the equipment on the price quotation from Monroe Truck Equipment will be
$32,914.00. This total price is $3,086.00 under the budgeted amount of$36,000.00.
We recommend seeking Board approval to purchase the pickup truck with trade-in from Bob
Ridings and the snowplow, lift gate and lighting from Monroe Truck Equipment.

In the past, the department has purchased two Hybrid utility vehicles through the State Purchase Program.
During the last and current fiscal years, the State Purchase Program has not included Hybrid utility

SPECIFICATIONS
Intent
It is the intention of these specifications to describe one Hybrid SUV - 4-wheel drive, 4 door
utility vehicle and to permit qualified bidders to bid on the furnishing of such unit in accordance
with these specifications.
General Terms
All parts not specifically mentioned in the scope of these specifications that are necessary to
provide a vehicle shall be furnished by the successful bidder. The vehicle furnished shall be the
manufacturer's current production model. The vehicle furnished shall be of domestic
manufacturing concern. These specifications shall be construed as minimum. Should the
manufacturer's current published data or specifications exceed these, they shall be considered
minimum and furnished.
The bid submitted (either on a vehicle to be ordered or that is in stock) must meet the
specifications as provided. Deviations from the specification that can be shown to be as a result
of the manufacturer's (GM, FORD, CHRYSLER) design revision must be noted, and could be
found to be acceptable.
Each line must indicate by checking on the YESINO line adjacent to each item on the
specification pages if the unit you are bidding meets the specifications or not.

GENERAL INSTRUCTIONS AND REQUIREMENTS TO BIDDERS
1.
All items contained in the "Instructions to Bidders" are applicable to this call for bids.
2.
The lowest three bids may not be withdrawn after the scheduled closing time for receipt of
bids for at least thirty days, and thereafter must be done so in writing indicating the
reasons for the withdrawal to the Village of Mundelein.
3.
An authorized officer or employee of the company must sign and date the bid. The firm
name shall appear on all bid proposals. All parties involved shall follow all bid submittal
instructions contained within the bid packet.
4.
The Village Administrator (Finance Director, City Clerk, etc.) upon request will execute
the exemption certificates in connection with all orders when Federal Excise Tax would
otherwise be due.

Parts and materials must be of CUlTent date (latest model) and meet the specifications

Bids will be considered on equipment or material complying substantially with the
specifications provided each deviation is stated and the substitution is described, including
technical data when applicable, in a letter attached to bid. The Village of Mundelein
(Municipality) reserves the right to determine as to whether such substitutions or
deviations are within the intent of the specifications and will reasonably meet the service
requirements of the using department. In addition to price and applicability, consideration
for award may be given to engineering design, which adds safety, convenience or
adaptability for use intended. Brand name, which may be mentioned in specifications,
does not indicate a preference and is used only as a reference to the type and quality of
material or equipment desired. (As Applicable)

Time of delivery/completion is a part of the bid award consideration, and must be stated in
definite terms, as this may be a factor in making the award. If time varies on different
items, the bidder shall so state.
11.
Unless otherwise specified, services, materials, and equipment purchased will be inspected
by the Department of Public Works as to meeting the quality and requirements of all call
for bids. When deemed necessary, samples of supplies or materials will be taken at
random from stock received for submission to a commercial laboratory and other
appropriate inspection agency for analysis and tests as to whether the material conforms in
all respects to the specifications. In cases where this action is required, the expense of
analysis is to be borne by the vendor and the order of balance thereof may be canceled if
necessary by the Village of Mundelein (Municipality). (As Applicable)
12.
The vendor shall hold the Village of Mundelein (Municipality), its officers, agents, and
employees, harmless from liability of any nature of kind on account of use of any
copyrighted or un-copyrighted composition, secret process, patented or un-patented
invention, article or appliance furnished or used under the bid call.
13.
Successful bidder is specifically denied the rights of using in any form or medium the
name of the Village of Mundelein (Municipality) for advertising unless express permission
is granted by the Village of Mundelein (Municipality).
14.
The Village of Mundelein reserves the right to reject any or all bids, or any part thereof, or
to accept any bid, deemed to be for the best interest of the Village of Mundelein.
15.
If there is a trade-in consideration, trade-in will not be released until the new
vehicle/equipment is delivered and accepted. In addition, there is no warranty expressed
nor given on any trade-in item. Trade-in considerations are "as is".
16.
The vendor/contractor is responsible to provide any and all personnel, vehicles, equipment,
materials, and supplies in order to complete the program, project, and work associated with
the bid, and must be included in the bid sum entered. No additional costs are to be
provided by the Village of Mundelein, unless approved in advance by the Village of
Mundelein.

As technology has improved and the costs come down, the use of electronic advertising has become increasingly popular.
The Village Board has granted variations to public and quasi-public institutions such as the Park District and, private
schools, to display religious and community announcements. With the increase in popularity, the Village Board questioned
whether the current way of granting variations is the most effective manner to handle these types of requests.
At the conclusion of the Committee of the Whole meeting, it was agreed upon that the Village of Mundelein has the right
to regulate electronic message board signs in the interest of public safety and aesthetics. The Village Board had requested
additional information, and a draft electronic message board regulation to be prepared for consideration.
The following are answers to the questions raised at the committee meeting. Pictures of recently approved signs have
been provided. Pictures have also been taken of recently approved electronic signs found in surrounding communities.
What is nits?
A nit is defined as a luminance unit equal to one candela (one candle) per square meter measured perpendicular to the rays
from the source. From the Latin word nitere, meaning lito shine ll , nits are used to measure display intensity or brightness.
Nits, when used in conjunction with contrast ratio and viewing angle, determine the quality of the image in the desired
application.
A candela is tlle base unit of luminous intensity or power emitted by a light source in a particular direction, weighted by the
luminosity function (a standardized model of the sensitivity of the human eye to different wavelengths, also known as the
luminous efficiency function). A common candle emits light with a luminous intensity of roughly one candela. If an
opaque barrier blocks emission in some di.rections, the emission will still be approximately one candela in the di.rections
that are not obscured.
A monochromatic sign is adequately seen during daylight at nit levels (approximately 5,000 nits) that are lower dun RGB
signs. The level of brightness for RGB signs can range from 5,000 - 11,000 nits. A full color, high-resolution sign needs
higher nit levels to be seen in the daylight. On cloudy days, signs at their fullest level of brightness may be too bright and
need a manual override. At night, signs can be seen at about 1,000 nits.

Draft Electronic Regulations
The draft-suggested standards, electronic message regulations is a compilation of feedback provided by the Village Board;
research of communities recently adopted regulations, i.e. Naperville, Crystal Lake, and Lake County; and expanded upon
language of Camiros, Ltd., in the draft Zoning Orclinance Update. The current proposal prohibits commercial electronic
message signs, but permits signs for public and quasi-public entities. Along with the regulations, new definitions will be
necessary to accommodate the new terminology.

Conclusion
An amendment to the Sign Ordinance to add regulations for electronic reader boards will be necessary as the Village
receives more requests. The Village Board should proceed cautiously when determining what types of users should be
permitted to install these signs, where these signs should be located, and how they are operated. As you may recall, lvIr.
iv'Iarino's opinion affirms that the Village can regulate these types of signs and prohibit their installation and use at
commercial establishments and prohibit the display of commercial messages.

1. Electronic Message Centers
a.
Electronic message centers do not include video signs, tri-vision signs, and
animated signs, which are prohibited.
b.
Flashing lights, scrolling lights, rotation of lights, and moving borders around
the sign so as to draw attention and cause a distraction are prohibited.
c.
Electronic message centers shall be prohibited from all zoning districts and
uses except public uses and institutional uses.
d.
Electronic message centers are limited to the following uses: public. auaslpublic, religious and educational institutional uses. Exception: Gasoline
Service Stations shall be permitted to use electronic numbers in lieu of
manual changeable numbers to display the prices of gasoline.

Commercial messages are prohibited on electronic message signs.

allowable sign area and the electronic message portion of the sign may not
exceed thirty-two (32) square feet
I.
The sign in its entirety is limited to fifty (50) square feet
m. Electronic message center signs must be at least fifteen (15) feet from the
property line.

No sign with electronic message center components may exceed fifteen (15)
feet in height

No electronic message sign shall be located within 2000 feet of another
electronic message sign.

Electronic message signs shall only be located on properties with at least five
hundred (500) feet of frontage.

Only one electronic message sign is permitted per zoning lot (or
development if the site has multiple users that would fall within the
regulations for granting an electronic sign), regardless of the number of

No site under 5 acres may be permitted an electronic message sign.

The message area of an electronic message center may be illuminated by
white incandescent lamps. LED (light-emitting diodes) or magnetic discs.
Whatever the light source, undue brightness is prohibited.
i.
For the purpose of enforcing this provision, "undue brightness" will
be construed to mean illumination of a white portion of the sign in
excess of the intensity levels specified below:
1.
Day: 5,000 nits for monochromatic red and amber signs.
2.
Day: 7,000 nits for RGBs with a resolution of 25mm pixels or
greater (meaning increasing the distance of the pixels).
3.
Day: 9,000 nits for 24 mm pixels or lower (higher resolution
signs).
4.
Night: 1,000 nits
ii.
To ensure compliance with this provision, the sign must have an
automatic phased proportional dimmer, which must be used to
reduce nighttime brightness levels (compared to daytime brightness
levels). Further, prior to the issuance of a permit for an electronic
message board sign, the applicant shall provide written certification
from the sign manufacturer that the light intensity has been factory
preset not to exceed the levels specified above, and the intensity
level is protected from end-user manipulation by password-protected
software or other method as deemed appropriate by the Director of
Building.
iii.
At the reguest of the Village, electronic message sign users shall
reduce the level of brightness if determined by the Village that the
light levels are greater than the maximum permitted nits as specified
in this Section.
t.
Each message displayed on an electronic message sign must be static or
depicted for a minimum of four (4) seconds.
u.
The Zoning Administrator may impose, as a condition of the issuance of a
sign permit. such requirements as to the material manner of construction
and method of erection of a sign as are reasonably necessary to assure the
safety and convenience to the public. Should a conflict arise, the
Appearance Review Commission shall hold a public meeting to determine
the appropriateness of design for the sign.

a meeting Monday July 27, 2009 at 1000 North Midlothian Road,
Mundelein. O1airman Kessler convened the meeting at 6:45 pm.

O1airman Nutschnig stated the purpose of the Zoning Board of Appeals
Committee meeting was to discuss ZBA-06-2009, a request for a variation
to Section 20,46.050(c) of the Mundelein Municipal Code to permit a sixfoot fence to be built from the rear of the principal building to within one
foot inside the property line adjoining a street to enclose the resulting reat
yard.
Background
O1airman Nutschnig stated the petitioners Mr. John & Barbra Tector have
applied for a variance to Section 20,46.050(c) of the Mundelein Municipal
Code to construct a six-foot fence on the corner lot at 1646 Wmston Court.
The proposed fence would run southeast from the rear of their home to
within one foot of the property line and continue northeast along the
property line to the back of the property.
Section 20,46.050(c) of the Mundelein Municipal Code states that a fourfoot fence is permitted on corner lots from the rear of the principal building
to within one-foot inside the property line in a side yard adjoining a street to
enclose the resulting rear yard. Because the petitioner is proposing to build
a six-foot fence, they have requested a variation. It should be noted that the
petitioner's neighbor to the northeast has constructed a fence of the same
height and style the petitioner is proposing to build.

Notice of the Public Hearing was published in The Daily Herald on July 10,
2009.
O1airman Nutschnig stated Section 20,48.070 of the Mundelein Municipal
Code outlines the procedure and instances for granting a variation. When a
property owner or its agent shows that strict application of the terms of this
ordinance relating to the use, construction, or alteration of buildings Ot
structures, or the use of land imposes upon him practical difficulties, or a
particular hardship, then the Village Board of Tmstees, with the
recommendation of the Zoning Board of Appeals Conunittee may
authorize such variations. A variation from the strict application of the
tenns of the Zoning Ordinance may be granted if it is in harmony with the
general purpose and intent of the Ordinance, and provided that a granting
of such variation will not merely serve as a convenience to the applicant, but
is necessary to alleviate some demonstrable hardship or difficulty so great as
to warrant a variation from the provisions of the Zoning Ordinance, as
demonstrated through the Standards of a Variation.

The petitioner requested the variation be granted because a four-foot fence is
low enough for their dogs to jump over, which poses a threat to people
passing by their home.
JustificationiHardship
Staff has reviewed the petitioner's application and finds the petitioner did not
create the hardship, and granting of the variance would not have a negative
impact on the surrounding property owners or the Village as a whole.
Analy>is
Commissioner Voss stated she looked at the property and spoke with the
neighbors and had no objection to the variance, and felt it would enhance the
neighborhood to have continuity throughout the neighborhood.
Discussion
Colllilllssioner Sullivan stated he agreed with Comnllssioner Voss regarding
the enhancement of the neighborhood.
Colllirussioner Meier stated she too, went to the property and did not have an
objection.
Chairman Nutschnig opened the floor to the public.

Commissioner Sullivan stated he understood the frustrations the petitioners
had with this request and added the Village is not trying to make it difficult
for homeowners to upgrade their homes, however it is necessary to have
guidelines and standards for the Village.
Motion by Nutschnig, seconded by Meier to recOlmnend granting approval
for a variation to Section 20.46.050(c) of the Mundelein Municipal Code to
pernllt a six-foot fence to be built from the rear of the principal building to
within one foot inside the property line adjoining a street to enclose the
resulting rear yard at 1646 Wmston Court. Upon roll call vote, the vote was
as follows: Ayes: Nutschrllg, Meier, Nutschrllg, Semple, and Sullivan; nay>:
none; absent and not voting: Lentz.
Motion by Nutschrllg, seconded by Meier to adjourn the Zoning Board of

The SEC Group will assist the Engineering Department with construction engineering of the Illinois Safe
Routes to School sidewalk improvement project. Services included in the agreement include but are not
limited to land survey and construction stakeout, material testing, project documentation, pay estimate
preparation and coordination with the Illinois Department of Transportation. Under the terms of the
Illinois Safe Routes to School joint funding agreement, 100 percent of the fee is eligible for
reimbursement.
RECOMMENDATION
Motion to approve a Engineering Services Agreement with SEC Group, Inc., for the Illinois Safe Routes
to School Sidewalk Improvement Project in an amount not to exceed $29,943.85 and authorize the Mayor
and Clerk to sign the Agreement.

WHEREAS, a petition for a zoning variation was filed by John and Barbra Tector

which is legally described on Exhibit A attached hereto; and
WHEREAS, pursuant to notice as provided by statute and ordinance, a public hearing
was held on July 27,2009, by the Mundelein Zoning Board of Appeals; and
WHEREAS, following said hearing, the Zoning Board of Appeals recommended
approval ofa variation to Section 20.46.050(c) to permit a six-foot fence to be built from the rear
of the principal building to within one foot inside the property line adjoining a street to enclose
the resulting rear yard; and
WHEREAS, at the Village Board meeting on August 10, 2009, the Mundelein Village
Board authorized the preparation of an ordinance granting said variation.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MUNDELEIN, COUNTY OF LAKE, STATE OF
ILLINOIS as follows:
SECTION I.
A variation from Section 20.46.050(c) of the Mundelein Municipal Code
is hereby granted to John and Barbra Tector to permit a six-foot fence to be built from the rear of
the principal building to within one foot inside the property line adjoining a street to enclose the
resulting rear yard at 1646 Winston Court, Mundelein, 11.
SECTION II. This Ordinance shall be in full force and effect from and after its passage,
