On July 23, 2010, the Court
of Appeals for the Third Circuit,
Western Pennsylvania, affirmed
the decision of Judge Terrence
McVeery of Sept. 15, 2009,
dismissing on summary judgment
the suit brought by Specialty Tires
of America, manufacturer of
American Racer race tires, against
Hoosier Racing Tire, and Dirt
Motor Sports, Inc. In its 2007 suit,
Specialty Tires of America (STA)
alleged Hoosier and Dirt Motor
Sports violated antitrust laws. In
dismissing the suit, McVeery, last
September, determined that
Hoosier, and DIRT Motor Sports did
not violate the Sherman Antitrust
Act and further that Specialty Tire
did not have standing to bring
suit, meaning it did not suffer an
injury resulting from an antitrust
violation, writing "...the Court
finds and rules that Plaintiffs have
not demonstrated that they have
sustained an antitrust injury
because the summary judgment
record is devoid of any evidence
which demonstrates that
Plaintiff’s losses were ‘of the type
the antitrust laws were intended
to prevent’ nor did any injury to
Plaintiff’s ‘flow from that which
makes Defendants’ acts
unlawful.’ ...The motions for
summary judgment filed by
Defendants Hoosier Racing Tire
Corp. and DIRT Motor Sports, Inc.

Greater Respect For Race Track Food

Traveling as we do, we choose the fast food drivethrough more often than we should, and we can tell
you that if we were a promoter with a short car count
in our top class, we’d be promoting the heck out of our
food and beverage, adding patios with tables
sheltered by umbrellas, and working with vendors on a
signature burger and other items to make our track
stand apart from local dining establishments. After all,
where is the money made at today’s weekly race
tracks? Are race tracks not outdoor sports bars with
live races instead of dozens of TVs showing guys
kicking a checkered ball around?
The universally recognized arches, lauded as they
are as business leaders, can deliver a hot Coke and a
cold burger and fries as well as any race track. And,
frequently, they do, and when temperatures are correct
the fries need salt and the burger is askew on the bun
with condiments leaking everywhere, while soda drips
out of an overfilled cup. Even when short track food
leaves the taste buds wanting, our order is correct and
soda cans or cups are not leaking. We contrast our fast
food experiences with the several burgers at short
tracks recently that rivaled some we make on our own
grill, or CHARLIE CATHELL’s crab cake sandwiches, or
Boone (IA) Speedway’s pork tenderloins and we are
reminded to give greater credit to race track kitchens,
and we think promoters should as well.
We all have our race track food or restroom
stories, but ours are outnumbered by stories of fast
food orders gone horribly wrong, and we should give
greater recognition to our industry’s standouts. More
important, many promoters themselves are not selling
what they should take greater pride in. Announcers
urge people to enjoy intermission at the snack bar, but
they should be doing more, inviting fans to “Make this
the night they experience the track’s half-pound Angus
burger and a cold (brand) beer.” And while we’re on
the topic, tracks need more point-of-sale signage for
their food and beverage and they might experiment
with nightly promotional items to get fans to sample
their food or to increase incremental sales. They need
their own version of the shamrock shake and happy
meal. No one expects track food to surpass a gourmet
restaurant, but it can, and frequently does match or
surpass the best national franchises, and we can say
with authority that in many crossroads of America, it is
already better than the fast food place on the edge of
town or the main street diner, and that’s a strong
selling point.

Valuable “Bright-line” Established

or other spec rules. The Court underlined the fact that
sanctioning bodies and promoters have the right to
establish their own rules of the game, including
specifying a single-supplier’s products, and created a
so-called "bright-line rule.”
The Court's ruling, a result of STA’s appeal to the
higher court, says that sanctioning bodies can legally
enter exclusive contracts where they have in good faith
“freely adopted their own equipment rules and then
freely entered into exclusive contracts with the
respective suppliers.” It also noted that in this case, the
evidence supported the sanctioning bodies’ good faith
belief that single-tire rules benefit racers and
motorsports in general, including by promoting parity
among racers, increasing safety, and controlling overall
costs of so-called “tire wars.” The court’s ruling is
intended to make possible predictable and consistent
legal results, reducing the burden on courts to hear
cases and to minimize the risk to businesses and
individuals from suits. The widely encompassing ruling
will help the governing bodies of sports of all types, not
just racing. Four other sanctioning groups filed Amicus
Briefs, NASCAR, Grand Am Road Racing, USAC Racing,
and IMCA, expressing their concern that a ruling was
needed to discourage costly future litigation similar in
nature.
The Court gave a clear ruling because sanctioning
bodies have ultimately won antitrust challenges to their
specification rules in the past (For instance, the much
discussed in these pages and Workshops, Hoosier v.
M&H Tire, in 1984, in which Hoosier and promoters
ultimately won after Marvin Rifchin alleged that "onetire rule” established by NEDOC, Stafford Motor
Speedway and Seekonk Speedway was illegal under the
Sherman Antitrust Act, but only after incurring
considerable legal expenses.) “Motorsports sanctioning
bodies, as well as similar organizations in other sports,
deserve a bright-line rule to follow so they can avoid
potential antitrust liability as well as time-consuming
and expensive antitrust litigation…,” wrote the court.
“Contrary to the pro-competitive purposes of antitrust
law, this expense may have real anti-competitive effect,
especially on the smaller sanctioning bodies.”
The decision and last year’s “Order Granting
Summary Judgment” are interesting reading. Among
things that stood out was this remark about the
contradictions of Specialty Tire's allegations against
Hoosier. Judge McVerry quoted STA’s website in his
2009 decision when he wrote: "STA has supported
single-tire rules generally and believes that single-tire
rules have significant benefits for racing. STA states on
its website that it developed and promoted the concept
of a “single-tire” rule more than thirty (30) years ago...
In the 1970's, Joe Jacobs, the developer of the race tire
business that eventually became Race Tires America,
proposed and encouraged race tracks and promoters to
adopt spec-tire or track-tire rules. Under this concept,
track owners and promoters adopted a manufacturer’s
tire for a particular class of races for the duration of a
racing season. The purpose of the rule was to avoid the
almost constant pace of tire changes that were
particularly costly to racers, and to encourage racer
parity... With all racers competing on a single tire design
and compound, the tire wars would be quelled and race
results would be more related to a driver’s skill and
ability and not a more expensive ‘state-of-the-art’ tire."
The court said in another telling remark: "STA
argues that Hoosier’s exclusive single-tire contracts
foreclose competition in dirt oval track racing tires. In
support of this argument, STA relies on the following
undisputed facts: Hoosier’s exclusive contracts obligate
the sanctioning companies and tracks to ‘ensure that
Hoosier tires are the only tires used in competition’ by
racers. ...many [Hoosier Tire] contracts provide for a
duration of multiple years... And many contracts

Evil Weeds: Clearing The Air
We recall when smoking pot was illegal and
smoking tobacco wasn't. Now midway through the
2010 season, we find ourselves talking with one
promoter figuring out what to do with a driver that
possesses a medical marijuana card and another
promoter whose track was cited by authorities
because fans smoked cigarettes on the premises. As if
just selling tickets was not challenge enough! The
irony is that Dan Mann can do something about the
card-carrying driver, because the solution to the
problem lies in his own track drug policy and its
enforcement. Amy Kolo, on the other hand, is victim
of fans' nicotine cravings, social militancy and the
unintended consequences of Wisconsin's new public
facility smoking ban, things she has no control over.
Mann, Electric City (MT) Speedway, is among
promoters doing business in one of the 14 states (AK,
CA, CO, HI, MI, ME, MT, NM, NV, NJ, OR, RI, VT, WA) that
permit medical marijuana. After other drivers ratted
out a driver last year who flashed his medical
marijuana card and talked of his prescription. Mann,
following Workshops attorneys' advice, requested that
the driver produce a physician’s letter of
recommendation stating it was all right for the driver
to race before he would be granted permission to
enter Electric City events. The driver didn’t produce
such a letter, but instead had an attorney representing
him contact Mann about the issue. Despite pressure
from the attorney, Mann did not relent, and so far the
driver has not attempted to race.
