Review of Council Meeting Agenda 4.1 Remove from afternoon agenda as the current animal control agreement with Brunswick County is still in effect. 5.6 Mr. Baldwin (Village Attorney) suggested the Planning Board should take a closer look at chapter 32-10 of the Village Ordinances to readdress the issues with trailers 3. Workers Compensation 3.1.Worker's Comp Discussion Brian Leaird Caroline Mitchell, Director of Public Safety, informed Council that all physicals were completed last month for both staff and volunteers. Of the approximately thirty-five (35) volunteers only eight (8) are fully qualified for interior firefighting with no restrictions. The remaining 27 have restrictions ranging from weight restrictions to only available for support or administrative duties. Jay Howell, VFIS/Code 3, who is our insurance carrier advised Council it is up to the Village to have a policy in place to address the issues of coverage. It would be difficult for the insurance company to exclude coverage, even if a person who was driving a Village vehicle, was not released to do so. That is not to say that even though the coverage is there that in the future the Village could either be dropped or Village of Bald Head Island Page 1 Packet Pg. 2 Minutes Acceptance: Minutes of Dec 12, 2014 9:30 AM (Consent Agenda) Mayor Sayre called the meeting to order at 9:32 with all in favor (3-0). 2.1 Minutes Village Council December 12, 2014 it could cause a rate spike in the future. To Mr. Howell's knowledge there have been no claims like this filed against the Village in the past. Caroline Mitchell went on to state the intent of the physicals are not to exclude or do away with the volunteer system as our Island does not operate without volunteer support. Staff is to put together a Standard Operating Procedure for Volunteers, address any staffing levels as a result of the number of volunteers available, and be ready with a recommendation to Council at the January 16, 2015 meeting. 4. Closed Session Pursuant to N.C. General Statutes 143-318.11 (a)(1) Councilman Douglas made the motion to go into closed session at 10:36 am with all in favor (3-0). * Consult with Attorney 5. Adjournment Councilman Douglas made the motion to go out of closed session, into open session and adjourn at 11:29am with all favor (3-0). Andrew Sayre, Mayor ATTEST: ________________________ Daralyn Spivey, Village Clerk Village of Bald Head Island Page 2 Packet Pg. 3 Minutes Acceptance: Minutes of Dec 12, 2014 9:30 AM (Consent Agenda) Brian Leaird with the NC League of Municipalities Risk Management, informed Council if a volunteer was injured and not cleared by the physical, workers comprehensive insurance will cover the claim, any governing body would have that responsibility as regulated by National Fire Protection Act (NFPA) 15-82 which addresses the issues of firefighters/emergency responders and injuries. Statistics show fifty three (53%) percent of fatalities were volunteers and in a majority of those fatalities, the cause of death as overexertion/sudden cardiac arrest, showing how important to the physicals are. 2.2 VILLAGE OF BALD HEAD ISLAND COUNCIL REGULAR MEETING 2:30 PM December 12, 2014 Location: BHA 1. RESULT: MOVER: AYES: ABSENT: ADOPTED [UNANIMOUS] Robert Helgesen, Councilman & Chair of SIG Sayre, Douglas, Helgesen, Ridgeway Morris 4.1.2013-14 Annual Auditors Report Deb Straub Wayne Berry, Berry, Padget and Chandler CPA, presented the Council with the 2013-14 audit report for the Village. The Village is in good standing. RESULT: NO ACTION NECESSARY 4.2.November 2014 Financial Statement Deb Straub Deb Straub, Finance Director, reported ad valorem taxes are at $2M collected to date which is ahead of prior years, accommodations taxes collected at 86% of the annual budget and total operating revenues are slightly ahead of prior years. General Fund expenditures are on target. Utility Fund: For revenues the Village has received three (3) water and three (3) sewer tap fees to date and expenditures are slightly below prior years. Capital Project fund balances are: Beach Fund-$1.1M Village Facilities Construction/Expansion-$421K Stormwater Management-$52K Infiltration Pond System-$9K and noted there were expenditures incorrectly charged to the infiltration Pond Fund that should have been charged to Utility Fund for a total of $31k and will be corrected in December. RESULT: NO ACTION NECESSARY 4.3.Terminal Groin Bid Award Calvin Peck Mr. Peck advised Council on Wednesday afternoon bids were opened for both the Marina Jetty Extension and the Timber Groin ranging from $4.8M to $12M. The three bidders were Orion, T.I.C. and W.F. Magann. After consulting with Eric Olsen (Olsen and Associates) regarding the bids and contents, Staff recommendation is to sign the award letter to Orion Marine Construction. Councilman Douglas made the motion, Councilman Ridgeway seconded with all in favor (4-0). RESULT: MOVER: SECONDER: AYES: ABSENT: ADOPTED [UNANIMOUS] Gene Douglas, Mayor Pro Tempore Joe Ridgeway, Councilman Sayre, Douglas, Helgesen, Ridgeway Morris 4.5.Resolution Authorizing Issuance of Bonds - 2014 Deb Straub Mrs. Straub presented the Council with a resolution for the GO bond. The interest rate will be 1.95% which is well within the reasonable market rates. Councilman Douglas made the motion,, Councilman Ridgeway seconded with all in favor (4-0). RESULT: MOVER: SECONDER: AYES: ABSENT: ADOPTED [UNANIMOUS] Gene Douglas, Mayor Pro Tempore Joe Ridgeway, Councilman Sayre, Douglas, Helgesen, Ridgeway Morris 4.6.Zoning Ordinance Towed Vehicle Amendments Calvin Peck Mr. McCall updated the status of the request for a conditional use permit from Mr. Pitera of MoJo's restaurant regarding the use of a kitchen trailer. Mr. Pitera has rescinded his application. Staff requests, after some ambiguity of the definition of trailers, this be taken back to the Planning Board for review and action. This resolution would be for the Zoning Board of Adjustments, Strategic Issues Group and the Planning Board. Councilman Douglas made the motion with all in favor(4-0). Manager's Report Brunswick Beaches Consortium held their meeting yesterday and Mr. McCall has been appointed as the temporary chair and Councilman Douglas as the Vice Chair with a short term goal of revamping the organization. The USACE has award to their contract for dredging to the Great Lakes Dredging two days ago and equipment will start arriving soon. This will be a busy summer on the beach and the Village will strive to keep good communication with all stakeholders. 5.1.Public Safety Statistics November 2014 Caroline Mitchell Caroline Mitchell informed Council, she met with Joyce Fulton, Chad Paul and Claude McKernnan of Bald Head Island Limited along with Coast Guard Station Oak Island to set for a possible ebola outbreak to draft a policy. Going forward, that policy is in place should it ever be needed. RESULT: NO ACTION NECESSARY 5.2.Development Services Monthly Report Stephen Boyett Stephen Boyett, Building Inspector advised Council the IPC building construction is started and if anyone would like to see those plans, they are welcome to come tot he front desk at Village Hall. RESULT: NO ACTION NECESSARY 6. Strategic Issues Group Councilman Helgesen reported the project looks promising and is moving forward, but will take time to complete. North Carolina State law requires that we can only do a referendum at primary time only which is at a minimum next November for approval of the voting body. Future development and the sustainability of the Island in the future rides on this project. 7. Comments, Reports and Questions 1. Citizens Diane Mesaris would like to ask the Public Safety Department to look into training the Island community in hands only CPR and statistics show it is as effective has conventional CPR. This technique can double or even triple the survival rate. She would like to see Public Safety offer this type of training Island wide quarterly along with AED training. Richard Mesaris wanted clarification about the process of the bids and the terminal groin to be sure that the bids were responsive and responsible. Mr. Peck explained our engineer (Olsen and Associates) had completed that task as required. 7. Mayor and Council No Comment 8. Village Manager Recommendation: Recommend that Council award bid to Island Contracting for the Creek Access Project : Base Bid- $90,581.79 to replace Concrete boat ramp and new Kayak launch ramp AND Alternate Bid- $27,175.00 to replace wooden retaining walls adjacent to concrete boat ramp.
