What is the ZAI Trust?
W.R. Grace's plan of reorganization became final on February 3,
2014. Consequently, W.R. Grace has now funded the Zonolite Attic
Insulation Trust from which eligible Claimants will be reimbursed for
their legitimate ZAI Property Damage Claims ("ZAI PD"). Under the
settlement, Grace will fund an independent Trust and Claims Facility
("the Trust") that will operate for a minimum of 20 years educating
the public about the potential health effects associated with
asbestos containing vermiculite/ZAI.
How much will be paid from the Trust for a ZAI Claim?
The Trust may provide a reimbursement contribution of 55% of the
abatement cost for eligible Claimants up to a ceiling of 55% of a
$7,500 removal bill (or $4,125). For example, if you spent $7,500
removing and replacing the insulation, you are potentially eligible
for the maximum reimbursement of $4,125. If you spent $3,000 for
abatement and re-insulation, you are potentially eligible for
reimbursement of $1,650 (55% of $3,000).
Who can make a claim?
If ZAI was installed in a structure which you own or rent, or have
owned or rented, and you incurred expense removing, abating (to
include re-insulation cost) or containing the ZAI, you are entitled to
submit a Claim. In order for your Claim to be successful, and for you
to receive compensation, certain evidentiary requirements must be
met. Those requirements are set forth in the Claim Form and can
also be found in Section 5.4 of the ZAI TDP. There may be
instances, such as might occur in a real estate negotiation, where
the parties agree as to who would have the rights to the
claim. Absent such an agreement the Trustee will resolve any
dispute as equity may dictate.
Can Payment from the ZAI Trust be made direct to the
abatement contractor?
Yes, under some conditions. There may be incidences in which a
homeowner and abatement contractor reach an agreement whereby
the Claimant authorizes the Trust to pay the compensation directly
to the contractor. In that event, as discussed in the "abatement
expense" section of the form, you must provide proof of payment of
the non-reimbursable portion. In other words, if you have a
successful Claim of $5,000 in abatement costs and have authorized
payment to the contractor, the Trust can pay the contractor of
$2,750 directly (55% of $5,000). You must, however, have proof of
payment of the remaining $2,250 (45% of $5,000).

Proper Use of Negative Air
Machines in Mold Remediation
ATLANTA - While the mold remediation industry
has produced a variety of approaches and
voluntary guidelines, no U.S. federal
government standards exist to define the
processes or procedures needed to control or
eliminate indoor fungal growth or fungal
hazards.
This leads to work practices and methods that
vary greatly, even if projects are very similar. One of the
remediation procedures not consistently applied is the use of
blowers and fans to create a pressure differential between the work
area and surrounding areas. This procedure typically creates a
space that is negatively pressurized compared to the noncontaminated or less-contaminated areas. These machines are often
referred to as negative air machines (NAMs). In certain
circumstances, NAMs are being turned off prior to clearance or post
remediation verification (PVR) air sampling.
"This practice could be considered to be inconsistent with other
remediation practices designed to protect the non-work areas from
contamination from airborne or settled mold spores," Kent
Rawhouser, president of IAQA, said.
IAQA recently released a new white paper, "The Use of Negative Air
Machines in Mold Remediation," to help identify gaps in current
industry knowledge and practice. The paper can be downloaded for

A task group was charged with determining if NAMs used to create
a negative pressure contaminant should be either "on" or "off" for
the PRV process and clearance sampling.
IAQA found that "the determination of whether a NAM is in
operation during the collection of PRV samples should be evaluated
on a case-by-case basis by the competent person who should
document their decision and rationale."
"With regard to air sampling, there is no published evidence that
supports the contention that turning a NAM off at the end of the
removal process will result in more realistic occupancy conditions,"
Rawhouser said. "Both the 'NAM on' safety and health premise, and
the 'NAM off' more accurate PRV sampling premise lack scientific
data supporting them and require further research."
As part of the paper, IAQA developed several recommendations.
These include:




Sharing this document with IAQ industry partners, as well
as others with a material interest in mold remediation, to
foster further discussions.
Supporting the need for research and development toward
a scientifically valid and industry accepted means by which
PRV sampling is performed and evaluated.
Supporting the need for research on particle profiling and
potential exposures, both inside and outside the work area,
while NAMs are running in order to improve the overall
understanding of particle dynamics, the specifics of
exposure and the potential for cross-contamination.
Supporting the need for research into whether postremediation clearance sampling, particularly spore trap
sampling, has any measurable merit in determining the
efficiency of the remediation process.
