A BUYERS GUIDE TO AUCTION
THE SOLICITOR – First you must advise your Solicitor of your interest and let him see the Auction
catalogue. He will need to read the General Conditions of Sale and apply for a copy of the Special
Conditions of Sale and have sight of any other relevant documents. Only then will he be in a position to
make legal enquiries on your behalf.
THE SURVEYOR – You will want to instruct your own Surveyor to check that the property is sound. If you
do not know of one in the area, we shall be able to help.
ARRANGING A MORTGAGE – If you are not in a position to pay cash, you will need to arrange a
Mortgage quickly enough to permit the potential Mortgagee to carry out his own survey in good time.
INSURANCE AGENT – If you bid at auction is successful, the property immediately becomes your risk
even though you have to wait for completion day to move in.
THE START – By the time the Auction begins, each potential purchaser is deemed to know all there is to
be known about the Lot he is interested in and the legal requirements that surround it. The Auctioneer may
have a few preliminary announcements to make and he will offer the first Lot accepting increments
according to the value of the property.
BIDDING – The Auctioneer will guide the bidding in a firm but flexible manner and you will need to raise
your catalogue or hand when the time comes clearly indicating your bid.
NO TRICKS – Contrary to the rumours which sometime circulate there is no ‘clever’ way to bid and little
point in holding back to see how it goes since a maximum of a few minutes is devoted to each Lot. Be
cagey and the Lot may be knocked down to someone else by the time you react. Be positive and you stand
a good chance of being successful, but remember your upper limit and the fact that a Contract exists the
moment the hammer falls.
SUCCESS – If yours was the highest bid over the reserve you need to give your name to the Auctioneer.
You will then need to approach the Solicitor dealing with that Lot in order to pay the deposit and sign the
Contract. A Bankers draft for the deposit, Building Society cheque or even a personal cheque with positive
means of identification will be acceptable.
BELOW RESERVE PRICE – It is not unknown, despite the Auctioneer’s best advice, for vendors to have
second thoughts and raise the reserve price the day before the Auction, especially if their property has
generated a lot of interest. If the property is not sold at the auction, please approach the Auctioneer after
the sale so that an offer can be made and instructions taken from the vendor in order to negotiate a sale.
CONDITIONS OF SALE – These properties will, unless previously withdrawn, be sold subject to the special
and general conditions of sale which have been settled by the vendors Solicitors mentioned in these
particulars and will be available for inspection during the five days (exclusive of Saturday or Sunday)
immediately before and exclusive of the date of the sale, but they will not then be read. The purchaser shall
be deemed to have notice of such conditions and all the terms thereof, shall be deemed to bid on those
terms, whether he shall have inspected conditions or not.
