Sealed tenders affixed with revenue stamps worth Rupees 5/= are invited on behalf of the Governor of Jammu and Kashmir State from registered/ reputed Manufactures, suppliers and authorized Dealers for supply ly of various flower bulbous, perenni perennials als and annual plant materials to Directorate of Agriculture, Kashmir. The tenders should reach the office of tthe undersigned by or before 14th March 2015 up to 4.00 P.M through registered post/courier service/ by hand hand. Tender document for the items to be purchased by the department can be had from Purchase Section of Directorate of Agriculture, Lalmandi, Srinagar by or before 12th March 2015 up to 3.00 3 PM against a payment of Rs. 300.00 (Rupees Three Hundred Only) to be deposited deposit with cashier of this office against proper receipt. Tenders to be deposited by hand shall be put in a tender box kept in the office of the undersigned upto scheduled date and time. Tenders received through speed Posts/Courier shall be accepted ed within Scheduled date and time. Any tender whether by post/courier or by hand received after the scheduled date & time i.e i.e, 14th March upto 4.00 PM will not be accepted. The specifications of the items are as under:- A. The tenders should be neatly written in ink/computer typed. Cuttings /over writings on quoted rates shall disqualify the tender from competition. The rates should be written both in words and figures against each item & cello tapes be affixed on the rates quoted by the tenderers. The tenders shall be opened by the purchase committee on the same day or any other working day convenient to the DLRCFC in presence of tenderers or their representatives who may wish to remain present at the time of opening of tenders. DLRCFC reserves the right to accept/reject any tender or all tenders without assigning any reason thereof. Conditional tenders shall not be accepted. Rates shall be quoted by the tenderers against each item inclusive of VAT, Tax etc and F.O.R mentioned above. 7. In case the supplier fails to make the supply in time, the Department shall be at liberty to arrange the material from other dealers/ suppliers at the risk and cost of successful tenderer, besides initiating proceedings against him as warranted under rules. In case the extra cost involved exceeds the CDR amount, the same will be recovered from the defaulting supplier. The decision of the Chairman DLRCFC (Agriculture Department) in this regard shall be final and binding upon the supplier. The suppliers shall have no right to claim such refu-nd at all. The supplier should be responsible for proper transportation of material and to ensure delivery of material in good conditions to the consignee at the destination. In the event of any damage, breakage or shortage the tenderer /suppliers shall be liable to make good such loss at the time of checking/inspection of the material by the consignee. No extra cost shall be admissible on such account. In case the supplied material is damaged or defective, the tenderer shall have to lift back the same at his own risk and cost. Payment shall be made only after receipt, verification of material and successful execution of contract by the supplier. The successful tenderer will have to enter into an agreement on judicial stamp paper of Rs. 20/= with intending Officer prior to placement of supply order issued in his/ her favour for affecting supplies by the intending Officer. The tenderer shall have to attach the copy of Sales Tax/Commercial Tax clearance certificate issued by the concerned assessing authority, if applicable. The quantity shown in the list for purchase by this department is tentative and is subjected to any increase or decrease at any time type of placing the supply order. Rates approved by DLRCFC shall remain valid for one year from the date of approval of such rates. 90% payment shall be released after receipt of material and 10% key back shall be released after ascertaining the desire germination in case of seeds/ bulbs/ corms and desired colors in case of perennials and roses. Bank commission charges on account of demand draft against due payment on account of the material shall be borne by the supplier. In case of any dispute the decision of the Chairman (DLRCFC) shall be find and binding on the both consigner and the consignee , the jurisdiction of any sort of legal litigation shall be the courts of Kashmir valley only. All other terms and conditions laid down in the J&K Financial Code regarding supplies/procurement of stores in Govt. Department shall remain applicable. 8. 9. 10. 11. 12. 13. 14. 15. 16.
