Bay-Arenac ISD Truancy Services
Referral Guidelines
Michigan Department of Education recommends that absences exceeding 10% of
the scheduled days of instruction be considered as truancy. Their belief regarding
this determination is that it becomes difficult to achieve success if a student is
missing more than 10% of the days school is in session.
The following should be considered guidelines for local districts in making truancy
referrals to the BAISD Truancy Services Program:
Truancy referrals may be made once a student accumulates 9 absences during
a semester or 6 absences during a trimester. These absences may be excused
or unexcused. Only unexcused absences will be considered by the court.
For students who are repeat offenders from the previous year, they may be
referred again once they accumulate only 3 absences in a semester.
For students who are habitually tardy, referrals may be made under the same
guidelines. Once a student accumulates more than 9 tardies during a semester
or 6 during a trimester, a referral may be made.
Once a referral has been made, a letter will be sent to the parent/guardian with
a date/time for a meeting at the school.
During the parent meeting, an agreement will be signed by the
parent/guardian, school official and truancy officer.
School personnel will notify the truancy officer of continued absences without
proper documentation.

For elementary students, if the problem cannot be corrected after working with
BAISD Truancy Services, a petition will be filed and parents will be
prosecuted. Parents may incur fines and court costs, jail time and/or
probation.
For middle school and high school students, if the problem cannot be
corrected after working with BAISD Truancy Services, a petition will be filed
with the prosecutor’s office. Parents may incur fines and court costs.
Students may incur a juvenile record and probation.
The compulsory school attendance law has changed. For students whose date
of birth is 12-1-98 or later, they must attend school from age 6 – 18.
As in the past, each local district should use their discretion in determining
when students are referred.

law requires regular and consistent attendance for students between the ages of 6 and 18. Since your child
has not yet reached the age of 6, this letter is being sent to you as a courtesy, out of concern for the education
of your child.
Even though your child is young, the amount of time they have been absent or tardy from school this year
certainly impacts their learning. Even at this early age, habits are forming with your child – whether they are
good or bad habits. The majority of students that I work with in middle school and high school had attendance
problems that began in elementary school. We are trying to focus on correcting those problems at an early
age so that they do not impact a child’s education at the higher grade levels.
If there are problems either in school or at home that are causing your child to miss school, it is important that
you discuss them with us so that we can try to help you resolve them. School personnel would be happy to
talk with you to address any concerns or problems that may be occurring.
This letter is being send to you now, as a courtesy, because your child will fall under the compulsory law next
year. If this same attendance pattern continues for the 2015-16 school year, a formal truancy referral will be
made to this office.

STATE OF MICHIGAN SCHOOL LAWS
SEC. 1561. (1) Except as otherwise provided in this section every parent, guardian, or other person in this state having control and charge of a child
from the age of 6 to the child's eighteenth birthday (6 – 18) shall send that child to a public school during the entire school year. The child's
attendance shall be continuous and consecutive for the school year fixed by the school district in which the child is enrolled. Michigan Compiled
Laws Section 380.1561(1).
SEC. 1588. The Attendance Officer, after giving the formal notice prescribed in Section 1587, shall determine whether the parent or other person in
parental relation has complied with the notice. The Attendance Officer shall make a complaint against the parent or other person in parental relation
having the legal charge and control of the child who fails to comply to the court having jurisdiction in the county of residence for refusal or neglect to
send the child to school. The Court shall issue a warrant upon the complaint and shall proceed to hear and determine it in the same manner as is
provided for other cases under its jurisdiction. Michigan Compiled Laws Section 380.1588.
SEC. 1599. A parent or other person in parental relation who fails to comply with this part is guilty of a misdemeanor, punishable by a fine of not less
than $5.00 nor more than $50.00, or imprisonment for not less than 2 nor more than 90 days or both. Michigan Compiled Laws Section 380.1599.
SEC. 1571. (3) An Attendance Officer of an intermediate school district or a local school district shall have the powers of a deputy sheriff within the
district or intermediate school district while performing official duties. Michigan Compiled Laws Section 380.1571(3).

Section 380.1561
380.1561 Compulsory attendance at public school; enrollment dates; exceptions.
Sec. 1561.
(1) Except as otherwise provided in this section, for a child who turned age 11 before December 1, 2009
or who entered grade 6 before 2009, the child's parent, guardian, or other person in this state having
control and charge of the child shall send that child to a public school during the entire school year from
the age of 6 to the child's sixteenth birthday. Except as otherwise provided in this section, for a child who
turns age 11 on or after December 1, 2009 or a child who was age 11 before that date and enters grade 6
in 2009 or later, the child's parent, guardian, or other person in this state having control and charge of the
child shall send the child to a public school during the entire school year from the age of 6 to the child's
eighteenth birthday. The child's attendance shall be continuous and consecutive for the school year fixed
by the school district in which the child is enrolled. In a school district that maintains school during the
entire calendar year and in which the school year is divided into quarters, a child is not required to attend
the public school more than 3 quarters in 1 calendar year, but a child shall not be absent for 2 or more
consecutive quarters.
(2) A child becoming 6 years of age before December 1 shall be enrolled on the first school day of the
school year in which the child's sixth birthday occurs, and a child becoming 6 years of age on or after
December 1 shall be enrolled on the first school day of the school year following the school year in which
the child's sixth birthday occurs.
(3) A child is not required to attend a public school in any of the following cases:
(a) The child is attending regularly and is being taught in a state approved nonpublic school, which
teaches subjects comparable to those taught in the public schools to children of corresponding age and
grade, as determined by the course of study for the public schools of the district within which the
nonpublic school is located.
(b) The child is less than 9 years of age and does not reside within 2-1/2 miles by the nearest traveled
road of a public school. If transportation is furnished for pupils in the school district of the child's
residence, this subdivision does not apply.
(c) The child is age 12 or 13 and is in attendance at confirmation classes conducted for a period of 5
months or less.
(d) The child is regularly enrolled in a public school while in attendance at religious instruction classes for
not more than 2 class hours per week, off public school property during public school hours, upon written
request of the parent, guardian, or person in loco parentis under rules promulgated by the state board.
(e) The child has graduated from high school or has fulfilled all requirements for high school graduation.
(f) The child is being educated at the child's home by his or her parent or legal guardian in an organized
educational program in the subject areas of reading, spelling, mathematics, science, history, civics,
literature, writing, and English grammar.
(4) For a child being educated at the child's home by his or her parent or legal guardian, exemption from
the requirement to attend public school may exist under either subsection (3)(a) or (3)(f), or both.
(5) For a child who turns age 11 on or after December 1, 2009 or who was age 11 before that date and
enters grade 6 in 2009 or later, this section does not apply to the child if the child is at least age 16 and
the child's parent or legal guardian has provided to school officials of the school district in which the child
resides a written notice that the child has the permission of the parent or legal guardian to stop attending
school.
