THE HAIGHT was built in 1890 and operated as the Elgin Storage and Transfer
Company for more than 25 years, running horse drawn buses carrying the Elgin watch
factory workers to and from their homes prior to the automobile being invented.
Over the years several businesses have occupied this space including the most recent
which was John Haight Studios a private industrial design company.
John was the patriarch of the Haight family as well as owner of the building now referred
to as THE HAIGHT.
This space and all it encompasses is dedicated to him.
Today THE HAIGHT offers it’s guests the quintessential “rustic/warehouse/loft”
experience. Our guests choose THE HAIGHT because it is truly the unique
experience they are looking for their event and their guest’s experience.
The venue offers an ambience that is smartly decorated with a nod to Elgin’s
historic and industrial heritage.
It’s a one of a kind venue in Kane County with its look and, most importantly , it’s
vibe.
It’s not the grandest venue in the area, but it is unique and in a nonintimidating
way; welcoming and comfortable. And classy.

AN ORDINANCE
GRANTING A CONDITIONAL USE TO PERMIT LAND USES
INVOLVING THE ASSEMBLY OF PERSONS
IN THE CC2 CENTER CITY DISTRICT
(166 Symphony Way)
WHEREAS, written application has been made requesting conditional use approval to
permit land uses that involve the assembly of persons within the first and second floor of the
building on property in the CC2 Center City District; and
WHEREAS, after due notice in the manner provided by law the Planning & Zoning
Commission conducted a public hearing concerning said application and has submitted its
written findings and recommendations; and
WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and
recommendations of the Planning & Zoning Commission.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1.
That the City Council of the City of Elgin hereby adopts the Findings of
Fact, dated February 2, 2015, made by the Planning & Zoning Commission, a copy of which is
attached hereto and made a part hereof by reference as Exhibit A.
Section 2.
That a conditional use to permit land uses that involve the assembly of
persons within the tenant space on the property in the CC2 Center City District at 166 Symphony
Way and legally described as follows:
Lot 3 (except the Westerly 32 feet and also except the Southerly 6 feet), reserved Lot No.
47 (except the Easterly 132 feet and except that part lying Westerly of the Easterly line of
the Westerly 32 feet of said Lot 3 extended Northerly) and the Southerly half of the
vacated alley lying Northerly of and adjoining in Phineas J. Kimball’s Jr. Second
Addition to Elgin, in the City of Elgin, Kane County, Illinois (Property commonly known
as 166 Symphony Way).
be and is hereby granted subject to the following conditions:
1. Substantial conformance with the Application and Attachments, submitted by
John Haight and Raul Negron, dated received April 18, 2014.
2. Substantial conformance with the Statement of Purpose and Conformance and
Examples of Floor Plans Layouts, as revised by Doree Haight, on behalf of the
applicants, dated received December 9, 2014.
3. Substantial conformance to the Exterior Egress Stair Project Rendering (Sheet A2), prepared by Proffit and Wallen LLC., dated January 21, 2015.
4. All graphics must meet the requirements of Chapter 19.50 Street Graphics of the
Elgin Municipal Code.
5. Compliance with all applicable codes and ordinances.

That the conditional use granted herein shall expire if not established

commonality is the word "adaptive reuse."

future of our community.

Text Amendment to Various Provisions of the Zoning Ordinance
SUMMARY
From time to time, staff becomes or is made aware of minor issues with text of the zoning
ordinance. The purpose of this amendment is to correct those minor problems within one
application before city council.
ADDITIONAL INFORMATION
This section provides an explanation of each of the proposed six minor amendments.
Amendment 1
At more than 20 locations throughout the municipal code, including the zoning ordinance,
the Community Development Department is referred to as the either the City Planning
Department or the planning department. This amendment replaces those out-of-date and
inconsistent references with “the Community Development Department” as established by
Chapter 2.28 of the Elgin Municipal Code.
Amendment 2
The zoning ordinance has no locational considerations for shopping cart corrals or electric
vehicle charging stations. This amendment would make both items permitted yard
obstructions within a street yard, a side yard, or a rear yard.
Amendment 3
The ARC arterial road corridor overlay district prohibits new and used auto dealerships
along the city’s arterial streets when the associated property is less than four acres, and
State Route 19/East Chicago Street is one of the listed city arterial streets. However, the
city has made it a point to congregate new and used auto dealerships to this area,

specifically between Willard Avenue and Shales Parkway, going so far as to allow special
sign considerations for motor vehicle dealers on lots of four acres or more. This
amendment would allow new and used auto dealerships on any sized lot along State Route
19/East Chicago Street between Willard Avenue and Shales Parkway, but it maintains the
current limit for special sign consideration to only those lots of four acres or more.
Amendment 4
The zoning ordinance provides relief from the off-street parking requirement for uses
within the center city zoning districts; however no relief from the off-street loading
requirements is afforded any uses anywhere within the city. The minimum size of a
required loading berth is 10-feet wide by 25-feet long with a 14-foot vertical clearance.
This amendment would eliminate the requirement that a use within the CC1 or CC2 center
city zoning district provide a loading berth. Note that this amendment does not mean that a
use within the downtown cannot have a loading berth; rather it simply makes the provision
of such a facility elective rather than mandatory.
Amendment 5
The zoning ordinance provides no finality for applications for zoning relief that have had a
zoning public hearing but are not acted upon by city council. This amendment establishes
that an application for map or text amendment, planned development, conditional use,
variation, or appeal is denied if the application is not approved within 12 months of the
close of the public hearing.
Next, this amendment eliminates the requirement that applicants provide as many as 12
copies of an application for planned development or conditional use. As staff and the
Planning & Zoning Commission have embraced the electronic submittal and distribution of
applications and their associated documents, a requirement to submit 12 printed copies of
an application is wasteful.
Next, this amendment eliminates the requirement that an application for planned
development have a formal concept review. Note that this amendment does not mean that a
concept review cannot take place; rather it simply makes the consultation with staff
elective rather than mandatory.
Finally, this amendment eliminates the suggestion that planned developments should have
limits to certain site design regulations when other sections within the planned
development chapter already suggest that the site design regulations shall be those
regulations provided in the most-similar zoning district which is not a planned
development. Regardless, still other sections within the planned development chapter give
city council the authority to depart from the standards, regulations, requirements, and
procedures of any other provision of the zoning ordinance.

Amendment 6
The supplementary regulations for a “residential occupation, conditional” erroneously
states that such uses are subject to the provisions of chapter 19.60, when chapter 19.60
regulates planned developments. The correct reference should be chapter 19.65, which
regulates conditional uses.
RECOMMENDATION
At its February 2, 2015 meeting, the Planning & Zoning Commission concurred with staff
and recommended approval of Petition 01-15. On a motion to recommend approval and to
adopt specific findings, the vote was five (5) yes and zero (0) no. The written findings and
recommendation of the Commission and staff are attached under separate cover as required
by the zoning ordinance.

consideration, it was determined that an amendment to Section 19.90.015, regarding the
definition and supplementary regulations for “dwelling, upper floor apartment,” is not required.
FINDINGS OF FACT
After due notice as required by law, the Planning and Zoning Commission held a public hearing
and considered Petition 01-15 on February 2, 2015. The city submitted a Statement of Purpose
and Conformance and Text Amendment Review dated February 2, 2015.
The Community Development Department and the Planning & Zoning Commission find that
these proposed revisions comply with the following purposes and intents of the Zoning
Ordinance (§ 19.05.300):
 Promote the public health, safety, comfort, morals, convenience, and general welfare;
 Conserve the taxable value of land and structures throughout the City;
 Establish standards to which building or structures therein shall conform; and

 Define and limit powers and duties of the administrative officers and bodies as provided
in the zoning ordinance.
RECOMMENDATION DETAIL
The Community Development Department and the Planning & Zoning Commission
recommend approval of Petition 01-15. At the conclusion of the February 2, 2015 public
hearing, the Planning & Zoning Commission concurred with staff and recommended approval of
Petition 01-15. On a motion to recommend approval and to adopt specific findings, the vote was
five (5) yes and zero (0) no.

AN ORDINANCE
AMENDING TITLE 17 “DEVELOPMENT IMPACT FEES,” TITLE 18 “SUBDIVISIONS,”
TITLE 19 “ZONING ORDINANCE,” TITLE 20 “HISTORIC PRESERVATION,” AND
TITLE 22 “SANITARY SEWER REIMBURSEMENT” OF THE
ELGIN MUNICIPAL CODE, 1976, AS AMENDED
WHEREAS, the development administrator for the City of Elgin filed a written
application for an amendment to the text of Title 19 of the Elgin Municipal Code, 1976, as
amended, entitled “Zoning Ordinance” to correct various minor issues; and
WHEREAS, that application for text amendment was assigned Petition No. 01-15; and
WHEREAS, the Planning and Zoning Commission of the City of Elgin held a public
hearing on February 2, 2015 and considered Petition No. 01-15; and
WHEREAS, the Community Development Department of the City of Elgin and the
Planning and Zoning Commission have submitted their Findings of Fact regarding Petition No.
01-15; and
WHEREAS, the Community Development Department and the Planning and Zoning
Commission recommended approval of Petition No. 01-15; and
WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and
recommendations of the Community Development Department and the Planning and Zoning
Commission; and
WHEREAS, other titles of the Elgin Municipal Code, 1976, as amended, including but
not limited to Title 17 “Development Impact Fees,” Title 18 “Subdivisions,” Title 20 “Historic
Preservation,” and Title 22 “Sanitary Sewer Reimbursement,” require similar amendments only
to correct similar minor issues as those identified by the development administrator within Title
19 “Zoning Ordinance;” and
WHEREAS, the City of Elgin is a home rule unit and as a home rule unit may exercise
any power and perform any function pertaining to its government and affairs; and
WHEREAS, development impact fees, subdivisions, zoning, historic preservation, and
sanitary sewer reimbursement, including but not limited to this ordinance amending the
associated text of the Elgin Municipal Code, 1976, as amended, pertain to the government and
affairs of the city.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
