NOTICE IS HEREBY GIVEN THAT, on 18 December 2015 Scottish Ministers in
exercise of the powers conferred on them by section 71(2) of the Roads (Scotland) Act
1984 confirmed the above-mentioned Order.
Copies of the Order as confirmed and of the accompanying plan have been deposited at
the following locations and may be inspected during normal working hours Monday to

The effect of the Order is stated in Notice 1501 in the Edinburgh Gazette Number
2337975 dated 22 May 2015 and in the Rutherglen Reformer dated 20 May 2015
The Order comes into operation on 4 April 2016.

For the introduction of a stopping up order

Proposal:
Stopping Up of footpaths
1.
The footpaths between Larchfield Drive, Hillhead Avenue, George Mann Terrace,
Woodend Road, Upper Bourtree Drive, and Neilvaig Drive are located between
Fernhill Road and Burnside Road, and are used as pedestrian linking routes
between the aforementioned streets.
2.
There are currently no restrictions on the footpaths between Larchfield Drive,
Hillhead Avenue, George Mann Terrace, Woodend Road, Upper Bourtree Drive,
and Neilvaig Drive.
3.
The proposed extension to the Cathkin By-pass, between Fernhill Road and
Burnside Road, closely follows the route of the existing footpath network,
overlapping with it at times.
4.
It is proposed to provide a footway adjacent to the new vehicular carriageway
and to provide a fully Equalities Act compliant remote footpath network to replace
the existing one. (For the purpose of this order it should be recognised that a
footpath is deemed as a road under the terms of the Roads (Scotland) Act 1984.)
5.
The Chief Constable and the Local Members have been consulted and have no
objections to the proposals.
6.
I recommend, therefore that South Lanarkshire Council advertises its intention to
make a Traffic Regulation Order stopping up footpaths between Larchfield Drive,
Hillhead Avenue, George Mann Terrace, Woodend Road, Upper Bourtree Drive,
and Neilvaig Drive, Rutherglen.

The South Lanarkshire Council, in exercise of the powers conferred on them by Section
68 (1) of the Roads (Scotland) Act 1984 and of all other powers enabling them in that
behalf, and having considered that the roads specified in Part I of the Schedule to this
order will become unnecessary and that suitable alternative roads will exist, hereby
make the following order:1.
This Order may be cited as "The South Lanarkshire Council (Cathkin Relief
Road, Rutherglen) (Stopping Up) Order 2015" and shall come into operation
when the alternative roads specified in Part II of the Schedule to this order are
completed and open to traffic.
2.
The stopping up of the roads in the Rutherglen area of South Lanarkshire
specified in Part I of the Schedule to this order is hereby ordered.
3.
Where there is, immediately before the date on which the said roads are stopped
up under this order, any apparatus belonging to any statutory undertakers under,
in, on, over, along or across that length of road for the purpose of carrying on
their undertaking, the said statutory undertakers shall after commencement of
this order continue to have all rights in respect of the said apparatus as they had
immediately before that date.
The Scottish Ministers, in exercise of the powers conferred by sections 71 (2)(a)(ii) of the
Roads (Scotland) Act 1984 and of all powers enabling them in that behalf, hereby
confirm The South Lanarkshire Council (Cathkin Relief Road, Rutherglen) (Stopping Up)
Order 2015.

Part I
Footpaths to be stopped up
1. The footpaths west of Burnside Road, (commencing south of the footpath at
Larchfield Drive), north-westwards to Fernhill Road, (south of George Mann
Terrace), including the linking footways between it and Woodend Road, Hillhead
Avenue, and the footpath leading to Neilvaig Drive, as shown zebra hatched on
the plans (PU/TRO/RC85/01) to (PU/TRO/RC85/05) annexed.
Part II
Alternative Footpaths
1. Footways contiguous with the new road being constructed between Burnside
Road and Fernhill Road and footpaths between the new road and Larchfield
Drive, Neilvaig Drive, Woodend Road, Hillhead Avenue and George Mann
Terrace, as shown on plans (PU/TRO/RC85/01) to (PU/TRO/RC85/05) annexed.
Statement of Reasons
It is considered necessary to make the above Order because the sections of road will
become unnecessary.
Parts of the existing network of footpaths require to be stopped up to allow the delivery
of a new transport infrastructure project which includes an enhanced network of
cyclepaths, footways and footpaths. The existing footpaths will either be severed or are
not presently suitable for all users. The project is one of the first to progress as part of
the Clyde Valley Infrastructure Fund / City Deal Initiative.
