Are You Conforming to the New MARS Rule?
Don’t Worry!! If You Are Not Conforming, It Will Only Costs You $11,000
The new MARS rule applies to all real estate brokers,
agents, title officers, etc. who try to negotiate, or
otherwise provide services, and/or venture in efforts
related to halting a foreclosure, or obtaining lender
or servicer approval of a short sale.

been in effect for over 6 months now, I am still
finding that some of my real estate colleagues are
completely unaware of neither this new law nor

the seriousness of not complying with it. Therefore
I felt that this article as well as a seminar was an
immediate and essential necessity.
The following are some of the key points covered
within this new rule:
• It’s illegal to charge upfront fees.
• You must clearly and prominently disclose
certain information before you sign people up
for your services.
• You should never advise someone not to pay
his or her mortgage, but if they choose not
to you must clearly and prominently disclose
in writing the negative consequences that
could result.
• Record-Keeping and Monitoring
Requirements.
• You must disclose key information to your
customer if you forward an offer of mortgage
relief from a lender or servicer.
• Don’t misrepresent your services.
• Homeowner has the right to reject an offer,
and no fees would be charged.
There are numerous things that you need to know
to ensure that you comply with all of the rules. Too
many to go over in one article which is why I urge
you to attend the MARS seminar that I will be
presenting on August 6, 2011. We will go over what
marketing you need to put disclosures on and the
verbiage those disclosures must have. We will also provide
specific forms that you will need to have in every file that
is going to be a short sale. You will learn what records you
have to keep and for how long. I will go over every aspect
of the MARS rule in detail to make sure you are aware of
everything needed to make certain you are in compliance.

In short, you are only left with the following three options:
1. Don’t work on short sales. (However, you August want
to get in another line of work since over 75% of listings
are short sales)

on the heels of Google’s most
recent changes to Google Doc.
Google has just made it easier
for you to stay connected to your
business files while you are on
the go. The July Google Docs
update is for web browsers using
Smartphones and tablet devices.
The update includes new drop
down categories in the navigation
bar that make it easier for users
to sort and share multiple docs
in the mobile docs list. Of
course, Google Docs is not only
for mobile devices… it’s an enormously popular
collection of online applications that you can
access for free on your desktop computer.
You may have heard about “Cloud” computing.
As long as you have an internet connection
you can access your files that are stored online
or as they call it, in the “Clouds.” It makes
collaborating easy. You no longer have to email
documents back and forth nor do you have to
store it on your flash drive and take it everywhere
with you. When your files are stored in the clouds
they are secure and you can access them from any
computer. You will never hear, “I lost that file;
can you send it to me again.”
It’s such a cool tool that the City of Orlando
became the first city in America to switch all of
its employees to Google’s Gmail last year. You
can use the Google applications for free with
limited storage. Storage is limited because
Google saves the data online or in the “Clouds”
and not your computer.
Want a free Business phone number? Google can
do that. You can forward this Google number to
any number. As an investor you can have your
business calls go to the Google number. You have
the ability to screen calls. When someone leaves a
message Google will transcribes it as well and can
send both versions to you in a text or email.

In these days of Tweets and texts, introducing
ourselves on Facebook and LinkedIn, it sometimes
seems the fine art of conversation has gotten lost.
To be a successful investor requires the ability to
gather information, assess it and then present an
offer. Once presented, we may have to address
an objection or two or even re-negotiate the
terms of our offer. All of this requires an ability to
communicate with another party, a person, a fellow
human being. More than that, we need to know
what to say and how to say it.
While technology can be a viable part of an
investment business, never forget for a minute that we
are in a people-centered business. Websites are great
for building credibility and an image. Data-mining
can help generate more and better quality leads. Drip
email campaigns help with top-of-mind awareness,
but in the end, there has to be a CONVERSATION
between buyers and sellers. I work with a lot
investors, both new and experienced, and this is where
the ‘fear monster’ rears its’ ugly head.
Do you remember being told, “Don’t talk to
strangers” when you were a kid? Many of us heard
that warning time and time again while growing up.
That’s bad programming embedded in our minds…
and it can stick around with you until you exorcise
it. The good news is that it can be done. Talking
with sellers is pretty easy once you know how.
Imagine never having that fear again! Did you know
that questions and objections can actually increase
your chances of winning a deal? It takes practice,
commitment, and persistence to develop these skills
but once you have them, you own them forever!
It all boils down to this: to build a great transaction
you have to have great conversations. Those
conversations are the foundation upon which great

deals are built. I’m talking about conversations
between principals, not middlemen. Unless they are
incredibly talented and know your mind, situation,
and preferences, how can anyone represent you as
well as you can represent yourself or the other party?
You have the knowledge, flexibility, and creativity to
solve the other party’s problem. You can choose to
walk away or stay at the table.
Transaction Engineering is about having
conversations that clarify ‘needs’ versus ‘wants.’ It’s
about knowing how to use multiple techniques to
buy and sell property because this is not a one-sizefits-all business. Options, leases, private money,
seller financing, and existing financing are all
mechanisms for buying or controlling property…
they are all possibilities to make a deal happen.
They can be used independently or in combination
to engineer great deals. The possibilities are
only limited by your creativity. The common
denominator is you have to have an interactive
conversation. One that ebbs and flows in order to
create synergy, a meeting of the minds, where both
parties contribute and both parties WIN.
Knowing what to say is only part of the equation.
Conversation has two components. One is
talking. Can you guess the other? You’ll need to
know this one too in order to have confident and
productive conversations.

longer have to email documents back and forth nor do you
have to store it on your flash drive and take it everywhere
with you. You will never hear, “I lost that file; can you send
it to me again?” Google Forms is another free tool that
can make you money. You can easily create a customizable
Google Forms to use on your house buying website. There
you can ask the sellers for their information. Google stores
the data into a spreadsheet for you... Now ask yourself how
much is it worth if you can close on one of those leads?
Let’s say you want to go see one of those leads, you can use a
Google Calendar to schedule it. You can share the calendar
with your associates so they know your availability. If you
just want people to see when you are available but not your
appointments, you can do that as well! We haven’t even
scratched the surface of what is available for you to use for
free with Google. You may already be using Gmail for your
emails. But what all of these other Google investor friendly
applications (see page 12).
