Present were Commissioners Kip Bruender, Drew Campbell, Mark Piepho, Will Purvis, and Vance Stuehrenberg. Also present were County Administrator Robert Meyer, Assistant County Attorney Mark Lindahl, and Administrative Specialist Jessica Anderson. Board Chair Kip Bruender called the meeting to order. PLEDGE All present said the Pledge of Allegiance to the Flag. AGENDA REVIEW Commissioner Piepho moved and Commissioner Campbell seconded the motion to approve the agenda. The motion carried. 2016-051 Commissioner Purvis moved and Commissioner Stuehrenberg seconded the motion to approve the following bills: For the week of January 28-February 3, 2016 totaling $1,689,758.25 For the week of February 4-10, 2016 totaling $1,409,274.87 The motion carried. 2016-052 Commissioner Stuehrenberg moved and Commissioner Purvis seconded the motion to approve the following Human Resources item: Authorization for the County Board Chairperson and County Administrator to sign the agreement with the American Federation of State, County, and Municipal Employees, AFL-CIO, Minnesota Council No. 65 (Human Service) for calendar 2016 – 2017. The motion carried. 2016-053 (Adjust Budgets Accordingly) Commissioner Purvis moved and Commissioner Campbell seconded the motion to approve the following Human Services item: Authorization for the County Board Chairperson and County Administrator to sign the agreement with the American Federation of State, County, and Municipal Employees, AFL-CIO, Minnesota Council No. 65 (Courthouse) for calendar 2016 – 2017. The motion carried. 2016-054 (Adjust Budgets Accordingly) Commissioner Stuehrenberg moved and Commissioner Purvis seconded the motion to approve the following Human Resources item: 4 Authorization to initiate recruitment for a Library Clerk (.25 FTE) (A12). (2016 New Position – Library) (Adjust Budgets) The motion carried. 2016-055 MEDICAL EXAMINER AGREEMENT Mr. Michael Maurer, Chief Deputy, presented the following item to the Board: Commissioner Campbell moved and Commissioner Piepho seconded the motion to approve an agreement with M.B. McGee P.A. as Medical Examiner for Blue Earth County effective April 1, 2016 through December 31, 2018. The motion carried. 2016-056 PLANNING AND ZONING Mr. George Leary, Land Use Administrator, and Mr. Aaron Stubbs, Land Use Planner, presented the following item to the Board: RESOLUTION GRANTING APPROVAL TO AMEND CHAPTER 14 (THE SHORELAND ORDINANCE) AND CHAPTER 24 (THE ZONING ORDINANCE) OF THE BLUE EARTH COUNTY CODE OF ORDINANCES. THE AMENDMENTS TO THE SHORELAND ORDINANCE INCLUDES THE ADDITION OF A DEFINITION RELATED TO A SMALL SOLAR ENERGY SYSTEM AND INCLUDES SMALL SOLAR ENERGY SYSTEMS AS DEFINED BY THE ORDINANCE AS A PERMITTED ACCESSORY USE WITHIN THE SHORELAND OVERLAY DISTRICT. THE AMENDMENTS TO CHAPTER 24 INCLUDES THE ADDITION OF DEFINITIONS AND UPDATES TO THE SOLAR ENERGY STANDARDS SECTION. THE AMENDMENTS UPDATE THE APPLICABLE ZONING DISTRICTS WHERE SOLAR ENERGY SYSTEMS ARE LISTED AS EITHER PERMITTED OR CONDITIONAL USES. WHEREAS, Minnesota Statutes 394.21 to 394.37, commonly known as the County Planning and Zoning Enabling Legislation, gives Counties the authority to regulate land development by adopting and amending Official Controls to protect the public health, safety, and welfare: and, WHEREAS, the Planning Agency of the County prepared an amendment proposal and completed a report pertaining to staff report PC 04-16, a copy of said report has been presented to the Planning Commission and County Board; and, WHEREAS; the Planning Commission of the County on the 3rd Day of February, 2016, following proper notice held a public hearing regarding the amendments (see Attachment A1), and following due consideration of presented testimony and information, the Planning 5 Commission unanimously voted to forward a recommendation of approval to the County Board; and, WHEREAS; the County Board of Commissioners on the 16th day of February, 2016, following proper notice held a public hearing regarding the request, and following due consideration of presented testimony and information, voted to adopt the proposed amendments; and, WHEREAS, the Blue Earth County Board of Commissioners finds that: a) The purpose of the amendments is to improve the standards related to approval of solar energy systems in order to guide the appropriate siting of these facilities to protect sensitive natural resources, safeguard existing and future land uses. b) The proposed amendments will help protect the public interest, health, safety and welfare of the County. NOW THEREFORE BE IT RESOLVED, by the Blue Earth County Board of Commissioners, that the amendments to Chapter 14 (the Shoreland Ordinance) and Chapter 24 (the Zoning Ordinance) of the Blue Earth County Code of Ordinances, are hereby adopted. These amendments shall become effective after their passage and required publication. The motion carried. 2016-057 ENVIRONMENTAL SERVICES Mr. Christopher Meeks, Land Use Specialist, presented the following item to the Board: Commissioner Purvis moved and Commissioner Stuehrenberg seconded the motion to approve the 2016-2017 MPCA County Feedlot Program Delegation Agreement Work Plan. The motion carried. 2016-058 DRAINGE Mr. Craig Austinson, Ditch Manager, presented the following items to the Board: Commissioner Purvis moved and Commissioner Campbell seconded a motion to authorize signature on a letter of support regarding a grant for treatment to improve the water quality on the County Ditch 56 system. The motion carried. 2016-059 6 Commissioner Stuehrenberg moved and Commissioner Piepho seconded the motion to accept the low bid of $596,861.50 from Dave Hulstein Excavating for improvements to County Ditch 78. Commissioner Purvis abstained. The motion carried. 2016-060 HUMAN SERVICES Mr. Phil Claussen, Human Services Director, and Mr. Jay Walters, Human Services Advisory Committee, presented the following items to the Board: Commissioner Stuehrenberg moved and Commissioner Piepho seconded the motion to approve the following Human Services items: Medica A contract to provide public health services. The contract allows Blue Earth County Public Health to bill for services, such as Maternal Child Health Visits, Nurse Education Visits, and Personal Care Attendant Services. The term of the contract is January 1, 2016, through August 31, 2016, with automatic renewal on the termination date for additional terms of two years. Improve Group A contract to provide data analysis on the SHIP Community Health Survey that is to be conducted in partnership with Mayo Health Systems. The reimbursement to the Improve Group will not exceed $1,200.00. Term of the contract is February 8, 2016, through April 30, 2016. Sibley County/Program Coordinator A contract to provide program coordination for the South Central Community Based Initiative. Sibley County will fund a part-time staff person to provide program coordination, administration, fiscal analysis, assessment of needs, and liaison duties between the Joint Powers Board and the Regional Management Team for the SCCBI. This is a new contract for a temporary employment need. The rate for the reimbursement is $32.07 per hour for 2015 and $32.87 per hour for 2016. All costs for this contract are reimbursed 100 percent through the Adult Initiative Grant (no levy funds will be used for this contract). The term of the agreement is December 14, 2015, through December 31, 2016. Sioux Trails Mental Health Center A contract with Blue Earth County as the fiscal host for the South Central Community Based Initiative in order to provide psychiatric medication management, diagnostic assessments, and urgent care services. The total amount to be paid for psychiatric urgent care and medication management must not exceed $155,703.22 annually. The term of the contract is from January 1, 2016, to December 31, 2016. Hearth Connections – Provider Contract A contract with Blue Earth County as the provider of supportive housing services for the eight- 7 county area, including Blue Earth, Brown, Faribault, Le Sueur, Martin, Nicollet, Sibley, and Watonwan Counties. The term of the contract is from January 1, 2016, through December 31, 2016. Hearth Connections – Regional Project A contract is for Blue Earth County, as fiscal host of Southern Regional Housing Project, for administrative and management of Supportive Housing Services utilizing three teams that serve the same geographic areas. The term of the contract is January 1, 2016, through December 31, 2017. Minnesota Department of Human Services: Regional Housing Grant A contract with Blue Earth County as fiscal agent of the Southern Regional Long-Term Homeless Supportive Housing Project. The term of the contract is January 1, 2016, through December 31, 2017. DHS Cooperative Agreement An agreement to operate the Child Support Enforcement Program. The agreement allows for the claim and reimbursement of FFP for eligible child support-related expenses. The term of the agreement is from January 1, 2016, through December 31, 2017. Child Support – Cooperative Agreement with Blue Earth County Attorney's Office A cooperative agreement to contract with Blue Earth County Attorney's Office and the Blue Earth County Sheriff's Office in order to fully operate and be reimbursed for child support enforcement programming. The term of the agreement is from January 1, 2016, to December 31, 2016. Committee Appointments Appointment of two community members to the Mental Health Task Force and the Human Services Advisory Committee. Piper Timmerman will join the Mental Health Task Force and is a resident of District 4. Darren Wacker will join the Human Services Advisory Committee and is a resident if District 4. The motion carried. 2016-061 Mr. Walters presented an update on the Advisory Committee. ADMINISTRATIVE SERVICES Commissioner Campbell moved and Commissioner Stuehrenberg seconded the motion to accept the low bid of $219,000.00 from Paape Companies for replacement of boilers at the Government Center. The motion carried. 2016-062 8 Commissioner Stuehrenberg moved and Commissioner Campbell seconded the motion to approve an agreement between the MN Department of Revenue and Blue Earth County for Collection of Local Transit Sales and Use Tax. The motion carried. 2016-063 Commissioner Piepho moved and Commissioner Purvis seconded the motion to approve a Multi-Agency Law Enforcement Joint Powers Agreement regarding enforcement of Internet Crimes Against Children. The motion carried. 2016-064 The January 31, 2016 Financial Status Report was presented as an informational item. Commissioner Stuehrenberg moved and Commissioner Piepho seconded the motion to adjourn the meeting at 10:44 AM.
