lack Monday of July 8, 2013 is the time when
the judges of corruption criminal act trial
found Indar Atmanto guilty of Indosat and IM2
case.
In his decision, Panel of Judges of Corruption
Criminal Act Trial led by Antonius Widjantono
sentenced Indar Amarto with 4 year imprisonment
and penalty in the amount of IDR200 million.
Meanwhile Indosat and IM2 were requested to pay
indemnification in the amount of IDR1.3 Trillion.
Even if Indosat is sentenced with one day
imprisonment, the guilty charge by panel of judges
against Indosat and IM2 cooperation in providing
Internet broadband takes everyone by surprise and
the impact is certainly extensive.

The cooperation between Indosat and IM2 which
is allowed by telecommunication regulation is
actually blamed by the general court which may not
technically understand telecommunication industry.
This Black Monday caused by Corruption Criminal
Act Trial decision will also have an impact on
the other 280 internet service providers (ISP) in
Indonesia, since almost all of them have cooperation
agreement pattern (PKS) just like that of IM2 and
Indosat.

hopes whether this Black Monday will lead to

he world of indonesia Internet enters the
dark period. The impact of IM2 and Indosat
which were found guilty by Corruption
Criminal Act Trial brings about concern of
internet doomsday in Indonesia.
If the cooperation of Indosat and IM2 is considered
as illegal, therefore the cooperations of other 280
ISPs can also be considered as illegal.
For such reason, ISPs that join Indonesia Internet
Service Provider Association (APJI) plan to return
their licences to the government due to their
concern that they will be blamed by the Attorney
and Court.
In addition to the demise of warnet (Internet
stores) there is even a larger impact, such as
critical infrastructure manager company operational
such as Pertamina and the Electric Company will
be ceased since their operationals entirely use the
Internet.

Just like living in the forest far from civilization,
despite being in the middle of the city, that’s what
it will be like if the world is without the internet.
Internet is not merely a lifestyle, it has become
a need. Several circles of people even make it as a
primary need.
One thing that is clear, if in the world suddenly
the internet dies, we will go back to the 1980’s and
suddenly we feel as if there was a natural disaster.
At this time the majority of the world population
has been acquainted with the internet, all of their
activities cannot be separated from the Internet, it
is like living in the internet world which is a taboo,

n consolidation, the government seems
to swallow its own saliva, since initially
it was on fire in driving operators to
conslidate, however when there was an
operator who intended to consolidate it spinned
out time, reviewed, and considered with a result
that would damage the operator that intended to
consolidate.
Such loss can be in the form of license
reduction, frequency reduction, or at least doubts
of foreign investors on telecommunication policy
in Indonesia. If it turns out that the license will
be reduced, the consolidation purpose which is to
optimize frequency utilization cannot be reached.
On the case of XL and Axis which intend to
consolidate, both by ways of acquisition and
merger, the obstruction from the beginning
comes from Indonesia Cellular
Telecommunication Association. It
is normal

since if Axis and XL consolidate, a
new power will emerge in the industry
of cellular in Indonesia.
With consolidation, by way of
merger, the joined operators will
own sufficient frequency, since at
this time XL is one of operators that
have entered red zone for frequency
insufficiency.With consolidation, in
addition to the solved frequency
issue, the network will also become more efficient
and users obtain better quality.
ATSI outlook which presents Telkomsel
outlook is also double standard. On the one
hand it supports consolidation, on the other
hand it also views that consolidation as well
as MVO cooperation can only be done if they
are between two equal operators, which means
operators with almost the same number of
customers and infrastructure.
If that is the milestone, then consolidation
will be difficult in Indonesia, and the purpose of
optimizing frequency which is under utilized by
mediocre operators will not be reached. On XL
case, Axis has under optimized its frequency and
it is asked by XL to consolidate to be able to
develop a joint network.
However, regulators did not directly approve,
it even provided strict signs concerning
competition, Bapepam and other reviews. If
initially operators that intend to consolidate are
scared away, then it is certain that consolidation
will be difficult in this country, since consolidation
can be considered as a forbidden matter.
XL is known to already sent an official application
letter concerning the plan of XL and Axis
consolidation to the Ministry of Communication
and Informatics. XL itself is reported to be willing
to return 5 MHz of its frequency. It is scheduled
this week there will be a principal decision from
Ministry of Communication and Informatics.
However, basically consolidation should not
be held back, it supposed to be provided with
incentives in the middle of telecommunication
industry which is unhealthy and uncertain at this

Certainly it is contradictory to the government
provision which obliges electronic system
providers to place data center in the areas of
Indonesia under Government Regulation Number
82/2012 regarding Electronic System and
Transaction Providing.
Government Regulation Number 82 of 2012
contains obligations that must be met by
electonic system providers. One of them is the
obligation for each of such providers to place data
center and disaster recovery center in Indonesia.
This covers also the providing of foreign
electronic system, such as Google, Yahoo, and
BlackBerry. Google Indonesia argued that what
was contaned in such regulation was merely public

service.
Google was requested to open itself and not
only utilize Indonesian as a market, instead also
contribute for real to the internet communty in this
country , considering that Indonesia at this time is
on the fourth or fifth place for countries that access
Google.
Even if Google obtains its server, the benefit that
Indonesia will gain will only in small portion compared
to the revenue that it gains from Indonesia eyeballs.
Probably now Google should be asked once again ,
from its total revenue, how many percent is ready to
be returned to Indonesia and in what form.
If Google is persistent with its arrogance then the
picture of China’s treatment towards Google will
emerge. In China, except Gmail, access to Google
and Youtube is often blocked by the government of
China due to such government regulation strictness.
On July 2010, Google Service was banned in most
parts of China. The government of China only allows
its people to access Gmail, an email service from
Google. The services that are fully closed
by the government of China are
web search, Google Ads, as well
as Google Mobile. On July
2011, it was China’s turn
to block a new social
network, Google+ a
couple of days after
being launched. This
blockage was caused
by the fact that
Google+ still used
google.com domain
that was still
blocked in China.
On November

y talking to Ari Santoso, we can learn
and know so much about education
and its issues in this country. It is
understandable since as Head of
Technology Communication Center of Ministry
of Education and Culture, he is closely related
to how education is in particular, how it keeps
developing and adopts the development of the
latest information technology.
The figure of Ari is very humble, but not his
works. He utilizes information and communication
to develop learning online through “Rumah
Belajar” (learning house) at http://belajar.
kemdikbud.go.is. This learning portal with
tagline “Learning is for Everyone” is visited by
thousands of students from all over this country.
It has complete feature from television and radio
streaming and learning material.
In this virtual class which he created, there have
been 12,934 complete learning materials that can
be accessed for free.
PROFIL
For learning material, Ari has tips that he used as
inspirations when he was in Germany. “I see that
each learning material is made in every 5 minutes.
Therefore if the learning material exceeds 5
minutes it will be made it into several series,”
said this Doctor who graduated from Montpellier
II University, France. This is intended in order for
the students not to get tired, since capturing
learning material is different from watching regular
movies. Having the principal not to eliminate what
has been created instead develop it, the earlier
works by Center of Technology and Communiation
such as television serial Aku Cinta Indonesia (I love
Indonesia)- ACI which was very popular in the 80s

go back home. I suggest
that Internet access be made available in school
environment. Certainly there will be many users.
However note that the school is provided with an
understanding that communities outside schools
that wish to use the internet should be allowed
to do so,” he suggested.

stated that he would respect the decision
of Corruption Criminal Act Trial. However,
the implication to the telecommunication
industry must be understood, since such decision
changes the licensing pattern of telecommunication
service provider and PKS (Cooperation Agreement)
between network and service. Consequently for the
time being licensing appllication and process
should be freezed to the time there is a
different decision or further freezed until
material test or interpretation test by
the Supreme Court is completed and
the authority of Regulator recovers.
In such decision it is stated that
Service provider can only be done
by the providers who have network
license. It means PKS between
Network provider and Service provider
is considered as against the law.
All service provider/UKM that utilize

industry and all business actors having
cooperation with Celular Mobile Network Provider
must first ask for a binding rule in religious matter
(fatwa) from Corruption Criminal Act Trial or the
Supreme Court before entering into a cooperation,
in order to avoid any lawsuit from the community
or non profit organization in the future.
Cellular Mobile Network Provider at this time
obtains providing license from the Ministry of
Communication and Informatics.

ll this time we
have often known
application, games,
music, or ring back
tone purchasing transaction
using phone credit for
prepaid customers, and bill
value increasing for postpaid
customers.
We cannot imagine how much ‘virtual’ money
spinned behind such transaction, therefore the
financial authority cannot check how large is the
money circle in such telecommunication industry.
Telecommunication industry is indeed rich in
creativity, and Indonesia is one of the countries
CYBERLIFE
which are very active in producing new content or
application in cellular segment.
We have long known about phone credit transfer
and digital money. Even now, the customers of
three opertors, namely Telkomsel (T-cash), Indosat
(Dompetku) and XL (XL Tunai) can transfer such
digital money to each other.
There are also cellular phone numbers that
are made into bank account numbers as well
as BlackBerry application which is criticized by
regulators due to the unfairness of revenue gained
by operators as its network providers.
The question is despite phone credit used as
the payment instrument, sellers still take profit.
It means, if a game is purchased offline in the
amount of IDR96,000, buyers must transfer phone
credit in the amount of IDR100,000. This IDR$,000
discrepancy is called by a number of experts as
money creation.
What needs to get attention is that phone
credit is not money both physically and digitally,
therefore until today there has not been any rule in
Bank Indonesia that allows money creation or profit
taking through sale puchase transaction using
phone credit.
Imagine if the discrepancy of IDR4,000 mentioned
earlier is “created” continually, therefore such
