AX IS Arif Pitoyo 8 Majalah ICT No. 14• July 15—28, 2013 O n consolidation, the government seems to swallow its own saliva, since initially it was on fire in driving operators to conslidate, however when there was an operator who intended to consolidate it spinned out time, reviewed, and considered with a result that would damage the operator that intended to consolidate. Such loss can be in the form of license reduction, frequency reduction, or at least doubts of foreign investors on telecommunication policy in Indonesia. If it turns out that the license will be reduced, the consolidation purpose which is to optimize frequency utilization cannot be reached. On the case of XL and Axis which intend to consolidate, both by ways of acquisition and merger, the obstruction from the beginning comes from Indonesia Cellular Telecommunication Association. It is normal TELECOMMUNICATION since if Axis and XL consolidate, a new power will emerge in the industry of cellular in Indonesia. Such search engine giant opined that server and data center placement in Indonesia was useless. Certainly it is contradictory to the government provision which obliges electronic system providers to place data center in the areas of Indonesia under Government Regulation Number 82/2012 regarding Electronic System and Transaction Providing. Government Regulation Number 82 of 2012 contains obligations that must be met by electonic system providers. One of them is the obligation for each of such providers to place data center and disaster recovery center in Indonesia. This covers also the providing of foreign electronic system, such as Google, Yahoo, and BlackBerry. Google Indonesia argued that what was contaned in such regulation was merely public INFORMATION TECHNOLOGY service. Google was requested to open itself and not only utilize Indonesian as a market, instead also contribute for real to the internet communty in this country , considering that Indonesia at this time is on the fourth or fifth place for countries that access Google. Even if Google obtains its server, the benefit that Indonesia will gain will only in small portion compared to the revenue that it gains from Indonesia eyeballs. Probably now Google should be asked once again , from its total revenue, how many percent is ready to be returned to Indonesia and in what form. If Google is persistent with its arrogance then the picture of China’s treatment towards Google will emerge. In China, except Gmail, access to Google and Youtube is often blocked by the government of China due to such government regulation strictness. It is understandable since as Head of Technology Communication Center of Ministry of Education and Culture, he is closely related to how education is in particular, how it keeps developing and adopts the development of the latest information technology. The figure of Ari is very humble, but not his works. He utilizes information and communication to develop learning online through “Rumah Belajar” (learning house) at http://belajar. kemdikbud.go.is. This learning portal with tagline “Learning is for Everyone” is visited by thousands of students from all over this country. It has complete feature from television and radio streaming and learning material. In this virtual class which he created, there have been 12,934 complete learning materials that can be accessed for free. We cannot imagine how much ‘virtual’ money spinned behind such transaction, therefore the financial authority cannot check how large is the money circle in such telecommunication industry. Telecommunication industry is indeed rich in creativity, and Indonesia is one of the countries CYBERLIFE which are very active in producing new content or application in cellular segment. We have long known about phone credit transfer and digital money. Even now, the customers of three opertors, namely Telkomsel (T-cash), Indosat (Dompetku) and XL (XL Tunai) can transfer such digital money to each other. There are also cellular phone numbers that are made into bank account numbers as well as BlackBerry application which is criticized by regulators due to the unfairness of revenue gained by operators as its network providers. The question is despite phone credit used as the payment instrument, sellers still take profit. It means, if a game is purchased offline in the amount of IDR96,000, buyers must transfer phone credit in the amount of IDR100,000. This IDR$,000 discrepancy is called by a number of experts as money creation. What needs to get attention is that phone credit is not money both physically and digitally, therefore until today there has not been any rule in Bank Indonesia that allows money creation or profit taking through sale puchase transaction using phone credit. Transactions through phone credit cutting is highly risky, since finance automatically cannot monitor the circling money. If we look at the the cooperation between banking and telecommunication companies at this time when we purchase phone credit for cellular phones through the ATM machines there is no difference between phone credit debit and digital money debit. It seems that Indonesia Telecommunication Regulatory Board has not have the legal instrument or umbrella that regulates application sale purchase by cutting phone credit, therefore consumers’ position is very weak.
