It is the exhibition season and last month we exhibited at Professional Beauty North in Manchester where we also ran an Education event for lecturers headed up by Joan Scott; supported the Careers fair and ran the Business Seminar Programme with speakers with a hair, beauty and business background. All the seminars were very well attended and as such we have been asked to run more at the ExCel show in February – another string to the Habia bow. We have also been to Olympia Beauty where we met up with many of our London and Southern based customers who benefited from great deals on training, courses and memberships and are looking forward to being at Salon International where we are on exhibition stand M220 please come and see us and benefit too. As mentioned in the last issue we are strengthening our Skills Team and I would like to thank all who expressed their interest in joining us and I look forward to telling you about new courses and seeing them in action! The Register of Beauty Professionals now has an updated website and I urge you to visit it to see the membership features and industry offers, www.registerofbeautyprofessionals.co.uk and there is a full progress update in the magazine. We have teamed up HMRC to give you the information you need to run your business in bite-size snippets and our social media links to this have proved very popular, so much so we have included some of the info in the magazine, as mentioned in the last issue we are offering Business Skills training under the Habia Business Academy so check those out – as Gill Morris is often heard saying “Being a great hairdresser, therapist or nail technician is no guarantee for business success!” The level of interest in Habia international qualifications is greater than ever so it’s an exciting time for the Habia International Section and I’m looking forward to welcoming our international partners to our stand at Salon International Although it doesn’t seem quite right to be writing about this now, I want to wish you all a great Christmas with family and friends. In particular I wish you a fabulous business run up to the festive period with the opportunity to see most of your clients and of course make lots of sales! Should you need any help with retailing do consider our ever popular Selling Skills course. Salon owners must have a pension scheme up and running by their ‘staging date’, the golive date which is assigned to businesses by the government. Many salons will have been notified of this date already in a letter from the Pensions Regulator, but some will still be waiting for their letter to arrive. Log onto the Pensions Regulator website and enter your employer PAYE number to check your staging date: http://www.thepensionsregulator.gov.uk/employers/know-yourstaging-date.aspx Auto-enrolment is a legal requirement with 3 points employers must comply with: 1. To provide all of your workers with access to a qualifying workplace pension scheme 2. To automatically enrol eligible workers into a qualifying workplace pension scheme 3. To pay a minimum level of contributions Auto-enrolment has been phased in, with the largest firms going first so hundreds of thousands of small businesses will be going live between now and 2018. It will become difficult for hair and beauty businesses to find suitable pensions schemes as the industry isn’t attractive to pension scheme providers due to the high number of small and micro businesses, where earnings are often low and wages are processed on many different software systems or even manually. So to make sure hair and beauty businesses weren’t left high and dry, the National Hairdressers Federation (NHF) set up a pension scheme specifically for salons to help owners meet their employer obligations. The NHF pension scheme is open to both members and non-members, with guaranteed acceptance for businesses on the SkillsActive beauty professional registers (quote code 1234567). The one-off registration fee to set up a pension scheme is £395 + VAT, with nothing more to pay until your staging date arrives. The Pensions Regulator advises businesses to start preparing for pensions auto-enrolment 12 months in advance. So salon owners can’t afford to leave it to the last minute. To help employers understand which members of staff have to be enrolled, what it will cost and how to prepare, the NHF runs evening events on pensions around the UK throughout the year. www.nhf.info/events. For full details about what’s involved visit www.nhfpensions.co.uk or call the NHF on 01234 831965. Shirley Davis-Fox, co-founded Bridgend-based ISA Training, said everything was perfect, as her husband, Gren, son Marc, who flew in from his home in France and step son Richard were there to witness the ceremony and share the moment with her. “I was so proud to be representing all my colleagues at ISA Training and in the hair industry because without them I would not have received the MBE,” she said. “Every step I took, I took for them as well me. “The Princess Royal was genuinely interested in what I had to say about the hair industry. It was an absolutely fabulous day and fascinating to meet all the other recipients from all walks of life. I didn’t want the day to end.” Shirley was awarded the MBE in the New Year’s Honours List for her services to the hairdressing industry. Having co-founded ISA Training in 1998, she now heads a successful company with more than 60 staff, who deliver training to around 800 apprentices in 500 businesses across Wales and the borders. The MBE recognises her tireless campaigning to promote the professionalism of the hairdressing industry, driving up standards, offering outstanding opportunities to ISA Training’s apprentices and gathering respect and recognition for the vibrant hair sector and all who are qualified and practice within it. “I feel so honoured to have received this recognition,” she said. “I passionately believe in the hair sector and the professionalism of hairdressing.” Shirley has been a member of the Hair Council since 2011, was appointed vice chair in May and is also the organisation’s political lobbyist following her successful campaigning work in Wales for the state registration of all qualified hairdressers and barbers. In 2013, ISA Training was named Training Provider of the Year in the Apprenticeship Awards Cymru and also won the Bridgend Business Service of the Year award. In the last issue of Habia News we met some of the steering group and in this issue we will meet the rest of the group. Meet the Steering Group Members - Large Employers Helen Buck, Senior HR Business Partner and Sassoon Apprenticeship Coordinator, Regis UK Ltd. Helen Buck “Apprenticeship reform is long overdue, but at last employers are being given the chance to be in the driving seat of developing programmes that meet the needs of the industry. The inclusion of an end point assessment is really going to raise standards across the board and give employers confidence that anyone who has completed an apprenticeship really is “job ready”. Stephen Kee, Managing Director at Saks Hair & Beauty “Trailblazers are the government initiative to improve apprenticeships across all vocations. In hair and beauty we’ve relished the challenge of a real shakeup of apprenticeships in our industry and for the opportunity to create a high-end apprenticeship to benefit all types of employers, both large and small, which will in turn increases the uptake of young people into our industry. Stephen continues: “Main changes include a ‘trade test’ at the end of the apprenticeship to ensure learners really are shop-floor ready by being assessed by an independent examiner who doesn’t know the employer, learner or training provider. Only at this point will they be deemed as fully qualified. We’re hoping for an opportunity of a higher level apprenticeship to be introduced, but this has yet to be decided.” Stephen Kee Cathy Weston National Director of Apprenticeships at Toni & Guy Cathy Weston 10 “Trailblazers have brought the high street into direct consultation with government and education in an effort to radically refresh the vocational hairdressing standards and embed employability and professionalism in the measured outcomes of hairdressing apprenticeships. Whilst our industry has always led from the front in the development of vocational education, hairdressing apprenticeships are now no longer just about achieving qualifications underpinned by experience in the salon, Trailblazers are also about professionalising the industry, assessing behaviours, employability and values. Trailblazers have been an amazing experience for everyone involved and who have contributed to the development of the new standards”. habia news standards and qualifications Meet the Steering Group Members - Barbering Employer and Educator Gary Machin SRSB, Director of Rogers of Chell Barber Shops Ltd, Education Director rb training uk ltd and Chairman of the Barber Council. Gary Machin “The introduction of the apprenticeship reforms in barbering, hairdressing and beauty have led to the development of a new set of standards to mould and nurture future apprentices in our sector. The apprenticeship provides them with the necessary skills and knowledge to enter our industry as professionals and help them to be more employable, equipped with the qualities salon owners expect to complement their business. I feel proud to be part of this process and think these standards will only push the boundaries of quality within the industry and lead towards a higher skilled and more job ready work force” . Meet the Steering Group Members - Small Employer, Tutor, Assessor and Internal Verifier Yvonne McConnell has been a tutor, assessor and internal verifier in the hair and beauty industries for the past eighteen years working in further education colleges and Schools as well as being a successful business owner of Phase 1 Hair, Nail and Beauty Lounge. “My passion is the Industry and the training and education of our future Hairdressers and Beauty Therapists, aimed at continuously striving to raise standards. That’s why I’m excited to be part of this fantastic new adventure for our future industry. With these new qualifications employers and apprentices can be guaranteed and will know that at the end of their training they will be job ready and will have gained a quality professional qualification”. Yvonne McConnell Meet the Steering Group Members - Educator and Employer Edward Hemming Education Director and Creative Director of Alan d Hairdressing Education Since completing his initial training in 1992, Edward has worked in the West End of London continuously, first as a Junior Stylist, Stylist, Salon Manager and in 2005, Creative Director and Director of Education for Alan d Hairdressing. He ensures the smooth running of the busy Academies in London and Ipswich, makes and changes policy, and motivates our Creative Education team. This is done using standard changes from the awarding bodies, OFSTED inspections, the weekly salon-experience and what he feels is best-practise. Success was recognised last year when Alan d were awarded Grade 2 by OFSTED in a climate of downgrades and poor performance in the education arena. Edward Hemming “I’m really excited about the new apprenticeships. I believe we finally have a qualification that apprentices in our industry deserve. We have always delivered the highest possible standards and now no training organisations will be allowed to slip, the end-test will ensure it!”. Marie-Louise Coster To become a Habia Endorsed Training Provider is a real kite mark for those providing training within our industry. There are many training providers available to learners – all with very mixed levels of experience, expertise and delivery. We have all experienced second rate training during our careers I have no doubt, at the hands of training providers who are not all that proficient in the subject matter themselves and who lack practical skill and experience. The content of the course will not have been comprehensive enough and we will have come away from training somewhat uninspired still lacking the required skills and knowledge. As a training provider it has always been my belief that training should be a stimulating and inspirational experience whereby you come away excited about what you have learnt and putting these new skills into practise. A lot of that enthusiasm will not only come from the course content but also from the trainer delivering it. There are many routes to take when accrediting and endorsing your courses but none offer the robust checks carried out by Habia when embarking on the endorsement process. Habia are the standard setting body for the hair and beauty industry, therefore it goes without saying that to be endorsed by Habia demonstrates to potential learners and employees that the level of training you provide is of the highest standard. Habia offers an independent, quality assurance check on training which is assessed by industry experts to a set criteria and national occupational standards (NOS), making endorsement second to none. Employers and individuals look for the Habia Endorsement logo because it gives them the confidence in knowing that the training they book on to is safe, effective and - most importantly - regulated. All About Mi – The Salon If you are a training provider and you want to be a market leader in training then Habia endorsement is the obvious route to take. It is not an easy route, it will require hard work and determination, but quite honestly if it was too easy it wouldn’t be worth it. There are rigorous checks and criteria to meet – quite rightly – but obtaining the endorsement at the end of the process will show the excellent standard of training provided by your establishment. For me, it was quite honestly a ‘no brainer’ to obtain endorsement because it shows my commitment to delivering first class training and allows me to stand out from the competition. Besides the kitemark that endorsement demonstrates to your competitors, students and employees there are many other benefits to being endorsed. One of the key ones being that you can register your company details and the training courses you have endorsed on the quality training portal website. This website is the unique home of training that is quality assured by Habia and Skills Active and has over 6000 unique hits per day of people looking for quality training in the UK. This will open you up to a wide audience all of whom are looking specifically for training like yours making it a great marketing tool and resource for you. As a Habia Endorsed Training provider and Chair of the Advisory Committee for the Professional Registers I wholeheartedly encourage any training provider to obtain endorsement because besides the benefits to your business, endorsement will benefit the industry as a whole in the raising of standards in the therapists we produce – and that can only be a good thing. To find out more about endorsement with Habia contact Habia on 0845 6 123555 or email sales@habia.org 14 habia news feature FACE - the Facial Aesthetics Conference & Exhibition This year, in its thirteenth year, FACE the UK’s premier facial aesthetic conference saw an array of seven concurrent agenda and workshop programmes. To assist you on the battlefield, men’s grooming expert Andy Rouillard (AKA the ‘Wax Daddy’) shares some tactical pointers on the art of manscaping. • Other clients are embarrassed about their body hair, so getting rid of unwanted tufts can have a massive impact on their self-esteem. I’ve lost track of the number of guys who have told me they feel more confident stripping off at the beach or taking their kids to the pool after taming their back and shoulder tendrils, for example. • For some it’s simply a matter of personal preference: they or their partners may prefer the smooth look. • On a practical level, a hairless body often has sports-related benefits, making waxing a great add-on service for personal trainers, masseurs and sports therapists. From wayward brows to Hobbit toes and everything in-between, guys have been shaving, plucking and trimming unruly hair in the privacy of their own homes for years. The fact remains, however, that all of these methods can be time consuming and only provide smoothness for a few days before the dreaded itch of regrowth sets in. Fortunately, male waxing is a quick and easy way of temporarily shifting unwanted body hair without the mess and fuss of creams or razors. The results not only last longer, but also bring with it a built-in bonus for therapists: hair has a habit of growing back. Although men’s waxing has always been prevalent within various sectors of the sporting community, the last few years have seen its popularity rocket outside of this arena amongst guys of all ages and backgrounds. In fact, recent research from Mintel revealed that 50% of men feel there is more pressure than ever before for them to remove or groom their body hair, with only 30% of men NOT removing any hair from their bodies in the last year. Data from the consumer hair removal giant Braun supports this, with their own research finding that 62% of all men now ‘manscape’ their body hair on a regular basis. That’s a huge potential market by any stretch of the imagination. Spurred on by media fascination with fuzz-free celebrities and gentle persuasion from partners, chaps across the UK are increasingly taking the plunge and booking themselves in for a spot of ‘border control’. Waxing is now one of the most soughtafter salon services by UK males, and the trend shows no sign of slowing down. From builders to bankers, personal reasons for waxing are as many and diverse as the guys who get it done: • Many guys find that being hair-free feels cooler, fresher and more comfortable, especially during the summer months. 20 • Guys with piercings and tattoos are also a captive audience, as waxing allows them to show off their artwork to its full potential, rather than hiding it under a bushel of hair. • Waxing of intimate areas heightens sensitivity… say no more! While furry backs, fuzzy nostrils and fluffy ears remain the most common areas singled out for deforestation, an increasing number of fellas are also opting for more extreme hair removal in the form of intimate waxing. This eyebrow-raising treatment is perhaps better known as the infamous ‘back, sac and crack’ or ‘Bro-zilian’, and it’s never been more popular. But one step at a time! Whether you are a seasoned pro or just starting out, a little insider knowledge goes a long way towards making the whole experience less painful for both you and your customers. Training in male-specific techniques is available from several providers, including Habia-endorsed workshops from Axiom Wax Academy. Always look for a trainer with commercial experience in providing waxing for men, as they will be able to give advice not just on technique, but also on pricing, marketing and retailing. In the meantime, here are a few tips to get you started. THE ESSENTIALS Your basic waxing technique will stay the same regardless of the client’s gender or body part, but there are some extra considerations when working with male clients: • Most areas of the male body can be waxed safely, with the exception of scalp and beard hair. While it is okay to remove the odd stray hair on the throat and upper cheeks to create a tidy beard line, men’s facial hair is particularly coarse and strong. In addition to the process being extremely painful, there is a real risk of infection and scarring if you try to wax the beard area, and for these reasons it is not recommended. habia news feature • Communication is king! Remember that most new male customers are likely to be feeling apprehensive, especially if their only point of reference is YouTube. Start by putting a list of ‘frequently asked questions’ on your website. On the day of the appointment, take a few minutes to explain the procedure and answer any questions your client may have before slapping on the sticky stuff, and continue to explain what you are doing as you work. • Invest in a good set of electric clippers. They are faster than scissors and pose less risk of nasty nicks when trimming. Use them to shorten long hair before waxing, which will make it easier to see the direction of growth and prevent lengthy tufts from getting tangled as you work. You can also use clippers after waxing to blend between areas of hair and freshly plucked skin, and offer body hair trimming as a secondary service on your treatment menu – they’ll pay for themselves in no time. • The back and chest areas are particularly prone to irritation and may experience acne-like breakouts in the days following treatment, especially with first-timers. Retail an antibacterial cleanser or lotion to help prevent and treat any pimples – products containing tea-tree, lemon myrtle, witch hazel or willow bark extract are good choices. • Ask male clients to bring a clean cotton t-shirt with them to change into after chest or back waxing. This can go a long way towards reducing any post-wax irritation, especially in hot sticky weather or if he is coming to you straight from work in a collar and tie. • A quick buff with an exfoliating mitt or body scrub twice a week will help stave off the dreaded ingrown hairs. For stubborn spots, a product containing salicylic acid is an excellent retail opportunity and clients can also use this to treat any razor bumps in the beard area. MARKETING YOUR MALE WAXING SERVICES • Despite its growing popularity, body hair removal is still much less of a ‘social expectation’ for men than it is for women, so we need to work harder at getting the boys through the door. It helps to be specific when selling the benefits of waxing to a male audience, for example: male waxing is popular among cyclists where hairless skin has advantages in terms of comfort and performance, whereas bodybuilders are more likely to be interested in how the removal of their hair can help enhance muscle definition. Andy Rouillard • Consider adding treatment codes to your pricelist, like a takeaway menu. This allows male customers to book an appointment without the embarrassment of others overhearing what they are having done. • If you have a barbershop or hairdressing salon, facial waxing services are a great way of extending your shop-floor grooming services and capturing a new market. A brow tidy, nostril and ear wax can quickly and easily be added to the end of a haircut or shave, and can be performed in a barbers chair without the need for extra floor space or costly equipment. Habia-endorsed training in men’s facial waxing techniques is available for barbers, hairdressers and beauty therapists across the UK through Axiom Wax Academy. THE FUTURE OF MALE WAXING • Get online. A website and social media accounts are no longer ‘optional extras’. Men shop differently to women and will often Google services before making an initial enquiry. In this day and age, any salon or therapist that isn’t on the web is pretty much invisible to the majority of potential male clients. With no sign of waxing waning in popularity, what does the future hold? I suspect we’re still several years away from seeing men discussing the intricacies of pe-jazzling over a pint and a packet of pork scratchings, but one thing is certain: male waxing is big business, and guys are currently travelling many miles to find a therapist who is willing and able to do the deed. Once they discover for themselves the benefits of having smooth, hair-free skin, men become very loyal customers and will return year-round for their monthly de-fuzzing. • List your male grooming services separately from your ladies’ treatments. This simple distinction will make male customers feel better catered for and more welcome as a result. For therapists prepared to throw open their doors to the fellas, male waxing can be an extremely lucrative and rewarding profession, and is a valuable addition to many a treatment menu. We are delighted to welcome Andy Rouillard as a new member of the Habia Skills Team. Businesses are growing and moving faster than we could ever have imagined and so too is our industry; changing and developing every day with new techniques, treatments, clinical products and research regularly emerging. What’s more, as the internet starts to play a larger part, businesses and individuals must work harder to establish a point of difference that enables you to stand out from the crowd. This is where joining the Register of Beauty Professionals is an excellent step to take, as part of your business, employment or personal strategy, enabling you to reach your goals and have a competitive advantage. What is the Register of Beauty Professionals? The Register of Beauty Professionals which is owned and operated by Skills Active, (Sector Skills Council) of which Habia is part, is supported by the government and many of the top Spas, Salons and product houses in our industry. It is an independent, public Register for individuals working in the beauty industry. It ensures that registered beauty professionals have relevant expertise and industry qualifications, so that they have the ability to perform their specific professional job roles and raises the profile of the true industry professionals. The register covers five category sectors, Beauty Therapy, Make-up, Nails, Spa and Holistic Therapies. Reassuring the Public The register is an excellent way for your customers to identify quality therapists, and to understand and appreciate your level and calibre of training. The internet gives your potential clients access to more information and therefore choice, so the register helps provide an independent benchmark to them. Membership of the Register includes an online profile and Member Directory, which your potential clients can search at will, gaining the relevant reassurance they need. They can view your profile or any individual member, specifically within a selected geographic radius, gaining a detailed insight that the individual performing their treatment or working in a particular business holds the relevant qualifications that meet the National Occupational Standards (NOS), and adhere to an Ethical Code of Conduct. This reassurance is often the information that converts a potential client into a new and regular one. Aiding the Student and Experienced Industry Professional Kim.C.A.Ford For any therapist, the register is an excellent place to show a future employer your commitment to the industry, demonstrating you are learning new skills, updating existing ones and ensuring your skills continually meet industry standards. For mature industry professionals, who don’t hold modern qualifications we have processes in place for your membership which will reflect your experience and current professional status. Once a member you should promote the fact so put it on your CV and don’t forget to add it to your social media, all of which adds to your credibility. Benefit to the Employer As an employer time is precious, and anything that saves time is a real benefit. Enhance and simplify your recruitment process. All therapists who have been independently vetted and meet or exceed qualification standards are listed online and easily searchable; by utilising the register to give assurance that the qualifications your potential employee holds are industry backed you can verify that they have the skills to do the job; view the employees ‘Active Passport Account’ to see their qualifications, attainments and career history. For students who are still studying to gain their qualifications, the register is an excellent place to profile their new qualifications, show prospective employers how they are adding new skills, and demonstrating their commitment to continued professional development. The other added bonus for the students is that membership is free if they are enrolled on a minimum Level 2 QCF Awarding Body qualification if their lecturer enrols them. Important changes to Health and Safety Law and the Self Employed Back in 2011 the government commissioned a review of health and safety legislation lead by Professor Loftstedt. His review focused on reducing the burden on business and he recommended that those self-employed whose work activities pose no potential risk of harm to others should be exempt from health and safety law. This recommendation was accepted by Government. So, from 1 October 2015, if you are self-employed and your work activity poses no potential risk to the health and safety of other workers or members of the public, then health and safety law will not apply to you. HSE are estimating that health and safety law will no longer apply to 1.7 million self-employed. What is meant by self employed? For health and safety law purposes, ‘self-employed’ means that you do not work under a contract of employment and work only for yourself. If you are self-employed and employ others the law will apply to you. You may be self-employed for tax purposes, but this may not be so for health and safety. What is a risk to the health and safety of others? This is the likelihood of someone else being harmed or injured (e.g. members of the public, clients, contractors etc.) as a consequence of your work activity So where does the self employed hairdresser, barber or beauty therapist fit into this? The Health and Safety at Work etc. Act 1974 (General Duties of SelfEmployed Persons) (Prescribed Undertakings) Regulations 2015 says: • if your work activity is specifically mentioned in the regulations above • or if your work activity poses a risk to the health and safety of others, then health and safety law still applies to you Essential Health & Safety training and support, delivered and written by Wendy in easy to understand language is now available from Habia and includes: • Salon Owner/Manager /Team awareness training - ½ day seminar with Wendy at Habia Head Office • Consultancy for your business; where you have one-to-one access to Wendy How do I know if I create a risk to others? Hairdresser – I’m a self-employed hairdresser, does the law apply to me? If you use bleaching agents, hair colours, straightening treatments or similar chemicals then yes, the law will apply to you. If you are simply washing and cutting hair, then health and safety law will no longer apply. Barber – I’m a self employed barber, does the law apply to me? If you are providing shaving services, or using chemical treatments on clients then yes the law will apply to you. If you are simply washing and cutting hair, then the health and safety law will no longer apply. Beauty therapist– I’m a self-employed beauty therapist, does the law apply to me? If you use lasers/IPL equipment, needles used to pierce the skin (electrolysis/micro pigmentation), or tinting chemicals (eyebrows/lashes etc.), then yes the law will apply to you. If you are simply cleansing/moisturising or applying makeup, then health and safety law will no longer apply. You should consider the risks your salon and services/ treatments present to clients and others who may be affected and this will help you determine if you are exempt. The examples given above are not fully inclusive and thus other treatments you provide may mean that the law still applies to you. REMEMBER this only applies to the self employed, working only for themselves. • Level 2 Award in Health & Safety for salons – our Health & Safety qualification designed specifically for the hair and beauty industry • The Habia Health & Safety Pack – one stop solution for salons, helping you to get complaint and stay up to date with legislation Call 0845 6 123 555 or email sales@habia.org for further information 37 employment law habia news Employment Law Update Habia’s Employment Law advisor David Wright looks at the issues that could affect your business. A Reference – Is it worth the effort? The reference potentially is a valuable aid to salon owners but it is frequently ignored. There are many myths surrounding the reference. This may result in employers refusing to provide references in the belief that negative ones are unlawful. References the Facts There is no legal requirement for employers to provide a reference for an employee as long as it’s a consistent policy. Similarly there is no legal requirement for salon owners to obtain a reference before offering someone a job. As a range of practices currently exist • References are taken up prior to the interview and these form part of the selection decision. • References are taken up only for the successful applicant after they have been selected –i.e. appoint subject to a satisfactory reference • References are limited to confirm the former employee worked at the salon between specific dates. Whatever position you hold it should be a matter of policy for your business and apply in all cases. Many Employers view a reference from the most recent employer as invaluable. However rigorous your selection process the current employer has practical insight of the applicants performance over a period of time. They can comment on such things as their technical skills, retailing skills and attendance record. On the other hand some employers are sceptical regarding the honesty of references they receive. Similarly when providing a reference a salon owner might not want to prejudice an employee’s chances of getting a job particularly if it has already been offered subject to references. This results in some salons refusing to provide references or only providing the most basic information. reference request to be sent by email to make it even more convenient and speed up the process. Ironically it is more likely to be completed if it is quick and easy to fill in and can be emailed back to you. Critical References It is a myth that employers cannot give a critical reference. If the comments are factual e.g Sarah received a written warning for xxx on the 1st June, or Sarah’s client retention rate was under 25%, or Sarah regularly failed to hit her target. When these are based on your own observations and are factual then there is little problem. The problem occurs when the comments are malicious or, misleading or based on 3rd party information e.g “the staff believe Sarah has a drink problem”. The Law An individual can request a copy of a reference from the employer who has received it, this is only likely to occur if an offer of employment has been withdrawn or the appointment not confirmed. In these cases it is pretty obvious something has happened since the interview. The duty on employers is to write the reference with reasonable care. So stick to the facts and stick to items you can back up. The option is open to employees to make a claim for damages at Court if they feel a reference is unjust. These cases aren’t common and typically the employee has to show the reference was inaccurate and or misleading AND that they have suffered a loss. Another even less common situation is where an employee has been dismissed because their employer has received a reference request i.e. it looks like they are leaving. This would be unfair dismissal and the employee’s route is via an Employment Tribunal. Cases are not common but a famous one relates to an employee in the insurance industry who was leaving to join a rival. The reference was bad enough to be called “a kiss of death” and the employee had the offer of a job withdrawn and was unable to find work for several years. This case went as far as the House of Lords before it was confirmed that the employer did indeed have a duty of care when providing references. Helpful Hints-Requesting a Reference If an applicant gives you details of referees then you might consider telephoning them, sometimes a good chat is far more enlightening. Offering a job subject to a reference can mean there is a delay whilst it is received and the employer might feel their hands are tied. What do you do if it is unfavourable and particularly after the new employee has started? If you simply ask for a general reference there is much more scope for a salon owner to reply in very general terms even though the wording might give you a clue that all isn’t well eg “when at work Sarah tries her best to achieve a satisfactory standard”. Why not design a short reference request form which asks specific questions? You can even attach a copy of the job description so the referee is clear of the role on offer, you can even arrange for the 38 Additional Employment Law services now available from Habia include: • Written contracts /contracts check • Letter check • Consultancy for your business Call 0845 6 123 555 for further information To stay up to date with changes to Employment Law, sign up to Habia’s Employment Law Club at www.habia.org/c/1751/employment-law Setting the standard for student kits.
