Ohio Victims of Crime Compensation Program Annual Report for FY 2005 Dear Fellow Ohioan: I’m very proud of the hard work and dedication of the men and women of the Crime Victims Services Section who have received more claims under the Victims of Crime Compensation Program in fiscal year 2005 than previous years, yet administrative costs have declined again this year. My office paid out $10.5 million in compensation this year to victims of crime which is more than a 5% increase from the previous year. I continue to aggressively seek ways to assist hit-skip victims under the Victims of Crime Compensation Program. And, our office continues to assist victims and families of victims who died or were injured by crimes of terror in Iraq. Embracing technology, streamlining the organization, and promoting efficiency have yielded measurable returns for Ohioans from our Crime Victims Services Section. In addition to the Victims of Crime Compensation Program, the section also administers a variety of other programs for victims of crime. Some of the highlights from these programs include: We furthered the Identity Theft Verification PASSPORT program by training and equipping nearly 500 law enforcement agencies so that they can participate in this dynamic new initiative. Under our Crime Victims Assistance Program, we continued to administer millions of dollars in grant funding to victim service providers. This year, we initiated a new Web site and other technological enhancements in the Missing Children Clearinghouse to aid in the expedited recovery of missing children. This report highlights the programs my office offers to help victims of crime on the road to recovery. Introduction No one ever asks to be a victim of crime. People are victimized by random chance or because they were acquainted with or related to a person who commits a criminal act. When a person commits a crime, from a legal perspective, that person acts out against the state or the community, and the victim of the crime is simply someone who happened to be caught up in events outside of his or her control. That is why, when the police arrest a criminal and that person is charged with a crime, the indictment reads “State v. …” rather than “Victim v. …” Before there was a state or a government, it was the responsibility of the victim or his family and friends to seek retribution or “justice.” In fact, the concept of a crime being different from a civil wrong is a relatively new idea for civilized society. Of course, over time, civil society grew and flourished, laws were written, police forces were created and the concept of the state catching and preventing crime was founded. For a long time, unfortunately, there was no thought for the victims of crime. The rights of the accused to a fair trial and humane treatment were developed and codified, but the place for the victim in the criminal justice process became secondary to the need for the protection of the defendant’s rights and the rehabilitation of the convict. Society seemed to forget that the innocent victims of crime were asked to bear terrible physical, psychological and financial burdens alone. Victims may have insurance, but insurance does not pay for lost wages of family members who attend the trial of the person accused of killing a sister or daughter, for example. Insurance might replace the window broken by an intruder, but it does not pay for the cost of a security system that allows a rape victim to feel safe at night. The victims or their survivors were left to fend for themselves. Crime victims were the missing pieces of the criminal justice puzzle. Eventually, victims, survivors and their advocates began to demand a place in the picture. The criminal justice system and the legislatures heard their pleas and crafted laws that ensured that not only would victims be allowed to be active participants in the investigatory and judicial processes, but that they were entitled to be compensated for their losses. Crime Victims Compensation Services to Victims Since its inception in 1976, the Ohio Crime Victims Compensation Fund has paid out more than $257 million to victims and their providers. The compensation fund provides applicants up to $50,000 for their economic losses resulting from personal injury as a result of a violent crime. In Ohio, the Victims of Crime Act (ORC §§ 2743.51 to 2743) allows crime victims to apply for an award of reparations for economic loss suffered as a result of the criminal act. Once a court-based, multi-layered format involving the Attorney General’s Office and the Ohio Court of Claims, the program has been operated solely by the Attorney General’s Office since July 2000. Since then the program has decreased delays in processing claims, decreased the number of decisions appealed and reduced administrative costs. Applications for reparations may be filed in person, online or by mail. Applicants may represent themselves or be assisted by attorneys. Attorneys are not permitted to charge applicants for their legal services, but they may make application to the program for compensation of their legal fees at a rate of $60 per hour. Once a claim is filed, the statute requires that it be investigated. During the investigatory period, a field 1 specialist collects information about the underlying crime. A criminal history specialist works with the Bureau of Criminal Identification and Investigation (BCI) to verify that the victim, or any of the applicants, does not have a disqualifying conviction or disqualifying acts of criminal conduct. Also, an economic loss specialist reviews the claimed losses, identifies other available sources of benefits, and performs the economic loss calculations on the claim. After the reviews are completed, the claim is assigned to an assistant attorney general who prepares the Finding of Fact and Decision. If an award is granted, payment is rendered to the applicant and/or providers of service to the victim as appropriate. If an applicant does not agree with a Finding of Fact and Decision, the applicant (within 30 days of the decision) may file a Request for Reconsideration to have the claim reviewed once again by the office. The Attorney General has 60 days to conduct the additional review and render a Final Decision on the claim. If the applicant does not agree with the Final Decision, the applicant may file an appeal to have the claim heard before a threecommissioner panel of the Court of Claims of Ohio within 30 days. Arguments and new evidence, including testimony, may be presented at the hearing. The commissioners render a written decision, which may be appealed to a judge of the Court of Claims. No new evidence can be presented at the hearing before the judge, and the judge may overturn a panel’s decision only in those instances where the panel’s decision is against the manifest weight of the evidence or is contrary to law. In Fiscal Year 2005, 7,062 claims were received compared to 6,987 in the previous fiscal year. Only 119 decisions were appealed to the Court of Claims. Having less then 2 percent of decisions appealed demonstrates the quality of the decisions being written. The average processing time for an application was 125 days. The total number of awards paid was 3,181 compared to 3,017 the previous year. The average award paid was $3,302.45. The chart that follows as well as Appendix A on page 20 give more detail about applications and awards. The amount of the awards granted increased 1.75 percent from $10.2 million in Fiscal Year 2004. The positive impact can be attributed to more decisions rendered over last fiscal year. Total number of awards paid increased 5.44 percent from 3,017 in Fiscal Year 2004 to 3,181 in Fiscal Year 2005. The following charts provide more details of the total. Also, a list of every claim that received an award in Fiscal Year 2005 is included in Appendix B on page 21. By embracing technology and adopting innovative methods, the Crime Victims Services Section strives to maximize the productivity of the resources at our disposal to provide top quality service to our clients and constituents. Streamlining the organization, encouraging forward thinking and promoting efficiency have yielded measurable returns for Ohioans. In Fiscal Year 2005, total administrative costs were $6.9 million compared to $7 million in Fiscal Year 2004. Since 2000, administrative costs have decreased over $870,000. Despite lowering administrative costs, the section continues to process a large number of claims in an efficient and timely manner. Under the Sexual Assault Forensic Exam (SAFE) Program, the Office reimburses medical facilities for each rape kit completed in compliance with established state protocol and examinations for the purpose of gathering evidence for possible prosecution. The SAFE program reimburses at a rate of $532 per kit or examination. Reimbursement increased 1.65 percent from $3.4 million to $3.5 in Fiscal Year 2005. Year SAFE Payments SAFE Payment 2000 $0.00 2001 $1,773,500 2002 $3,030,000 2003 $3,179,000 2004 $3,448,164 2005 $3,506,092 Sexual Assault Nurse Examiner/Sexual Assault Response Team In conjunction with the Ohio Chapter of the International Association of Forensic Nurses and the Ohio Department of Health, the Attorney General’s Office has created a video that helps train Sexual Assault Nurse Examiners – nurses who have been specifically trained and educated to provide comprehensive care regarding the specific medical and forensic needs of sexual assault patients. These nurses united with other medical professionals to create a Sexual Assault Response Team, which explains the medical treatment and legal processes, offers options for the prevention of disease and provides counseling and referrals for victims. Payments for Legal Assistance Private attorneys who represent victims with their Ohio Victims of Crime Compensation Program applications may be paid at a rate of $60.00 per hour from the fund. This payment does not reduce any award granted to the victim. In addition, victims may be reimbursed for attorney fees incurred to separate victims from their offenders. This includes obtaining offender repayment, reimbursement and restitution. The unit also recovers money awarded from lawsuits and insurance claims when a Crime Victims Fund claim has been paid. Subrogation collections decreased from $488,936 to $344,028 in Fiscal Year 2005. This past year the Ohio Supreme Court overruled the Scott Pontzer case, which significantly reduced the amount of insurance available to victims through their employer. This decision adversely affected the Subrogation Unit. Despite this development, collections from individual offenders required to reimburse the crime victims fund continues to increase. The Crime Victims Fund Remains Healthy The Crime Victims Fund remains healthy at $42.3 million. Funding provided by CVA helps support direct victim services such as rape crisis centers, domestic violence shelters and criminal justice advocacy. Other services provided by CVA include TWO DAYS IN MAY, an annual conference for victim advocates providing training for those who assist victims in the aftermath of crime, coordination of activities in Ohio for National Crime Victims’ Rights Week and to provide training to victim service providers. Federal Victims of Crime Act The Victims of Crime Act (VOCA) was passed by Congress and signed into law by the President on October 12, 1984 and later amended by the Children’s Justice and Assistance Act of 1986, the Anti-Drug Abuse Act of 1988, the Justice Appropriations Act of 1994 and the Violent Crime Control and Law Enforcement Act of 1994. The original statute was the product of the President’s Task Force on Victims of Crime. The Task Force concluded that the needs of crime victims could be adequately met only by federal, state and local governments, in conjunction with the private sector, sharing the responsibility of providing victims assistance. The Act established within the U.S. Treasury a separate account known as the Crime Victims Fund. The Fund is generated entirely by fines, penalty assessments, forfeited appearances and bail bonds collected by the federal government. The Attorney General of the United States is designated as the administrator of the Fund. Services to Victims Advocates The State Victims Assistance Act (SVAA) was passed by the Ohio Legislature and signed into law by the Governor on June 27, 1984. The Bill was one of several proposals made to address the needs and rights of victims of crime at the state level. This Act established within the Office of the Ohio Attorney General, the Crime Victims Assistance Division (CVA). They are charged with two primary responsibilities: 1. To determine crime and delinquency victim service needs and policies and to exercise leadership in the qualitative improvement of crime and delinquency victim programs in the State of Ohio. 2. To determine which victim assistance programs will receive state financial assistance from the Crime Victims Reparations Fund as appropriated by the Ohio General Assembly The SVAA also established the State Victims Assistance Advisory Board. The Board is appointed by the Attorney General and consists of sixteen members and four ex-officio members. It serves in an advisory capacity in determining victim service needs and establishing policies that seek to improve the quality of victim service programs who receive funding. It is also charged with the responsibility of reviewing local victim assistance programs and to recommend which programs should receive financial assistance under the SVAA. Appendix D, on page 41, shows the distribution of SVAA and VOCA grants, by county, for the Federal Fiscal year (10/1/04 - 9/30/05). The Application Process The CVA Division distributes and makes available on-line in March of each year, “Guidelines and Application Procedures” for the Victims of Crime Act Grant Program and the State Victims Assistance Act Program. Applications are reviewed by staff and presented to the Advisory Board, who review each application and make funding recommendations. Final decisions as to recipients and funding levels are made by the Attorney General. Letters of Determination, Grant Awards and Acceptance forms are mailed to the approved recipients by midAugust of each year. The funding period is 12 months beginning October 1 through September 30. Grants under $5,000 may be disbursed by the CVA Division in lump sum payment and those more than $5,000 are typically disbursed in monthly payments. All funds must be expended before September 30. 8 Applicant Eligibility To be eligible to receive funding, a program or organization must provide services that directly benefit individual victims of crime. Further, the entity: 1. Can be a new or existing program. 2. Must be incorporated in the State of Ohio as a non-profit corporation or established by a unit of state or local government. 3. Must provide services that meet the needs of the racial, ethnic and socioeconomic diversity of the community or region served. Types of programs include, but are not limited to, rape crisis centers, domestic violence shelters, child abuse treatment facilities and other community based service organizations. In addition, public and nonprofit organizations such as criminal justice agencies, religiously affiliated organizations, hospitals and emergency medical facilities and other state and local public agencies such as mental health service organizations, legal services agencies and public housing authorities are also eligible to receive funding with the stipulation that they include components within the organization specifically trained to provide direct service to victims of crime. Funding and Reporting Requirements Grant recipients must submit monthly and/or quarterly financial reports to the CVA Division and are required to maintain complete and accurate financial records which are subject to federal audit requirements in certain circumstances. Two Days In May Conference Two Days in May brings together crime victim advocates in the fields of victim service providers, law-enforcement, social workers, criminal justice officers and Ohio prosecutors, offering a number of educational workshops on topics ranging from sexual assault to murder. This year’s conference was held May 9-10, 2005. It was sponsored by Action Ohio Coalition, Mothers Against Drunk Driving, Ohio CASA/ GAL Association, Ohio Coalition on Sexual Assault, Ohio Domestic Violence Network, Ohio Network of Child Advocacy Centers, Ohio Prosecuting Attorney’s Association, Ohio Victim Witness Association and Parents of Murdered Children. Attorney General Jim Petro honored four Ohio crime victim advocates with a Special Achievement Award during his 2005 Conference on Victim Assistance. Award winners included Molly Burchfield (Athens County), Patty McCarter (Jackson County), Theresa Singleton (Hamilton County) and Abigail Wexner (Franklin County). “Each of these leaders has displayed an extraordinary dedication to crime victim advocacy,” Petro said. “I sincerely congratulate each award winner.” In 1997, Burchfield joined the Athens City Police Department to focus on domestic violence concerns in the community. Teaming with a sworn police officer, she monitors area domestic violence intervention programs, assists victims in working with the police, helps victims 9 understand and receive assistance from local agencies and investigates domestic violence cases. Burchfield has also assisted other Ohio communities in setting up both shelters and domestic violence prevention and protection programs. Jackson County Sheriff’s Deputy McCarter has faced difficult times of her own, but she has always remained a devoted crime victim advocate. In 1994, she became the investigator for all sex abuse cases in Jackson County. In 1998, she was diagnosed with leukemia. While undergoing treatment; she would continually check the status of her cases and keep in touch with the victims. She also started a TRIAD program to educate the public on issues affecting the senior members of the community. TRIAD is cooperation among law enforcement, seniors and the community striving to reduce criminal victimization of the elderly. As the Director of Protection from Abuse at the Cincinnati YWCA, Singleton has seen first hand the results of destructive relationships. With a strong focus on education as prevention, she has developed, coordinated or given more than 350 presentations dealing with domestic violence. Her latest education initiative came in 2004 when she was the Executive Producer of Batterers Will Kill. This video was created with a goal of helping social service providers learn the signs and indicators of “Intimate Partner Homicide” in order to prevent it from happening. Wexner is an involved and compassionate advocate for abused women and children of central Ohio. In 1998, she joined with other central Ohio community members to create the Columbus Coalition Against Family Violence. This organization is committed to breaking the cycle of violence in homes, schools, businesses and neighborhoods. She also founded and serves as the chair of the Center for Child and Family Advocacy. It is the nation’s first center of its kind to integrate treatment and services for domestic violence and child abuse victims. Abigail Wexner speaks at the TWO DAYS IN MAY conference All nominees must have at least five years experience in victim assistance. They also must serve victims in at least one of the following disciplines: child advocacy, judiciary, domestic violence/violence against women, law enforcement, sexual assault, prosecutor-based victim assistance and general victim services. The award winners’ work must increase public awareness of the rights and needs of crime victims, show selfless dedication to his/her particular conviction, show creativity and/ or innovation and encourage diversity in addressing the needs of crime victims. National Crime Victims’ Rights Week This year’s theme for National Crime Victims’ Rights Week was “Justice Isn’t Served Until Crime Victims Are” and was held April 10-16, 2005. More than 1,100 victim service providers participated. The CVA Division coordinates this activity by providing victims and service providers with a comprehensive county-by-county guide to events, seminars, training workshops and exhibits being held across the State of Ohio in recognition of and support for victims’ rights. Crime Victims’ Rights Information Picking Up the Pieces: Your Rights & Responsibilities As A Crime Victim is a publication that identifies and explains the rights of crime victims in Ohio. It is written in an informal and easy to read format and provides 10 the Ohio Revised Code Chapter and Section numbers for those wishing to research the laws of Ohio that govern the rights of crime victims. The publication is available in English and Spanish via on-line at www.ag.state.oh.us/online_publications/crime_victims_services/index. htm or by calling (800) 582-2877. VINE The Victim Information and Notification Everyday (VINE) statewide project is a free, anonymous, computer-based service that provides victims of crime with two important services: Information and Notification. The project is funded through a VOCA grant and is coordinated with the Buckeye State Sheriffs’ Association, the Ohio Prosecuting Attorneys’ Association, the Ohio Department of Youth Services (ODYS) and the Ohio Department of Rehabilitation and Correction (ODRC). VINE is an automated telephone system that permits callers to stay informed about the status of an offender housed in a county jail, ODRC or DYS facility. They can find out about the transfer, release, escape or death of an inmate, an inmate’s custody status and location and about upcoming court events. Callers may also register for automatic notification of this information via telephone, e-mail or pager. VINE links county sheriffs and statewide correctional facilities to make this information available 24 hours-a-day, 365 days-a-year. Anyone may call the toll-free VINE Hotline at (800) 770-0192, which is available in English and Spanish. When completed, the service will electronically link all of Ohio’s county courts, county jails, state prisons and juvenile facilities to the VINE National Call Center in Louisville, Kentucky. Identity Theft Verification Passport Program Identity theft, which occurs when someone uses another’s personal information to obtain credit or evade criminal liability, is quickly becoming one of the most common types of fraud. Its victims can spend an enormous amount of time cleaning up the mess the thieves have made of their good name and credit record. Until now, those affected by identity theft have had few ways to establish their innocence and reassert control over their information. Attorney General Jim Petro’s office is taking innovative action to fight this particularly harmful form of crime. As part of his duty to assist victims of crime, he has brought together a coalition of agencies with the special mission of helping identity theft victims through a unique program called the Identity Theft Verification PASSPORT Program. Under the PASSPORT Program, victims reporting ID theft to local authorities will be given step-by-step information about how to alert creditors to fraudulent activity in their names and simple, fill-in-theblank affidavits to send to credit bureaus and creditors. The cornerstone of PASSPORT is the card victims can show to creditors and law enforcement personnel establishing that they have been victimized. Law enforcement agencies and creditors can verify the validity of the PASSPORT by calling (877) VERIFY-IT. Law enforcement will also be able to access all information provided during the application process, including the original police report, digitized fingerprint, photograph and signature of the victim through the Ohio Law Enforcement Gateway. 11 Sara Schaffer (center) received the first PASSPORT identification card from Jim Petro In concert with the Ohio Peace Officer Training Academy, also operated by the Attorney General’s Office, instructors visited local law enforcement offices and provided hands-on instruction in how to generate an identity theft report. Between December 2004 and August 2005: • 1,189 officers were trained. • 517 agencies were trained. • 494 agencies were equipped with the hardware and software necessary to run the program. • 283 PASSPORT applications were received. • 196 Passports were issued. A unique program in the United States, funding for PASSPORT comes in part from a grant by the United States Department of Justice. We are confident the PASSPORT Program will serve as a model for other states in their fight against this serious criminal threat. Missing Children Clearinghouse The Ohio Missing Children Clearinghouse (MCCH) acts as a central repository to coordinate and improve the availability of information on missing children to aide in their recovery. MCCH assists in the search for missing children, handles supplemental cases, creates public awareness of pertinent issues and develops and disseminates educational information about missing and abducted children. The MCCH staff operates a toll-free hotline, (800) 325-5604, which receives tips, sightings and calls for information from law enforcement, parents, relatives of missing children, concerned citizens and various non-profit organizations. The MCCH provides referral information and literature, generates posters of missing children, provides child safety information and training, assists parents and law enforcement and verifies missing children’s information in the FBI’s National Crime Information Center. AMBER Alert and Training AMBER Alert, patterned after the successful Dallas, Texas AMBER Alert Plan, came into place in 1996 in honor of Amber Hagerman, a 9-year-old girl, abducted and murdered by a stranger. The Ohio Missing Children Clearinghouse and the AMBER Alert Steering Committee have worked tirelessly on training efforts. More than 850 of Ohio’s law enforcement personnel, media, emergency management agency personnel and victim advocates took advantage of the eight regional AMBER Alert training sessions: Nelsonville, Cincinnati, Garfield Heights, Youngstown, Lima, Cambridge, Swanton and Clayton. In addition, many local AMBER Alert training sessions have taken place. An online AMBER Alert/missing children training module was made available to law enforcement personnel through the Ohio Peace Officers Training Academy portal of OHLEG. The AMBER Alert/ Missing Children workshop at the Attorney General’s Law Enforcement Conference trained officers from across the state. The U.S. Department of Justice hosted its National AMBER Alert Conference, September 8 – 10, 2004, at the Hyatt Regency Hotel. Ohio’s participants included local and state AMBER Alert Plan steering 12 committee members, local team members and U.S. Attorney Greg Lockhart, Southern District of Ohio. Attorney General Jim Petro provided the opening remarks at the conference and our office cofacilitated a workshop for the attending state clearinghouses. The Ohio AMBER Steering Committee meets several times each year including a meeting which took place on October 7, 2004. Responsible for implementing Ohio’s AMBER Plan, the group launched a toll-free phone number, (877) AMBER-OH. Anyone in Ohio may call this phone number and obtain information on active AMBER Alerts, or report possible sightings of abducted children when an alert occurs. The emphasis on AMBER Alert is paying off as the program has proven itself successful in the recovery of many of Ohio’s abducted children. A synopsis of a successful recovery follows: On July 26, 2004, four children, ages 10, 6, 4 and 2, were taken from Miamisburg, Ohio, by their step-grandfather. He had told the children’s parents they were going to the local park. When they did not return at the prearranged time, they notified the authorities. Learning that the suspect was a convicted child molester and could possibly harm the children, law enforcement issued an AMBER Alert. A motorist saw a sign posting the AMBER Alert information and noticed that the vehicle in front of him was the car pursued by police. The driver called 911 and the police soon caught up with the vehicle. Upon apprehending the grandfather, they recovered the children safe and unharmed. Governor Taft honored this citizen and others for their heroic recovery acts at the National AMBER Alert Conference. Truckers Helping to Recover Ohio’s Missing Children On January 16, 2004, Attorney General Jim Petro launched an initiative that is ongoing throughout fiscal year 2005 which provides the ability to go beyond the normal protocol when searching for missing children. It is issued simultaneously with an AMBER alert or when an AMBER alert may not be issued but the missing child meets the trucker’s advisory criteria. Through the cooperation of Ohio’s trucking industry, law enforcement has additional means of searching for children who have been abducted by a stranger or a family member, locate runaways who are believed to be endangered, or to locate a child who is lost or has gone missing. MCCH/Ohio Law Enforcement Gateway Automation System The Ohio Law Enforcement Gateway (OHLEG) is a one-stop, secure web-based crime fighting and information tool that provides law enforcement agencies with a single location for information on missing children. Enhancements to OHLEG have streamlined the process for distributing information about missing children in Ohio, as well as increase the audience that receives notification. • Ohio Citizens Alert Network (CAN) – The public may go to the Ohio AMBER Alert Web site at www.ohioamberplan.org to sign up to receive AMBER Alert e-mails and SMS text messaging to their cellular phones. • Screensaver of Missing Children – A screensaver is available to that includes rotating photographs of missing children. 13 OhiO laW enfOrcement gateWaY • Desktop Pop-up Message – A downloadable agent will provide a pop-up message for an issued or updated AMBER Alert. This Web site is the official Internet source for Ohio missing children information for law enforcement. This application is a critical missing child response program that utilizes the resources of law enforcement agencies and media to notify the public of abducted and endangered children. This application is dedicated to keeping the law enforcement and the public informed about currently activated Alerts. Public awareness to Alert information is intended solely for the edification of the public and the safe return of abducted children. Fingerprinting Cross Match Technology graciously provided their child identification system that captures a photograph, vital demographic and medical information, along with the child’s 10 fingerprints onto a wallet-sized card for parents. The Attorney General’s Office used the system to provide identification cards to hundreds of children visiting the Ohio State Fair. A Child Is Missing, Inc. Children receive fingerprint identification cards from the Attorney General’s Office at the Ohio State Fair. This first responder program provides law enforcement the ability to notify one thousand residents, in one minute within a geographical area of a missing child, elderly person with Alzheimer’s disease, mentally challenged or disabled person that needs located. Code Adam This child safety program assists businesses and public facilities in preventing child abductions from their premises. The MCCH, in conjunction with the National Center for Missing and Exploited Children, continue to promote this program encouraging others to implement this plan into places where children may visit. Web site MCCH maintains a Web site, www.mcc.ag.state.oh.us, which feature posters of known missing children for public viewing and printing, in hopes of identification and recovery. The Web site also contains useful links, publications and safety tips. Inter-State Enforcement Agencies to Recover Children Advisory Council MCCH participates in the Inter-State Enforcement Agencies to Recover Children Advisory Council (I-SEARCH) which is an interstate network of 13 Midwestern states designed to aid in the improved safety, identification and recovery of missing children. 14 Victims’ Stories Lake County Sheriff’s Deputy David Garden On June 2, 2004, 50-year-old Lt. David Garden of the Lake County Sheriff’s Office was working his post-retirement job as a full-time security officer for the common pleas courtroom. On that date, a jury trial was concluding regarding a defendant charged with two counts of Felonious Assault. When the offender was found guilty by the jury, Lt. Garden attempted to take him into custody, but the defendant ran towards the jury box and pulled something out of his pocket. When the lieutenant caught up to him, the defendant stabbed Lt. Garden in the leg with a knife that he had hidden on his person. The lieutenant sustained injuries to his knee and had to have 16 staples in his left leg. He was disabled as a result of this incident for six months. The defendant later admitted that he had planned several days in advance to take a female hostage if he was convicted. (There were three women in the courtroom at the time who could have been singled out by the defendant, including a pregnant assistant county prosecutor). Lt. Garden suffered a severe laceration in his thigh requiring 16 staples to close the wound. Off work for approximately five months, Lt. Garden lost more than $10,000 in wages between what his disability insurance paid and what he would have earned on active duty. After he applied to the Ohio Victims of Crime Compensation Program, Lt. Garden was awarded $10,153.53 in lost wage compensation. He is now back at work. 15 David Garden with wife Kay Garden and daughter Michaela Garden on a sightseeing trip. Anthony Eble For as long as he can remember, Anthony Eble has had a passion for music. A freelance musician with a bachelor’s degree in Jazz Studies from the University of Akron, Anthony is well known to fans of the thriving Cleveland music scene. His guitar work has been featured in many local venues, and also with the New York-based world music ensemble, Ghetto Gitano. Tony Eble (center) playing guitar. On June 24, 2003, Mr. Eble’s life was changed forever when he became the victim of an attempted car-jacking. During the robbery, the perpetrator shot Mr. Eble in his arm and his foot. The injuries prevented Mr. Eble from practicing his beloved art, which only made his victimization that much worse. With fortitude, patience and the financial assistance of the Ohio Victims of Crime Compensation Program, which made up lost wages, Mr. Eble embarked on an arduous, two-year recovery and eventually reported that he has returned to performing. A letter from Anthony Eble sent to Jim Petro on July 25, 2005. 16 Jeffrey Thompson Jeffrey Thompson of Dallas was a mountain of a man with long brown hair and a thick beard. His size and appearance, and the fact that he loved heavy metal music might have scared off some people, but those who knew Jeffrey understood that beneath the gruff exterior was a correspondingly large heart and generous soul. Jeffrey was proud of his Scot heritage, but no one who saw the 6-foot, 7-inch, 375-pound man in his beret and plaid kilt would ever have assumed that he was anything other than a powerful, good man. Children, who seem to know never to judge a book by its cover, gravitated to Jeffrey at the heritage festivals where he would perform and compete, and he was always happy to spend a moment explaining the significance of his outfit and instruments. Children gravitated to Jeffrey Thompson. On December 8, 2004, Jeffrey was on the road with his favorite band, Damageplan, which was appearing at the Alrosa Villa club in Columbus, Ohio. Jeffrey worked as a bodyguard for the group, which had a national following and was on its way toward achieving great things. The venue was small, but it was good, because the Alrosa was known as the launching pad for some of rock’s greatest acts. The crowd was enthusiastic and the band had just begun playing when an angry, mentally ill fan rushed the stage with an handgun and began firing. Jeffrey took his job as a bodyguard seriously, and had often joked with the band that “he would take a bullet for ‘ya.’” Instinctively, as the mayhem started, Jeffrey did what he was supposed to do, but tragically, he was killed in the attack. The Ohio Victims of Crime Compensation Program was able to award Jeffrey’s father $3,869.72 toward funeral expenses, flowers for the funeral home and a burial plot for his final resting place. Although Jeffrey resided in Texas, his claim was eligible for compensation through the Ohio Victims of Crime Compensation Program because, under the statute, if the crime occurs in Ohio claims are eligible for consideration regardless of the victim’s permanent residence. That night of tragedy was also a night of heroism. Surviving band members credited Jeffrey with saving their lives, and the Columbus police officer who was the first responder to the scene selflessly placed himself at risk but still managed to stop the carnage by shooting the assailant. Jeffrey’s self-sacrifice helped ensure that others would live. Jeffrey will not be forgotten. As long as friends gather to laugh and play music, giant men compete in acts of strength, and people unite to honor their heritage, Jeffrey Thompson will be remembered. 17 Jeffrey Thompson performing at a heritage festival. Katherine Zarate Almost every victim of a crime asks the same question, “Why me?” This is one of life’s imponderable issues, for which there is no satisfying answer. The most tragic and frustrating response is that a person is simply in the wrong place at the wrong time. In reality, there is no “wrong place” or “wrong time.” If we can learn anything from studying victimization it is that all of us have a right to live our lives, to go where we can and to do what we should. To tell a victim of a crime that he or she was “in the wrong place at the wrong time” implies that the victim was someplace he or she should not have been or was in some way complicit in the act. More often than not, random chance designates who is a victim of crime. Although many victims know their attackers, most are just targets of opportunity to criminals. Sometimes the criminal is after something, as in a robbery. Other times, the offense simply defies description. Such is the case of Katherine Zarate. On July 12, 2004, an unknown assailant began firing a gun into a group of people, hitting her in the leg. Katherine’s recovery included nearly a week in the hospital, and missing almost a month of work. The Ohio Victims of Crime Compensation Program was able to award Katherine $3,238.61 following this incident, including $891.18 for her lost wages. A letter sent from Jason and Katherine Zarate to Ohio Victims of Crime Compensation on February 11, 2005. 18 Amy Jones Amy Jones is a strong role model not only for victims of crime, but for anyone who has ever seen an injustice and chosen to do something about it. In July 2004, Amy’s marriage to her then-husband, Christopher Rezos was failing because of his physical abuse. Amy met with him at a hotel to discuss their divorce and Rezos responded by attempting to bludgeon her to death and drown her in a bathroom. She was fortunate to survive the attack and Rezos was put in jail. He was subsequently released on $100,000 bail without ever appearing before a judge, and plotted to strike again. Two weeks after his initial attack, Rezos hid in Amy’s van and when she got in, he shot her twice in the head. Again, Amy was strong enough to survive, but even from his jail cell Rezos tried to finish what he had started. He hired who he thought was a hit man to kill Amy, but the killer turned out to be a police officer. For his crimes, Rezos was sentenced to 30 years in prison. Amy has not only chosen to go on with her life, but she has become a spokesperson for victims of domestic violence and an advocate for victims who are physically disfigured by their abusers. She was never unwilling to show the world what an abused victim looks like and urged a change in Ohio law that now prevents persons accused of domestic violence offenses from being released on bond without a hearing. She fought vehemently for the passage of House Bill 29, which came to be known as “Amy’s Law.” The new law, which Governor Taft signed on May 25, 2005, requires judges to consider the severity of the incident and the offender’s mental health when determining bail in domestic violence cases. Previously, judges were required only to consider whether it was the offender’s first offense. Through two separate claims (one for each incident), the Ohio Victims of Crime Compensation Program was able to award Amy a total of $6,907.40 toward her lost wages and medical expenses. Conclusion Victims of crime have the right to feel safe, to express their feelings and emotions in healthy ways, and the right to be informed about their role in the criminal justice process. Attorney General Jim Petro’s Crime Victims Services Section helps those whose lives have been touched by crime to begin the healing process. Government agencies provide many essential services to their constituents, but perhaps there are none more important than those performed by the Ohio Attorney General’s Crime Victims Services Section: standing beside victims, giving assistance and guidance, providing answers and support. This report of the activities of the Crime Victims Services Section demonstrates the commitment of Attorney General Jim Petro and the men and women of his office to Ohio’s crime victims, letting them know that they are not alone and that they need not be victims forever.
