motion were adopted.

Report of m. W. Kidd, Cheif of Fire Department, for the year 1941
was presneted to Council and accepted with thanks by the entire
body, and 'IRS as fibllows:
During the year we have answered 100 calls, which was composed
of: grass fires 27; out of town 6; fals 4; auto 6.
We have made an average of .two. fire inspections per month in
business dis.trict and have made several correction in residences.
~ have issued 193 building permits which amounts to $218,689.00
Which composed of 51 new residences totaling $89,800.00; five
non-residences composed of. $86,000.00, and repairs $32,829.00.
The insurance loss for the year 1941 was $7,108.21. Of this
amount $6,739.01, was covered by insurance leaving an uninsured
loss of '269.20.

1941 was presented to Council and accepted with thanks by the
entire body, and was as follows:

Dear Mr. Ware:
1 have inspected the markets (meat) in Newnan, Georgia, for the
year 1941 from two to four times monthly and have found them to
be in good condition most of the time and when they were not in
good conaitomn I made suggestions that would get them back in
conditions and then made a recheck in twenty to forth eight
hours and alswoys found the O.K. And as you alread know I had
some reports printed so that I could give the market a copy of
my report and. keep one for our record and for your meeting the
first of each month.
My records shows that I have condemned about three thoudand
pounds of meat.and meat products and had them removed from the
markets and also about seventeen hundred pounds of fish that I had
removed by your sanitary Department.
I find that Mr. McWaters of your sanitary department has been
very helpfull to me in going around.with me and when I condemn
any prOducts of the market he sees that they are removed as instructed and have also helped keeping boxes and trash from stores
and markets that helps the general sanitary conditions of the
City as well as the markets.
I have answered ten calls by people making complaints about back
doors, cow pens, and chicken houses.
1 have made a total of 33 inspections of dairies that sell milk
in Newnan, Ga., and written some .forty to forty five letters tp
people that .sell milk and butter in Newnan, Georgia, and I find
that our dairies are in good condition and most of them are
making some improvement every year.
I think we have had a good year and that our markets and dairies
are all up to a high standard.
I feel satisfied with the progreethat we have made and I.have
enjoyd the work and appreciate the help and encouragment from you
and your commettee and also the entire Council. And hope the
Council will continue this work and reappoint me as your inspector.

service during 1941 •

be paid the sum of One Hundred ($100.00) Dollars for service
as Mayor Pro~Tem for the year 1941.
Motiion adopted.
At this time Mayor Pro-Tern C. W. Farmer administated
oath of Office to Mr. a. J.Smith who was recently reelected
Mayor for the city of Newnan for a term of two years.

On motion duly seconded Mr. C. W. Farmer was elected Mayor ProTem.
On motion duly seconded street tax were fixed at Two and 50/100
($2.50) Dollars if paid on or before May 1, and Three ($3.00)
Dollars thereafter or a penalty of work if not paid for six days.
The follwoing ladies and gentlemen were elected to the Library
Committee for the year 1942.

Motion adopted.
The following resolution was adopted.
Due to the illness of Alderman F. W. Stripling and his inability
to -discharge the duties of Chaiill~Bf Street Committee, Alderman.
C. ~. Farmer, Vice Chairman of tim Committee is hereby designated
as acting Chairman with full and complete powers to handle the
affairs of tim Committee. Alderman Farmer will be entitled to
such additional compensation for serviing in this capacity
as chairman of the Committee would received, and will so serve
until Alderman Stripling is able to resume the full duties
of ·the Chairmasship. All effected departments will Pe pleas.e
be governed accordingly.

No license shall issue unlessapplicantsfUe, with City
Clerk, sworn affidavit naming location in Newnan where busi~
ness is to be conducted and if non-resident.give name of town
and county where ,principal office is located. Also stating
fees charged for work where office is located and where applicant does business in,more than one l~cality, ,applicant shall
life schedule of fees charged for work in each of the other
localities outside of the City of Newnan •. If it appears that
any applicant for ,license in Newnan proposes to charge more or
less in Newnan than is charged for similar work in any other
locality .wheresaid applicant is do,ing.business or principal
of said applicant is doing business, .and it appears that applicant intends to ,engage .in unfair competition in Newnan applicant shall not be entitled to,a.license and the City Clerk shall
decline to issue the ,same.
If any applicant proposes ,to remove or cause to be removed
an article from the City of Newnan belonging to residents of
Ne~nan for the purpose of laundering, cleaning. or dyeing before
such applicantshall engage in ,business in saud City applicant
shall berequired.to,give a ,bond payable to the City of Newnan
in the sum of $2000.00 with some solvent surety Company or a
citizen of Coweta.County, ,Georgia, as surety, the said Surety
Company or Citizen to be acceptable to the Mayor and Aldermen
of Newnan which said. bond shall be to indemnity customers against
loss or damage to articles removed from the City and conditioned
to settle any and ,all claims for damage filed with the said
principal by customers within tlll'n days after written notice for
damage is fi led.

Be it further ordained by the Mayor and Aldermen of the City
of Newnan. That the license provided for in this ordinance shall
be for the fiscal year beginning the first Monday in January, 1942
and ending the first Monday in January, 1943, Inclusive, and is
imposed and assessed on each person, firm, or corporation engaged
in or carrying on any business, vocation, or occupation, by agent
or otherwise, within the limits of the City of Newnan, and all persons, firms or corporations desiring to engage in or carryon any
business, vocation or occupation for which a license is required
must, prior to engaging in or carrying on such business vocation
or occupation, pay to the City Clerk the prescribed license.
Be it further ordained, That all licenses shall be issued for
the current year, provided however, after September 1st, 1942, licenses for the balance of year on payment of one-half for the prescribed annual license tax. No license is transferable.
Be it further ordained that the license upon any business or
trade not herein specifically proviaed for shall be fixed by the
Mayor and it shall be unlawful for any person, firm or corporation
to engage in any such business or trade in said City without paying
the license fixed by the Mayor.
Be it further ordained, That the license levied and imposed by
this ordip~nce are cumulative, and no person, firm or corporation
in this city, shall engage in or carryon two or more of the classified businesses on Which a license is imposed by this ordinance w~th­
out paying the license prescribed for each business engaged in or
carried on.
Be it further ordained, That no person, shall be allosed to
peddle within the fire limits of said City of Newnan.
Be it further ordained, That no person shall be licensed to
engage in any business or engage in any business in the City of
Newnan that is cnducted wholly or in part from a stand, booth,
box or other structure located, situated or placed in or on, or
that in any way encroaches upon or extents into any streets, highway or side wau.k of said city, or whose business as conducted or
carried on, obstructs in whole or in pact any streets, highway
or side wlak b~ said city.
Be it further ordained, That no itinerant vender, peddler,
or medicine vendor or peddler authorized to engage in any
business in said City of NeWnan shall, in carrying on said business, obstruct the whole or any part of any side walke, street
or highway of said City, and ahy ~uch person peddling in said
City, or using the streets or saide walks in said city for the
purpose of selling or offering for sale any goods, wares, medicines or merchandise of any kind, shall continually move from
place to place in said city, and shall not in the conduct or
carrying on of said business obstruct the whole or any part of
any side walk, street or highway in said city.

Be it further ordained, That it shall be the duty of any
person authorized under the laws of the State of Georgia to engage in business in the City of Newnan without paying license
for the privilege before engaging in business in said city to
register with the City Clerk of said City of Newnan in a book
to be proviaed for said purpose, and it shall be un~awful for
an~ person to vngage in business in said City without registering
with the Clerk as aforesaid, provided that no person shall be allowed to register by the said Clerk who is guilty of violating any

of the ordinances of City of Newnan, or under charge thereof,
or who is guilty of violating any law of the state of Georgia,
or the United States- of American. or under charge thereof, and
provided- further· that- if· any. person after registering as aforesaid, shall then be convicted of violating any. of the ordinances
of the Ci ty of Newnan-, any law of the State of Georgia. or of
the United states~ the said-person shall no. longer be authorized to engage in business in Said City of Newn~~, and it
shall be-unlawful for-such person, to engagein business in said
Ci ty of Newnan, thereafter-, - and provided fur.ther_, that it shall
be unlawful· for any person after registering as aforesaid, who
is engaged in any business in said City of Newnan, and who,
thereafter. is charged with violating any ordinance of said
City, or law of the Sate of Georgia, or of the United States
to continue to engage in business in said City pejding the t
trial of said charges and until acquitted of the charge or
charges then pending.
Be it fur~her ordained, That if any person, firm or corporation engages in business in said City, throught any agent
or agents, then the agent in charge of said business shall become liable for the license upon the business in which he or
they are engaged, and it shall be unlawful for any agent, or
agents to engage in any business, vocation or occupation, or
du any act in this city for which a cl1cense is required, before taking out such license, and shall upon conviction be
punished as prescribed in section 245 of the Code of the City
of Newnan. By this provision it is the duty of the agent to
see that the principal pays the license.
Be it further ordained, That the licenses issued by virtue
of this ordinance are to be held and used subject to the restrictions provided by the charter and ardinances of the city
and are subject to biiLrevoked by ordinance or change in this
ordinance.
Be it further ordained, That 1t shall be unlawful for
any person. firm or corporati.on to engage in any business,
vocation or occupation, or do any act in this city for which
a license is required, before taking out such license, and
shall upon conviction, be punished as preacribed in Section
No. 245 of the Code of the City of Newnan.
Be it further ordained, That no persQ~, firm or corporation in said City shall operate two or more places of business under one and the same license, but shall pay the license prescribed on each separate place of business conducted
in aU.d City.
Be it further ordained, That no person shall be allowed
to peddle with1Ii--the fire limits of the City of Newnan or to
engage in any business within said fire limits that is conducted or carri9d on in any way that obstructs the whole or
any part of any side walk or streetwith1n the said fire
limi ts.
Be it further ordained, Thtat the licenses prescribed
herein and those not here1n specifically prescribed by which
shall be fixed by the Mayor shall be and are hereby declared
to be a lien upon the goods. wares and merchandise of the person, firm or oorporation engaging in any of the business herein specificed for which a license is required and if any person, firm or corporation shall engage in any business 1n said
City for whicha license is required and fail, or refuse to
pay the said license, the City of Newnan. in the discretion
of the Mayor and Aldermen, may issue an execution against
the said person, firm or corporatio~. for the amount of the
license due, which said execution shall be levied upon the
goods, wares and chattels of any such said person, firm or
corporation and after advertisement and other proceedings as
in cases of taxes due the City of Newnan the said property
levied on as aforesaid may be sold to satisfy the said
execution. The remedy provided is cumulative and shall not
be construed as preventing the prosecution of any person,
firm or corporationfor violating the terms of this ordinance.

The government has put into effect tire and auto rationing and in the near future will perhaps ration fuel, and some
material and equipment. Municipalities are on eligible lits
for some or all of these articles. I will be necessary however to file applifati ons, etc., for any rationed article.
In order to have on hea-d tOo not only familiarize himself
with all rules, regulations, etc., but also to save duplication
of effert, I have appointed Alderman H. S. Johnson to act for
and in behalf of the City in all maters relating to rationing
for any article or material that may be used by the City.
You will please therefore give Mr. Johnson any information
he may request form any Department of the City and advise him
of your needs and requirements for any rationed article or
materiaL THIS DOES NOT APPLY TO ANY ARTICLE OR MATERIAL THAT
IS NOT RATIONED. Any requisition for rationed articles or
materials, however, must be approved by Mr. Johnson.
Mr. Johnson will have sole authority to act in thea matters
insofar as the City's interest is concerned.

Whereas, the Water and Light Commission, during the year ending
December 31, 1941, contributed to the ~neral Fund of the City
of Newnan the sum of $2,000.00 each month, and'

lJihereas, the ensuing year, 1942, from every indication, will
require a larger expendfture of money for the' opeRation of the
city government, and

Vfuereas, additional appropriations will be reauested for the
pUblic school system, and

Vfuereas, anticipated repairs to the Library will approximate
$10,000.00 or $12,000.00 and no Bonds will be issued therefor,
and
Whereas, Civilian Defense Activities will necessarily incur
extra costs to the City, and
Whereas, the fact that our country is at war, a war which has
been brought closer home to us that any previous war, and the
closeness of same makes it mandatory that rn!L"licipal governments
co-operate in every way with the National and State Governments
in doing eveFything possible to prevent a sucessful attack on this
municipality by our enemies, all of which will require additional
expenditure of money, and
~hereas, salaries of employees of the City of Newnan have benn
sUbstantially raised on account of the higher cost of living.
Therefore, B~ it resolved by the Mayor and Council of the City
of Newnan th.at the Mayor and Council express their gratitude and
appreciation to the Newnan Water and Light Commission for the above
mentioned monthly contribution for the year 1941 and for their cooperation and assistance otherwise, and
Be It Further Resolved, that the Mayor and Council of the City of
Newnan, for the reasons above stated, request the Newnan Water and
Light Commission to continue such monthly contributions in the
amount of $~,OOO.OO per month.

above Resolution was passed at the regular meeting of City Council
on January 19, 1942, and said Resolution has been placed on the

operate Taxies in the City of Newnan.
Motion Mr. Farmer second by Mr. Mann that license be issued to
Mr. Milan provided he met the conditions of the Taxi License Ordinance.

Mayor Smith stated to council that Mr. H. C. Arnall, member of
Water and Light Comma~sion had made a request of council that
they be relieved of their monthly payments of Two Thousand ($2000.00)
Dolla:d:s to the General Fund Account for Sixty (60) or Ninety (900'
Days on account of having to pay for the incinerator at this time.
Motion of Mr. Farmer second by Mr. Mann that the request of Mr.
Arnall, member of Water and Light Commission, be granted but they
be notified at the same time they would be expected to pay to the
General Fund Account the sum of Twenty-four Thousand ($24,000.000
Dollars during the year 1942.

Minutes of meeting of March 2, were read and on motion were
adopted.
A bill from Mr. Harry E. Abels, building contfactor, of incinerator for the sum of Four Hundred and No/laO ($400.00) Dollars
in final payment of his contract was presented to Council and
on motion of Mr. Ware and second by Mr. Uohnson the above mentioned
bill was approved by council and city clerk authorized to notify
the Water and Light Commission and they be authorized to pay the
above account provided it met with their approval.
Motion adopted.
Mr. L1roy Mann had been notified of his Curb and Gutter charges
on Me ntosh Street in front of 9IDme of some vacant property.
Mr. Mann thought the account to be excessive due to the value of
the vacant property and he requested council to make some allowance in the account.
A motion was made by Mr. Johnson and second by Mr. Ware that the
request of Mr, Leroy Mann on the above matter be referred to
street Committee with authority to act.

At a meeting of the Board of Education of the
City of Newnan on March 23, the following resolution was
unanimously adopted:
"Resolved: That the Mayor and the City
Council be requested to assign rent free to
the Board of Education, for the use of the
Opportunity School or for any other use, the
North side of the second floor of the Carnegie
Library Building."
This request is made due to the fact that the space now
used for this purpose is inadequate and unsatisfactory. In
addi ti on to this the Board of Education is required to pay
rent for the opace now occupied.
Your favorable consideration of this request will be
appreciated.

All Dogs must be Inoculated by July 5, 1942.
Doggs kept in the City of ·'ewnan must be immediately inoculated as
provided in.the ordinance of said City requiring the inoculation.
Arrangements have been made with Dr. C. A. Moody to inoculate dogs
at an expense to the owner of $1.00 for each inoculation.
Your cooperation is earnestly requested and willbe appreciated.
Inoculate your dog and reduce the hazarQ of rabies.
The dog owner who fails or refuses to have the dog inoculated can
and will be tried and punished for violation of the ordinance.
No layman will be allowed to inoculat.e dogs in the City of Newnan,

TO THE HONORABLE MAYOR M:D ALDERMEN OF THE CITY OF :,EWNAF:
Under date of July 24, 1912, the City of l"evman by ordinance granted
to Columbus Power Company, its successors, lessees and assignes,
certain franchise rights in connection with the operation of an
electric system upon the streets and pUblic places of the City of
Newnan and to supply electric service to power loads in excess of
50 horsepower.
Section 4 of that ordinance provided that the franchise should
terminate at the end of thirty yea~s unless renewed or extended
prior to its termination date, namel¥:, July 24, 1942.
Tne same section prOVides that application for renewal or extension
of the franChise could be made and granted at any regular meeting of
the Mayor and Aldermen of the City of Newnan during the term of the
franchise or any renewal or extension of the same.
The Georgia ?ower Company, present holder of this franchise as successor by consolidation to the Columbus Electric & ?ower Company, the
assignee of Columbus Power Company, hereby applies foran extension
of the above described franchise for a period of thirty years from
July 24, 1942, and prays your Honorable Body will grant said extension to and in the name of Georgia Power Company.

is hereby declaled to be a ''triffic bouj.evard and persons travelling on and along said street are declaLed to be entitled to the
right of way.
Be it further ordained by the authorities aforesaid that any person dtiving any vehicle from any intersection street onto or into

A. letter from the Texas Oil Company asking for a reduction
in their 1942 ~ity tax return was read to council by clerk
and on motion ~f Mr. Johnson and second by Mr. Hubbard, that
city mmerk be authorized to refund to The Texas Oil Company
the sum of $ight and e$a.CO) Dollars on receipt of their
payment of the-ir 1942 tax and requested that he notify The
Texas Company -of the action of the city council.

Motion Mr. Hubbard second by Mr. Parks that Chairman of
Purchasing Committee. Police Committee and Fire Department
Committee be authorized to purchase uniforms for the city
employees.

the year 1942 be fixed at 16 mills(Sixteen Mills) and the
following ordinance be adopted:
Be it ordained by the Mayor and Aldermen of the city of
Newnan and it is hereby ordained by authority of the same,
that for the purposes herein after stated, and for the purpose of raising revenue for the support and maintainance of
the said city ~or the year 1942, there is hereby levied on
all property both real and personal SUbject to taxation by
the city of Newnan, Georgia, the sum of .016 on each $1.00
of- the assessed value of property or tne and 60/100 ($1.60)
Dollars on each One Hundred ($100.00) Dollats of the assessed
property value.
Be it further ordained the authorities aforesaid that the
said amount so raised shall be apportioned and expened by
the city of Newnan, as follows:

Whereas, There is a considerable portion of East Washington Street
in the city of Newnan, lying between the Atlanta & West Point R. R.
Co. and Perry Street, on the south side of said street is unpaved
and
Whereas: There is no present intention of paving said portion, and
same is unsightly, and a large amount of rubbish and trash accumultes
on same creating a fire hazard to the property of R. D. Cole Mfg. Co.
lying south of said area and on whose property is located a lumber
shed:
THEREFORE BE IT
R~OLVED:
That the said R. D. Cole Mfg. Co. is hereby granted the right to
encroach upon said vacant area lying north of said lumber shed and
south of the said street with the right to use same for business.

of said East Washington Street so that the area they are hereby permitted to use shall be a strip extending east and west Two Hundred
and One (201) feet with itsmorth side parallel with, and seven (7)

Georgia, for assistance in various ways; and
Ubereas: Recently the Commissioners of Coweta County, have furnished the City of Newnan with equipment to and have graded and
leveled the negro football field and pa~t of the cemetery at the
request of the Mayor and Council, and such work was done in a
splendid and capable manner; and
Whereas: Dr. T. W. Sewell, R. H. Johnson, H. L. Camp, J. S.
Carmical, and W. H. Johnston, Commissioners of Coweta County,
Georgia, have exhibited a splendid spirit of cooperation with
the officals of the City of Newnan and hav worked toward the

Whereas, J. E. Stephens, of Lakeland, Florida, has submitted
two (2) 21do One Hundred Dollar U.S.A. Treasury Bonds, bearing
Nos. 71671 A and 71672 B, which bonds will mature in 1972, to
the city of Newnan so tha t the income therefrom may be us ed
for the perpetual keep of a certain cemetery lot in the Oak
Hill cemetery at Newna", Georgia, and
Therefore, be it resolved by the Mayor and Council of the City
of Newnan that receipt of said bonds be and is hereby acknowledged for the purpose above mentioned.
Be i t further resolved that the City of Nevman, for and in consideration of said bonds, agrees to use tb income from same to
the 2erpetual keep of the C. P. Stephens lot in said cemetery.

was accepted and approved by the Council.

AN ORDINANCE REGULATING ARTIFICIAL ILLUMINATION
BE IT ORDAINED BY THE MAYOR AND ALDERMEN OF THE CITY OF NE~JAN,
GEORGIA,.ana it is hereby ordained by the authority of same, as
follows:
SECTION 1. Every person ha~ing custody or control of any
building, signboard, illuminated sign, display windOW, or any
other structure or place of any ktfud or character where artificial
illumination is used, shall observe the following regulations:
(a) A definite and easily operated means shall be provided at
all times to completely extinguish all illumination promptly.
(b)· No light or reflection from light shall be left on
between sundown to sunup unless someone is immediately available
within such bulding or opon such premises to extinguish such
light, except under the follQ~ing conditions:
Where~~rtificial illuminiation is produced by electricity
a switch controlling all lights may be installed on the exterior
of the building or at some other clearly marked and easily accessible point on the outer side of the building or vacant premises which
can be found by any warden, or other person, quickly and easily.
Such switch shall be placed in such a position and at such a
height as will fully protect all persons from danger, and shall
be clearly marked by a White circle at least twelve inches in diameter.
SECTION 2. From and after the passage of this ordinance it
shall be·unlawful for any person, firm or corporation to violate
any or all of the terms of this ordinance.
SECTION 3. Any person, firm or corporation violating any or
all of the terms of this ordinance shall on conviction be punished
as prescribed in Section 245 of the City Code.
SECTION 4. All ordinance and parts of ordinances in conflict
to this ordinance be and the same are hereby repealed.

adopted:
AN ORDINANCE AUTHORIZING BLACKOUT AND AIR-RAID
PROTECTION ORDERS, RULES AND REGULATIONS; AND
DECLARING AN EMERGENCY.
WHEREAS, a state of war exists between the United States of America
and Japan, Germany and Italy, and the defense of the United States
of America is in the hands of the Army and Navy; and.
in modern warfare no City, however distant from the enemy,
is free from attack; and

WHEREAS, lights at night time are a definite aid to the enemy in
reaching military and other objectives; and
WHEREAS, blackouts, when· ordered by the Army Qr~Navy are essential
to the preservation Of life and property in this City, and it is
imperative that the City of Newnan aid the Army and Navy by all
possible cooperation and assistance; and
qREREAS, failure to extinguish lights when ordered to do so by duly
authorized authorities may result in loss of life by thousands of
the residents of the City of Newnan as well as the residents of
other parts of the Nation when lights in this City are used as a
guide to other objectives;
WHEREAS, failure to comply with orders, rules and regUlations
governing evacuations, traffic mo~ements, cogregation of person in
streets and other pUblic places will result in confusion and unnecessary loss of life both during blackouts and aP«ing air raids
in the daytime, now therefore,
BE IT ORDAINED by the Mayor and Aldermen of the City of Newnan, and
it is hereby ordained by authority of same as follows:
SECTION 1. AUTHORITY TO PROMULGATE NECESSARY ORDERS, RULES AND RE~
GULATIONS FOR BLACKOUTS AND AIR RAIDS. In order to protect life
and property in the City of Newnan from enemy action the Mayor and
Aldermen (or the Civil Defense Officer designated by the Mayor and
Aldermen) are authorized and directed to carry out blackouts and
air raid protection measures in said City at such times and for
such periods as are authorized or ordered by the Army and Navy and
to promulgate such orders, rules and regulations as may be necessary
to insure the success of the blackouts and air raid protection
measures aad to protect life and property during said periods.
Said orders, rules and ~egulations shall include traffic movements
of emergency or other vehicles, evacuation of residents,. congregation
of persons on pubilc streets, sidewalks, in pUblic places or buildings, but this enumeration shall not be taken as a limitation on
the power to promulgate orders, rules, regul"tions governing any
other SUbject, persons or property which must be regulated in order
to insure the proper
carrying out of any duly authorized blackout
or air raid protection measure. Practice blackouts and air raid
drills may be carried out at such times and for such periods as the
Mayor and Aldermen (or the Civil Defense Officer designated by the

Mayor and Aldermen) shall in their descretion deem appropriate
or necessary, but sUbject always to the orders and directions
,6f the Army and Navy, and the orders, rules and regulations
authorized herein.
ISECTICN 2. GENERAL ORDERS, RULES AND REGJLATIONS TO BE IN
WRITING. All orders, rules and regulations authorized by this
ordinance for the conduct of the general pUblic shall be in wri ting and shall be aVCiilable for public inspection at the place
and during the hours fixed by the Mayor and Aldermen (or the
Civil Defense Officer dSsignated by the Mayor and Aldermen).
SECTION 3. ORDK",S, RULES AKD REGULATIONS EFFECTIVE UNTIL HE*
PEALED BY THE MAYOR A:-:D AWERMEN. Any order, rule or regulation
promulgated pursuant to the authority conferred by this ordinance shall be in force and effec,j. from the time of promulgation
until amended or repealed by the Mayor and Aldermen of the City
of Newnan.
SECTION 4. APPOINTME~(T OF AUXILIARY OR SPECIAL POLICE-IDENTIFY"ING EMBLEM. The Mayor and Aldermen may appoint for a specified
time as may auxiliary or special police, without pay, from
among residents of the City of Newnan as may be deemed advisabie
for service in co~nection with any blackout or air raid protection measure. During the term of service of such auxiliary or
special police they shall pos ... ess those pwoers and privileges as
shall be given them in writing by said Mayor and Aldermen and
only such powers and privileges as are contained in said written
authority. Said police must wealt such identifying emblem as may
be prescftibed by said Mayor and Aldermen and it shall be unlawful
for any such policeman to carry out any order, rule or regulation
promulgated under the authority conferred by this ordinance when
he is not wearing said identifying emblem.
SECTION 5. UNAUTHORIZED WARNING OR ALL-CLEAR SIGNALS PROHIBITED.
Any unauthorized person who shall operate a siren or other device
so as to simulate a blackout signal or air raid, or the termination of a blackout or air raid shall be deemed guilty of a violation of this ordinance and shall be sUbject to the pemalties
imposed by Section 10 of this ordinance.
SECTION 6. NO MUNICIPAL OR PRIVATE LIABILITY. This ordinance is
an exercise by the City of its governmental functions for the
protection of the pUblic peace, health and safety and neither
the City of Newnan, the agents and representatives of said City
or any individual, receiver, firm, partnership, corporation,
associatior:, or.trustee, or any of the agents thereof, in good
faith garrying out, complying with or attempting to comply with,
any order, rule or gegulation promulgated pursuant to the provisions of this ordinance shall be liable for any damage sustained
to persons or property as the result of said activity.

SECTION 7. LIGHTS DURING BLACKOUT DECLARED PUBLIC NUISANCE. Any
light displayed contrary to any order, rule or regulation promUlgated pursuant to the provisionscof this ordinance constitures
a pUblic"nilisance and' when deemed necessary in order to protect
life or property during a blackout or air raid the police, or
the Special police authorized herein are authorized and direcled
to enter upon any premises within the City of Newnan, using reasonable force, and extinguish lights or take other necessary
action to make effective any order, rule or regulation promulgated
under the authority conferred by this ordinance.
SECTION 8. CON7LICTING ORDINANCES, ORDERS, RULES AND REGULATIONS
SUSPENDED. At all times when the orders, rules and regulations
made anu promUlgated pursuant to this ordinance shall be in effect,
they shall supersede all existing ordinances, orders, rules and
regulations in so far as the latter may be inconsistent therewith.

SECTION 9. NO CO\lFLICT WITH STATE DR FEDERAL STATUTES. This
ordinance uhall not be construed so as to conflict with any state
or Federal statute or with any Military or Naval.order, rule or
regula ti on.
SECTION 10. PENALTIES FOR VIOLATIOi"S. Any person, firm or corporation found guilty of violating any of the provisions of this
ordinance or any order, rule or regulation issued pursuant thereto
shall be fined not less than One .($1.00) Dollar aor more than One
Hundred ($100.00) Dollars and sentenced to serve on the streets
of the City of Newnan for not less than Five (5) days not more
than Sixty (60) days, either fine or sentence or both to be im~
posed at the descretion of the Recorder of the City of Newnan.
SECTION 11. SEPARABILITY OF ·PROVISIONS. It is the intention
of the Mayor and Aldermen of the City of Newnan that each separate
provision of this ordinance shall be deemed independent of all
other provisions herein and it is further the intention of the
Mayor and Aldermen that, if any provision of this Act be declared
to be invalid, all other provision thereof shall remain valid and
enforceable.
SECTION 12. FINDr:G OF EMERGE"CY. This ordiaance is passed as
an emergency measure and the Mayor and Aldermen do by the vote
of which this ordinance is passed, hereby declare that a national
emergency e"ists, which makes it imperative that this ordinance
should become effective forthwith, the nature of said emergency
being as follows:
a state of war exists between the United
States of America and Japan, Germany and Italy, ar..d the President
of the United States has declared that an invasion or predatory
incursion is threatened, and it is necessary in the furtherance
of the pUbli~health, safety and welfare of the residents of this
City that this ordinance be effective immediately.
