Introduction
For the second time we are pleased to provide you with this publication, which was prepared for the
Government of Warmia and Mazury and designed for partners interested in establishing business contacts with
companies from the Warmia and Mazury.
This publication aims to present the base voivodeship export branches. It contains information about
companies that are leaders in these industries in terms of export production volume. In the first part
of the publication you can find basic information about the rules of intra-Community acquisition of goods.
The following concepts will be described: the territory, the community, the goods, the transactors and the
conditions for intra-Community acquisition of goods.
We hope that this export folder containing basic information about the region will be useful in activating
economic cooperation with the companies from Warmia and Mazury.
Warmińsko-mazurskie voivodeship is located in north-eastern part of Poland in an attractive neighborhood
- from the north it borders with the Kaliningrad Oblast of the Russian Federation, from the west, via the Vistula
Lagoon, it is situated near the Baltic Sea. The distance between Olsztyn and Warsaw is 220 km, Olsztyn
and Gdańsk - 180 km, Olsztyn and Toruń - 170 km, with the distance to the border crossing with Lithuania
in Budzisko being approximately 222 km.
Warmińsko-mazurskie is the fourth largest Polish region with an area of over 24 thousand.
km 2. It is populated by almost 1.4 million inhabitants. The voivodeship is administratively divided into 116
communes from 19 districts. The regional capital is Olsztyn, inhabited by almost 180 thousand residents.
Other major centers in the region are the city of Elbląg (130 thousand inhabitants) and the City of Ełk
(60 thousand inhabitants).

Intra-community acquisition of goods
The abolition of customs between Poland and the EU countries, which took place on 1 May 2004, resulted
in many changes in business operations undertaken by Polish entrepreneurs within the Community. Imports
of goods, defined as the acquisition of goods made outside of Polish territory, have been replaced by imports
in the narrower meaning, and includes only the acquisition of goods from non-member countries, as well as the
intra-acquisition of goods, which refers to transactions solely within the European Union.
There is a similar situation with export goods, with exporting activities to European Union countries being
defined as intra-Community supply of goods. It should be noted that these transactions always occur in pairs
- intra-Community supply of goods in one Member State is always parallel to an intra-Community acquisition
of goods in the territory of another Member State.
For the acquisition of foods to be considered an intra-Community one, there are necessary conditions
to fulfill:
● The subject of an intra-Community acquisition must be a „commodity”,
● The transaction has to have an “intra-Community” character – i.e. involving physical movement of foods
between two EU countries,
● Intra-Community acquisition of goods must be made " in exchange for payment," both the buyer and the
person supplying the intra-Community transactions are subject to the added tax in accordance with the
provisions of the Community countries (such as VAT in Germany) as well as tax on goods and services within
the scope of the Polish act on goods and services tax.
In accordance with the section 9, paragraph 1 of the goods and services tax Act, the intra-Community
acquisition means acquiring the right to act as the owner of the goods, which, as a result of supply, are
shipped or transported from the territory of a Member State (other than the Member State making the delivery/
transport by the supplier on his behalf).
The concepts of country territory and the Community territory. Understanding the said concepts will
prove important to the entrepreneurs. According to the section 2, paragraph 1 of the Polish act on goods
and service tax, the „country territory” is the territory of Poland. According to section 2 paragraph 3 of the
Polish act on goods and service tax, the „Community territory” are the territories of European Community
Member States - accounting for the Principality of Monaco being a part of the French Republic, the Isle of Man
being a part of the United Kingdom of Great Britain and Northern Ireland, the sovereign zones of Akrotiri and
Dhekelia being a territory of the Cyprus Republic. Thus, for example, supply from the Principality of Monaco
isn’t considered an import, but an intra-Community purchase.
The following territories are treated as exempts from the European Community:
● Helgoland Isle, Buesingen territory – from the Federal Republic of Germany,
● Ceuta, Melilla, Canary Isles – from the Kingdom of Spain,
● Livigno, Campione d'Italia, Italian part of the Lugano Lake – from the Republic of Italy,
● Oversea departments of the French Republic,
● Mount Athos – from the Republic of Greece,
● Aland Isles – from the Republic of Finland,
● Channel Isles – from the United Kingdom of Great Britain and Northern Ireland,
● Gibraltar is also treated as an exempt from the European Community.
Any transactions performed on the aforementioned territories are not made within the Community. These
transactions are not considered intra-Community transactions – they are considered exports and imports
of goods for taxation purposes. It should be noted that the Community is treated differently in terms
of tax purposes and various customs duties. For example, the acquisition of goods from the Canary Islands
for tax purposes is the import of goods, but in terms of customs laws it is a transaction taking place within
the Community.
The concept of commodity. In accordance with section 2 paragraph 6 of the aforementioned Act, the term
“commodity” means movable property, as well as all forms of energy, buildings or building parts, subject
to transactions, subject to tax on goods and services that are listed in the classifications issued under the
provisions of the public statistics, as well as plots of land. It should be noted that there can be no effective
intra-Community transactions in respect of buildings, structures and building parts as well as plots of land
due to intra-Community transactions’ cross-border nature. The transactions require the need for physical
movement of goods, which in these cases is impossible.

Referring to the Polish act on goods and service tax the „commodities” are subjects fulfilling the following
criteria:
● must be subject to VAT tax, i.e. goods that are "capable of being subject to taxation," and, therefore, there
has to exist a free and legal possibility of commodity exchange in relation to the subjects,
● have to be mentioned in the classifications published on the basis of the public statistics.
In consequence, subjects, which not fulfill any of the requirements, cannot be taken into consideration
as „commodities”, in accordance to the Polish act on goods and service tax.
Requirements of an intra-Community acquisition of commodities. Article 5 section 1 paragraph 4 of
the Polish act on goods and service tax10 states, that the intra-Community acquisition of taxable commodity has
to be performed “in exchange for payment”.
For the goods acquisition to be performed „in exchange for payment” the following requirements are
to be met:
● there must be a close and direct link between the fact of delivery and the paid charge,11
● the received payment must be able to be appraised economically, in a monetary quota12.
Without a doubt, an essential precondition for the taxation of VAT should be taken that the transaction
carried out “in exchange for payment” occurs only if there is a legal connection between the partners (supplier
and buyer)13. The payment of the other side does not mean that it has a contractual basis, which reflects the
desire of the party involved, and, as a result, it is involved in the transaction of singular purchase14.
The trade between the Member States is not subject to customs duties, while imports from countries outside
the group apply a uniform tariff. Customs duties are levied at the border of a country or a customs union with
regard to the commodities transported across the border. The customs union is to eliminate all customs duties
and other barriers to trade flows between members of the union (such as quantitative restrictions, charges
on the same principle as customs duties, ie, only from foreign products, etc.) and to determine a common
(identical for all members union) tariff and customs rules in the relations between EU Member States and third
countries.15
Entities of intra-Community acquisition of commodities. In order for intra-Community acquisition
of commodities to occur (analogically to intra-community supply of commodities), the recipient must be:
● a Polish or EU VAT taxpayer, and the purchased commodities have to be intended for activities performed
by him as a taxpayer, OR
● a legal entity, not being taxable as per mentioned earlier.
Subsequently, the supplier also has to be a Polish or EU VAT taxpayer. The fact that not every taxpayer
can offer a successful intra-Community commodity supply is worth mentioning – in accordance to article
13 paragraph 6 of the Polish act on goods and service tax16, the intra-Community supply occurs, if the supplier
is a taxpayer willing to perform intra-Community commodity supplies and was registered as an EU VAT taxpayer
due to article 97 of the aforementioned act.17

More information devoted to the common EU trade policy applied to third countries, including issues
arising from the work of the World Trade Organization (WTO) can be found on the website of the Ministry

In the foreign trade bookmark you will find, among others, the current information about the regulation
of EU trade with third countries, as well as information on issues currently discussed at the EU forum and the
WTO. The issues of measures regulating the exchange of goods in terms of the “EU - Third countries” were
also addressed: customs tariff, duty exemptions and other preferential tariff measures, whose essence comes
down to the possibility of imports at lower tariff rates than those of the EU customs tariff, as well as various
measures of regulating the exchange of goods with third countries, such as those resulting from anti-dumping,
anti-subsidy and against excessive imports.
The Ministry of Economy is also responsible for the promotion of Polish export in the country. The Export
Promotion Portal was created for this purpose:

Those interested will find the detailed, practical information on the development of foreign markets,
questions of foreign customers who are looking for Polish suppliers and information about legal tenders. Polish
entrepreneurs interested in exporting their goods and services are free to put their company offer on the

Beyond the borders of Poland, the exporters are promoted through the Departments of Trade and Investment
Promotion. The Department’s scope of activity involves:
● Promotion of Poland and the Polish economy,
● Support and advice for Polish exporters seeking market outlets in the territory of the DTIPs,
● Encouraging companies operating in the territory of the DTIPs to make investments in Poland
● Assistance in establishing business contacts between Polish and foreign companies
● Search for suitable distributors, importers and exporters,
● Providing information on fairs and exhibitions,
● Initiate cooperation between the Polish and foreign regions,
● Cooperation in the organization of economic seminars and missions.

The voivodeship promotes international cooperation through the Department of International Cooperation
and the Promotion Coordination Department of the Marshal’s Office of Warmia and Mazury.
Department of International Cooperation is responsible for coordinating international cooperation, initiating
activities aimed at including the region of Warmia and Mazury in international organizations, bringing together
regional and local authorities, drafting of plans for international cooperation and undertaking projects for
European integration.
The Promotion Coordination Department pursues economic promotion of the region to raise domestic
and foreign investment, as well as promotion of the region in the European institutions and international
organizations.

The Enterprise Europe Network contact point belongs to a network of contact points managed by consortia.
The Warmia and Mazury Regional Development Agency is a member of the BISNEP consortium Business and Innovation Support for North - East Poland, consisting of the University of Warsaw - the
coordinator of the project, Lubelska Development Foundation, Podlaska Regional Development Foundation, the
University of Warmia – Mazury and the Technical University of Lublin. The consortium area of jurisdiction are
the three voivodeships of the north-east Polish territory: Warmińsko-Mazurskie, Podlaskie and Lubelskie.
BISNEP serves as a linking point of the international Enterprise Europe Network, which is a new initiative
by the European Commission, the strategic goal of which is to help develop the potential and innovative
capacity of small and medium-sized enterprises in Europe, thus enhancing their competitiveness on the global
market. SMEs are particularly important for the European economy as a whole, constitute its economy core and
are the main source of jobs and innovation processes. The network brings together about 500 organizations
from almost 40 countries.
Common Network services are:

and commence new research and development activities,

Warmia and Mazury Investor Assistance Centre - a Certified Partner of the Polish Information and Foreign
Investment Agency (PaIiIZ in Polish) was established in February 2005 under a tripartite agreement between
the Polish Information and Foreign Investment Agency, Office of the Marshal of Warmia and Mazury and WarmiaMazury Regional Development Agency in Olsztyn. The main tasks of Warmia and Mazury Investor Assistance
Centre - Certified Partner of PAIiIZ (WM COI in Polish) is working for the promotion of the regional investment
offer, as well as active participation in the process of providing service to foreign and domestic investors at the
voivodeship level, maintaining databases and offering investment advice to potential investment recipients.
IAC Actions are focused in particular on the promotion of Warmia and Mazury as areas particularly attractive

3.1 Food industry and agriculture
The food industry in the region has a high share of total industrial output, high employment and high levels
of accessibility to raw materials (agriculture). Greatest importance in this section is held by the production
of foodstuffs and beverages, its value being approximately 1/3 of the sold production outcome. The region
has a dominant position on a national scale in the production of poultry meat (especially turkey), beef, pork,
ham, butter and beer. Fruit and vegetable juices, frozen food, cereal, flour, milk and milk supplies, honey, fish
(smoked and canned) have the most important position in the scope of food production in the Warmia-Mazury
region. Food processing is based mainly on local high-quality raw materials manufactured in a clean, natural
environment. Localized R&D units (mostly science-related research facilities of the University of Warmia and
Mazury) are involved in the regional food industry. They are one of the largest achievements in the country
in terms of research, development and implementation of inventions, especially in areas such as dairy products
(new technologies for maturing cheese, cottage cheese, cream, casein), meat industry, fruit and vegetable
processing.

Description:
Indykpol Group is the largest poultry organization in Poland specializing in production of turkey meat and
dairy products which holds an approximate 20% share in the domestic turkey market. Economic activity
of Indykpol takes place in several related areas of production. It consists of: production of turkey, chicken and geese
nestlings, turkeys for fattening and processing, marketing for the poultry products. Vertically integrated production
organization allows for better control of the introduced production of raw materials and guarantees realizing the
gross margin at various levels of organization. The company has been producing turkey on their own livestock
farms for 16 years, which provide 20% of the raw poultry material processed by the Group (35% of the raw turkey
resource). In the near future Indykpol intends to expand the structure of the company by its own fodder factory.
The processed products with the INDYKPOL logo are characterized by a high content of easily digestible and
digestible protein, low fat, low calorie, low cholesterol and high in vitamins from group B. In addition, these
products are delicate and mild flavored and are easy to prepare. Because of turkey’s nutritional qualities, the
products are recommended for anti-cholesterol prophylaxis for the elderly, convalescents and children.

The “Majonezy” company history has its roots in 1945, when the first plant was created based on the postGerman coffee roasting plant. In 1958, the company underwent a thorough modernization and reconstruction,

3.2 Wood and furniture industry, door and window
(PVC) carpentry
Wood & furniture industry is an economic showcase of the region by the fact that it generates a large
share of industrial output and employment. A large area of forests promotes improving the acquisition
of raw material. In addition, this sector is strongly export oriented. As a very strong branch of Warmia and Mazury
economy for some time, it is of interest to foreign investors, mainly the investment capitals of French, Dutch,
German, Swedish. As already mentioned, Warmia-Mazury has extremely favorable conditions for the functioning
of enterprises in the wood industry: the right climate, raw basic materials and proximity to regions with large
forest complexes. This has allowed cooperation between of manufacturers and suppliers, developed technical
infrastructure and decades of tradition. The Warmia and Mazury region occupies a leading position in Poland
