What a fabulous event for those who have never been or maybe it has been a while since you last attended. This year’s theme was “Family Matters”! The 3 days were packed with excellent speakers, continuing education, an awards dinner, top notch entertainment, a trade show and an opportunity to talk with other professionals in our industry. That helps you realize that you are not alone in this business and every situation we encounter has been shared by others and I find it fascinating to hear how others have handled them. It was great to see West Central Association well represented this year with many attendees. The excellent Continuing Education classes that were offered covered a variety of subject matter which included latest technology options to maximize our time, tax strategies that can help us all save more of our earned income, the best apps and trends in our industry and many more gadget and gizmo ideas to help us operate more efficiently. MLS Tips & Tidbits The number of photos allowed to be posted in the MLS has recently been increased to 36 photos. Legally Speaking: Do I have to release one of my listings? By Lorie Garland, OAR Assistant Vice President of Legal Services, ohiorealtors.org Q: Four months into a six month listing agreement my sellers have requested a release of the listing. The sellers have stated that they are happy with my work, as I had implemented an extensive marking plan and had many showings, but they have changed their mind about selling. I told the sellers that I would cease marketing the property and withdraw the listing from the MLS but I would not release them from their obligation to pay a commission if the property sells during the term stated in the listing agreement. The sellers are adamant about a full release which makes me doubt that they have changed their mind about selling. I suspect they want to sell to a friend who has expressed interest in the property. Do I have to release the listing? Can I agree to a release only if the sellers reimburse me for my marketing expenses? A: If a seller tells the listing agent to no longer market the house and to remove the listing from the MLS, the listing agent must honor that request. However, the listing brokerage is not required to release the seller from his obligation to pay a commission if the property sells during the term of the listing agreement. The listing agreement is a legally binding contract the terms of which can be altered by agreement of the parties, the seller and listing broker. When a seller asks for a release the listing broker can grant the request, grant the request if certain conditions are met or cease marketing the property but make clear to the seller that he will owe a commission if the property is sold during the term of the listing. A condition to granting the release could be payment of the costs incurred to market the property. Once payment is received by the brokerage the listing termination agreement could be executed. When the brokerage is not releasing the seller from the obligation to pay a commission if the property sells, this continuing commission obligation should be clearly stated in the agreement to no longer market the property. If the property does in fact sell, the seller would owe the listing brokerage the commission stated in the listing agreement. She currently serves as Chair on the Equal Opportunity/Fair Housing/Civil Rights Committee, Professional Standards Committee as Vice Chairperson and on the Board of Directors and would appreciate the opportunity to serve again. Her goal is to represent the members to the best of her ability and always look out for their best interests. ANTWILLA DAVIS - Century 21 Sunway Realty LLC (Candidate for Director) Antwilla has been serving Hardin County as a Realtor since getting her license from Hondros in 2009. Currently she is serving on the Grievance Committee, RPAC Committee, and as Chair on the Membership Committee. In 2006 she married and moved to Kenton and has a son and daughter. In Hardin County, she is a member of The Chamber of Commerce and PTA and participates in many of their committees. Antwilla’s goals for the Board in the upcoming few years is for it to continue to offer support and education to the members. She is also looking forward to finding new and exciting ways to get more members to participate. She hopes to be able to help the Board to keep moving forward. She believes that there are a lot of good ideas in place and the board just needs people to carry forward these goals and commit to seeing them accomplished. She has been active in trying to improve our Board and will continue to do so. JEFF DULMAGE – Broker - Hartsock Realty (Candidate for Director) Jeff has been a Realtor for over two years. He is currently serving on the Technology Committee. He received the OAR President’s Sales Club Award of Distinction for 2015. He is married to his wife Sarah and they have three children. In his spare time, he enjoys spending time with his family by taking them on day trips to historical sites and museums. His goal for the Board is that we continue to grow in professionalism and technology. DEVIN DYE – Ron Spencer Real Estate Company (Candidate for Director) - In 2011 Devin obtained his real estate license and started helping clients reach their real estate goals. As a self-proclaimed personal growth junkie, while working full time in the real estate business, he decided to return to college and finish his degree in business management. As the sole provider of his family, full time student, full time Realtor, husband, and father he knows all too well the value of time management and working efficiently. He started school in the fall of 2012 and graduated summa cum laude while obtaining the 2014 President’s Sales Club Award of Achievement and the 2015 President’s Sales Club Award of Distinction. His dedication to his profession and work ethic, and a patient wife, are attributed to his early success in this business and he strives to continue to grow in all aspects of life. His goals for the Board are to become more technologically advanced from an entire board perspective. With his age and knowledge of the technology that is available for our industry he thinks our board could benefit from taking advantage of some of the options available. In his spare time he enjoys spending time with his beautiful wife Kylie and equally beautiful daughter Paisley Grace. You may also find him working on his handicap score from time to time. ROB GAMBLE – Bee Gee Realty (Candidate for Director) Rob graduated from Van Wert High School in 1998. After high school he attended and graduated from the University of Toledo with a Bachelor’s degree in business finance. While in college he met his wife Nicole. They have been married 10 years and have 2 children. Immediately after college he entered the banking field where he stayed for 11 years. This past Spring he decided to join the family business leaving banking behind and joining Bee Gee Realty & Auction Company as a full time Realtor. In his spare time, he enjoys fishing and boating. Page 5 KNOW YOUR CANDIDATES 2016 Board of Director Elections DAN IRWIN – Irwin Real Estate (Candidate for Director) Dan has been a full time Realtor with Irwin Real Estate since 2003, and is the manager of Irwin Real Estate’s Ottawa office. Dan is a President’s Sales Club Award of Achievement recipient in 2015. His goal for the Board is to be a good representative of the entire membership. He and his wife Cindy have three grown children and six grandchildren. In his spare time he enjoys camping, boating, sports and anything to do with family. JASON KASER – Real Living CCR, REALTORS® (Candidate for Director) Jason Kaser is a Real Estate Professional for Real Living CCR Realtors. He started his Real Estate career back in 2008. He has been doing Real Estate full time since the first day he started. The reason he got into Real Estate was based on a few things. He loved helping people in the community and he has been in sales since the age of 18 and decided that he might as well get into something that he has a passion for and make it a career. He is very active in community events around the area and is always willing to lend a helping hand. The past 3 years Jason has been a Million Dollar Producer and plans on keeping his streak going and pushes himself to become a five million dollar producer in the next few years. Jason is a member of the Young Business Professionals and was on the golf committee for the board office. He is very easy to get along with and would love to have the opportunity to be a member of the West Central Association Board of Directors. TIM PARKER – Berkshire Hathway Home Services (Candidate for Director) Realtor since 2004. Moved to Lima, Ohio and joined the West Central Association of Realtors in 2010. I have been happily married to my LCC grad, Shandra, for 24 years. We have 4 children ranging from our eldest at 20 to our youngest at 11. I am currently serving as President of the Bath Schools Parent Teacher Society of which I have led fundraising efforts over the past year to increase our ability to contribute to our schools and community in amounts exceeding all predecessors by 25%. I have been chosen as a member of the select committee for the Century Celebration for Saint Gerard's church of which I have been a member since 1990. This year will also be my 8th season working with the Columbus Blue Jackets professional hockey team and I, as most of you are, am hoping that this one brings the Stanley Cup to Ohio! I have accepted the nomination to run for the West Central Board of Realtors at the request of a few of our fellow brokers because I recognize the hard work and dedication that it takes to be a Professional Realtor. I believe that I understand what actions can be taken by our local Board to best support you and, even more importantly, stop those actions of the Board which may hinder your ability to perform at your individual best. KATE SHULAW- Real Living CCR, REALTORS® (Candidate for Director) Kate was born and raised here in Lima, left for a short time to attend The Ohio State University where she earned her Associates of Arts degree, then continued on to get her Bachelor’s in Business from Tiffin University. She returned to Lima after college and worked many years in the customer service/upper management field. She is the mother of 4 very active boys and married to fellow Realtor Steve Shulaw. Since getting her Real Estate License in 2012, she has tried to get fully immersed in the business in any aspect she can. She has served on the RPAC committee and the Technology Committee at the West Central Association of Realtors as well as researched ways to use technology to make our jobs more efficient. She truly enjoys working with people and serves on 2 non-profit organization boards; Lima Junior Service League an organization dedicated to children's literacy and P.E.O. an organization of women helping women succeed through education. In her free time she enjoys Crossfit and an occasional trip to the Casino! She is honored to be asked to run for a Board of Directors position and looks forward to the challenges of the position. Her goals for the Board are to make it a source for fellow Realtors to come for advice, help, and training. JAYLENE SMITH – Ron Spencer Real Estate (Candidate for Director) Jaylene is a lifelong resident of Allen County and currently lives in Shawnee with her family and enjoys all of the activities that they participate in. She enjoys watching her girls cheer and tumble as well as watching sports and doing crafts. She had an early experience with real estate as her parents owned rental properties for many years and bought and sold homes. She has worked in real estate for 13 years now, starting as an administrative assistant and eventually taking classes, getting licensed and becoming the Office Manager of Ron Spencer Real Estate. She has been on the Nominating Committee and the RPAC Committee and would welcome the opportunity to participate in the continuation of what is in the best interests of the Board Office and namely our members. Her goals for the Board are to help increase the participation of Realtors in our Board. She stresses that we need more interest in and participation in activities and discussions regarding our ever changing profession. SCOTT WEAVER - Real Living CCR, REALTORS® (Candidate for Director) Scott was born and raised in Lima, graduating from Lima Senior High School in 1997. He became a licensed Realtor in 2012 as a member of the Dayton Board of Realtors. He previously worked at Bill Lee & Associates, ReMax Alliance and Keller Williams Advantage, all in the Greater Dayton area. He joined Real Living CCR in December of 2014 and achieved Million Dollar producer in his first six months. He currently serves on the Community Service Committee and MLS Committee. His goals for the Board are to bring our board up to speed with the larger markets in Ohio from a marketing and policy stand point. He hopes to offer an out of the box perspective. He is a big Ohio State fan, loves to play golf and is an avid runner.
