or liquidators are increasingly compelled to put
property up for sale under execution. This type of
sale, however, seldom results in price optimization
for either residential or business property. Partly
for this reason, auctions are sparingly made use of

Calling out the word ‘mine’ was until now the only way
to make one’s will known. In these days of rapid internet
connections, simple provision of information and efficient
communication technology, a method is now available
which significantly improves the legal manner in which a sale
under execution is conducted. DTZ Zadelhoff combines the
traditional manner of conducting an auction with interaction
with bidders through the internet.
This has considerable advantages:
• Low-threshold and much simpler participation than in
traditional auctions, as potential purchasers do not need to
be present in person but can make real-time bids;
• You can reach a larger group of interested parties, which
usually results in a higher price. DTZ Zadelhoff’s network

many potential interested parties for your property;
• Legal, structural and financial information about the
properties to be auctioned is easily made accessible in a
digital data room, linked to the auction site. This means

Sales under execution through the internet
If desired by the vendor, interested parties may be offered
the opportunity of making a bid until a specified time prior to
the online auction process. DTZ Zadelhoff’s property agents
are proficient in conducting such a negotiation process as
effectively as possible. In a sale under execution, a sale by
private treaty is possible subject to the permission of the
court in interlocutory proceedings and the mortgage holder
selling the property by execution. In the last resort, the
properties are offered for sale by public auction.
Online property auction
In the days when there were no fast computers, vendors
and purchasers met on the trading floor and expressed
what they wished to trade and at what price through words
and gestures. The sale under execution of property still
follows this procedure in the Netherlands, with strict rules,
usually laid down by law:
• The auction must take place in the presence of a civil-law
notary;
• The auction must be a public Dutch auction (sale in two
sessions: highest-bid session followed by a descendingprice session);
• In the highest-bid session, the bids must be made openly
and in a clearly visible manner;
• In the subsequent descending-price session, the word
‘mine’ must be called out when the auctioneer calls out the
amount.
The new platform means that DTZ Zadelhoff is able to
provide a customized sale under execution. The system of
internet bidding used by us has been carefully tested; an
online auction complies with the legal requirements and is
secure.
DTZ Zadelhoff organizes auctions where purchasers can
also bid online. Every auction is announced well in advance
through dtz.nl and the website of BVA Auctions. This gives
interested parties plenty of time to register, view the property
and ask any questions. DTZ Zadelhoff uses this period to
put your property on the market. The sales through our
auction platform are by Dutch auction. Making one’s bid
known during the highest-bid session and calling out ‘mine’
during the subsequent descending-price session is a matter
of pressing a button on the website.
