December 2009 • Vol. 46 No. 12 The Official Publication of the Arizona MultiHousing Association Valley Vacancies Remain High, New Construction Slows, Rents Fall VALLEY Average monthly rent in the Valley in third quarter 2009 was $752, down from $770 observed one year ago. (The AMA at its September 2008 Perspectives and Projections Arizona Apartment Outlook conference forecasted falling rents for the coming year.) The North Scottsdale/Fountain Hills submarket recorded the Phoenix metropolitan area’s highest averageasking rent during third quarter 2009 at $912, compared to $976 observed in third quarter 2008. (The June 2009 edition of Apartment News reported that continued rent reductions in the area were likely within the year.) The weighted average monthly asking rental rate for each of the top five submarkets is lower than it was in third quarter 2008. Competition from foreclosed single-family homes as rentals and owner-occupied units, economic weakness and record-high vacancies have forced landlords to lower rents. New apartment construction is a fraction of what it was just one year earlier. The Valley’s lowest average rent in third quarter 2009 was in the West Central Phoenix submarket at $560, compared to $598 one year ago. Average rents in the Central Black Canyon submarket have fallen to $579 from $604 during the same period. The September issue of Apartment News reported that these areas would see falling rents in the foreseeable future due to job losses and continued after-effects of the employer sanctions bill. The South Paradise Valley submarket saw asking rents decrease to $620 from $712 since last year. Area vacancies in third quarter 2009 stood at 11.9 percent. South Scottsdale submarket vacancies stood at 15.9 percent, and rental reductions of 9.5 percent are necessary to combat area vacancies. Almost one-quarter of these complaints (23 percent) concerned a failure to provide a reasonable accommodation for someone with a disability. The Fair Housing Act defines "disability discrimination" to include the failure of a housing provider to provide reasonable accommodations necessary to permit a resident or applicant with a disability to use and enjoy a dwelling. To establish a claim of a failure to accommodate, the renter or applicant must show the following: • He or she is a person with a disability, in that he or she has a physical or mental impairment Professional Publishing, Inc PO Box 30327 Portland, OR 97294-3327 that substantially limits or restricts one or more of his or her major life activities. • He or she must make management aware of the disability. • He or she has requested a reasonable accommodation to help him or her overcome the effects of the disability and to use and enjoy the premises. • Management has denied the accommodation. I have been in this apartment business for over 22 years and know how difficult times have been for many. Although signs point to continued difficulties in the economy and, specifically, the multi-family industry I know that our continued hard work, commitment and, most importantly, friendship will endure us to success and the stability of our great industry. We have to work together, lock arms and battle through these times. A brighter time certainly lie ahead and although financially 2009 was not the greatest year for the AMA there are many, many successes that we can celebrate. With my final column as your AMA chair, I’d like to take this opportunity to look back on 2009 and the accomplishments of the Association. GOVERNMENT AFFAIRS ACTIVITIES Government affairs continue to be the most important focus of the AMA. In 2009, we were instrumental in protecting the interests of our members on both the state and mu- nicipal level. Here’s a recap of this year’s successes: • 2009 Legislature o HB2220-Private Property Trespass Towers. The AMA helped defeat this proposal that would have made property owners and landlords liable for towing expenses if a towed vehicles owner refused to pay towing-affiliated charges. o Development Impact Fees. We supported legislation included in the 2010 state budget that: • Freezes development impact fees effective June 5, 2009-June 30, 2012. • Implements development impact fee reforms, including a 24-month “grandfathering” of impact fees upon site plan approval. • Implements a building code lockin provision that will “grandfather” projects that have received site plan, PAD or similar approval until June 30, 2012. • Municipal o Tucson. The AMA successfully defeated a city proposal to implement a 2 percent sales tax on rent. This action will save the industry approximately $12 million annually. o Casa Grande. After successful lobbying by the association, the city adjusted their multi-family The Arizona Multihousing Association: waste water rates to a consumption formula, thereby saving 10 city properties $200,000 each year. o Buckeye. The town changed its methodology for calculating water and waste water impact fees thanks to the AMA and its government affairs team. Buckeye will now use a per-unit calculation rather per-meter. If this didn’t occur, impact fees would have increased by almost 1,000 percent, costing the industry almost $4,400 per unit. As we enter a new year, our government affairs team, led by consultant Courtney LeVinus and the Government Affairs Committee, remains vigilant of issues that could potentially impact our industry. I’d like to thank them for their hard work in helping us protect our interests. With over 80 seminars on topics ranging from leasing techniques to preventive maintenance, our education program ran the full gamut of subjects important to the operations of your rental properties. As relatively small independent property managers, the Independent Rental Owners Council (IROC) provides us an opportunity to communicate and learn how to better our business. The Council’s monthly meetings are geared to provide the tools to do just that. As we approach 2010, most of us should have completed our goal planning for the new year. It’s never too late to consider a few last-minute additions, and I’d like to use this column to address these. THE RENTING PROCESS There are small property owners who cross the line of privacy and expectations, and they cannot distinguish between the ownership of the property and the residents’ rights to its quite enjoyment. Then we have the doubters, desperate individuals who agree to everything to fill the unit in high hopes of obtaining a renter who pays on time and takes care of the property. What can we learn from the larger apartment communities? In short: The leasing process. When an individual is interested in the property, he or she sits in an office, reviews the available units, provides an identification card, and then previews a model or available unit. (The leasing staff will not show available units unless they ready for occupancy.) Although this typically is not the case for the IROC member, there are some considerations: • Completing the application. Make sure the applicant fills everything at this time. Not answering a question is not lying. If the individual answers “no” to whether he or she has had a felony conviction and you find out later that he or she has, this creates grounds for an immediate termination. • Go over the lease with the resident and explain your expectations as well as the terms of the contract. (The AMA has a very good lease written by attorneys who spend their lives in court defending property owners. The lease is available to members at www.azama.org.) • • • • • Aside from the actual leasing process, here are additional tips for your rental operations: • spend two months getting bids to repair a shower enclosure, thereby forcing the resident to use one shower. It is not about you saving money; it is about providing your renters with what they leased, such as more than one shower, in this case. Do not show properties alone. Have your property rent ready when possible before showing. Run credit and criminal background d checks. Require renters insurance before your residents move in. Stand firm of due dates and five-day notices. Have an attorney who specializes in landlord-tenant issues on your team. • Look at your bookkeeping system. Many types of systems are available, along with classes that show how to maximize their use. Check into an undated version of what you are currently using. • Repair the property in a timely manner. It really is not acceptable to I encourage all IROC members to attend our monthly meetings, where you’ll learn even more tips for successful operation of your rental investments. (Safety Awareness Family Education) this past spring, and over 125 communities hosted events where residents and neighborhoods learned tips on such topics as identity theft, stolen vehicles, household fires and dangerous situations and encounters. On behalf of the AMA, I’d like to personally thank them for their commitment to the Big Hearts for Little Hands campaign and look forward to many more years of assisting these transitional housing facilities and the individuals who rely on their invaluable services. Continued rental rate decreases for the area are likely in the coming year. There were five submarkets with measurable asking rental rate increases from third quarter 2008 to third quarter 2009. Four of these submarkets accounted for 58 percent of the new apartment inventory added Valleywide through third quarter 2009. New units will usually pull area average asking rents up, but under current market conditions, the actual rent growth is negligible or negative. The lone exception is the Northwest/ Southwest County submarket, which saw no units built in 2009. VACANCY Phoenix-area vacancies rose to 15 percent in third quarter 2009 from 13 percent in third quarter 2008. This is the second highest vacancy rate reported by AMA for the Valley apartment market. (The AMA at its Perspectives and Projections conferences in September 2007 and September 2008 reported that climbing vacancies for the Phoenix area apartment market would occur in the future.) The contributing factors include area single-family and multifamily foreclosures, weakness in the area’s job market and the addition of 3,178 units since the beginning of 2008. As noted in the September issue of Apartment News, Central Black Canyon and West Central Phoenix submarkets would continue to have devastating vacancies. Each of these areas is facing continued competition from singlefamily homes—both as rental units and as owner-occupied units—and from area foreclosures. The September issue of Apartment News reported that rents for these areas would likely continue falling as a result. CONCESSIONS The percentage of communities offering concessions in third quarter 2009 stood at 87 percent, the highest level since third quarter 2003. The area also had the Valley’s seventh lowest rental rate and seventh highest vacancy for the period. (The September 2008 edition of Apartment News reported that area concessions and vacancies were likely to remain high and that rent growth was likely to be vapid.) Each of the top five concession ratio submarkets were above 90 percent for the period. It also had the Phoenix area’s highest percentage-point gain in vacancy from third quarter 2008 through third quarter 2009 and the area’s fifth highest va- cancy overall in third quarter 2009. Asking rents have increased 7 percent since last year, and there were an additional 470 units added to the submarket this year. Area concessions will increase in order to reduce vacancies. NEW CONSTRUCTION The Valley in third quarter 2009 saw the addition of eight projects totaling 2,121 units. This compares with eight projects totaling 2,268 units in third quarter 2008; four projects totaling 663 units in third quarter 2007; seven projects totaling 1,812 units in third quarter 2006; six projects totaling 1,294 units in third quarter 2005; seven projects totaling 1,780 units in third quarter 2004; four projects totaling 1,063 units in third quarter 2003; and four projects totaling 662 units in third quarter 2002. Founded in 1992 by former officer Tim Zehring of the Mesa Police Department, the Crime Free MultiHousing Program (CFMHP) offers landlords and rental property operators the necessary tools for keeping crime off their communities and maintaining a safe environment for their residents. The need for such a program arose from the number of service calls Zehring and the department received from apartment communities throughout the city. Determining that there had to be a better way to address the issue of calls for service by the police department, he founded the CFMHP, now utilized by police departments throughout the United States, Canada, Australia and other countries. THREE PHASES CFMHP includes three phases: Phase 1: An eight-hour training class for owners, managers, leasing agents, maintenance and other staff members. Phase 2: The Crime Prevention Through Environmental Design (CEPTED) inspection. A CFMHP coordinator will conduct both daytime and nighttime CEPTED inspections of the property, focusing on such areas as landscaping, door locks, peep holes, lighting and other areas or items easily altered to prevent “crime pockets.” Phase 3: A resident function or “social.” Management will invite 4 As of third quarter 2009, there were three projects totaling 665 units under construction in the Phoenix metropolitan area. The agency representatives will describe the program and why resident participation is imperative for its success. CFMHP not only teaches apartment staff about the program, but also about fair housing principles, drug recognition, landlord-tenant regulations and eviction laws. The applicant shall agree to abide by the provisions of the Articles of Incorporation, the Bylaws of the association, and by the Code of Conduct prescribed by the association. The applicant will then be classified as a Provisional member. During this period, the Provisional member will have the rights and responsibilities of full membership. Within 60 days of applying for membership, the names of the Provisional members will be published in Apartment News, and existing members will be encouraged to provide comments on the suitability of the application. If no negative comments are received from existing members within 90 days of membership application, the Provisional member will be deemed automatically approved into membership. If any negative comments are received, the Ethics Review Board must review the application Regular Members within 120 days from the receipt of the negative comment and recommend to the Board of Directors the acceptance or rejection of the application. If the Ethics Review Board does not recommend acceptance of a Provisional member, the Provisional member must be notified and given the opportunity to request a hearing pursuant to the Bylaws. If the directors reject an applicant, the AMA refunds all membership fees paid except for a $35 application-processing charge. The facts in this case were not disputed. The renters entered into a residential lease agreement with the landlord. Included in the lease was a provision entitled “Rent Payment” that stated: If resident, for any reason, fails to honor the full term of this rental agreement, the resident agrees to pay management a lease break fee equal to two months’ rent as determined by the current monthly rent resident is paying. The residents breached the lease two months before it expired and paid two months’ rent, minus a security deposit. PETS A COMMON EXAMPLE One of the most common examples of a reasonable accommodation request is when the resident requests that the property waive its pet rent and pet deposit requirements for his or her animal. Even if the renter has no obvious physical impairments, but tells the management staff that he or she needs the animal to help him or her out, management can either grant the accommodation if it seems reasonable or engage in an interactive process to discover additional information about why the person needs the particular accommodation sought and whether it would be reasonable under the circumstances. At the time the check came back, the renter had just passed As part of this interactive process, the landlord may ask the resident to provide additional information about his or her limitations; a letter or other certification from a medical or other provider that establishes that the resident is a person with a disability; and an explanation of how the particular accommodation sought will help the individual use and enjoy the property. Management can request medical evidence of the need for the accommodation, unless the need is evident without medical evidence. For example, it would be inappropriate to require a person who is obviously blind to prove that he or she could not see before allowing him or her to have a seeing-eye dog. On the other hand, if the person has an invisible disability or if the need for the accommodation is not evident, then it is appropriate to ask the individual to demonstrate the medical need for it. Landlords should keep confidential any medical information and should reveal it only on a need-to-know basis. A : away. However, the Fair Housing Act does not allow for exclusion of individuals based upon fear, speculation or stereotype about a particular disability or persons with disabilities in general. A determination that an individual poses a direct threat must rely on an individualized assessment based on reliable, objective evidence, such as current conduct or a recent history of overt acts. This assessment must consider for following: • The nature, duration and severity of the risk of injury. • The probability that the injury will actually occur. • Whether there are any reasonable accommodations that will eliminate the direct threat. When management is evaluating a recent history of overt acts, it must take into account whether the individual has received intervening treatment or medication that has eliminated the direct threat. In such a situation, a landlord may request that the individual document how the circumstances have changed so that he no longer poses a direct threat. Management could also obtain satisfactory assurances that the person will not pose a direct threat during the tenancy. If management has made the determination to deny the request for accommodation because it is not reasonable, it should discuss with the person whether there is an alternative accommodation that would effectively address his or her disability-related needs without a fundamental alteration to the provider's operations and without imposing an undue financial and administrative burden. If an alternative accommodation could effectively meet the person's disability-related needs and is reasonable, management must grant it. Consequently, the interactive process in which management and the individual discussed the disability-related need for the accommodation is essential. It is in the best interest of the landlord to carefully analyze all accommodation requests at the management level and refrain from quick judgments until a complete assessment of all the facts and circumstances can occur. q Scott M.
