The Board Chairman will call individuals to speak in the order listed on the sheet provided. The Board would like to remind everyone in attendance that to avoid violations of individual rights of privacy, a member of the public wishing to address the Board during this time will not be allowed to make comments about any student, staff member, or member of the general public during his/her designated time to speak. In addition the Board will not hear comments on contested cases or other adjudicative proceedings. Depending on the number of persons who wish to address the Board, the Board Chairman may place reasonable time limits on comments, in order to maintain and ensure effective and efficient operations of the Board. By law the District cannot take any action on any matter discussed during the "public comment" portion of the meeting, until such time as the matter is specifically noticed on the agenda, and the public has been allowed the opportunity to comment. We will convene in the high school library at 6:30. Since it is a student issue the meeting should be closed to the public unless the parents request otherwise. I suggest the board review the information regarding expulsion proceedings. Superintendent Board Notes For April 13,2015 Regular Meeting 6.1 We had a Facilities Planning Meeting on March 25*' We used that time to go over the recommendation and prepare for the presentation to the board. 6.2 The labor management committee met with the administrators to discuss a pay matrix. The most recent will have been on the morning of the 13"^. 7.1 I will have an update from the legislature hopefully. Bills of note this time are HB 373 and HB 377. 8.1 LaNette would like to introduce the new MTSBA president Paul Finnicum. 8.2 John Eisen will be at the meeting to make the presentation of the recommendations about facilities to the board. 8.3 At the last meeting we discussed the Third Party Property Manager as a way to deal with our staff housing issue. We received one proposal from Connie Smith for $350/month. I recommend that we go with that proposal 8.4 Policy 3350 Extra Curricular/Co-Curricular Drug Testing will be presented for the first reading. 8.5 Donations - none at this writing. 9.1 High School Hiring: The principal will present the list of teacher hirings for the next year. I would also recommend Wade Murphy as Principal and Stephen Schreibeis as assistant. With any luck at all we may have some new hires to present as well. There will be one non-renewal recommendation from Mr. Murphy. 9.2 Elementary Hiring: The building principals will present a list of teacher hirings for the next year. I also recommend Willie Thibault as middle school principal, John Larsen as Lincoln principal, and hopefully I will have a recommendation for the Jefferson elementary position by meeting time. There are new hires to be considered as per the agenda. CALL FOR ELECTION R Farber briefly reviewed budget projections. P Denning moved Jenifer Knutson s e c o n d e d to adopt the following resolution to call for a T r u s t e e election and an Elementary S c h o o l District #1 G e n e r a l F u n d levy election. WHEREAS, this School Board has determined that on May 5, 2015 an election of the registered electors for Glendi Elementary School District # 1 and Dawson High School will be held for t h e purpose o f electing three (3) Trustees f r o m School District # 1 each for a three (3) year t e r m ; one (1) Trustee f r o m School District #3675, for a t h r e e (3) year t e r m ; and one (1) Trustee f r o m School District #367N, for a one (1) year t e r m . WHEREAS, this School Board has determined that an election of t h e registered electors for Glendive Elementary School District # 1 be held for the purpose of voting on the question of w h e t h e r t h e Board of Trustees of t h e Unified Board of Glendive, Montana, shall be authorized t o run additional levies for t h e purpose: Of providing funds t o support the General Funds for the proper maintenance and operation of the school programs, building, altering, repairing, or enlarging any . school house of the district, furnishing additional school facilities for the district, acquisition of land for said Glendive Elementary School District # 1 for the 2015-2016 school year beginning July 1 , 2015. If it is later determined t h a t any portion of the election is not required, t h e Board of Trustees authorizes Anne Sadorf, election administrator, t o cancel t h a t portion of the election in accordance w i t h 13-1-304 and 20-3-313, MCA. The election administrator will appoint t h e following qualified individuals t o act as judges at t h e voting place: Pat Boje; Agnes Kinney; Judy Reddig; Collette W i l b u r n ; and counting board judges, LeLe Hunemuller, Donava Oas; Rita Edwards; and Marion Chouinard. Alternate - Connie Undem. If any of these judges should not be able to serve, the election administrator will choose a replacement f r o m certified judges. The election will be held at the Dawson County High School for Elementary District # 1 and Dawson High School. High School Ballot issues for outlying districts will be held at Lindsay School Dist. #367 and Deer Creek Elem. #3. Polls will open at 12:00 noon. Once opened, the polls shall be kept open continuously until 8:00 P.M., except t h a t whenever all t h e registered electors have v o t e d , the polls shall be closed immediately. Absentee ballots will be available for voting at the County Clerk and Recorder's office on April 15, 2015, t w e n t y (20) d a y ^ prior t o t h e election, until noon t h e day before t h e election. His s c h e d u l e did not allow him to be present at the March meeting. Mr F i n n i c u m will attempt to attend the April T r u s t e e meeting. MTSBA SURVEY L Simonton a s k e d all m e m b e r s p r e s e n t to complete the M T S B A s u r v e y recently distributed. 202723 REPORTS W Murphy reported that the pole v a u l t pits n e e d to be replaced at a n anticipated c o s t of approximately $20,000. CUSTODIAN wages will be billed at actual costs and paid to the District. These fees and regulations apply to all bookings. In figuring rental fees, a portion of an hour will be considered the same as a full hour, and the time will be determined by the administration or representatives designated by the administration. The procedure for facility rentals will be established by school administration and will be handled by the building principal's office. Adequate supervision is required for any activity utilizing District facilities. Failure to provide satisfactory supervision vvdll be grounds for denial of requests for future facility use. Any waiver of rental fees will be determined by appeal to the District Board of Trustees at a regular scheduled meeting prior to the scheduled event. Grounds for the waiver may be, but are not restricted to, any activity that will benefit the students of Glendive Public Schools and where a profit is not being made. Any special restrictions, obligations or accommodations will be listed in the lease agreement. Studies throughout the United States indicate that education alone, as a preventive measure, is not effective in combating substance abuse. Our commitment to maintaining the extracurricular and cocurricular activities in the School District as a safe and educational environment requires a clear policy and supportive programs relating to detection, treatment, and prevention of substance abuse by students involved in extracurricular activities. Scope Students participating in any extracurricular or co-curricular activity represent the community, the school and their peers. When a participant uses illegal substances and/or alcohol, such use impinges upon the team's motivation, cohesiveness and performance. As a result, the well being of the individual, the team, and the general school community is diminished by the participant's use of illegal substances and alcohol. As participation in any extracurricular activity is a privilege, those students voluntarily subject themselves to a degree of regulation higher than that imposed on students generally. Students who voluntarily participate in extracurricular activities have reasons to expect intrusions upon normal rights and privileges, including privacy. The Dawson County School District will test student participants in any extracurricular activity for illegal substance and alcohol use by administering urine analysis or saliva analysis tests. This policy applies to all Dawson County School District students participation in extracurricular activity sponsored or sanctioned by the Montana High School Association [MHSA). Definitions Drug: Any substance considered illegal or controlled by the Food and Drug Administration Student Participant: Any student participating in any extracurricular or co-curricular activity under the control and jurisdiction of the Montana High School Association and/or Dawson County High School Activity Season: Fall, Winter, and Spring seasons begin with the first day of practice/participation allowed by the MHSA/Dawson County High School, and end after the final competition for that activity and the student has returned to Dawson County High School or having been released to their parent or guardian. Positive: When referring to a drug use test administered under this policy, "positive" means a toxicological test result that demonstrates the presence of an illegal drug or the metabolites thereof using the standards customarily established by the testing laboratory administering and evaluating the drug use test. Illegal Drugs: Any substance that an individual may not sell, possess, use, distribute, or purchase as defined by either federal or Montana law. In addition, "illegal drugs" include all prescription drugs obtained without authorization, all prescribed and over-the-counter drugs, or other substances being used or misused for an abusive purpose, faux drugs, alcohol, tobacco, and drug paraphernalia. Consent Form 3350 It is mandatory tliat eacli student wlio participates in extracurricular activities sign and return the Consent Form prior to participation in any extracurricular activity. Failure to comply will result in nonparticipation. Each extracurricular participant shall be provided with the Consent Form which shall be read, dated and signed by the participant and by the parent/guardian. In doing so, the student is agreeing to participate in the random drug-testing program at Dawson County high School. Frequency of Testing The following provisions apply to the frequency of testing: One hundred percent of the student participants will be tested at the beginning of each season or activity. The initial screening will occur anjrt;ime from the first day of practice to the day preceding the first contest/event. The following participants will be the different pools for the specific seasons: Fall: Football, Cross Country, Golf Volleyball, Fall Cheer Team Winter: Speech & Drama, Wrestling, Boys Basketball, Girls Basketball, Winter Cheer Team Spring: Track, Tennis, Softball, Music Random testing may occur during an activity season. Up to twenty-five (25) percent of all students participating, regardless of activity, may be tested on a periodic basis. Once a student is in the pool, they will remain in the pool for the remainder of the activity calendar year. Verification of Legal Drug Use Student participants who are drug tested under this policy will be given a reasonable opportunity to submit verification of legal drug use. At the time of the testing, each student will be given written notice that he or she has forty-eight (48) hours to submit verification of any prescription drug use by providing a copy of the prescription to the building administration in a sealed envelope. The building administration will submit the sealed envelope, unopened, to the testing laboratory for consultation in making an analysis. The information regarding the use of prescription drugs is confidential and will not be shared with any school official. If the student fails to provide timely verification of legal drug use and tests positive, he or she will be subjected to retesting. Sample Collection/Confirming a Test Result Any drug test will be administered by or at the direction of a professional laboratory chosen by the Dawson County School District. The professional laboratory shall be required to use scientifically validated toxicological testing methods, have detailed written specifications to assure chain of custody of the specimens and proper laboratory control and scientific testing. All aspects of the drug testing program, including the taking of urine specimens, will be conducted so as to safeguard the personal and privacy rights of the student to the maximum degree possible. The test specimen shall be obtained in a manner designed to minimize intrusiveness of the procedure. The District may choose to collect urine or saliva samples. 3350 An initial positive test result showing the presence of an illegal drug or the metabolites thereof, will be subject to confirmation by a second and different test to be collected within 24 hours at a secure site. School administration will arrange an appointment for a second sample to be collected. Failure by a participating student who has tested positive to arrive for a second test will be treated as a positive and subject to discipline outlined in DCHS policy. A drug test shall not be treated as "positive" and treated such as unless the second test is also positive. The testing l a b o r a t o r y w i l l notifythe supervising school administrator of any confirmed positive test. The school administrator will schedule a conference with the student (and parent-guardian if under age 18) and explain to the student that there is a confirmed positive test and give the student the opportunity to submit additional information to the administrator or the testing laboratory to challenge the confirmed positive test. The student may submit additional information challenging the confirmed positive test. If he or she challenges the test, the school district will rely upon the opinion of the testing laboratory as to whether the confirmed positive test has been satisfactorily challenged or negated by that new information, such as whether the positive test result was produced by something other than consumption of an illegal drug. At that time arrangements will be made for the participating student to submit to a second test. If this second test also test positive, the participating student will be subject to discipline as set forth by DCHS policy. After receiving the report of a confirmed positive test, if the student admits to using illegal drugs, the student will be subject to immediate discipline as set forth by DCHS policy. Appeal An activity student who has been determined by the principal/activities director to be in violation of this policy shall have the right to appeal the decision to the Superintendent or his/her designee(s). Such request for review must be submitted to the Superintendent in writing within two (2) calendar days of notice of the second positive test. If the appeal is not successful, discipline will be imposed as set forth by DCHS policy. A student requesting review will remain eligible to participate in any extracurricular activities until the review is completed. The Superintendent or his/her designee(s) shall then determine whether the original finding was justified. No further review of the Superintendent's decision will be provided and his/her decision shall be conclusive in all respects. Confidentiality The results of the test will be made available to the designated personnel. To keep the positive test results confidential, the designated personnel will only notify the principal, activities director or designee, the student, the head coach/sponsor, and the parents or custodial guardian of the student of the results. The principal/activities director or designee will schedule a conference with the student and parent or guardian and explain the student's opportunity to submit additional information to the principal/activities director or to the lab. Test results will be kept in files separate from the students other educational records, shall be disclosed to those school personnel who have the need to know, and will not be turned over to any law enforcement authorities. Training Rules 3350 A positive result will result in the application of the training rules found in the activities section of the student handbook. Non-Punitive Nature of the Policy Detection of illegal substances or alcohol obtained pursuant to this policy will not be used as a basis to discipline a student or penalize him or her academically. Such detection will not be made a part of a student's permanent record. Information regarding the results of the drug tests will not be disclosed to criminal or juvenile authorities absent legal compulsion by valid and binding subpoena and other legal process, which the school will not solicit. Refusal to Submit to Drug Testing A participating student, who refuses to submit to a drug test authorized under this policy, shall not be eligible to participate in any activities covered under this policy including all meetings, practices, performances, and competitions for the remainder of the school year. Additionally, each student shall not be considered for any interscholastic activity honors or awards given by the school. Testing Protocol The company/professional l a b o r a t o r y selected for conducting the drug testing must follow the standards set by the Department of Public Health and Human Services. It shall be required to use scientifically validated toxicological testing methods, have detailed written specifications to assure chain of custody of the specimens, and have proper laboratory control. All drug tests will be supervised by a school administrator or designee who is responsible for escorting students to and from the collection site. The students should not be allowed to go to his/her locker but should carry all personal belongings with him/her. All students being tested shall remain under school supervision until they have produced an adequate sample. The test must be completed within the time limit estabhshed by the company/professional laboratory. If the student fails to complete the test within the time limit, that student will be deemed to have refused to participate in the drug test. The testing process will be conducted so as to minimize intrusiveness and safeguard the privacy of the student to the maximum degree possible while still ensuring that the sample process is unadulterated. In order to maintain confidentiality, the container that contains the sample to be tested will not have the student's name on the container but will have an identification number as established in the testing protocol. // it is proven that a student has tampered with the sample or cheated during the sample collection process, the studentwill be ineligible for all activities for the remainder of the schoolyear. If a drug test occurs during the school day, the DCHS activity student shall be allowed to makeup any missed work during the time of absence from class. Faculty shall make all reasonable accommodations to assist the student in gathering the materials missed and/or completing the work. Immediately after the sample is collected, the student will return to class with an admit slip or pass signed by the supervising administrator or designee who shall also note the time when the student left the collection site. 3350 Financial Responsibility 1. The District will pay for the random drug testing and the second test of the same sample conducted to confirm an initial positive test. 2. The District will pay the reasonable costs for drug testing for students who have previously tested positive and are subject to the mandatory testing program. 3. Any additional tests or any testing done at the request of the student or parent-guardian are the financial responsibility of the student or parent-guardian. 4. Counseling and/or treatment of any kind provided by non-school agencies are the financial responsibility of the student or his/her parent-guardian. t DAWSON COUNTY HIGH SCHOOL EXTRACURRICULAR ACTIVITIES DRUG TESTING PROGRAM CONSENT FORM I have received and have read and understand a copy of the "Dawson County High School Extracurricular Activities Drug Testing Program" pohcy. I desire that participate in this program and in extracurricular programs at Dawson County High School and hereby voluntarily agree to be subject to its terms for the entire high school career [grade 9-12]. I accept the method of obtaining urine and/or saliva specimens, testing, and analyses of such specimens and all other aspects of the program. I agree to cooperate in furnishing urine and/or saliva specimens that my be required from time to time. I further agree and consent to the disclosure of the sampling, testing and results provided for this program. This consent is given pursuant to all State and Federal Privacy Statutes and is a waiver of rights to nondisclosure of such test records and results only to the extent of the disclosures in the program.
