Joedy Patrick of The Institute, The Source for Continuing Education,
LLC, will be instructing a con-ed class for the Northeastern Michigan
Board of REALTORS® on Friday, September 29, 2006 at the Big Boy
Restaurant in East Tawas. Joedy is a licensed Michigan real estate broker and member of MAR’s Public Policy Committee. Class will run
from 8:00 a.m. until 2:45 p.m. Cost of the class will be $35 for REALTOR® members and $45 for non-REALTORS® for those that register
prior to 9/13/06. Registrations received after 9/13/06 will be $45 for
REALTORS® and $55 for non-REALTORS®. To register, please send
copy of license ID card and check (payable to Northeastern Board) to

CRS Class
The Northeastern Board will be sponsoring a CRS class on November 6
& 7, 2006. The CRS designation is the highest awarded to sales associates in the residential sales field. It recognizes professional accomplishments in both experience and education. CRS training gives you
in-depth knowledge about business planning, making listing presentations, negotiating and closing smoother transactions, working in the
buyers’ and seller’s best interest and building a referral business. The
class being offered at this time is CRS 201, Listing Strategies for the
Residential Specialist. The cost is $175 for Northeastern Board Members and $325 for REALTOR® members. It will be located at the Quality Inn, West Branch. Registration will begin at 7:30 a.m. on Nov. 6,
class begins at 8:30 a.m. and ends at 5:00 p.m. for both days. More details to follow.

Once again, the annual election of board officers will be held
Thursday, October 5 aboard the AuSable River Queen. The following positions are open: Vice Presidents--Arenac, Iosco,
Ogemaw counties, President Elect, Secretary/Treasurer (all are
one-year positions) and 2 Director positions. Director positions are
for 3 years. If you are interested in serving in one of the positions,
please contact the Board Office.

NEW MEMBER ORIENTATION
An orientation class has been scheduled for August 8, 2006
at the Hale United Methodist Church. Registration begins at 8:30
a.m. with class starting at 9:00 a.m. and concluding at 5:00 p.m.
All members are required to attend the orientation class. A lot of useful information is disseminated during this class and it is especially
important for new members to attend. Contact the Board Office to
register.

Northeastern Board Golf Outing
Mark your calendars for Thursday, August 10, 2006. The 12th annual golf outing (scramble-type event)
will start with registration at 3:30 p.m. and tee off at 4:30 p.m. Cost is $21 per person (includes golf, cart,
and dinner) or $8 for dinner (non-golfers). Dinner immediately following (approximately 7:00 p.m.).
There will be door prizes and lots of fun--get a team together (or we can form teams) and join us for a
fun-filled evening!! More details to follow. If you would like to donate door prizes/cash for the outing,
please contact the Board Office.

For those of you wishing to complete your con-ed on-line, you may do this by going to the Board’s website,
www.prohomesellers.com and clicking the “on-line con-ed” link that is located on the left side of the page.
Follow the instructions from that link. We are working with Jack Miedema of Great Lakes Realty Systems,
Inc. to bring this service to you.
Implementation of MLS Fines
The Board of Directors appointed a Procedures/Guidelines Task Force to review some areas of concern:
Reports of lack of professionalism
Violations of advertising laws
MLS violations/disregard for data entry
The task force held discussions concerning the three areas of concerns and will be presenting their ideas at the
next broker meeting (time/date TBD). They did recommend to the Board of Directors that the Board begin imposing fines relating to incorrect/incomplete data that is outlined in the MLS Rules and Regulations. The task
force will be working with the MLS committee to clarify what will result in fines. They recommended a start
date of October 1, 2006 to begin imposing fines. Any questions may be directed to the Board of Directors.

DEER MANAGEMENT CHANGES
The Natural Resources Commission voted to approve several proposals for deer management in 2006.
Plus additional quotas for the areas open for antlerless licenses will be decided at their July meeting.
Some of the changes will be:
1. No more than three antlerless licenses may be bought by an individual statewide.
2. Antlerless licenses in the northern portion of the lower peninsula and in the upper peninsula may not
be used on parcels of land less than 40 acres. Although the TB Zone and the southern part of the
lower peninsula would not have to meet this acreage requirement of antlerless licenses.
3. Fourteen zone units will have no private or public land antlerless licenses available.
4. Eighteen counties in the state will have no public land antlerless licenses available.
5. All of the modified zone areas for Bovine TB will have a late antlerless season available.
WINDMILLS
Senate Bill 803, introduced by Senator Janson Allen (R-Traverse City), would change the General
Property Tax Act to specify that a “wind energy system” is to be personal property for taxes. Under the
General Property Tax Act, alternative energy personal property is exempt from taxation through 2012.
A “wind energy system” would include a wind turbine, an electrical generator, a control system, an inverter and a tower that uses moving air to produce power. This bill just reported out of the House Tech
and Energy Committee and is waiting floor action.
NATIONAL
CLEAN WATER ACT
The U.S. Supreme Court issued a decision on June 20, 2006 regarding the Clean Water Act. The decisions in two cases, involving the scope of federal jurisdiction over wetlands located on private property.
In Raponas vs. United States and Carabell vs. U.S. Army Corps of Engineers. The Act prohibits the
discharge of dredged or fill material into “navigable waters” without a permit. The Act defines
“navigable waters” as “the waters of the United States, including territorial seas.” To bring a wetland
under federal regulatory jurisdiction it must be shown that:
1. The adjacent water is relatively a permanent body of water like a river, ocean, lake or stream.
2. The wetland has a continuous surface connection with the water, but it is difficult to determine where
the “water” ends and the “wetland begins.”
Concurring in the judgment to reverse the Sixth Circuit, one Justice wrote his own separate opinion.
