After receiving a Bachelor of Laws Degree from Tulane Law School in 1966 he
became an Associate of Bailey & Mouton. From 1972 to present Billy has been
a member of Wm. H. Mouton Law Offices, A Professional Law Corporation and
from 1994 to present he is also the President of Lafayette Title Company. Billy has
been a visiting lecturer for many organizations over the years including the USL
Petroleum Land Management Degree Program where he lectures on Oil & Gas
leases, Farm Out Agreement, Louisiana Mineral Code, Community Property, and
Title Abstracting for Petroleum Operations. Billy is also associated and involved
with many organizations such as Acadian Home Builders Association, Louisiana
Home Builders Association, Lafayette Board of Realtors, Greater Lafayette Chamber
of Commerce, Vermilionville Historic Foundation, Inc. and Hospice of Acadiana, Inc.
Billy is married to Ramona Venable and has two children, Ben and Mona.

LETTER FROM THE 2ND Vice PRESIDENT
Dear LAPL Members:
I hope this letter finds everyone in great health and spirit and with plenty
of work. This time last year, I wrote this article from a cold hotel room in North
Little Rock, AR. Needless to say, it’s great to be back in South LA, where the
food is great and the folks are even better. It seems that there continues to be
a lot of work out of state, but there is still plenty of work to be found locally.
Last week, I attended the Gulf Coast Institute, Legends Night and October
luncheon with Scott Angelle. The speakers were great, but I have to commend
Scott Angelle on a fine speech and his continued support of our industry. The
turnout was impressive and there is a lot of praise to go around. As you might
suspect, there is a great deal of work that goes on behind the scenes and all
of you who worked on this project should be commended, especially Keith
Hebert.
In last month’s newsletter, Chris Roy asked for any comments, complaints
or compliments. On the front of the newsletter, there is a listing of all of the
Committee members’ phone numbers. Please do not hesitate to contact anyone
of us with any suggestions, etc. The LAPL is an organization for ALL of us. I urge
everyone to get involved in some capacity and give back to an industry that
has been very good to us.
There are a lot of new faces in our industry and I challenge every member
to get at least one new member to join our fine organization. The committee
is working hard on some new and progressive ideas that will benefit all of us.
Until we meet again, take a moment and thank God for the good times we
are experiencing and pray that we continue to reap the fruits of a bountiful
harvest.

Succession of Gore, 931 So.2d 1150 (La.App. 4th Cir.), writ denied 937 So.2d 394 (La. 2006).
Connie Gore executed a general power of attorney appointing Hazel Lansou, one of her two
daughters, as her agent and attorney-in-fact in 1996. In March of 2001, Mid-South Estate Planning, L.L.C.,
prepared the Connie C. Gore Revocable Living Trust and other documents. The documents were drafted
for execution by Hazel Lansou as the agent for her mother and they were so executed. As originally
drafted, the trust gave one-half to each daughter, or her descendants, as principal beneficiaries. Helen
Hipp, the other daughter, died on November 15, 2002.
On December 4, 2002, Mid-South prepared an amendment to the trust, which was executed by
Ms. Lansou as her mother’s agent. The trust was revised to have the principal allotted one-fourth to
Ms. Lansou and three-fourths to be divided equally among the grandchildren. Inasmuch as Ms. Hipp
had one child and Ms. Lansou had four children, this amendment reduced the share of Jeffrey Hipp, the
son of Helen Hipp, from one-half to three-twentieths.
Ms. Gore died on March 14, 2003. Ms. Lansou distributed the trust assets on the basis of the
amended trust. However, upon objection by Jeffrey Hipp, she agreed to return his share to one-half.
Ms. Lansou and her children then sued Mid-South and its agent for negligence which resulted in the
invalidity of the trust. The trial court in the negligence suit refused to consider the matter until the trust
and other documents were adjudged invalid. The present action was then brought for a declaration of
invalidity. The trial judge found the trust invalid. Mid-South appealed.
Louisiana Civil Code article 2997 provides that a power of authority must give express authorization for the agent to “Make an inter vivos donation, either outright or to a new or existing trust or
other custodial arrangement.” The power of attorney simply had no such provision. The judgment was
affirmed.
Although this decision is quite straight-forward, it should remind us that just because there is
a power of attorney attached to a document, it does not mean that the agent was granted authority
by such power of attorney to execute such document. We should also keep the requirements of Civil
Code articles 2996, 2997, and 2998 in mind as to those matters which must be expressly authorized.
Succession of Jenkins, 936 So.2d 268 (La.App. 2d Cir. 2006), No. 41,202 (7-26-06).
This appeal was dismissed on the basis that the judgment was not final. However, the Court’s
discussion of the merits raises very important legal issues, which hopefully will be resolved after remand
and subsequent appeal.
The decedent, Joyce Jenkins, was killed in her home in Shreveport on March 8, 2003. Her husband, Avery Jenkins, who had staggered into the Police Department covered with blood stating that he
may have hurt his wife, was charged with her murder. Mrs. Jenkins’ daughter opened her succession
and qualified as administratrix. As administratrix, Linda Parker filed a request to sell the family home.
Despite an opposition filed by her incarcerated step-father, the trial court authorized the sale. The trial
court ordered Mr. Jenkins to sign the deed. His agent, Susan Jenkins, eventually signed the deed on his
behalf.
Mr. Jenkins filed a motion to withdraw his share of the proceeds. The Succession opposed the
motion and requested reimbursement of maintenance expenses and mortgage payments. Before the
hearing, Mr. Jenkins died. His succession was substituted. After the hearing, the trial court entered
judgment denying the motion of Mr. Jenkins to withdraw his funds and granted the motion for reimbursement. However, no specific amount was set. (This lack was the basis for dismissal of the appeal
for lack of finality.)
The Court of Appeal found no basis for the authorization of the wife’s succession representative
to sell the husband’s interest in the community home. It succinctly stated the basis of its opinion as
follows:

Upon the death of Joyce Jenkins, the community property regime that existed between
her and Avery was terminated. See La. C.C. art. 2356. As Joyce died intestate, her children
(her only heirs) succeeded to her property, which was a one-half interest in the community
property. Avery then become one-half owner of his portion of the community. La. C.C. art.
2369.2. In other words, upon the termination of the community property regime, Joyce’s succession and Avery became co-owners of the former community property, and the provisions
governing co-ownership applied. La. C.C. art. 2369.1. Thus, the Curtis Lane home became
owned in indivision by the Succession of Joyce Rogers Jenkins and Avery Jenkins, who was
incarcerated and awaiting trial for Joyce’s murder.
The Succession of Joyce Rogers Jenkins then sought authority to sell the Curtis Lane
home at private sale, noting in its motion to the trial court that it already had a purchaser
for the property. . . . [W]e question the legal authority by which the trial court ordered Avery to sell his one-half interest in the home without properly following the procedure for a
judicial partition. See La. C.C.P. art. 4602. Moreover, the trial court clearly lacked authority
to order Avery, a co-owner of the property, to sell his one-half of the Curtis Lane home at
a private sale.
The Court ultimately concludes that despite such lack of legal authority, the sale was valid
because Avery Jenkins acquiesced and participated in the sale. We certainly question whether signing
a sale after being ordered by the Court to do so can be considered acquiescence. However, the more
important issue is whether the authorization was proper.
We tend to agree with the above-quoted legal rationale. Although dicta, it certainly makes a
compelling argument why the interest of the surviving spouse should not be subject to administration
in the succession of the decedent spouse. However, such ruling is contrary to prior jurisprudence, none
of which is cited. In Prejean v. First Mississippi Corp., 506 So.2d 885 (La.App. 1st Cir.), writ denied 508
So.2d 69 (La. 1987), a mineral lease, executed with court authority by the succession representative,
was held to prime a subsequent mineral lease granted by the surviving spouse as to her community
interest. In Succession of Pailet, 602 So.2d 152 (La.App. 5th Cir. 1992), it was even held that the
succession administrator of the second spouse to die could not sell her community interest while the
succession of the first spouse to die was still pending.
It appears that the issue of whether the surviving spouse has authority over his or her interest
in community property is unsettled at the present time. Therefore, one should obtain rights from
both the succession representative and the surviving spouse. If they are the same, it should be made
clear that they are signing in both capacities. If a succession is under administration and one wishes
to obtain a mineral lease on former community property, one should have the lease executed by both
the surviving spouse and the properly authorized succession representative – at least until this issue
is completely resolved.
Louisiana Crawfish Producers Association - West v. Amerada Hess Corporation, 2006 WL
1896205 (La.App. 3d Cir. 2006), 2005-1156, 7-12-06).
Over ninety commercial crawfishermen and their association sued eighteen defendants who
were allegedly engaged in oil and gas exploration, dredging and pipeline activities or providing surveying services for those conducting such activities. Plaintiffs alleged that in the course of such activities,
defendants created spoil banks and dams that impeded natural water flow in the Buffalo Cove area,
thus destroying the aquatic ecosystem and eliminating or greatly diminishing plaintiffs’ ability to catch
crawfish in Buffalo Cove.
The trial court found that the plaintiffs had no cause of action under Louisiana state law, but
reserved any rights they might have under federal maritime law. Plaintiffs appealed this ruling. The
Court of Appeal affirmed. It agreed with the trial judge that a plaintiff cannot recover for economic loss
resulting from physical damage to property in which he has no proprietary interest. The crawfishermen
did not own or have any economic interest in Buffalo Cove or the crawfish to be found there. Therefore,
even assuming the defendants caused the damages alleged, plaintiffs could not recover. They did not
own the cove or the crawfish.

LA LANDMAN 101
LA Landman 101 is now being offered to aide in the training and education
of entry-level landmen. Ceci O. Neustrom, CPL and Madeleine E. Kimbrell, as owners
of TitlePro LLC, developed the program last spring and have held seven seminars
to date in Lafayette, Bossier and Baton Rouge. Dozens of participants from around
the State, and as far as Texas, Tennessee, and Oklahoma have attended the two
and one-half day seminar, which includes one-half day hands-on training at the
local clerk of court’s office and two days of classroom-type instruction. The
seminar focuses on several of the most pertinent aspects of landwork, including
title research, property / mineral law, the mineral lease, and drilling & unitization
with Sonris application. In addition to Ceci’s and Madeleine’s presentations, two
sessions are presented by a guest oil / gas attorney and a guest landman. Students
receive an excellent resource book.
LA Landman 101 has been approved for 13.5 RPL points by the AAPL. The
seminar targets persons with little or no knowledge of the land profession; however,
students with over one-year’s experience have found it beneficial. Here are some quotes from the evaluations from the last seminar:

Walter K. “Dub” Rainbolt, Jr.: a native of Lafayette, Louisiana and the son of a former landman.
