LEE, JR., CPL, AAPL President Knute H. Lee Jr., CPL, is an independent landman from Albuquerque, New Mexico, and is the president of the American Association of Professional Landmen (AAPL). He began his career as a landman working for a family-owned oil and gas business operating primarily in the Williston Basin. He is the owner and operator of KHL, Inc., a privately held brokerage, oil, gas, mining and investment company, involved with land and drilling efforts, concentrating primarily in the western United States. Knute has been an active member of the AAPL since 1976, serving as treasurer in 1987, second vice president in 1993, first vice president in 2005, and as the AAPL region VIII director for more than 20 years. He has also served on numerous committees such as chairman of the educational foundation, the NAPE organizing committee, the annual meeting committee, the ad hoc compensation committee, the ad hoc name change committee, the issues management council and as the chairman of the prayer breakfast held at AAPL’s Annual Meeting. Knute has been the treasurer and vice president of the Rocky Mountain Association of Mineral Landmen and is the current president of the Albuquerque Petroleum Association. He is on the board of directors of the Independent Petroleum Association of New Mexico, has served as co-chair/membership for the Independent Petroleum Association of America and is a member of the New Mexico Landmen’s Association. He serves on the board of directors for a number of local corporations including Santa Fe Trust Company and the Albuquerque Petroleum Club. He is also a member of the Rotary Club of Albuquerque. He served on the board of trustees, is the past chairman of the personnel committee and has been a Sunday school teacher for more than 20 years at Hoffmantown Baptist Church. LETTER FROM MEMBERSHIP CHAIRMAN I hope everyone had a wonderful holiday season. I am confident everyone is now well rested and ready to commence the New Year with a rejuvenated zeal for work and life in general. Our last letter from our esteemed Secretary touched on LAPL’s increased efforts to expand the benefits of being a LAPL member and this effort is in full swing as a result of the LAPL recently conducting a comprehensive survey on its web site requesting membership feedback concerning a variety of membership benefits and events including the golf tournament, the crawfish boil, educational events, etc. This membership benefit initiative may already be paying off dividends as the LAPL has had a very successful renewal rate with current members and a significant increase in membership that includes both students and practicing landmen. I look forward to the continued growth of our noble professional association and the LAPL can only become a better association with the addition of more dynamic personalities who can offer their talents to the benefit of the LAPL and its future. I want to thank the LAPL for giving me the opportunity to serve as its Membership Chairman and I look forward to continued growth in its membership as a result of the Executive Committee’s commitment to developing a diverse array of benefits for the LAPL members. As an undergraduate at the University of North Dakota, Knute majored in business and sold door-to-door during the summers. While a student, he became active with Campus Crusade for Christ and eventually went to work for the Billy Graham Evangelistic Association. He is happily married to his college sweetheart, Annie. Their three children Kirsten, Kjelse and Cody are grown, “colleged, married and jobbed,” leaving time for travel, golfing with Annie, fishing on the San Juan River in New Mexico and working in the exciting oil, gas and mining industry. App 1 Cir. 12/6/06) illustrates the part tacking of possession plays in establishing ownership of immovable property by ten years acquisitive prescription. Plaintiff (“Mr. Mai”) filed a declaratory judgment action in 2002 alleging ownership of Lot 10, Square 9 of the “Addition to Roppolovilla” based upon good faith possession under title for more than ten years. On appeal the First Circuit Court of Appeal reversed the trial court and rendered judgment in favor of Mr. Mai. The Court stated the question to be resolved was whether Mr. Mai acquired ownership by acquisitive prescription. As Mr. Mai alleged ownership based on ten years good faith possession, the court found it necessary to determine whether Floyd had carried the burden of proving bad faith. The Louisiana Civil Code defines the good faith component of the requisites to establish title by ten year acquisitive prescription as a reasonable belief, in light of objective considerations, that the claimant is the owner of the thing he possesses (La. C.C.P. art. 3480). If possession has commenced in good faith, subsequent bad faith does not prevent the accrual of ten years prescription (La. C.C.P. art. 3482). If the Tabrizis and Susan Zare were in good faith when they purchased the lots on May 4, 1990, then Mr. Mai could tack their possession (add their possession to his) and become the owner of the lot through ten year acquisitive prescription even though he had possessed the lot for less than ten years. The Court apparently believed that the Tabrizis and Susan Zare were in good faith and commenced actual possession of Lot 10. Floyd attempted to disprove Mr. Mai’s good faith, but the Court found he did not carry the burden. However, Mr. Mai’s good or bad faith at the time of his acquisition, which occurred in 1996, was immaterial. As he had to tack the possession of his predecessors-in-title to accumulate ten years uninterrupted possession, the question was whether the possession to be tacked had begun in good faith. This case illustrates the benefit of tacking possession to establish title by acquisitive prescription. Although Mr. Mai did not possess Lot 10 for ten years, he was able to add the possession of the Tabrizis and Zare to his possession to establish title by ten year good faith possession. (Attention is called to the fact that Tabrizi was married when the Alberts sold Lot 10 to Tabrizi and Susan Zare and when Susan Zare sold her interest to Tabrizi. The Tabrizis were divorced before Mr. Mai’s purchase from only Mr. Tabrizi. The decision indicates that the Tabrizis acquired their interests as community property, but no mention was made whether Tabrizi acquired his wife’s interest. Louisiana Civil Code art. 3442 states that the transferee can tack the transferor’s possession if there has been no interruption of possession. It is not known if the Court considered whether the sale from Tabrizi to Mr. Mai was a sufficient link for tacking of possession as to ownership of the entire interest in the property. If the conveyance to the party seeking to tack possession actually affects only an undivided interest, it may be questioned if possession can be tacked as to the entire interest.) In summary, the requisites for acquiring immovable property by ten year good faith possession are that the initial possessor be in legal good faith when he acquires the property (has a reasonable belief, in light of objective considerations, that he is the owner of the thing he possesses), the possession continues uninterrupted from the initial possessor to the current possessor (either by onerous or gratuitous transfers, inheritance or legacy) and there is an act such as a sale, exchange or donation, sufficient to transfer ownership of the immovable.
