In 2006, we updated our Royalty Fee Schedule, particularly for reproduced music; the new Schedule better reflects the realities of today’s market and also incorporates significant changes to previous fee levels. At the same time, we were authorised by DILIA and OOA-S to collect royalty fees from TV broadcasting in public places. The year was without negative media campaigns, without legislative turbulence, without external shocks/jolts. To be sure, OSA contributed to this through our active media policy. The Department of Communications started operations, providing the media with dozens of statements and announcements. OSA was a partner of the Composition of the Year category of the prestigious Anděl Allianz Awards of the Academy of Popular Music. I would also like to mention in this context that in 2006 we hosted the first evening ceremony of what we expect will be a new tradition, the Annual OSA Awards, at which recognition is given to the most successful authors and musical works of the prior year. We believe that the trend begun in recent years will continue; that we will also succeed in the current year to improve our efficiency levels and approach those of our European affiliated societies; and that ultimately we will continue to improve our standing as well as those of our members and represented persons. Total royalty billings grew to CZK 513.6 million, which is CZK 75.8 million more than in 2005. ABOUT US INTRODUCTORY REMARKS III 6 III Allow me to take a brief look back at 2006, which was a good and successful year for OSA. Collections from granted licenses in the year grew by CZK 56.3 million to a total of CZK 631.7 million and represent an historic record. This was achieved with a virtually unchanged level of total expenses, so we can be pleased with another decrease in overhead expenses from 17.1% to 16.17%. I would like to thank all our employees and colleagues, who helped us attain this positive result. SUPERVISORY BOARD The Supervisory Board is OSA’s governing and supervisory authority. It is comprised of 13 members, specifically 6 composers, 3 lyricists and 4 publishers. Its members are elected by the General Assembly for three-year terms. Supervisory board The Music Classification Committee The Music Classification Committee assigns registered works to appropriate categories according to Amendment No. 1 to OSA’s Distribution Rules (Point Tables); expresses its views in disputes on authorship in respect of creative matters; resolves disputes between represented persons about authorship; and identifies possible plagiarism. The Committee has 9 members, of whom 8 are composers (4 from the field of classical music and 2 from popular music) and 1 lyricist. The Supervisory Board simultaneously appoints 4 alternates: 3 composers (1 from the field of classical music) and 1 lyricist. The reason for stating this is that in 2005 we received a one-time extraordinary collection from NOVA, the commercial televison operator, for payments due in 2002-2004. We experienced an increase in collections from private and public radio and television stations as well as from cable television operators. On the other hand, we received a significant decline in collections from operators of mobile content (ringtones). ROYALTY FEES COLLECTED IN 2006 In calendar year 2006, OSA achieved total collections of CZK 631,719,000 which is a growth of CZK 56,285,000 (+9.78%) over 2005. PUBLIC PERFORMANCE DEPARTMENT Despite the negative effect of the parliamentary amendment to the Czech Copyright Act regarding hotel rooms in February 2005, the Public Performances Department registered a total increase in collections in 2006 (+16.62%). In contrast to 2005, there were increases primarily in reproduced music (over 17%) and in live music (over 15%). Collections from central licensing was the major contributor to this growth. DOCUMENTATION DEPARTMENT The database of domestic musical works with or without lyrics in 2006 grew by 12,611 titles and as of 31 December 2006 reached 267,287 documented Czech musical works. In comparison with 2005, there was a stabilisation of collections from abroad, into which must be factored the stronger Czech crown. Nevertheless, the Department registered a slight increase in collections of CZK 541,000. DISTRIBUTED ROYALTY FEES IN 2006 In 2006, a total of CZK 353,999,000 in royalty fees was distributed to domestic rights holders and CZK 155,387,000 was distributed to foreign rights holders. Total royalty fees distribued during the year amounted to CZK 509,386,000. REPRESENTED PERSONS AND MEMBERS OF OSA IN 2006 As of 31 December 2006, OSA, a civic association, represented 5,604 rights holders, of which 3,219 were living authors, 2,360 were heirs to 1,573 deceased authors, and 69 were publishers. 238 authors and 7 publishers were registered during the year. In 2006, OSA had 608 members – 426 composers, 108 lyricists, 20 publishers and 54 heirs of major music composers. OSA’S OPERATING EXPENSES IN 2006 Total operating expenses for OSA’s activities in 2006 were CZK 102,124,000 which compared to 2005 marked an increase of 3.98%, with resulting overhead charges of 16.17%. Total overhead charges decreased by 0.90%. This decline is the result of the increase in collections during the year. Compared to the parliamentary amendment which became effective at the beginning of 2005, we regard this rather extensive amendment to copyright law as positive. For OSA, the biggest impact was in the area of the collection of private copy levies from the import of unrecorded carriers and devices for making copies. This amendment clarified disputed aspects of the prior law and it gave the Ministry of Culture the chance to issue a public notice stipulating the amount of specific royalties in a manner which guarantees fair compensation to rights holders for the ability of people to of make copies of works for their personal use, which has become more widespread due to continued advances in technology. HIGHLIGHTS OF FINANCIAL RESULT FINANCIAL RESULTS INTERNATIONAL ACTIVITIES OF OSA IN 2006 In 2006, various members of our staff participiated in regular international committees and seminars organised by CISAC and BIEM. In the second half of 2006 there was intensive discussion at international levels about online rights and adjustments to be made to existing agreements concerning the representation of rights holders. Uruguay AGADU Uruguay Venezuela SACVEN Venezuela The results used in deciding our awards are derived from the records of used works in OSA’s repertoire, with the exception of the recipient of the highest award – the OSA Golden Award for his or her exceptional contribution to Czech music, which is voted separately by the Supervisory Board. Awards are given to authors of classical and popular music for original compositions. Artists have the chance to compete for this award in 14 categories – for example, in the category of Lyricist of the Year or Composer of the Year in the fields of classical and popular music; the most frequently played popular or classical composition; or the most widely sold ringtone of the prior year. The first Annual Awards Ceremony was held on 13 June 2006 in the Retro Music Hall in Prague and was attended by almost 200 artists. During the evening there were live performances by, for example, Dan Bárta, the Luboš Andršt Blues Band and Alice Springs. The first OSA Golden Award for the most significant contribution to Czech popular music was given by the Supervisory Board to Karel Svoboda. Two glass sculptures went to Richard Krajčo, who was both the most successful composer of popular music as well as the most successful lyricist of the year in 2005. In particular, his compositions and lyrics were the most often played of the Top 50 hits of last year. According to the same criteria, the winner in the category of the most successful composer of classical music was presented to Petr Eben. The most frequently played live composition of popular music in the Czech Republic in the last year was “Jasná Zpráva”, by Petr Janda, with lyrics by Pavel Vrba. This song was performed 6,673 times. In the classical music category, first place was awarded to Zdeněk Lukáš’s composition “Missa Brevis”, which was performed 65 times during the year. The composition of reproduced music the most frequently in the prior year was “On My Head”, the title song of the Czech film “Snowboarders”. The music of Miroslav Chyška and Dan Bárta, with lyrics by Ota Klempíř, was heard nearly 20,000 times on radio and television stations. A total of twenty-two performances during the year entitled Ondřej Kukal’s Symphony No. 1 to the award for the most reproduced classical composition. The best-selling ringtone was František Táborský’s “Tabáček”, with lyrics by Pavel Grohman. OSA gave the awards for the most often played foreign compositions of 2005 to “Bad Day” by Daniel Powter and to “Spiegel im Spiegel” by Arvo Pärt. The most successful publisher in 2005 was EMI Music Publishing CR. Two categories of the annual OSA Awards are related to young authors up to the age of 30, who are presented with a glass sculpture and 50,000 CZK. Lukáš “Lukemo” Vyhnal of the band Clou was announced as the most successful young author of popular music; in classical music it was the composer and musicologist Michal Rataj. OSA – Society for the Protection of the Rights of Music Authors and Publishers – established the OSA Music Foundation on September 12, 1998, for the active participation in support of Czech music culture. The Music Foundation provides grants of financial aid annually on the basis of need and merit. In 2006, the Foundation supported 149 musical events, including music festivals, music shows and competitions, the release of CDs of Czech authors, and concerts of contemporary classical and popular music. The winner in the category Music Composition of the Year, in which OSA was a partner, was the 2005 Anděl favourite band Clou, with its “Island Sun” composition.
