APPLICATIONS FOR CONSENT (B-28/14) & ZONING BY-LAW AMENDMENT

Purpose and Effect of Consent Application B-28/14
The purpose and effect of the consent application is to sever a surplus farm residence and a
metal clad shed on a lot with a lot frontage of approximately 61.040 metres (200.262 ft) along
Charlton Drive and an area of approximately 0.53 hectares (1.31 ac) from a farm holding with a
lot frontage of approximately 603.5 metres (1,980 ft) along Charlton Drive and a lot area of
approximately 40.47 hectares (100 ac).
The consent application also seeks to establish a permanent easement for geothermal lines that
are located on the farm proposed to be retained. The proposed easement is in favour of the
parcel proposed to be severed and has an area of approximately 664 square metres (7,147.24
sq ft).

Purpose and Effect of the Zoning By-law Amendment Application
The purpose and effect of the zoning by-law amendment application is to implement the abovenoted severance by rezoning the parcel proposed to be severed to a zone which would permit
the residential use of the land and prohibit livestock and by prohibiting new dwellings from being
constructed on the parcel proposed to be retained. The new lot area of the parcel proposed to
be retained would also need to be recognized as the Comprehensive Zoning By-law requires a
minimum lot area of 40 hectares (98.8 ac), whereas the farm holding would have an area of
approximately 39.94 hectares (98.69 ac).
Description and Location of Subject Land
Known municipally as 11697 Charlton Drive, the subject property is located on the south side of
Charlton Drive and west of New Ontario Road. The subject property is legally described as Part
of Lot 19, Concession 10 (geographic Township of Lobo), Municipality of Middlesex Centre.
Public Hearing and Public Meeting
The Municipality’s Committee of Adjustment will hold a public hearing to consider the consent
application. In addition, Council will hold a public meeting to consider the zoning by-law
amendment application. The details for both are as follows:

You are invited to attend the public hearing and public meeting, and present oral and written
comments on this matter.

Other Information
If you do not attend or are not represented at the Hearing, the Committee may proceed in your
absence and you will not be entitled to any further notice of the proceedings. Written comments
may be submitted to the Secretary-Treasurer prior to the Hearing.
Copies of decision are provided only to those persons making a written request for the Notice of
Decision. There is a 20 day appeal period from the date of mailing of the decision, in which time
the decision of the Committee may be appealed to the Ontario Municipal Board. The Ontario
Municipal Board may dismiss an appeal if the appellant has not submitted written or verbal
comments to the Committee.
If a person or public body does not make oral submissions at a public meeting or make written
submissions to the Municipality of Middlesex Centre before the Zoning By-law Amendment is
passed, the person or public body is not entitled to appeal the decision of the Council of the
Municipality of Middlesex Centre to the Ontario Municipal Board.
If a person or public body does not make oral submissions at a public meeting, or make written
submissions to the Municipality of Middlesex Centre before the Zoning By-law Amendment is
passed, the person or public body may not be added as a party to the hearing of an appeal before
the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do
so.

planner for the Municipality of Middlesex Centre at 519-666-0190. If you are aware of any
persons affected by these applications who have not received a copy of this notice, it would be
appreciated if you would so advise them.
